Parliamentary Workplace Standards and Integrity Regulations 2025

The instrument rests on a few tightly defined legal concepts derived from the Act but operationalised in the Regulations.

• Confidentiality notice (Form 1, Schedule 1): the document issued under section 77 of the Act that designates specific restricted matters and prescribes who may and may not be told about them. The Regulations prescribe a standard, mandatory form for this notice (Regulation 5).

• Prescribed services and purposes (Regulation 4): a closed list of named crisis, suicide prevention and mental health support services that count, for the statutory purpose in section 81(2)(f)(iii) of the Act, as authorised recipients for limited welfare-related disclosures. The list names national providers (for example Beyond Blue, Lifeline), a youth service (Headspace), an LGBTIQ+ service (QLife), SANE and an Aboriginal health co-operative. The list is expressed in Regulation 4(1) as providers "prescribed for the purposes of seeking crisis support, suicide prevention and mental health and wellbeing support services" under the cited Act provision.

• Prescribed insurer (Regulation 4(2)): the Victorian Managed Insurance Authority (VMIA) is prescribed specifically for "insurance and indemnities in relation to legal costs" under section 81(2)(f)(iii) of the Act. The Regulations therefore identify the insurer that a notice-holder may involve for legal-cost indemnity purposes.

• Restricted matter and authorised disclosures (Schedule 1, Form 1, parts 1-4): the Form requires the Commission to describe the restricted matter(s) and then to state, for each restricted matter, who the recipient "can" disclose to and who the Commission has directed the recipient "cannot" disclose to. The Form emphasises that disclosure is only permitted where the recipient and the recipient’s intended recipient appear under the specified permitted list; if an entity does not appear, disclosure to that entity is prohibited.

• Recipient obligations when disclosing (Schedule 1, Form 1, part 5): the Form mandates that, when a permitted disclosure is made, the person disclosing must give the other person a copy of the confidentiality notice and any relevant cancellation or extension, unless they have a "reasonable excuse". The Form warns that failure to comply can attract the penalties stated in the notice.

• Termination and variation events (Schedule 1, Form 1, part 6): the notice ceases to have effect upon certain enumerated events, including cancellation by the Commission, replacement by a new notice, or conclusion of an investigation; the Form also contemplates extension by order of the Supreme Court.

• Cross-references to other statutes (Schedule 1, Form 1, parts 2-4 and Endnotes): the Form explicitly cross-references a number of other Acts and bodies to which disclosures are always permitted (for example the Independent Broad‑based Anti‑corruption Commission, Integrity Oversight Victoria, Fair Work Act 2009 matters, Public Interest Disclosures Act 2012 obligations, and the list of investigating entities whose published reports may remove restriction).

The Regulations therefore operationalise the Act’s confidentiality and support/insurance exceptions by fixing a standard notice, listing named support providers and specifying the insurer for legal-cost purposes. The Commission’s discretion to issue, cancel, vary or authorise disclosures sits behind the notice; the Regulations make that discretion administratively transparent in the form the recipient receives.

Identify who is directly and indirectly affected by the Regulations as drafted, with the statutory anchor for each category.

• Recipients of confidentiality notices: the immediate individuals to whom Form 1 is issued under section 77 of the Act. The prescribed Form 1 sets out rights, prohibitions and explicit obligations for recipients, including criminal penalties for unauthorised disclosure (Schedule 1, Form 1, parts 1, 3 and 5). Recipients bear the principal compliance burden created by the Regulations.

• The Parliamentary Workplace Standards and Integrity Commission: the body that issues, cancels, replaces or authorises confidentiality notices. The Commission’s decisions determine which restricted matters are captured and which categories of persons are authorised or prohibited from receiving disclosures (Schedule 1, Form 1 parts 1-4). The Regulations do not expand or curtail the Commission’s statutory powers, but prescribe the exact communication the Commission must give and the named lists that act as statutory touchpoints.

