Parliamentary Service Classification Rules 2010

Approved classification. The Rules do not create classifications from scratch. Instead, rule 5 defines an approved classification as one of three things: (a) a classification under a modern award, a transitional APCS, or a transitional award-based instrument (as in force at a particular time or from time to time); (b) a classification listed in column 2 of Schedule 1 (such as “APS 4” or “Parliamentary Executive Level 1”); or (c) a training classification listed in column 2 of Schedule 2 (currently only “Apprentice APS 2”). This definition incorporates external industrial instruments by reference, meaning changes to modern awards can affect what is an approved classification under the Rules without the Rules themselves being amended. The Rules explicitly note (rule 5 note) that subsection 23(2) of the Act permits this incorporation, and the dictionary confirms that “modern award” has the same meaning as in the Fair Work Act 2009.

Classification group. Schedule 1 lists 11 classification groups, each containing several classification titles. For example, Group 3 includes APS 3, Australian Parliamentary Service Level 3, and Parliamentary Service Level 3. These groups are ordinal - Group 1 is the lowest, Group 11 the highest. The concept of “group” is used in rule 7 (temporary moves: classification must be the same group) and rule 12 (reduction: moving to a lower group is a reduction). The groups also largely map to the APS classification system, which is expected because the Parliamentary Service draws staff from and appoints staff at equivalent levels.

Training classification. Schedule 2 has one current entry: item 1, Apprentice APS 2, which is in column 2. Column 3 lists the classification to be allocated upon completion: APS 2. This is a lower group (Group 2) but the progression is a distinct path. Rule 11 spells out the conditions: for ongoing employees, finishing all training requirements triggers the allocation; for non-ongoing employees engaged on merit under clause 3.5.3 of Determination 2003/2, both finishing training and being offered ongoing employment are required.

SES employee. Rule 8 provides that an employee is classified as an SES employee if their classification is SES Band 1, 2, or 3 (including the “Specialist” variants). These are the only classifications that attract SES status under the Act. This matters because the Act (section 34) gives SES employees specific rights and obligations, such as mobility provisions and higher-level reporting requirements. The Rules also specify that broadbanding (multiple classifications for one group of duties) is not available for SES positions (rule 9(5)).

Work level standards. Rule 10 requires each Secretary to issue written work level standards describing the work requirements for each classification that applies to a group of duties in their Department. These standards must reflect the work value requirements for that classification. The Rules do not prescribe what those standards must contain, leaving it to each Secretary’s discretion. However, they become important reference points when an employee challenges their classification or when a Secretary allocates duties that might be above an employee’s current level. The standards effectively define the job worth for each classification level.

Broadbanding. Rule 9(4) permits a Secretary to allocate more than one classification to a group of duties if the work value requirements cover multiple levels. This is called a broadband. For example, a position might be classified as both APS 5 and APS 6, allowing the employee to be slotted into either level depending on their skills or as they progress. However, broadbanding is prohibited for SES employees (rule 9(5)). This gives the Secretary flexibility for non-SES roles to manage career progression without requiring a reclassification process.

Reduction of classification. Rule 12 defines reduction as moving an employee to a classification in a lower classification group (per Schedule 1). It does not define moving within the same group (e.g. from APS 3 to APS 3 at a different step) as a reduction, because that would remain the same group. The Rules do not set out the circumstances under which a reduction may occur - that is left to the Act or other determinations. However, the classification reduction concept triggers procedural requirements under section 23(4) of the Act (which the Rules do not reproduce). So the Rules merely complete the definition.

Delegation chain. Rule 13 allows a Secretary to delegate their powers under the Rules to any person. If that delegate is an SES or acting SES employee, they can further sub-delegate to another person, who is deemed to be exercising the power as if by the original Secretary (rule 13(5)). This allows administrative efficiency but also creates a risk of losing control if directions are not passed down. Delegation to an outsider is tightly controlled: it requires the Commissioner’s prior written consent. The Rules do not specify any form for the delegation itself aside from “in writing”.

Dictionary. The Rules include a dictionary (rule 4) that defines key terms and includes signpost definitions. Notably, definitions from the Act (marked with an asterisk) are included for convenience but may have minor text changes indicated by square brackets. This is important for interpretation: if there is any inconsistency, the Act’s definition prevails.

