Parnpajinya Community By-laws 2006

The by-laws organise community governance around a small set of recurring legal and administrative concepts. These are the Committee of Management; membership of the Association; community lands; permission and conditions; out‑of‑bounds areas and signage; definitions of prohibited substances; police enforcement powers; and statutory offences with limited penalties and a customary practice defence.

Committee of Management and welfare standard: the Committee is the primary decision maker for on‑land regulation. The Committee must give the “welfare of the community” priority when making decisions under the by‑laws (by‑law 2(1)). The Committee may delegate decision‑making to a named member in writing (by‑law 3(1)). The by‑laws specify that the Committee need not provide reasons for decisions (by‑law 2(2)), and that it may communicate decisions orally, in writing or by public notice on the lands (by‑law 2(3)).

Membership and access: membership is defined by the Association’s own rules; members have an unconditional right to be on the community lands “at any time” except where removed by police under the by‑laws (by‑law 4(1)). Non‑members require Committee permission, or permission under another law, to be on the lands (by‑law 4(2)). The Committee may make areas entirely or partially out of bounds to all persons or to particular categories of people and may require permission to enter particular places (by‑law 5(1)-(3)). Signs may be used to communicate restrictions (by‑law 5(4)).

Permission, conditions and revocation: where a by‑law contemplates permission, the Committee can refuse it; where it grants permission it can impose conditions, change those conditions, or revoke permission (by‑law 3(3)-(4)). Delegation must be made in writing (by‑law 3(1)), and requests for permission must be made to the Committee or the named delegate (by‑law 3(2)).

Behavioural rules and definitions: conduct rules cover damaging property and unauthorised use (by‑law 7), indecent or disorderly behaviour including fighting or carrying weapons (by‑law 8), noise controls at night with specified hours and exceptions by Committee permission (by‑law 9), rules for entering others’ houses (by‑law 10), and strict controls on alcohol, illegal drugs and harmful substances, including a requirement that intoxicated persons must leave or return home and remain there until sober (by‑laws 11-13). An “illegal drug” is defined by reference to Western Australian law (by‑law 12(1)), and “harmful substance” is defined by reference to substances not intended for ingestion or injection which may harm health, with illustrative examples such as glue or petrol (by‑law 13(1)). A medical exception applies for lawfully prescribed drugs and proper medication use (by‑law 12(3)).

Police powers and enforcement: police may ask for name and address, and may arrest and remove persons who are or are believed to be breaching the by‑laws or likely to injure people or damage property (by‑laws 14(1)-(3)). Police may remove items, including vehicles, they believe are connected to breaches (by‑law 14(4)), and they can enforce the by‑laws using their existing powers and charging regimes (by‑law 14(5)).

Offences and defences: failing to obey a by‑law or a condition imposed with permission constitutes an offence (by‑law 15(1)). The by‑laws create a specific statutory defence for community members if the conduct was a custom of the community at the time (by‑law 15(2)). Maximum penalties on conviction are set at $5,000, and courts may award compensation up to $250 where property is damaged (by‑law 15(3)-(4)).

These concepts structure who decides, the permissible conduct on the lands, how access is controlled, and how non‑compliance is handled administratively and criminally.

The instrument draws a clear distinction between three categories of people: members of the Parnpajinya Aboriginal Association, non‑members or visitors, and members of the Police Force, each with different rights and obligations.

Members of the Association: membership is defined by the Association’s own rules, and members can be on the community lands at any time except if removed by police per the by‑laws (by‑law 4(1)). Members remain subject to the behavioural, safety and substance prohibitions in the by‑laws (by‑laws 7-13), but the by‑laws also create a statutory defence for members: a member will not be guilty of an offence under these by‑laws if, at the time of the alleged offence, the conduct in question was a custom of the community (by‑law 15(2)). That creates differential legal exposure for members compared with non‑members when customary practice is claimed.

