Parole Orders (Transfer) Act 1984

The Act organises a cross-jurisdictional administrative process around a small set of legal concepts that determine who can ask, who may decide, what must be provided, and what legal consequences flow from registration.

Defined scope of "parole order": The Act defines parole order broadly (s 3). That definition expressly includes parole orders in force under the Sentence Administration Act 2003 or a law of another State or Territory, and additionally covers statutory authorities or release instruments that are to be deemed parole orders by law (s 3). The statutory definition therefore treats a range of release authorities as parole orders for purposes of transfer and registration.

Reciprocity through "corresponding law" and "designated authority": The Act operates on a reciprocal basis, activated where another State or Territory has a "corresponding law" (s 3). A corresponding law is a law relating to transfer of parole orders that the Western Australian Minister declares by Gazette notice to be a corresponding law for this Act. The person or body in the other jurisdiction with comparable powers is the "designated authority" (s 3). The mechanism requires official bilateral recognition and identification of comparable counterpart authorities.

Ministerial and Registrar roles: The Minister holds the central decision-making role for accepting inbound transferred parole orders and for requesting outbound transfers (s 5). The Registrar is the operational repository; registration is effected by the Registrar's memorandum on the parole order and by record-keeping of the judgment or order that produced the imprisonment (s 8). The Registrar must also forward copies to the Prisoners Review Board and serve notice personally on the parolee (s 8(2)).

Thresholds for registration: Before directing registration of an inbound parole order the Minister must be satisfied that registration is desirable in the parolee’s interests and that the parolee either consents/requests the transfer or is residing in Western Australia (s 7(1)). The corresponding thresholds apply to outbound requests (s 7(2)). The Act uses the statutory terms "satisfied", "desirable", and "reasonable grounds" without prescribing evidentiary standards, leaving evaluative discretion to the Minister supported by document exchange (s 6).

Application of Western Australian law to registered orders: A registered parole order is to be treated as if it were made under Western Australian law and as if the relevant sentences had been imposed by the appropriate WA court (Magistrates Court for summary jurisdictions, Supreme Court otherwise) (s 9(1)-(3)). The Act specifies calculation rules for the parole period when the order was never previously in force in WA or has previously been in force in WA (s 9(4)-(6)). The parole period caps are: for life sentences up to 5 years as specified by the Minister (s 9(4)(a)); for indeterminate detention up to 2 years specified by the Minister (s 9(4)(b)); and for other cases the lesser of specified calculations capped at 2 years (s 9(4)(c)).

Consequences on cancellation and transfer: Cancellation while registered triggers specified consequences. For life and indeterminate cases, the statutory consequences are resumption of the original sentence or detention at the Governor’s pleasure respectively (s 9(7)(a)-(b)). For determinate sentences, the parolee becomes liable to serve the unexpired portion of the term less reductions calculated under s 9(8)-(10). A transfer of a Western Australian parole order out to another jurisdiction causes the order to cease to be in force in Western Australia and suspends WA effects until any subsequent re-registration (s 10).

Exclusion of natural justice rules: The Act expressly provides that rules of natural justice, including any duty of procedural fairness, do not apply to or in relation to a direction, request, or decision given or made by the Minister under the Act (s 10A). This is a clear statutory exclusion for the particular ministerial acts described.

Procedural and evidentiary apparatus: Document requirements for outbound requests include the parole order and variations, the judgment or order creating the liability to imprisonment, last known address, and a written report containing relevant records and materials that assisted the body making the parole order (s 6(1)). Evidence provisions allow certified copies of the Registrar’s endorsements and parole orders to be admitted in court without further proof (s 11). Delegation to public service officers is permitted for Ministerial powers except the power to delegate itself (s 12). The Governor may make regulations to carry the Act into effect (s 13).

Collectively, these concepts form a compact statutory framework to receive, register, apply, and, where necessary, suspend or transfer interstate parole orders while prescribing documentation and temporal limits on the parole period after registration.

Primary persons affected by the statute are parolees whose parole orders are transferred into or out of Western Australia, and the administrative actors who manage and decide on registration. The Act expressly names and empowers the Minister, the Registrar of Transferred Parole Orders, the Prisoners Review Board, and designated authorities in other States and Territories (s 3, s 4, s 5, s 8). Courts are implicated by the statutory fiction that, once a parole order is registered, the relevant sentence and parole order are to be treated as if imposed or made by the appropriate Western Australian court (s 9(2)-(3)). That classification affects the Magistrates Court and Supreme Court, depending on the original sentencing court (s 9(3)).