• Prescribed support service providers: each entity named in Regulation 4(1) is prescribed "for the purposes of seeking crisis support, suicide prevention and mental health and wellbeing support services" under the Act provision cited. The named organisations are 1800 Respect (Telstra Health), Beyond Blue, Headspace, Lifeline, QLife, SANE Australia and the Victorian Aboriginal Health Service Co‑operative (Regulation 4(1)). Those organisations are therefore listed in statute as authorised recipients for the specified support purposes when a confidentiality notice permits such disclosure.

• The Victorian Managed Insurance Authority (VMIA): prescribed under Regulation 4(2) for purposes relating to insurance and indemnities for legal costs in connection with the Act. The VMIA is the body to which disclosure may be authorised under notices, and thus it is the statutory vehicle for legal-cost indemnity relationships in this scheme.

• Employers, trade unions, employee assistance programs and workplace regulators: Form 1 explicitly contemplates disclosures, where permitted, to an employer or manager, to a trade union of which the recipient is a member, to an employee assistance program, and to the Victorian WorkCover Authority for workers’ compensation claims, and to the Fair Work Commission for applications (Schedule 1, Form 1, part 3). These workplace actors will be affected where the Commission authorises disclosure to them, and they acquire duties if given a copy of the notice as required.

• Legal practitioners: Form 1 allows disclosure to a legal practitioner for the purposes of obtaining legal advice or representation relevant to the notice (Schedule 1, Form 1, part 4). Legal practitioners will be recipients of disclosure and are specifically noted as able to receive disclosure where professional obligations or legal duties require disclosure.

• Investigating bodies and oversight agencies: Form 1 lists a range of bodies where disclosure is always permitted, including Integrity Oversight Victoria, the Independent Broad‑based Anti‑corruption Commission, Victoria Police, the Victorian Ombudsman, the Judicial Commission and other statutory integrity entities (Schedule 1, Form 1, part 4). These agencies are carved out of the confidentiality restriction and will therefore continue to receive information in the conduct of statutory investigations.

• The Supreme Court: the Form contemplates orders of the Supreme Court that may extend a notice (Schedule 1, Form 1, parts 4 and 6). The Court therefore has a procedural role in extending judicially a notice’s effect.

• The Parliamentary workplace generally: because the Act and Regulations deal with workplace standards and integrity in the parliamentary context, parliamentary staff, members and offices will be indirectly affected through the Commission’s exercise of confidentiality-notice powers, though the Regulations themselves operate at the level of notice form and prescribed external bodies rather than changing internal employment rules.

• Prescribed service providers’ clients: individuals seeking support who may be named in notices may find their ability to contact certain providers is expressly permitted under the notice (Regulation 4(1) and Schedule 1, Form 1, part 3). The list thus affects pathways for support.

The Regulations therefore allocate decision-making power to the Commission, specify a closed list of external service recipients and an insurer, and place explicit procedural obligations and criminal-warning language on recipients. The parties who "pay" in practical terms are the recipients who must comply, the support providers that are named in statute and may receive disclosures, and the insurer listed to handle legal costs for covered matters.

The Regulations themselves do not create freestanding duties beyond prescribing an authorised form and a list of service providers and insurer. However, by prescribing a mandatory notice text, they fix the content of duties and rights the Act places on notice recipients. The core duties and rights, as expressed in the prescribed Form 1, are as follows.

Duties placed on recipients (Schedule 1, Form 1)

• Non‑disclosure duty: recipients are not permitted to disclose restricted matters except in the authorised circumstances described in the notice. The Form frames this as a prohibition tied to "restricted matters" identified in the notice (Schedule 1, Form 1, part 1). The notice warns of severe penalties for breach, including up to 12 months imprisonment or a fine of up to 120 penalty units or both (Schedule 1, Form 1, part 1).

• Copying duty on permitted disclosure: if a recipient makes a permitted disclosure, they must give the person they disclose to a copy of the confidentiality notice and any order extending the notice, unless they have a "reasonable excuse" (Schedule 1, Form 1, part 5). That duty also extends to giving notice of any replacement, cancellation or extension of the confidentiality notice to previous disclosure recipients.