Non‑members and visitors: non‑members can only be on community lands if they have Committee permission or permission under another law (by‑law 4(2)). Non‑members are therefore subject to access controls and potential conditions imposed by the Committee (by‑laws 3 and 5). They must observe the same conduct prohibitions as members, and they do not have the statutory “custom” defence available to members under by‑law 15(2).

The Committee of Management and its delegates: the Committee is the principal decision‑maker, required to place the community’s welfare as the most important consideration when making by‑law decisions (by‑law 2(1)). The Committee decides who may enter, which places or vehicles are out of bounds, what signage will be used to inform people, and may give, refuse, or revoke permission and impose, change or remove conditions attached to permission (by‑laws 3 and 5). Delegation of decision powers is permitted but must be in writing (by‑law 3(1)). The Committee also has the internal administrative power to ask disruptive people to leave meetings and to use notices to communicate rules (by‑laws 2(3) and 8(4)).

Members of the Police Force: police have specified authorities under the by‑laws. They may ask for name and address where they believe a person is contravening or has contravened a by‑law (by‑laws 14(1)-(2)). Police may arrest and remove persons they believe are breaching the by‑laws or likely to injure others or cause property damage, and they may remove items or vehicles they consider connected to an offence or to be evidence (by‑laws 14(3)-(4)). Police enforcement may proceed by using “existing police powers” and through charging for offences against the by‑laws (by‑law 14(5)).

Property owners and the Association: third parties may be directly affected by property damage or by the Committee’s vehicle and area restrictions. If a court finds a person guilty of an offence and finds property was damaged, it may order compensation payable to the other person or the Association, up to $250 (by‑law 15(4)). The Association as land manager gains operational instruments to control access and behaviour on its community lands.

Who pays and who decides: offenders who are convicted may pay fines up to $5,000 and possibly compensation up to $250 (by‑law 15(3)-(4)). The Committee decides access permissions and conditions, and the Police implement enforcement under the by‑laws and the broader powers of Western Australian law (by‑laws 3, 14 and 1(7)).

Consequential effects on behaviour: the by‑laws create clear incentives for non‑members to secure Committee permission to be on the lands, require all persons to avoid prohibited conduct and substances, and place administrative burdens on the Committee to create signage and document delegations and decisions if it intends to rely on them in enforcement contexts.

The by‑laws impose a set of affirmative duties on persons on community lands and confer specific rights and administrative powers on the Committee and, to a narrower extent, on community members.

Primary duties imposed on individuals

• Obey Committee signage and driving directions: drivers must drive carefully and obey signs posted by the Committee about routes, speed and driving behaviour (by‑laws 6(1)-(3)). The Committee may post signs specifying where and how driving is permitted (by‑law 6(2)), and drivers must comply (by‑law 6(3)).
• Do not damage property or use others’ property without permission: there is a general duty not to damage anything that does not belong to you or that belongs to the Association, and not to use others’ property without consent (by‑law 7(1)-(2)).
• Avoid indecent and disorderly conduct: prohibitions include abusive language, fighting, carrying weapons and rowdy behaviour; persons must not obstruct the Committee, its members or employees in performing their duties; disrupting meetings may result in a Committee direction to leave (by‑law 8(1)-(4)).
• Observe noise curfews: it is an offence to make loud noises or play loud music after midnight on Friday and Saturday, after 10 p.m. on other nights, and before 7 a.m. on any day, unless the Committee gives permission (by‑law 9).
• Respect private houses: do not enter another person’s house without permission, and leave if asked (by‑law 10).
• Substances rules: strict prohibitions on bringing, selling, possessing, consuming or being under the influence of alcohol on community lands, plus mandatory requirements for intoxicated persons to leave or go straight home and stay home until sober (by‑law 11); prohibitions on bringing, selling, possessing, taking or being under the influence of “illegal drugs” as defined by WA law, with a medical exception for prescribed medications (by‑law 12); and prohibitions governing “harmful substances” not intended to be ingested and likely to harm health, including prohibitions on giving or selling where reasonable grounds suspect misuse, possession for misuse, and deliberate misuse (by‑law 13).