Parolees: The person to whom a parole order relates is the central subject. The Act requires personal service of notice of registration on the parolee (s 8(2)(b)). Registration may only be directed by the Minister when satisfied it is desirable in the interests of the person and either the person consents/requests registration or is residing in Western Australia, for inbound transfers (s 7(1)). For outbound requests by the Minister, similar tests apply (s 7(2)). Parolees face statutory consequences if the registered parole order is cancelled while registered in WA, including resumption of sentences, detention at the Governor’s pleasure for indeterminate cases, or serving the unexpired portion of a determinate term subject to reductions (s 9(7)-(10)). Parolees therefore bear the legal risk arising from registration actions.

Western Australian executive: The Minister has authority to accept requests from other jurisdictions and to direct registration in WA, and to request registration under corresponding laws elsewhere (s 5). The Minister must be satisfied as to desirability and consent or residence before directing registration (s 7). The Minister may delegate most of these powers to a public service officer (s 12), centralising administrative responsibility while allowing operational delegation.

Registrar and Prisoners Review Board: The Registrar records registrations, endorses parole orders, retains copies of the originating judgment or order, forwards copies to the Prisoners Review Board, and serves notice on the parolee (s 8). The Prisoners Review Board receives copies of the registered parole order and associated judgment (s 8(2)(a)), making it an affected decision-making body for any subsequent review or parole-related action under Western Australian law.

Designated authorities in other jurisdictions: These are the interstate or territorial counterpart bodies with powers corresponding to the WA Minister. They initiate inbound requests and respond to outbound requests (s 5, s 6). The Act requires exchange of source documents and reports to allow the Minister to assess desirability and to administer WA law to the registered order (s 6, s 7, s 8).

Courts and executive officers under sentence administration law: The Act’s mechanics treat interstate sentences as if imposed by WA courts, which creates legal consequences for courts and for persons named in the Sentence Administration Act 2003. The Act refers to cancellation under s 44 and s 67 of the Sentence Administration Act 2003 when calculating reductions in service periods (s 9(8)). It also references the chief executive officer under that Act in determining days related to offences causing cancellation (s 9(8)(b)(ii)). These references mean that WA sentence administration officials and instruments under that Act interact with transferred parole orders.

Legal practitioners, corrections administrators and compliance officers: Practitioners advising parolees or conducting interstate transfers must navigate s 6 document requirements, the Minister’s satisfaction thresholds in s 7, calculations in s 9 for parole periods and reductions, and the effect of transfer out under s 10. They are affected by the Act’s evidence provisions (s 11) and by the exclusion of natural justice for ministerial actions (s 10A).

In short, the Act concentrates legal effects on parolees while centralising decision and record-keeping with the Minister and Registrar and creating formal interfaces with interstate authorities and the Prisoners Review Board.

The Act structures a set of statutory duties for ministerial and administrative actors and prescribes certain statuory rights or prerequisites for parolees. These are the operative obligations and entitlements expressed in the text.

Minister’s duties and constraints: The Minister may direct the Registrar to register an interstate parole order in Western Australia, and may request that a Western Australian parole order be registered under a corresponding interstate law (s 5). However, before directing registration of an inbound order the Minister must be satisfied, on consideration of relevant information forwarded by the designated authority, that registration is desirable with regard to the interests of the parolee and that the parolee either consents or is residing in WA (s 7(1)(a)-(b)). Symmetrically, the Minister must be satisfied for outbound requests that registration under the corresponding law is desirable and that the parolee consents or there are reasonable grounds to believe the parolee is residing in the other jurisdiction (s 7(2)). These are statutory thresholds the Minister must apply prior to exercising the power; the Act prescribes the content of the documentary materials to be provided in support of outbound requests (s 6(1)(a)-(d)).

Registrar duties: Upon a direction under s 5(1), the Registrar must register the parole order by endorsing a memorandum on the parole order and keeping the endorsed parole order with the originating judgment or order in a register (s 8(1)). After registration the Registrar must forward a copy to the chairperson of the Prisoners Review Board and cause written notice of the fact and date of registration to be given to the requesting designated authority and to be served personally on the parolee (s 8(2)). The Registrar’s endorsements and certified copies have evidentiary effect in court (s 11).