• Duty to follow authorised lists per restricted matter: the Form requires recipients to check the specified list for each restricted matter; disclosure is permitted only to entities that explicitly appear under "You can disclose this restricted matter" or under the "Can you disclose in any other circumstances?" section (Schedule 1, Form 1, part 3). The Form emphasises that if an entity is not included, disclosure to that entity is prohibited.

Rights and authorised exceptions (Schedule 1, Form 1)

• Specificised permitted disclosures: for each restricted matter the notice must state who the recipient "can" disclose to. Examples in the template include spouse or domestic partner; employer or manager; registered health practitioner or prescribed service for support; trade union (if the recipient is a member); employee assistance programs; the Victorian WorkCover Authority; VMIA for legal-cost matters; and for Fair Work Commission applications (Schedule 1, Form 1, part 3). These are not blanket rights; they apply only if the specific restricted matter’s authorised list includes them.

• Always-permitted disclosures: the Form states a set of circumstances in which disclosure is always permitted irrespective of the per‑matter lists. These include complaints to Integrity Oversight Victoria or IBAC; complying with a witness summons from IBAC or Integrity Oversight Victoria; disclosure authorised by the Commission; disclosures authorised or required by the Parliamentary Workplace Standards and Integrity Act 2024; disclosures necessary to comply with a confidentiality notice or related court order where certain supporting disclosures (for example to interpreters, parents/guardians for under-18s, independent persons where literacy or impairment issues exist) are permitted; and disclosures to legal practitioners for legal advice or representation in relation to the notice under a listed set of Acts (Schedule 1, Form 1, part 4).

• Disclosure where information is otherwise public: the template permits disclosure where the restricted matter has been made public under the Act or has been published in a report by the Commission or certain listed investigating entities (Schedule 1, Form 1, part 4).

Operational rights vested in the Commission

• Direction and authorisation power: the Form permits the Commission to direct that a recipient cannot disclose certain matters, and also permits the Commission to authorise disclosure to particular persons or for particular purposes (Schedule 1, Form 1, parts 3 and 4). The Commission therefore retains an operational right to tailor restrictions and exceptions.

Interaction with legal professional privilege and duties

• Legal practitioner exception: recipients may disclose to a legal practitioner for legal advice and representation (Schedule 1, Form 1, part 4). The Form also allows legal practitioners to disclose where a legal duty or professional obligation demands it; this recognises professional obligations and legal duties as exceptions to the notice.

Form-derived obligations to attach statutory text

• Attachment and explanation: the Form instructs that sections 78 and 79 of the Act are to be attached to the notice together with an explanation of their effect (Schedule 1, Form 1, part 7). That produces a duty on the issuer to provide statutory text and explanatory material with the notice.

These duties and rights are fixed in terms by the prescribed form; any enforcement or criminal penalty arises under the Act and is communicated via the Form. Because Regulation 5 mandates the form for s77(3)(a) the Commission is constrained to use the prescribed text when imposing these duties and conferring the listed rights.

The Regulations do not themselves create a new penalty structure. They do, however, embed explicit penalty warnings and enforcement mechanics in the prescribed notice. Because Regulation 5 makes Form 1 the prescribed form for notices issued under section 77(3)(a) of the Act, the effect is that every confidentiality notice will carry the same statutory wording about offences, penalties and the Commission’s powers, unless and until the Regulations are amended.

Penalties stated in the prescribed form (Schedule 1, Form 1)

• Criminal sanction warning: Form 1 declares that "failure to comply with this confidentiality notice may be an offence" and states available penalties: up to 12 months imprisonment, or a fine of up to 120 penalty units, or both (Schedule 1, Form 1, part 1). The Form frames these as consequences for breaching the confidentiality notice by disclosing a restricted matter when not permitted.