Duties vis‑à‑vis police: if a police officer believes a person is breaching or has breached a by‑law, the officer may ask for the person’s name and address, and the person must provide it (by‑laws 14(1)-(2)).

Rights and powers of the Committee

• Priority welfare consideration: when making decisions under the by‑laws the Committee is to consider the welfare of the community as the most important factor (by‑law 2(1)).
• Delegation: the Committee may delegate permission decisions to a committee member in writing (by‑law 3(1)).
• Control of permission: the Committee may grant, refuse, or revoke permission to do things contemplated by the by‑laws; when granting permission it may impose conditions, change those conditions, or remove them (by‑laws 3(3)-(4)).
• Access control and signage: the Committee may declare areas out of bounds entirely or partially and may post signs to give notice of such restrictions (by‑laws 5(1)-(4)).
• Meeting management: the Committee may manage meetings and require disruptive persons to leave (by‑law 8(4)).
• Communication of decisions: decisions can be communicated orally, in writing or by public notice on community lands (by‑law 2(3)).
• No duty to give reasons: the Committee does not have to give reasons for decisions under the by‑laws (by‑law 2(2)).

Rights of members and other procedural features

• Unrestricted physical access for members: members can be on community lands at any time, subject to police removal powers under the by‑laws (by‑law 4(1)).
• Customary practice defence: a member will not be guilty of an offence under the by‑laws if they can show the conduct was a community custom at the time (by‑law 15(2)). This is a statutory evidentiary/defensive provision available only to members.
• Right to communicate: the Committee may post notices in public places to inform people of decisions (by‑law 2(3) and 5(4)).

Criminal enforcement rights

• Police powers: police may arrest and remove persons they believe are breaching the by‑laws or likely to injure people or damage property, and may remove items believed connected with offences or evidence, and may otherwise use existing police powers to enforce the by‑laws (by‑laws 14(3)-(5)).

Sanctions

• Offence exposure for non‑compliance: failure to obey a by‑law or a condition imposed with permission constitutes an offence (by‑law 15(1)).
• Maximum penalties: fines up to $5,000 for conviction and potential court‑ordered compensation up to $250 where property of another person or the Association is damaged (by‑law 15(3)-(4)).

Taken together, the by‑laws create duties that regulate access, behaviour, property use, vehicle movement, and prohibited substances, while giving the Committee broad administrative authority to control permissions and post restrictions, and vesting police with operational enforcement powers.

The by‑laws establish a criminal enforcement framework supported by policing powers and limited civil compensation, and they also create administrative sanctions available to the Committee.

Criminal offences and monetary penalties

• Commission of an offence is defined as failure to obey a by‑law or a condition imposed by the Committee when giving permission (by‑law 15(1)). That captures both breaches of substantive prohibitions such as alcohol or drug rules, and breaches of conditions attached to permissions.
• The maximum fine on conviction for an offence is $5,000 (by‑law 15(3)). This is the single highest monetary penalty stated in the by‑laws.
• In cases where the court finds an offender guilty and that property belonging to another person or to the Association was damaged when the offence was committed, the court may order compensation not exceeding $250 payable to the injured party or to the Association (by‑law 15(4)). The compensation cap is modest relative to the maximum fine and is limited to proven property damage in the course of an offence.

Police enforcement powers

• Police are expressly empowered under the by‑laws to take investigative and enforcement steps. If a police officer believes a person is breaking or has broken a by‑law, the officer may request the person’s name and address and the person must provide it (by‑laws 14(1)-(2)). Failure to provide name and address in that context becomes a separate compliance obligation arising under the by‑laws.
• Police may arrest and remove persons from community lands where they believe the person is breaching, has breached, or is likely to injure others or damage property (by‑law 14(3)). The arrest and removal power is tied to the officer’s belief about present or imminent misconduct or harm.
• Police may remove things, including vehicles, from the community lands if they believe the items are connected with, or are evidence of, a by‑law breach (by‑law 14(4)). This is a broad seizure or removal authority focused on connection to alleged offences.
• The by‑laws state that any member of the Police Force can enforce the by‑laws by using existing police powers and by charging people who break the by‑laws (by‑law 14(5)). That provision expressly links the by‑laws to the broader statutory powers and criminal procedures available to police under Western Australian law.