Documentary duties: If the Minister requests a designated authority to register a WA parole order under a corresponding law, the Minister must send to the designated authority the parole order and its variations, the related judgment or order, particulars of the parolee's last known address, and a written report containing information and documentary materials likely to assist court or authority in that jurisdiction, including the documents that were before the body making the parole order and records of convictions and sentence details (s 6(1)(a)-(d)). Preservation, certification and authenticity are required when originals are not supplied (s 6(2)).

Prisoners Review Board duties: The Board receives a copy of the registered parole order and the original or certified copy of the judgment or order (s 8(2)(a)). The Act thereby imposes an informational duty on the Registrar to equip the Board with the materials necessary to exercise its functions under WA law once the order is registered.

Parolee rights and preconditions: The Act recognises a parolee’s consent or request as one of the circumstances permitting registration. For inbound transfers, the Minister must be satisfied either that the parolee has consented or requested registration or that the parolee is residing in WA (s 7(1)(b)). For outbound requests the same options exist, with an alternative of reasonable grounds to believe the parolee resides in the receiving jurisdiction (s 7(2)(b)). Additionally, the Registrar must serve the parolee personally with notice of registration in WA (s 8(2)(b)), creating a right to be informed of the registration and its date. The Act does not set a right to procedural fairness in ministerial decisions under the Act, since it expressly excludes the rules of natural justice in respect of ministerial directions, requests and decisions (s 10A).

Rights to evidentiary recognition: The Act treats certified copies of the Registrar’s endorsements and the registered parole order as admissible evidence in court without further proof (s 11). That is a right of practical operation for the State and for other parties to rely on the Registrar's certificates.

Consequential duties on parolees: If a registered parole order is cancelled by WA law, the parolee becomes liable to resume serving the sentence or to be detained, or to serve the unexpired portion of the term less specified reductions (s 9(7)-(10)). These are statutory penalties or consequences that attach to cancellation while the order is registered in WA; they are not novel offences created by this Act, but they are specific obligations on the person subject to the parole order.

Delegation duty: The Minister may delegate powers under the Act, except the power to delegate, to a public service officer (s 12). Once delegated, actions by the delegate are to be treated as actions of the Minister (s 12(2)). This imposes an administrative duty to ensure appropriate delegation instruments are in place if the Minister chooses to exercise that option.

Regulatory powers: The Governor may make regulations for matters necessary or convenient to carry out the Act (s 13). The Act thus provides a mechanism to prescribe further duties or procedural requirements by regulation, subject to the extent of the enabling power.

In short, the Act sets out the Minister’s evaluative duty before registration, the Registrar’s record-keeping and notice duties, the document-exchange duty between jurisdictions, parolee entitlements to consent and notice, and statutory consequences for cancellation and transfer.

The Act does not create a standalone criminal offence or a specific schedule of fines within its text. Rather, enforcement under the Act operates through legal effects on the parole order and the parolee once registration occurs, and through evidentiary facilitation for courts and authorities.

Consequences embedded in registration: When a parole order is registered under the Act, Western Australian law applies to the parole order and the parolee as if the sentence had been imposed by an appropriate WA court and the order were made under WA law (s 9(1)-(3)). The practical enforcement consequence is that any breach of parole while the order is registered in WA will be subject to WA mechanisms for cancellation and enforcement under the Sentence Administration Act 2003 and WA sentencing law, as incorporated by s 9. The Act provides direct statutory consequences if a registered parole order is cancelled by WA law: for life-sentence parolees, resumption of serving the life sentence (s 9(7)(a)); for indeterminate detention parolees, further detention at the Governor’s pleasure (s 9(7)(b)); and for determinate sentences, service of the unexpired portion of the term less applicable reductions (s 9(7)(c), s 9(8)-(10)). These are enforceable outcomes under WA law that follow registration and cancellation; they are the principal enforcement mechanism supplied by the Act.

Evidence and admissibility: The Act creates evidentiary pathways to support enforcement in courts. A document purporting to be a copy of the Registrar’s memorandum is evidence that the parole order was registered on that date (s 11(1)). A parole order from another jurisdiction, once registered, may be received in evidence in any court by production of a copy certified as true by the Registrar (s 11(2)). These provisions lower procedural barriers for courts and enforcement authorities to rely on interstate parole orders once registered in WA.