• Penalty for failing to give a copy on permitted disclosure: the Form repeats that if a permitted disclosure is made and the discloser fails to provide the recipient of that disclosure with a copy of the confidentiality notice (and any extension or replacement), and they have no reasonable excuse, they can face the same severe penalties described above (Schedule 1, Form 1, part 5).

Enforcement pathway and actors

• Commission’s role: the Commission issues and cancels notices and can authorise disclosures. The Form plainly contemplates that the Commission both imposes restrictions and may authorise or direct their removal (Schedule 1, Form 1, parts 3 and 4). Any enforcement action for breach will therefore be taken under the Act’s enforcement machinery; the Form communicates the penalties that the Act makes available.

• Court extension and orders: the Form anticipates that the Supreme Court may make an order extending a confidentiality notice; that court order could affect enforcement timeframes or relief (Schedule 1, Form 1, parts 4 and 6). The Supreme Court therefore has a role in the legal process relating to notices.

• Intersection with other statutory complaint mechanisms: the Form specifies that disclosures for the purposes of making complaints to oversight bodies (Integrity Oversight Victoria, IBAC) are always permitted. That means recipients may access statutory investigatory channels without contravening the notice. Those oversight bodies are therefore potential enforcement actors or recipients of complaint information (Schedule 1, Form 1, part 4).

Limitations and procedural safeguards reflected in the Form

• Specificisation of restricted matters: the Form requires the Commission to describe specific restricted matters and to specify how each restricted matter relates to the recipient. That particularity narrows the ambit of a notice and provides a factual basis for enforcement or defence (Schedule 1, Form 1, part 1).

• Reasonable excuse carve-out for copying obligations: the copying duty contains a "reasonable excuse" exception. The Form does not define "reasonable excuse", but the presence of the phrase suggests an evidentiary or common-law assessment will apply if the copying obligation is contested (Schedule 1, Form 1, part 5).

Consequences of prescribing a uniform form

• Predictability for enforcement: by prescribing a single form that includes consistent penalty language and procedural instructions, the Regulations create a predictable notice structure for courts, oversight bodies and recipients. Enforcement decisions will be made against the standardised text the Commission is required to give.

• Risk of confusion in the template's example structure: the Form includes both lists of entities to whom a recipient "can" disclose and a subsequent list of entities the Commission "has directed" the recipient "cannot" disclose to, with identical entity labels in both lists in the template. That construction can create potential ambiguity in a particular notice unless the Commission’s chosen ticks and crosses are clear on the face of the notice (Schedule 1, Form 1, part 3). Ambiguities could affect enforcement outcomes by importing interpretive disputes about whether a specific disclosure was authorised.

In sum, enforcement stems from the Act’s offence provisions as communicated through the standard Form 1. The Regulations make the Commission’s communication mandatory and therefore shape the landscape in which enforcement, judicial review and compliance disputes will occur.

The Regulations explicitly cross-reference and interact with multiple Acts and statutory regimes by prescribing the form and by listing where disclosure is authorised. The interactions are textual and procedural rather than jurisdictional reassignments. The principal interactions expressed in the instrument are the following.

• Parliamentary Workplace Standards and Integrity Act 2024 (the Act): the Regulations are made under s114 of the Act (Regulation 2), prescribe the form for notices for the purposes of s77(3)(a) (Regulation 5) and prescribe providers for purposes of s81(2)(f)(iii) (Regulation 4). The Form instructs that sections 78 and 79 of the Act are to be attached and that an explanation of their effect should be provided (Schedule 1, Form 1, part 7). The Regulations therefore operate as subordinate instrumentising parts of the Act.

• Public Interest Disclosures Act 2012: the Form specifically warns recipients to be aware of obligations under sections 52 and 53 of the Public Interest Disclosures Act 2012 concerning confidentiality of assessable disclosures and people who make assessable disclosures (Schedule 1, Form 1, part 1). The Form thereby links the confidentiality notice scheme with the protections and obligations contained in the public interest disclosures regime.