Administrative powers and remedies

• The Committee can refuse permission, impose conditions, change or remove conditions, and revoke permission (by‑law 3(3)-(4)). Those administrative acts are not framed as criminal penalties but they alter access and privileges on the lands.
• The Committee may declare places out of bounds to all or some people, and to all or some vehicles, at particular times or continuously, and may post signs (by‑law 5(1)-(4)). Non‑observance of such directions is an offence under the by‑laws if it amounts to failing to obey a by‑law or a condition (by‑law 15(1)). The Committee may also ask disruptive persons to leave meetings and require compliance (by‑law 8(4)).

Procedural and evidentiary features that affect enforcement

• The Committee is not required to give reasons for decisions made under the by‑laws (by‑law 2(2)). That limits the procedural basis on which enforcement action deriving from Committee decisions may be contested within the by‑law text itself, although court review under external administrative law is not addressed in the by‑laws.
• The by‑laws permit communication of decisions by public notice on the community lands (by‑law 2(3) and 5(4)). Evidentiary issues may arise over whether a person had actual or constructive notice of signage or posted conditions.

Limits and scope of penalties

• The by‑laws specify only fines up to $5,000 and compensation up to $250 for property damage. They do not specify other penalties such as imprisonment, expanded restitution, or civil forfeiture within the text of the by‑laws themselves.
• The by‑laws do not set out the precise procedure for prosecution, which will follow the usual criminal process under Western Australian law where police lay charges and prosecutions are conducted in the courts (by‑law 14(5) and by‑law 1(7) noting the by‑laws are in addition to WA law).

In short, the enforcement model is a hybrid: administrative controls and signage and Committee permissions manage daily life on the lands, with police empowered to take investigative and coercive steps and courts able to impose monetary penalties on conviction. The by‑laws provide specific compliance obligations, and police have broad operational discretion to enforce them using existing legal powers.

The by‑laws explicitly locate themselves in relation to Western Australian law and make several cross‑references which shape their interpretation and enforcement.

Supplemental status to state law

• The by‑laws state they are “in addition to the laws of Western Australia” (by‑law 1(7)). That language places the by‑laws as complementary rules within the broader legal framework. They do not purport to displace or supersede state statutes; instead they operate alongside Western Australian laws applicable to conduct on community lands.

Definitions that import state law

• “Illegal drug” is defined by reference to drugs that are illegal to possess under the laws of Western Australia (by‑law 12(1)). That explicitly imports state criminal law definitions and prohibitions into the community context for the purposes of these by‑laws. As a result, what counts as an illegal drug for the by‑laws will mirror the state statutory regime at the relevant time.

Police enforcement and existing powers

• The by‑laws authorise any member of the Police Force to enforce the by‑laws “including by” using existing police powers and by charging people who break the by‑laws (by‑law 14(5)). This establishes that enforcement will generally be exercised within the contours of state policing powers and criminal process, rather than creating a parallel enforcement mechanism unique to the community.

Access permission under other laws

• A non‑member may be on the community lands if they have “permission under another law” (by‑law 4(2)). That contemplates circumstances where state statutes or other legal instruments grant access rights irrespective of Committee permission. The by‑laws acknowledge legal channels external to the Committee that may allow presence on the lands.

Customary practice defence and internal autonomy

• The by‑laws create a statutory defence for members if their conduct was “a custom of the community” at the time of the alleged offence (by‑law 15(2)). This provision explicitly recognises customary practices within the scope of criminal liability under the by‑laws, and creates a necessary element for courts to consider custom when adjudicating offences that involve members. The interaction with broader state law will depend on how courts interpret and apply that defence in the context of state criminal offences and by‑law prosecutions, but the by‑laws themselves enshrine the defence for by‑law offences.

