What it does
This instrument, the Parliamentary Superannuation Age Factors (Surcharge) Determination 2015 (No. 1), is a legislative determination made by the Parliamentary Retiring Allowances Trust under subsection 22A(1) of the Parliamentary Contributory Superannuation Act 1948 (the Trust records its action on the face of the instrument). The Determination performs three mechanical functions.
First, it sets the legal name of the instrument (s 1). Second, it prescribes the date when the instrument takes effect: it commences on the day after it is registered on the Federal Register of Legislative Instruments (s 2(a)). Third, it operates to revoke a prior instrument: it expressly revokes the Superannuation Pension Conversion Factors Determination No. 1/2004 made by the Trust on 9 December 2004 (s 2(b)). The instrument is signed and dated (12 August 2015) by two trustees of the Parliamentary Retiring Allowances Trust, Michael Francis McCormack and Philip Ruddock; that signing appears on the face of the instrument and anchors the administrative provenance.
Substantively, and most importantly, the Determination prescribes the age factors to be used “for the purposes of section 22A of [the Parliamentary Contributory Superannuation Act 1948]” (s 3). Those age factors are set out in a Schedule to the Determination in four discrete tables: Table A (Male Retirement Pension Age Factors), Table B (Female Retirement Pension Age Factors), Table C (Male Invalid Pension Age Factors) and Table D (Female Invalid Pension Age Factors). Section 3 also specifies the basis on which a table is selected for an individual: the person’s sex (male or female), whether the relevant benefit is a retirement pension or an invalidity pension, and the person’s age “when the benefit becomes payable” which the tables record as “age at last birthday prior to start of pension”. The Schedule therefore supplies the numeric age factor for each combination of those attributes for ages recorded in the tables (20-80). The Determination itself contains no detailed explanatory text about how the factors are to be applied within s 22A; it simply supplies the numeric factors and the selection rules in s 3.