• Independent Broad‑based Anti‑corruption Commission Act 2011 and Integrity Oversight Victoria Act 2011: Form 1 lists complaints to IBAC or Integrity Oversight Victoria as always-permitted disclosures (Schedule 1, Form 1, part 4). It also notes that recipients must comply with a witness summons served by IBAC or Integrity Oversight Victoria. Thus the notice regime is structured not to impede statutory investigatory processes under these Acts.

• Fair Work Act 2009: the Form lists "for the purpose of an application to the Fair Work Commission, including any related proceeding" as one of the example recipients where disclosure may be permitted under a notice (Schedule 1, Form 1, part 3). The Form also lists the Fair Work Act as one of the Acts under which a legal practitioner may advise a recipient in relation to the notice (Schedule 1, Form 1, part 4). That embeds an intersection between notice-restricted disclosures and workplace/industrial dispute resolution mechanisms.

• Local Government Act 2020, Racing Act 1958, Freedom of Information Act 1982 and other Acts: the Form explicitly lists these Acts among those for which legal advice or representation may be sought. It also identifies the Freedom of Information Act 1982 in the context of legal advice. These cross-references identify the statutory contexts in which notice-related legal advice may be relevant and suggest that statutory rights under those Acts are not overridden by a confidentiality notice where a specific legal requirement or right arises (Schedule 1, Form 1, part 4).

• Subordinate Legislation Act 1994: the Endnotes record the Regulations’ making and state that they will sunset 10 years after the day of making, on 8 April 2035, citing section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That places a temporal limit on the Regulations unless they are remade or extended.

• Interpretation of Legislation Act 1984 (ILA): the Endnotes include an interpretive note about style changes authorised by section 54A of the ILA and explain how ILA provisions relating to headings, examples and punctuation apply to the Statutory Rule. Those interpretive notes affect how the text of the Regulation and its Form are to be read as part of the statutory rule.

• Supreme Court orders: the Form contemplates that the Supreme Court may make orders extending confidentiality notices (Schedule 1, Form 1, parts 4 and 6). Therefore, judicial process can alter the temporal effect of a notice.

• Investigating entities’ published reports: the Form allows disclosure where the restricted matter has been published in a report by the Commission or listed investigating entities, including IBAC, Victoria Police, the Victorian Ombudsman, Integrity Oversight Victoria, the Judicial Commission and other listed regulators (Schedule 1, Form 1, part 4). That links the notice regime to the public reporting functions of those investigative institutions.

Taken together, these interactions show that the Regulations are designed to sit within a network of statutory disclosure, investigatory and workplace regimes. The Regulations do not displace those Acts; rather, they provide the Commission a standardised vehicle for restricting or authorising disclosure consistent with those other statutory processes. Where there is overlap, the Form seeks to carve out specific exceptions and to remind recipients of existing obligations under other laws.

The Regulations are newly made and, as at the last recorded version, have no amendments. The Endnotes set out the formal details required for subordinate legislation.

• Making, commencement and instrument details: the Regulations were made on 8 April 2025 by the Governor in Council, on the recommendation of the Premier, under section 114 of the Parliamentary Workplace Standards and Integrity Act 2024, No. 27/2024, and came into operation on 8 April 2025 (Endnotes, General information).

• Sunset: the Regulations will sunset 10 years after the day of making, on 8 April 2035, under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That creates a statutory expiry which requires a remaking process if continuity beyond that date is intended.

• Table of Amendments: the published Table of Amendments states "There are no amendments made to the Parliamentary Workplace Standards and Integrity Regulations 2025 by statutory rules, subordinate instruments and Acts" (Endnotes, Table of Amendments). That is consistent with the Regulations being new and unamended.

• Explanatory details: the Explanatory details section in the Endnotes records "No entries at date of publication" (Endnotes, Explanatory details). No separate explanatory memorandum or published amendment notes accompany the instrument in the text supplied.

• Versioning: the front matter records Version No. 001 and "Version as at 8 April 2025", indicating the Regulations are in their original form (cover page and head matter).