Governor’s role and statutory parentage

• The by‑laws were made by the Committee and approved by the Governor under the Aboriginal Communities Act 1979 (by‑law 1(2)-(3)), and the Governor has declared which lands are community lands (by‑law 1(5)). That situates the by‑laws within the enabling statutory architecture of the Aboriginal Communities Act 1979 and the delegated authority of the Governor.

Potential areas of overlap and practical interaction

• Because police enforcement is framed through “existing police powers” and because illegal drugs are defined by reference to WA law, prosecutions for by‑law breaches involving drugs or violence will likely follow the same evidentiary and procedural frameworks as state prosecutions. The by‑laws do not redefine police arrest powers, but they authorise local enforcement actions within the normal criminal justice system.
• The by‑laws do not expressly address inconsistency with state law or provide a supremacy clause. The text’s statement that they are “in addition to” WA law implies they are intended to supplement state law; if a conflict arises between a by‑law and a state statute, resolution will depend on statutory interpretation principles under Western Australian law rather than instructions within the by‑laws themselves.

Administrative vs criminal remedies

• The Committee has administrative instruments such as permissions, conditions, signage and declarations of out‑of‑bounds areas (by‑laws 3 and 5). Failure to comply with those administrative decisions can be criminalised under the by‑laws (by‑law 15(1)). The dual availability of administrative direction and criminal sanction creates an interface where administrative choices (for example, imposing a condition on a permission) can give rise to criminal liability if breached.

In summary, these by‑laws operate as local land governance instruments that import and rely on Western Australian criminal definitions and police powers while preserving a role for local Committee administration and a member‑specific customary practice defence. The text anticipates enforcement through state police and courts and allows for access under state law where applicable.

The only amendment history contained in the provided text is the original compilation detail for the Parnpajinya Community By‑laws 2006. The compilation table records that the by‑laws were gazetted on 31 October 2006 and commenced on the same date, 31 October 2006. No subsequent amendments, repeals or replacement by‑laws are recorded in the material provided.

Origin and approval

• The by‑laws were made by the Committee of Management of Parnpajinya Aboriginal Association Incorporated and were approved by the Governor (by‑law 1(2)). The enabling framework is the Aboriginal Communities Act 1979, which gives the Governor the power to approve by‑laws made by the Committee for the Association where community lands have been declared (by‑laws 1(3) and 1(5)).

No amendment mechanism within the by‑laws

• The text as supplied does not set out an internal procedure for amending the by‑laws themselves. The by‑laws describe administrative powers available to the Committee to impose conditions and to change or remove those conditions when permission has been granted for specific acts (by‑law 3(4)). Those powers do not constitute an internal method to alter the by‑laws; they govern the exercise of delegated permission within the existing by‑laws. The process to change the text of the by‑laws, or to re‑make them, is not described here and would be governed by the parent Act and the formal processes for Committee and Governor action under that Act.

Compilation note and dating

• The compilation table in the Notes section explicitly identifies the Parnpajinya Community By‑laws 2006 citation, the gazettal reference (31 Oct 2006 p. 4643-53) and the commencement date (31 Oct 2006). There are no subsequent entries in the compilation table indicating amendment dates, consolidations or repeals.

Implications of the absence of recorded amendments in the provided text

• Because no later amendments or re‑gazettals are shown in the document provided, the reader should treat the text as the operative by‑laws as made and approved in 2006, subject to any external repeal or modification by the Governor or under legislative action that is not captured in the supplied compilation table. The by‑laws themselves do not specify an internal amendment or review timetable.

Practical consequence for practitioners

• Where one requires the current form of the by‑laws for compliance, enforcement or legal advice, reliance on the supplied compilation is appropriate for the 2006 instrument. Any later changes would have to be identified by consulting the formal Western Australian Government Gazette, the enabling Act’s amendment records, or updates from the Association or Committee, none of which are included in the supplied text.

In short, the supplied material records the original making, approval and commencement of the Parnpajinya Community By‑laws in 2006 and contains no internal history of amendment or later changes within the document.