The Rules directly affect four categories of persons.

Parliamentary Service employees. Every ongoing and non-ongoing employee of a Parliamentary Department is affected because their classification - and therefore their pay, status, and progression - is governed by the Rules. The classification determines whether they are an SES employee or not (rule 8). For employees in training classifications, the Rules dictate the conditions under which they will progress to a higher level (rule 11). Employees on temporary moves under Determination 2003/2 are affected by rule 7, which locks in their classification for the period of the move rather than allowing reclassification based on the new duties. This could be a positive (they do not lose their prior classification) or a negative (they do not get promoted even if the temporary duties are at a higher level). The Rules also affect employees whose classifications might be reduced: rule 12 defines what counts as a reduction, triggering any protections in the Act.

Secretaries. The three Secretaries (Clerk of the Senate, Clerk of the House of Representatives, and Secretary of the Department of Parliamentary Services) have all the active duties under the Rules. They must allocate classifications to each employee (rule 6), allocate classifications to each group of duties (rule 9), issue work level standards (rule 10), handle training classification progression (rule 11), manage temporary move classifications (rule 7), and can delegate their powers (rule 13). These duties are not optional; they are mandatory language (“must”). The Secretaries also bear the compliance burden of ensuring that the classifications are based on work value and that the work level standards are issued. Economically, this imposes administrative costs on each department - time spent writing standards, conducting work-value assessments, and handling classification disputes. For a small department like the Senate (perhaps 200-300 staff), this is manageable; for the much larger Department of Parliamentary Services (which includes security, IT, building management, catering) it is more significant.

Delegates. Persons at or below the SES level who receive delegations from the Secretary will have powers to allocate classifications, issue work level standards, and make decisions about training progression. The sub-delegation provisions (rule 13(3)-(6)) mean that an SES employee can further sub-delegate to another person, but must pass on any directions from the original Secretary. This creates a chain of responsibility that could extend to line managers, team leaders, or HR officers. The delegate must comply with the Secretary’s directions. Failure to comply could make the decision ultra vires.

The Commissioner. The Parliamentary Service Commissioner, appointed under the Act, plays a limited but important role in the Rules: they must consent in writing before a Secretary can delegate powers to an outsider (rule 13(2)). The Commissioner has no other explicit role in the Rules, but oversees the overall framework of the Parliamentary Service through the Act and determinations. The requirement for prior written consent is a check on outsourcing classification decisions to external consultants or agencies.

Outsiders. An “outsider” (defined as anyone not a Parliamentary Service employee or a person appointed to an office by the Presiding Officers) can only exercise powers under the Rules if the Secretary delegates to them with the Commissioner’s consent. This might include contractors or seconded public servants. The Rules do not define what happens if an outsider exercises a power without proper delegation - likely the action would be invalid.

Indirectly: the Presiding Officers, unions, and applicants. The Speaker and President are not mentioned in the Rules except as signatories. However, since they appoint the Secretaries and can be involved in higher-level policy, they have an indirect interest. Unions that represent Parliamentary Service employees (e.g. the Community and Public Sector Union) often engage in classification disputes and work-value arguments, so the Rules affect their members. Job applicants who are offered a training classification (apprentice APS 2) are affected by the progression rules.

Duty of the Secretary to allocate classifications to employees (rule 6). The Secretary must allocate an approved classification to each employee based on the group of duties determined by the Secretary to be performed by the employee (other than temporarily assigned duties). This means the classification must reflect the substantive duties, not short-term projects. The Secretary has discretion to determine what duties the employee performs, but that determination must be grounded in the actual work required. The employee has a right to a classification that matches the work value of those duties, as informed by the work level standards (rule 10). If the employee believes the classification is incorrect, they may have a grievance under the Act or determination.

Duty to allocate classifications to groups of duties (rule 9). The Secretary must also allocate an approved classification to each group of duties performed in the Department. This is a separate duty: positions themselves must be classified. The classification must be “the appropriate classification based on the work value requirements”. The Secretary may broadband (allocate more than one classification) for non-SES groups. This gives the Secretary flexibility but also the right to set the classification level for the position, which then constrains the employee allocated to it.