Because the Regulations are at their first iteration, any future changes would be recorded in an updated Table of Amendments and Endnotes. The sunset date creates an administrative deadline for review if policymakers intend to continue the prescriptions or to amend the list of prescribed service providers or insurer.

The Regulations as published do not record any litigation history. The instrument’s Endnotes include a "Litigation history" heading only insofar as the Explanatory details and Table of Amendments sections are populated with "No entries at date of publication" or "There are no amendments" respectively. There are no cases, proceedings or judicial decisions referenced in the text supplied.

Concretely:

• No judicial decisions are cited in the Regulations or in the Form which would indicate prior litigation about the Regulations or the prescribed form.

• The Form anticipates a role for the Supreme Court in extending a confidentiality notice, but the instrument contains no record of any orders, proceedings or contested extensions to that date (Schedule 1, Form 1, parts 4 and 6).

• There is no recorded challenge to the prescribing of particular service providers or VMIA, and the Endnotes’ Table of Amendments shows no subordinate instruments have amended this Regulation.

If future litigation arises it would likely engage the Act’s provisions on confidentiality notices (for example s77-s79 as referenced in the Form) and procedural or constitutional questions around the Commission’s exercise of discretion, the definition of "restricted matter", or the clarity of the prescribed form. At present there are no such decisions recorded in the instrument.

The Regulations are short and tightly focused, but their design and the text of the prescribed notice create practical points of friction and interpretive risk for practitioners and recipients. The following are concrete operational pitfalls based on the text.

• Prescribed form is mandatory and verbose: Regulation 5 mandates that, for the purposes of s77(3)(a) of the Act, Form 1 is the prescribed form. That means the Commission must use the Form’s specific wording, including the prescribed penalty warnings and procedural obligations (Regulation 5; Schedule 1, Form 1). Clients should not expect variants; any deviation risks procedural or legal challenge to the validity of the notice.

• Template ambiguity in the permitted / prohibited lists: the Form’s example structure includes a table-style presentation where the same classes (for example spouse or domestic partner; employer or manager; registered health practitioner) appear in a "You can disclose" list and in a later "The Commission has directed that you cannot disclose" list, with ticks and crosses. Unless the Commission fills the template with clear ticks/crosses for the specific restricted matter, the template’s duplication could produce confusion about whether an intended disclosure is permitted. Practitioners should check the face of the issued notice for the specific ticks/crosses and not rely on assumptions about default permissions (Schedule 1, Form 1, part 3).

• Copying obligation and "reasonable excuse": the notice imposes a duty to give a copy of the notice (and any subsequent replacement/cancellation/extension) to persons to whom a permitted disclosure is made, unless the discloser has a "reasonable excuse" (Schedule 1, Form 1, part 5). The notice does not define "reasonable excuse". In practice this will be litigable; recipients should be cautious and document reasons where a copy cannot be provided immediately.

• Criminal penalties for failing to provide copy: the Form explicitly ties failure to give the notice copy (absent a reasonable excuse) to the same serious penalties as other breaches, including imprisonment and fines (Schedule 1, Form 1, part 5). This creates a discrete risk: a permitted disclosure that does not carry a copy as required could attract criminal exposure in its own right.

• Narrow prescription of support providers: Regulation 4(1) prescribes a closed list of named support providers for the purpose recognised in the Act. If an individual prefers or needs a different support provider not on the list, the Form does not, on its face, authorise disclosure to them for that specific statutory purpose. That could create a practical mismatch for recipients seeking culturally appropriate or specialised support beyond the listed entities (Regulation 4(1)).

• Single insurer specified for legal costs: Regulation 4(2) prescribes VMIA for "insurance and indemnities in relation to legal costs." The practical effect is that statutory recognition of insurer for legal costs is limited to VMIA. Parties seeking other indemnity arrangements may therefore need express Commission authorisation if they wish to disclose restricted matters to a party other than VMIA for legal-cost purposes (Regulation 4(2) and Schedule 1, Form 1, part 3).