The supplied text of the Parnpajinya Community By‑laws 2006 contains no reported cases, decisions, or litigation history. There are no judicial determinations, appeals, or annotated case references included in the material provided that interpret, apply or challenge these by‑laws.

Statutory features that could generate litigation

• The by‑laws include provisions which, by their terms, could result in litigation if enforced and contested, although no such litigation is recorded here. Examples of provisions likely to be subject to legal dispute if a case arose include the following:
  • Committee discretion and lack of reasons: the Committee “does not have to give reasons for any of its decisions under these by‑laws” (by‑law 2(2)). Litigation could conceivably involve procedural fairness or administrative law claims brought in a court external to the by‑laws, but no cases are cited in the supplied text.
  • Customary practice defence: the statutory defence for members that conduct will not be an offence if it was “a custom of the community” at the time (by‑law 15(2)) creates an evidentiary issue that could require judicial fact finding about the existence and content of a custom. Whether and how courts would apply that defence is not addressed in the by‑laws and no cases are supplied.
  • Police powers and seizure: police authority to remove people and things, including vehicles, and to arrest persons suspected of breaching the by‑laws or likely to injure or damage property (by‑law 14(3)-(4)) could give rise to disputes over reasonable belief, lawful seizure, or custody, yet no judicial treatment of those provisions is present in the text.

What the absence of litigation material means for users

• Because the text contains no litigation history, practitioners must not assume settled judicial interpretation of ambiguous or contested provisions from this document alone. Any legal advice that depends on interpretation of by‑law terms such as the customary practice defence, the scope of Committee discretion, the limits of police seizure, or procedural protections when permission is refused, will need to seek contemporary case law or authoritative administrative guidance outside the supplied material.

Where to look for adjudicative guidance if required

• The by‑laws themselves point to enforcement through existing police powers and prosecution in state courts (by‑law 14(5) and by‑law 1(7) noting the relationship with WA law). Accordingly, any adjudicative or appellate guidance would be found in Western Australian court decisions concerning prosecutions brought under these by‑laws, or in broader jurisprudence addressing similar by‑laws under the Aboriginal Communities Act 1979. None of that material is included or summarised in the supplied text.

In summary, the instrument as presented contains no litigation record or case law references. The text indicates several plausible litigation vectors that could arise in practice, but an absence of reported cases in the supplied material means practitioners must seek external authorities before relying on judicially settled interpretations.

The by‑laws create clear local regulatory powers but also include several provisions that raise practical risks, evidentiary issues and areas of implementation uncertainty. The following points are derived from the text and identify operational pitfalls and legal ambiguities users should notice.

Broad and non‑reasoned Committee discretion

• The Committee must prioritise “the welfare of the community” when making decisions (by‑law 2(1)) but “does not have to give reasons” for those decisions (by‑law 2(2)). That combination gives the Committee wide discretion to make access and behavioural rulings while removing an internal obligation to articulate rationales. For those subject to Committee decisions, this means limited visibility into the grounds for restrictions and potential difficulties when seeking review or contesting a decision, particularly where the by‑laws themselves do not prescribe internal review procedures.

Delegation must be in writing

• Delegation of permission decisions is permitted only if done in writing (by‑law 3(1)). If the Committee relies on purported delegates or informal delegations without written evidence, questions may arise about the validity of permissions or conditions imposed by persons claiming delegated authority.

Conditioning, changing and revocation of permission

• The Committee can impose, alter or remove conditions attached to permissions and can revoke permissions entirely (by‑law 3(4)). The by‑laws criminalise breaches of conditions as offences (by‑law 15(1)). Practical risk: a person granted permission who breaches a changed condition may be criminally liable even where the change was not effectively communicated, unless the Committee ensures clear notice practices such as written conditions and posted notices per by‑law 2(3) and 5(4).

Signage and constructive notice

• The Committee can post signs designating out‑of‑bounds areas and driving controls (by‑laws 5(4) and 6(2)). Enforcement that rests on signage presumes people have notice. Practical issues include whether signs are maintained, whether they are sufficiently clear, and whether enforcement action can be sustained where a person claims lack of notice.