No express penalty provisions in the Act: The text contains no express monetary penalties, custodial offences, or infringement regime created by this Act itself. Instead, enforcement depends on existing WA statutes and sentencing machinery to act upon a registered parole order, and on the evidence provisions to enable WA authorities to proceed. The Governor’s power to make regulations (s 13) could be used to prescribe procedural matters relevant to administration; the Act does not itself authorise regulation-made penalties, and no such penalties are set out in the Act’s text.

Administrative controls and exclusion of natural justice: The Act excludes application of the rules of natural justice to ministerial decisions, requests, and directions under the Act (s 10A). This statutory exclusion affects the procedural remedies available to affected persons with respect to those particular ministerial acts. The Act does not specify in its text whether other administrative law remedies, appeal rights, or judicial review avenues are available in respect of other types of decisions; it confines the exclusion to the rules of natural justice for ministerial acts listed in s 10A.

Interaction with Sentence Administration Act 2003: The Act relies on mechanisms of the Sentence Administration Act 2003 for the substance of parole cancellation and calculations of reductions (s 9(8)-(10)). Therefore the enforcement regimes and penalties that actually apply are those contained in WA sentence administration law, applied to the registered order as if it were a WA parole order (s 9(1)-(3)).

In practice, therefore, enforcement under this Act is indirect: the Act enables the legal recognition and administrative handling of transferred parole orders and supplies evidentiary support, while the existing WA statutory machinery enforces breaches and imposes the substantive penalties or resumed custody described in s 9.

The Act is expressly designed to operate in a networked legal environment. It references and imports aspects of interstate laws, the Sentence Administration Act 2003, the Public Sector Management Act 1994 and delegates regulatory competence to the Governor. These interactions determine how transferred parole orders are administered and enforced.

Reciprocity and corresponding laws: The Act depends on a corresponding law in another State or Territory to give effect to outbound requests and to accept inbound registrations (s 3, s 5). The Minister has to declare, by Gazette notice, which interstate laws are corresponding laws for purposes of the Act (s 3). The designated authority in the other jurisdiction is defined by reference to that jurisdiction’s corresponding law (s 3). Thus the Act functions as a statutory shell that activates only so far as reciprocal arrangements exist, and it requires formal recognition by the Minister that an interstate law is a corresponding law.

Integration with the Sentence Administration Act 2003: The Act treats parole orders under WA law as parole orders under the Sentence Administration Act 2003 for the purposes of definitions and operational effect (s 3). The Act calls on specific provisions of the Sentence Administration Act when calculating reductions in what a parolee must serve after cancellation: it refers to cancellation under s 44 and s 67 of the Sentence Administration Act 2003 as points for determining reduction endpoints (s 9(8)). It also references the "chief executive officer under that Act" for the purpose of identifying a day on which an offence occurred where the date cannot be ascertained (s 9(8)(b)(ii)). By prescribing that registered parole orders are to be applied "as if" they had been made under WA law (s 9(2)-(3)), the Act imports WA sentencing and parole administrative regimes wholesale for the period of registration.

Court jurisdiction and characterization of sentences: The Act instructs that when a sentence was imposed by a court of summary jurisdiction or on appeal from such a court, the "appropriate court" is the Magistrates Court; otherwise the Supreme Court is the appropriate court (s 9(3)). This provision clarifies how interstate sentences are to be treated for the purposes of WA statutory processes, including any court interactions under WA law.

Public Sector Management Act and delegation: Section 12 allows the Minister to delegate powers to a public service officer within the meaning of the Public Sector Management Act 1994. That cross-reference determines who may lawfully receive delegated powers under the Act and ensures that delegated ministers’ powers may be exercised by officers governed by public sector management rules (s 12).

Evidentiary interaction with court practice: The Act’s s 11 evidentiary provisions create a streamlined route for transferred parole orders to be received in evidence in WA courts by certified copy of the Registrar’s endorsement. This interacts directly with court evidentiary procedures and reduces the need for production of original interstate documents.