• Attachment of statutory provisions: the Form requires that sections 78 and 79 of the Act be attached and explained to the notice recipient (Schedule 1, Form 1, part 7). An issuer that fails to include those attachments and the explanation may produce a compliance or procedural gap. Practitioners preparing notices should ensure these attachments are physically included.

• Multiple statutory regimes invoked: the Form cross-references multiple Acts (for example the Public Interest Disclosures Act 2012, Independent Broad‑based Anti‑corruption Commission Act 2011, FOI Act 1982, Fair Work Act 2009). If a recipient has simultaneous obligations under other statutes, the interaction between those duties and the notice will require detailed navigation and possibly legal advice (Schedule 1, Form 1, parts 1 and 4).

• Supreme Court extension process: the Form contemplates that the Supreme Court may extend a confidentiality notice. Practitioners should note that judicial processes may be required to maintain confidentiality beyond a Commission cancellation or the conclusion of an investigation, and the Form does not set out procedural steps for seeking extension (Schedule 1, Form 1, part 6).

• Record‑keeping and operational burden: the regulated duties to give copies of notices and any replacements or cancellations to prior recipients mean a tangible administrative burden for a recipient who makes multiple permitted disclosures. The Form imposes ongoing notification obligations that continue even if the recipient made an initial permitted disclosure months earlier (Schedule 1, Form 1, part 5). That creates a compliance cost and record‑keeping requirement.

• Lack of a defined timeframe for expiry beyond enumerated events: the Form lists the events that terminate the notice but does not provide a default temporal limit. Practitioners should note that a notice may remain in force until the Commission acts, an investigating body reports publicly, the Commission cancels, or the Supreme Court orders an extension ends (Schedule 1, Form 1, part 6).

These are practical issues that follow from the text. They highlight areas where clarity on the face of an issued notice and careful record-keeping are necessary to reduce enforcement risk.

This section translates the Regulations and the prescribed confidentiality notice into concrete compliance steps for recipients, Commission officers drafting notices, employers and advisers.

For the Commission and notice drafters

• Use the prescribed text exactly: Regulation 5 requires Form 1 for the purposes of s77(3)(a) of the Act. Ensure the final notice uses the exact prescribed language, including the prescribed penalty warnings, and attaches sections 78 and 79 of the Act with an explanation as required (Regulation 5; Schedule 1, Form 1, part 7).

• Fill the per‑matter authorisations with clear ticks or wording: when specifying for each restricted matter who the recipient "can" disclose to and who the Commission "has directed" the recipient "cannot" disclose to, mark the choices clearly to avoid the template-style ambiguity. Use precise, unambiguous language tailored to the particular restricted matter (Schedule 1, Form 1, part 3).

• Specify the restricted matter with factual particularity: the Form requires a description of the investigation and the restricted matter and how it relates to the recipient (Schedule 1, Form 1, part 1). That factual particularity helps limit overbroad restrictions and supports enforceability.

• Provide attachments and accessible explanations: include the required statutory sections (78 and 79 of the Act) and a clear explanation of their effect. Where the recipient has language or literacy limitations, supply an interpreter or an independent person as contemplated in the Form (Schedule 1, Form 1, parts 4 and 7).

For recipients (individuals served with a confidentiality notice)

• Read the notice in full and check the per‑matter authorisations: do not assume default permissions. Confirm whether the person or body you wish to disclose to appears explicitly under "You can disclose this restricted matter" for the particular restricted matter (Schedule 1, Form 1, part 3).

• If in doubt, seek Commission authorisation: the Form permits the Commission to authorise disclosure where requested (Schedule 1, Form 1, part 4). If an intended recipient is not listed, apply promptly to the Commission for written authorisation rather than making the disclosure without authority.

• Preserve a copy and give copies on permitted disclosure: when making a permitted disclosure, give the other person a copy of the confidentiality notice and any orders extending or cancelling it unless you have a reasonable excuse. Keep contemporaneous evidence of having provided a copy (Schedule 1, Form 1, part 5).

