What it does
This Act transfers, dedicates and places a particular parcel of land (the Schedule) under the care of the National Trust of Australia (New South Wales) as trustee, while subjecting that land to a restricted subset of Crown lands and National Trust statutory regimes. Section 3(1) vests the land in Her Majesty, freed and discharged from prior trusts, estates, dedications, conditions, restrictions, covenants and provisions affecting it. Section 3(2) immediately characterises the land as Crown land and dedicates it under the Principal Act for "the preservation of the land and the old Government House and other buildings on the land as a historical site and historical buildings." Section 4 appoints the National Trust as trustee of the land and expressly deems that appointment to have been made under subsection (1) of section 26 of the Principal Act, despite the operation of section 5. Section 5 imports provisions of the Principal Act that relate to Crown lands dedicated under section 24 of the Principal Act and to trustees thereof, but excludes specific subsections of section 26 (subsections (1), (1A), (1B), (1D) and (1E)) from that import. Section 6 removes from applicability, in respect of the land, any statutory powers in the National Trust Act 1960 that enable the Trust to dispose of land (sell, exchange, lease, mortgage or otherwise) or to make by-laws, and it excludes all by-laws made under that Act from applying to the land. Section 7 creates a statutory access regime through Parramatta Park to the land for Trust members, staff and authorised visitors: access is permitted "at such times, in such manner and subject to such conditions" as are agreed between the Trust and the body managing Parramatta Park, or failing agreement, as determined by the Minister; subsection (2) makes this access regime prevail notwithstanding other Acts, rules, regulations, by-laws or ordinances applying to Parramatta Park. Section 8 conditions use of the land on the Minister's approval. Section 9 preserves pre-existing debts, liabilities and actions relating to the land. The schedule precisely describes the parcel by measurement and plan.