Interaction with other jurisdictions’ laws: When the Minister requests that a parole order in force under WA law be registered under a corresponding law, the Minister must send the parole order, judgment or order, last known address and the assisting report to the designated authority (s 6(1)). The receiving jurisdiction’s corresponding law will then determine the effect of registration there. The Act creates a pause-and-transfer structure: a transfer out to another jurisdiction causes the WA parole order to cease to be in force in WA (s 10(1)) and removes the WA statutory effects, until any subsequent re-registration under the Act revives WA effects (s 10(2)).

Regulations: The Governor may make regulations for any matter necessary or convenient for carrying out the Act (s 13). Regulations could therefore interact with existing criminal procedure, parole administration, and interjurisdictional administrative rules. The Act does not list specific regulatory matters, but the power is broad subject to usual legislative limits.

Exclusion of natural justice and administrative law interface: The Act expressly excludes the rules of natural justice in relation to directions, requests or decisions by the Minister under the Act (s 10A). The Act does not otherwise discuss judicial review or privative clauses, so how this exclusion interacts with broader administrative law remedies or interpretive doctrines is left to the broader legal system. The Act’s text thus carves out specific procedural rights in a bounded way while leaving the substantive enforcement machinery to interact with the Sentence Administration Act 2003 and other supporting laws.

Overall, the Act is a targeted instrument that relies on other legal frameworks for substantive enforcement, uses delegation under public sector governance structures, and depends on formal interstate counterpart laws to effect transfers. Its interactional design means successful operation requires coordination across statutory regimes, intergovernmental recognition of corresponding laws, and the operational capacity to exchange detailed records.

The compilation table in the Act provides the legislative amendments and their commencement dates, showing incremental changes since enactment in 1984. The original Parole Orders (Transfer) Act 1984 (No. 45 of 1984) received assent on 5 September 1984, with most operative provisions commencing on 12 October 1984 (s 1 and 2 commenced 5 September 1984, remainder 12 October 1984). Key subsequent amendments are recorded in the compilation table.

Acts Amendment (Imprisonment and Parole) Act 1987 (No. 129 of 1987): This amending Act, assented on 21 January 1988, inserted s 10A (exclusion of rules of natural justice) and other amendments. The commencement date for that amendment was 15 June 1988. The compilation notes include a transitional provision stating that acts or omissions done before the insertion of s 10A are to be treated as valid as if s 10A had been in operation when they occurred (see note 3 to the compilation table quoting the specific provision).

Parole Orders (Transfer) Amendment Act 1988 (No. 33 of 1988): Assented on 24 November 1988, and commenced the same day, this amending Act made further changes; the compilation table lists it in the chain of amendments that have been incorporated into reprints.

Acts Amendment (Public Sector Management) Act 1994 (No. 32 of 1994): Section 19 of that Act amended s 12 of the Parole Orders (Transfer) Act to cross‑refer to the Public Sector Management Act 1994 for delegation definitions; the amendment commenced 1 October 1994.

Sentencing (Consequential Provisions) Act 1995 (No. 78 of 1995): Part 60 of that Act effected amendments related to sentencing and parole provisions; the related amendments to this Act commenced on 4 November 1996. These amendments included updates to definitions and cross-references, consistent with the broader restructuring of sentencing legislation.

Sentencing Legislation Amendment and Repeal Act 2003 (No. 50 of 2003): Section 29(3) made subsequent amendments to align the Act with changes in sentencing legislation, with commencement on 31 August 2003. The compilation table includes this as part of the integrated reprint history.

Courts Legislation Amendment and Repeal Act 2004 (No. 59 of 2004): Section 141 adjusted references and provisions consequential on court legislation reforms, commencing 1 May 2005.

Parole and Sentencing Legislation Amendment Act 2006 (No. 41 of 2006): Section 92 of that Act further amended this Act, with commencement on 28 January 2007.

Reprints: The compilation table indicates a reprint of the Act as at 9 August 2002 that included amendments to that date, and a Reprint 2 as at 17 October 2008 incorporating the amendment history listed in the table. The Act’s notes indicate that a 1999 amendment was repealed before coming into operation by the 2003 amending Act (note 2 in the compilation table).

Notable inserted provision: The explicit insertion of s 10A (Exclusion of rules of natural justice) by the 1987 amendment is a significant change recorded in the compilation notes; the notes also contain a saving clause treating past acts as valid when s 10A was inserted.