Tension between member access and police removal

• Members can be on the lands “at any time” but that right is subject to removal by police under the by‑laws (by‑law 4(1) and 14(3)). This creates a direct interface where police powers can override Committee or member expectations of access on the basis of belief about breaches or imminent harm. For members, the statutory custom defence (by‑law 15(2)) may be relevant but only at the point of court adjudication, not at the point of police removal.

Police seizure of property and vehicles

• Police may remove things, including vehicles, they believe to be connected with a breach or to be evidence (by‑law 14(4)). This may affect owners and users of vehicles and other property; the by‑laws do not specify procedures for storage, return or compensation for items removed by police.

Limited compensation cap for property damage

• Where a person is convicted and the court finds property damage occurred, compensation is capped at $250 per by‑law 15(4). That ceiling may be lower than the actual loss in some instances, raising questions about civil remedies outside the by‑laws for higher losses.

Criminalisation of condition breaches and administrative actions

• The by‑laws make breaches of conditions imposed with permission criminal offences (by‑law 15(1)). This creates a situation where a routine administrative act by the Committee, such as imposing a temporary condition, could expose individuals to significant fines up to $5,000 if they fail to comply. Administrative clarity and documented notice of conditions are therefore operationally important.

Customary practice defence is member‑limited and fact‑specific

• The available defence applies only to members and only where the conduct was a “custom of the community” at the time (by‑law 15(2)). The by‑laws do not define “custom,” leaving it to fact‑finding. Practitioners should note evidentiary challenges and that the defence does not extend to non‑members.

Ambiguities in definitions and scope

• “Harmful substance” is defined by reference to substances not meant to be swallowed, inhaled or injected that may harm health, with examples such as glue or petrol (by‑law 13(1)). There may be borderline cases. Similarly, “illegal drug” is defined by reference to WA law (by‑law 12(1)), which can change over time. The by‑laws do not set out ancillary procedural definitions such as how permission requests must be made (by‑law 3(2) simply requires asking the Committee or a delegate).

Enforcement overlap with state law

• The by‑laws operate “in addition to” state law (by‑law 1(7)), and police are authorised to use existing police powers (by‑law 14(5)). Overlap with state criminal offences or civil claims can create duplication or tension in enforcement choices and prosecutorial discretion. The by‑laws do not prescribe how parallel state prosecutions or civil remedies interact with by‑law prosecutions.

Operational compliance costs for visitors

• Non‑members need explicit Committee permission or permission under another law to be on the lands (by‑law 4(2)). That requires a visitor to secure appropriate permissions in advance or risk criminal liability. For businesses, contractors or service providers, this is an administrative step that must be planned for.

No internal appeal mechanism set out

• The by‑laws do not provide an appeal or review process for Committee decisions, nor do they require reasons to be given. Those seeking review of decisions will need to rely on external legal processes under Western Australian law, something not contemplated in the text itself.

In summary, the by‑laws vest significant operational discretion in the Committee and significant enforcement discretion in police, while creating criminal exposure for breaches of permissions and conditions. Practical risk mitigation requires written delegations, clear notice procedures, documented permissions and conditions, and careful handling of situations involving alleged customary practices.

Compliance under these by‑laws requires coordinated action by the Committee, members, visitors and enforcement agents. Below are concrete, documentable steps and processes that follow directly from the by‑laws’ text and that will materially reduce legal risk.

For the Committee of Management

• Document delegations in writing. If the Committee intends to permit delegates to make permission decisions, ensure each delegation is recorded in writing as required by by‑law 3(1). Retain copies and make them available to those who need to verify delegated authority.
• Record permissions and conditions in writing. When granting permission under the by‑laws, record the permission, the identity of the person permitted, the conditions imposed, how and when those conditions were communicated, and any later changes or revocations (by‑law 3(4)). Written records will be central if an enforcement action is contested.
• Post clear signs and maintain them. Use signage to communicate out‑of‑bounds areas and driving restrictions (by‑laws 5(4) and 6(2)). Replace or repair signs promptly so the Committee can demonstrate effective notice under by‑law 2(3) where decisions are communicated by public notice.
• Keep minutes showing welfare consideration. Where decisions are made under the by‑laws, documenting that the Committee considered the welfare of the community (by‑law 2(1)) will assist in establishing that the Committee followed its own statutory standard if a decision is questioned.
• Create a permissions register for non‑members and contractors. Capture names, reasons for access, conditions, dates and expiry of permission. This helps to manage compliance and to demonstrate lawful access if challenged.