• Obtain legal advice for ambiguous cases: the Form permits disclosure to legal practitioners for advice and representation relating to the notice and lists relevant Acts to consider. If the status of an intended disclosure is unclear, obtain legal advice before acting (Schedule 1, Form 1, part 4).

• Document reasonable excuses: if you cannot provide a copy of the notice when making a permitted disclosure, document and preserve evidence of the reason, because the Form links failure to provide the notice-copy to significant penalties absent a reasonable excuse (Schedule 1, Form 1, part 5).

• Use the always-permitted channels where appropriate: if you want to make a complaint to Integrity Oversight Victoria, IBAC, or provide information because of a statutory witness summons, those disclosures are always permitted under the Form (Schedule 1, Form 1, part 4). That pathway is available without prior Commission authorisation.

• For under‑18s, those with limited English or impairment: the Form contemplates necessary disclosures to parents, guardians, interpreters or independent persons; follow those pathways and ensure the auxiliary person receives a copy of the notice as required (Schedule 1, Form 1, part 4).

For employers, unions, EAPs, VMIA and support providers who receive a disclosure

• Expect to receive a copy of the notice: the discloser must give you a copy of the notice when disclosure is permitted. Retain that copy and incorporate its terms into any subsequent handling of the information (Schedule 1, Form 1, part 5).

• Check authority and scope: note that the permitted disclosure may be limited to a particular restricted matter and purpose. Do not treat receipt of one disclosure as permission to solicit or receive other restricted matters without further authorisation from the Commission.

• For VMIA and insurers: as VMIA is prescribed for legal costs indemnities, VMIA should expect to be the statutory insurer for these matters. Ensure internal procedures reflect that statutory prescription and that any request for information fits the scope of the notice authorisation (Regulation 4(2) and Schedule 1, Form 1, part 3).

Record-keeping and internal processes

• Maintain auditable logs: for each permitted disclosure, record the date, recipient, copy given, the restricted matter identified, and any Commission authorisation. This is important both for compliance and as evidence of steps taken to meet the copy-giving obligation.

• Train frontline staff: organisations listed in the prescribed providers schedule and employers likely to receive disclosures should train staff to recognise the format of Form 1, the obligations it imposes and the need to escalate to legal or compliance teams.

• Review policies against the prescribed provider list: if an organisation provides support services not on the prescribed list, be aware the notice does not automatically authorise disclosure to that organisation for the statutory purpose; recipients should be directed to the listed providers or to seek Commission authorisation to disclose to alternative providers (Regulation 4(1)).

Handling cancellations, replacements and extensions

• Monitor for changes: under part 6 of Form 1, notices expire when the Commission cancels or replaces them; recipients who have previously made permitted disclosures must be given copies of new notices or cancellations (Schedule 1, Form 1, parts 5 and 6). Organisational processes should therefore include monitoring for such updates.

• Seek court orders if needed for extension: if ongoing confidentiality beyond a Commission cancellation is required, pursue the Supreme Court extension avenue contemplated in the Form (Schedule 1, Form 1, parts 4 and 6).

Cross-references and legal compliance

• Consider Public Interest Disclosures Act obligations: the Form specifically references sections 52 and 53 of the Public Interest Disclosures Act 2012 regarding confidentiality of assessable disclosures (Schedule 1, Form 1, part 1). If a disclosure may be an assessable disclosure, seek advice on the interaction between the notice and the public interest protections and confidentiality obligations.

• Use the "always permitted" exceptions strategically: disclosures to IBAC, Integrity Oversight Victoria, or other listed investigative bodies are always permitted and can be used where safety, corruption or serious misconduct concerns exist (Schedule 1, Form 1, part 4).

Following these steps aligns conduct with the specific prescriptions of the Regulations and the mandatory wording of the prescribed notice. Documentation, timely legal advice, and clear internal processes are the principal practical tools to reduce enforcement risk under the regime the Regulations implement.