Scope of changes: The amendments have been primarily technical and consequential amendments to align the transfer scheme with wider reforms to sentencing and public sector management, and to provide clarity to definitions and procedural mechanics. The compilation table provides the statutory sources, dates of assent and commencement for each change and confirms the Act as reprinted up to October 2008.

Practical implication of amendment history: Any practitioner relying on historical versions of the Act must check the commencement dates in the compilation table to determine which provisions applied at particular times, especially given the transitional note relating to s 10A. The reprint status indicates that the statutory text reproduced in this compilation incorporates those amendments up to the 2008 reprint, but any later amendments after that date would need to be checked in updated legislative databases.

The Act’s compilation and notes provided here do not include recorded or cited case law that interprets or applies the Parole Orders (Transfer) Act 1984. The text itself does not list any judicial decisions, and the compilation table records only legislative amendments and reprints. Therefore, as a matter of this source, there is no litigation extract, reported judgment list, or statutory annotation containing cases.

The Act does create points that are naturally capable of generating litigation or review, although no specific cases are named in the source material. Points of potential dispute that would ordinarily attract litigation include interpretation of ministerial satisfactions required under s 7, the proper construction of parole period calculations and reductions in s 9(4)-(10), the consequences of transfer under s 10, and the statutory exclusion of the rules of natural justice under s 10A. The Act does not in its text specify appellate or review routes for decisions under the Act, nor does it expressly include privative clauses beyond the s 10A exclusion of the rules of natural justice for the listed ministerial acts. Any such procedural or substantive challenges would therefore arise in the context of WA’s broader administrative law and sentencing frameworks.

Because the source does not provide litigation examples, users requiring precedent-based guidance or authoritative judicial interpretation will need to consult case law databases and court reports beyond this text. The absence of litigation references in the compilation suggests practitioners should be cautious in assuming settled judicial construction of discretionary phrases such as "satisfied" and "desirable" in s 7, and should verify whether courts have addressed the s 10A exclusion or the Act’s treatment of registration as equivalent to sentences being imposed by WA courts (s 9). Additionally, the interaction between the Act and the Sentence Administration Act 2003, particularly regarding cancellation consequences referenced in s 9(8), may have been explored in sentencing or administrative proceedings, but no such materials are contained in this compilation.

In practical planning, the absence of litigation in the source means that administrative actors and practitioners must rely on the statutory text, associated sentencing legislation, and any existing interjurisdictional protocols. Any challenge or judicial review would proceed against the statutory text as framed, with attention to the Act’s express exclusions and cross-references. For precedent-sensitive matters, an independent search of court reports and legal databases will be necessary to determine how courts have interpreted and applied the Act in particular cases since the dates of amendment and reprint.

The Act contains several provisions and procedural features that can produce traps for the unwary practitioner or administrator. These are specific, source-grounded risks or complexities drawn from the statute.

Exclusion of natural justice for ministerial acts (s 10A): Section 10A explicitly states that the rules of natural justice, including any duty of procedural fairness, do not apply to or in relation to a direction, request, or decision given or made by the Minister under this Act. That is a targeted statutory exclusion. Practically, that means the Minister’s decisions under s 5 and assessments under s 7 are not governed by the rules of natural justice as mandated by the statute. Procedural challenge avenues in relation to those specific ministerial acts are therefore narrower, which may be surprising to readers used to procedural fairness obligations in administrative decisions.

High-level ministerial discretion with low statutory prescription (s 7): The Minister must be "satisfied" that registration is "desirable" in the interests of the parolee, but the Act does not prescribe evidence thresholds, standards of proof, or factors to weigh. The Act requires the Minister to consider relevant information forwarded by the designated authority (s 7(1)(a)) and to consider consent or residence (s 7(1)(b)); however, the lack of detailed criteria gives wide elasticy to ministerial assessment. That can create unpredictability for parolees and for other jurisdictions requesting registration.

Personal service requirement (s 8(2)(b)): The Registrar must cause notice of registration to be "served personally" on the parolee. Failure to serve personally may have procedural consequences under the Act, but the statute does not specify alternative service methods or the legal consequence of defective service. Practitioners must ensure that personal service is effected and documented.