For community members

• Understand membership status and the customary defence. Keep evidence of community membership in accordance with the Association’s rules (by‑law 1(6)) and, where customary practices may be relevant, preserve evidence or witness statements that establish a claimed custom for an eventuality where a by‑law breach is asserted (by‑law 15(2)).
• Observe substance and behaviour rules. Do not bring, consume, possess or sell alcohol on the lands; if intoxicated follow the by‑law requirement to leave or go straight home and remain until sober (by‑law 11). Do not bring, possess, use, or distribute illegal drugs or harmful substances as defined (by‑laws 12 and 13). Avoid disorderly conduct, entering others’ houses without permission, and damaging property (by‑laws 7-10).
• Comply with posted signage and driving rules. Follow all driving signs and speed or route requirements the Committee posts (by‑law 6(2)-(3)).

For non‑members, visitors and contractors

• Obtain Committee permission before arrival. Secure written permission where possible to be on community lands (by‑laws 3(2) and 4(2)). Confirm any conditions attached to permission and retain a copy.
• Bring identification and contact details. If police ask for name and address in an enforcement context, provide it as required by by‑law 14(2). Maintain documentation demonstrating lawful access under another law if asserting that right.
• Ensure staff and contractors are briefed on by‑laws. Transactional parties should educate personnel about alcohol, drug and behaviour prohibitions, and about out‑of‑bounds areas and driving routes.

For police and enforcement agencies

• Record enforcement decisions and basis for belief. Where an officer exercises arrest or removal powers under by‑law 14(3), record the factual basis for the belief that a person was breaching, had breached, or was likely to injure others or damage property. Retain evidence supporting any decision to remove items including vehicles under by‑law 14(4).
• Use existing police procedures. The by‑laws authorise use of existing police powers and charging mechanisms (by‑law 14(5)), so normal recordkeeping, evidence preservation, and charge filing procedures should be followed.

For legal advisers

• Prepare customary practice evidence strategies. For defending members under by‑law 15(2), assemble contemporaneous evidence of customs, including sworn statements, community records or historical materials consistent with the community’s practice.
• Challenge notice and delegation gaps. Where enforcement arises from Committee actions, check for written delegations and adequate notice of imposed conditions. Absence of written delegation or poorly documented notice can be relevant to defending alleged breaches of conditions.
• Consider civil remedies for property loss. The by‑laws cap compensation at $250 when property damage is found in a by‑law prosecution (by‑law 15(4)). Where actual losses exceed that amount, advise clients about parallel civil claims under state law outside of the by‑law framework.

Operational policies and checklists

• Create an access policy template for visitors that includes written permission forms, condition checklists, and sign‑off protocols.
• Maintain a sign‑posting schedule to ensure all out‑of‑bounds and driving signs are visible, legible and replaced when damaged.
• Implement an incident log to record disruptive conduct, Committee decisions, permissions granted or revoked, and any interactions with police, including the names and badge numbers of responding officers.

Contingency planning

• Plan for police removal or seizure events by identifying secure storage arrangements for items removed and by establishing lines of communication with local police to reduce disputes about custody and return.
• Where intoxication leads to required removal from public areas, ensure local community services or transport mechanisms are available to comply humanely with by‑law 11(2) obligations.

By following these measures, written delegations, documented permissions and conditions, robust signage and notices, procedural records for police interaction, and targeted evidentiary preparation for customary practice claims, those governed by the by‑laws will materially reduce compliance risk and be better prepared for enforcement or contestation.
