75 Taking advantage of information

(1) A person who is or was a commissioner or Commission officer must not take advantage of any information acquired by reason of being a commissioner or Commission officer, or in the course of the performance of functions under this Act or any other Act, to benefit the person or any other person.

(2) A person does not commit an offence against subsection (1) if the information is in the public domain at the time the person takes advantage of it, otherwise than as a result of a disclosure that the person knows or ought to have known was unlawful.