Complex parole period calculations and caps (s 9(4)-(6), s 9(8)-(10)): The Act prescribes different rules for parole periods depending on whether the order was previously in force in WA or never was, and depending on the type of sentence (life, indeterminate, other). The rules use comparative calculations involving the unexpired portion of the term and the period elapsed since release, and they impose caps (5 years for life, 2 years for indeterminate, 2 years otherwise). Reductions for time served while registered, and for previous periods during which the order was in force in WA, are also complex (s 9(8)-(10)). These rules can generate non-intuitive results for the length of supervision post-registration and can produce administrative and evidentiary challenges when reconstructing dates and prior parole periods.

Suspension of WA effect on transfer out and revival on re-registration (s 10): If a WA parole order is registered under a corresponding interstate law, the parole order ceases to be in force in WA and each sentence ceases to have effect in WA (s 10(1)). Subsequent re-registration under this Act revives the prior WA force and effect (s 10(2)). This creates potential discontinuities in supervision and may affect time calculations and enforcement. Practitioners must track whether an order has been transferred out, and the legal status of a parolee in WA at any time.

Documentary and evidentiary authenticity requirements (s 6(2), s 11): Requests must be accompanied by originals or certified true copies of judgments and orders where original documents are not supplied (s 6(2)). The Act allows certified copies of the Registrar’s endorsement to be evidence of registration (s 11). However, inadequate certification or missing documentation can obstruct registration and later enforcement. Cross-jurisdictional differences in what constitutes a certified copy may complicate compliance.

Dependence on "corresponding law" declarations (s 3, s 5): The Act relies on the Minister’s Gazette notice declaring a law of another State or Territory to be a corresponding law. If no corresponding law is declared, or if other jurisdictions alter their laws without reciprocal recognition, the transfer mechanism may not operate. Reliance on intergovernmental recognition creates operational fragility and dependency on coordination.

Delegation mechanics (s 12): The Minister may delegate powers to a public service officer, but the power to delegate itself cannot be delegated (s 12(1)). Delegations must be properly executed in writing. Failure to follow formal delegation rules could expose actions to challenge on procedural grounds, although s 10A limits natural justice obligations regarding ministerial acts.

No express penalties in this Act (s 13): The Act does not create its own enforcement penalties; it relies on existing WA parole and sentencing laws to impose consequences. Practitioners must therefore understand the interplay with the Sentence Administration Act 2003 and other statutes to comprehend practical consequences. The Act’s cross-references to s 44 and s 67 of the Sentence Administration Act 2003 for calculating reductions (s 9(8)) make that necessary.

Potential for record-keeping errors in endorsements and registers (s 8): Registration relies on the Registrar’s endorsement and retention of documents in a register. Errors in endorsement dates, misplacement of original judgments, or failure to send required copies to the Prisoners Review Board may create administrative disputes about the validity or effective date of registration, particularly given the evidentiary role of Registrar certifications (s 11).

Absence of litigation guidance in the source: The Act as provided contains no case law or judicial interpretation. Practitioners cannot rely on settled judicial readings of ambiguous phrases in the Act without further research beyond this text.

These "gotchas" underline the need for precise documentary practice, careful date and period calculation, attention to personal service, and awareness that key ministerial decisions under the Act are statutorily not subject to the rules of natural justice.

This section outlines concrete, source-grounded steps for administrative officers, legal advisers, and practitioners handling transfers or registrations under the Act. The duties derive directly from s 5-9, s 11-13, and s 3-4.

Documents and information to gather for outbound requests (s 6): Before the Minister makes a request under s 5(2) that a Western Australian parole order be registered under a corresponding law, ensure the package to the designated authority includes (s 6(1)):

• the parole order and any variations, in original form where possible;
• the judgment or order by virtue of which the person became liable to imprisonment for the relevant term;
• written particulars of the parolee’s last known address; and
• a written report and accompanying documents likely to assist a court or authority in the receiving jurisdiction, including documents that were before the body which made the parole order, conviction and sentence details, minimum terms, periods served, class of prisoner, remissions, and prior parole grants.

If originals cannot be provided for items other than the parole order, include copies certified as true copies by the person who has custody of the original (s 6(2)).

Threshold considerations and evidence for ministerial satisfaction (s 7): The Minister must be satisfied that registration is desirable in the interests of the parolee and that the parolee has consented or is residing in the relevant jurisdiction (s 7). Before directing registration inbound under s 5(1), compile and forward to the Minister the designated authority’s materials, ensuring they specifically address the parolee’s interests, consent or residence. For outbound requests use the same material set to evidence desirability and consent or reasonable grounds for residence (s 7(2)).

