#### 10 Act to be construed not to exceed legislative power of State 10 Act to be construed not to exceed legislative power of State > > (1) This Act is to be construed as operating to the full extent of, but so as not to exceed, the legislative power of the State. > > > (2) If a provision of this Act, or the application of a provision of this Act to a person, subject matter or circumstance, would, but for this section, be construed as being in excess of the legislative power of the State— > > > > > (a) it is a valid provision to the extent to which it is not in excess of the power, and > > > > > (b) the remainder of this Act, and the application of the provision to other persons, subject matters or circumstances, is not affected. > > > (3) This section applies to this Act in addition to, and without limiting the effect of, any provision of this Act.