Registrar registration procedures (s 8): When the Minister directs registration under s 5(1), the Registrar must:

• endorse a memorandum on the parole order signed by the Registrar that the parole order is registered on the date of endorsement (s 8(1)(a));
• keep the endorsed parole order in a register along with the original or certified copy of the originating judgment or order (s 8(1)(b));
• forward to the chairperson of the Prisoners Review Board one copy of the parole order bearing the memorandum and one copy of the judgment or order (s 8(2)(a)); and
• serve notice in writing of the fact and date of registration to the requesting designated authority and cause the notice to be served personally on the parolee (s 8(2)(b)).

Personal service on the parolee must be documented. Maintain chain-of-custody and proof of service records.

Parole period calculations and recording (s 9(4)-(6), s 9(8)-(10)): For new registrations, calculate the parole period per the statutory rules:

• if life sentence at time of parole order, the Minister may specify a period not exceeding 5 years (s 9(4)(a));
• if detention for an indeterminate period, the Minister may specify a period not exceeding 2 years (s 9(4)(b));
• in other cases, the parole period is the lesser of the period by which the unexpired portion of the term of imprisonment exceeds the period elapsed since release, or 2 years (s 9(4)(c)).

For parole orders previously in force in WA apply s 9(5) and s 9(6) to determine the remaining portion or the applicable previous parole period. Record calculations and supporting date evidence carefully, in case reductions or enforcement are later contested.

Cancellation and reduction calculations (s 9(7)-(10)): If the registered parole order is cancelled, the consequences differ by sentence type. For determinate sentences, calculate the period to be served as the unexpired portion of the term less:

• the period from registration to cancellation per s 9(8) (with specific timing rules for cancellation under s 44 or s 67 of the Sentence Administration Act 2003), and
• the whole of each previous period during which the parole order was in force in WA (s 9(10)).

Ensure coordination with the Sentence Administration Act 2003 authorities to verify dates of cancellation under s 44 or s 67 and to obtain determinations from the chief executive officer where necessary (s 9(8)(b)(ii)).

Evidence handling (s 11): Preserve original parole orders, endorsed memoranda, and certified copies. The Registrar’s certified copies are admissible evidence in court (s 11(1)-(2)). Ensure that any copies supplied to other jurisdictions are correctly certified and retained. Maintain a register that captures endorsement dates and copies of the originating orders.

Delegation and governance (s 12): If the Minister delegates powers, ensure the delegation instrument is in writing, signed by the Minister, and delegated to a public service officer within the meaning of the Public Sector Management Act 1994 (s 12(1)). Record the delegation and the scope, because delegated acts are treated as Ministerial actions for the purposes of the Act (s 12(2)).

Inter-jurisdictional coordination: Before making outbound requests, confirm the receiving jurisdiction has been declared by Gazette notice as having a "corresponding law" (s 3). Obtain the name and contact details of the designated authority. Use the documentation checklist in s 6(1) to avoid delays.

Notifying the Prisoners Review Board (s 8(2)(a)): After registration forward the required copies to the chairperson without delay. This is a statutory obligation and necessary for the Board to exercise its WA powers in relation to the registered parole order.

Regulatory compliance (s 13): Stay alert to any regulations made under s 13 that prescribe further procedural requirements. Check current regulations to ensure compliance with any additional rules that might have been promulgated under the Act.

Administrative record-keeping and audit trail: Keep meticulous records of all communications with designated authorities, copies of documents transmitted and received, evidence of personal service on the parolee, Registrar endorsements, and calculations of parole periods. Given the evidentiary role of Registrar certificates (s 11), administrative accuracy is essential to avoid disputes.

Legal advice and further research: Where interpretation of s 7 (ministerial satisfaction), s 9 calculations, or the effect of s 10 transfer out is uncertain, obtain legal advice. The Act’s text does not include case law, and s 10A excludes the rules of natural justice for ministerial acts; accordingly procedural challenge options may be limited.

Following these steps will align administrative practice with the statutory requirements set out in the Parole Orders (Transfer) Act 1984 as reproduced in this source.