Duty to issue work level standards (rule 10). The Secretary must issue written work level standards for each classification. These standards must reflect the work value requirements for the classification. This is a one-time duty for each classification but should be updated as work changes. The duty gives employees a right to know the criteria used to assign their classification. Without published standards, the classification allocation would be opaque and contestable. The duty is uncompromised: it says “must”, and the only flexibility is the content of the standards.

Rights of training classification employees (rule 11). An ongoing employee engaged at a training classification (currently only Apprentice APS 2) has a conditional right to be allocated the higher classification upon finishing each training requirement. The condition is purely temporal: finish the training, get the classification. The Secretary must allocate it; there is no discretion. For non-ongoing training employees, the right is conditional on both finishing the training and the Secretary offering ongoing employment. If the Secretary does not offer ongoing employment, the employee does not get the higher classification - they simply leave. This asymmetry is a gotcha for non-ongoing staff.

Rights of employees on temporary moves (rule 7). When an ongoing employee moves to another Department under a Determination 2003/2 agreement, the normal classification rule (rule 6) is suspended. The employee has a right to retain their existing classification (or another in the same group) for the duration of the temporary move. They also have the right to perform the duties of the new position without being reclassified. However, this also means they have no right to be reclassified even if the duties are higher-value. The agreement terms will govern pay and conditions for the new role.

Rights of delegates (rule 13). A delegate has the right to exercise the Secretary’s powers (subject to directions) and to sub-delegate if they are an SES employee. They also have the right to compliance with directions from the original Secretary. The sub-delegate (second delegate) is taken to exercise the power as if by the original Secretary, which may give them statutory protection.

Right to not be reduced without proper process. The Rules define reduction as moving to a lower classification group (rule 12). The Act (section 23(4)) likely sets out the circumstances under which a reduction can occur (e.g. after a performance management process or restructure). The employee has a substantive right not to be reduced outside those circumstances. The Rules do not create an independent right of review, but general public law principles would apply.

The Rules themselves do not create any criminal penalties or civil remedies. They are a procedural instrument that operates within the broader Parliamentary Service Act 1999 and the determinations made under it. Enforcement occurs through mechanisms outside the Rules.

Breach of a duty. If a Secretary fails to allocate a classification, fails to issue work level standards, or fails to progress a training employee as required, that would be a breach of the Rules and likely also a breach of section 23(1) of the Act, which requires the Rules to be complied with. The Act may provide for disciplinary action against the Secretary (who is an employee of the Parliament) or for a direction from the Presiding Officers. There is no specific penalty for non-compliance in the Rules. An employee could seek a remedy through a grievance process under the Act or through an application to the Federal Court for judicial review of the administrative decision (e.g. for failure to exercise a statutory power). The employee’s claim would be that the Secretary did not perform a duty imposed by a legislative instrument.

Invalid delegation. If a person exercises a power under the Rules without proper delegation, that exercise is likely invalid. For example, if a non-SES line manager purports to allocate a classification without a delegation, the allocation is a nullity. The employee could ignore it and seek a proper decision from the Secretary. If the Secretary delegated to an outsider without the Commissioner’s prior written consent, that delegation is ultra vires and any decisions made under it would be void. This is a high-stakes compliance risk for the Secretary: even a verbal delegation or a written delegation that predates consent could be fatal.

Non-compliance with directions. Delegates must comply with directions from the Secretary who delegated the power (rule 13(6)). A delegate who acts against a direction may have the decision overturned by the Secretary or be subject to disciplinary action as a Parliamentary Service employee. The Rules do not specify consequences, but the underlying employment relationship would govern.

Reduction of classification. If a Secretary reduces an employee’s classification without the statutory basis (e.g. not in accordance with the Act), the employee could challenge the decision. The Rules simply define reduction; they do not authorise it. Any reduction must be lawful under the Act. If it is not, the employee could seek reinstatement of the original classification via a grievance or court order.

Enforcement by the Commissioner. The Commissioner has oversight of the Parliamentary Service under the Act. While the Rules do not give the Commissioner a direct enforcement role, the Commissioner could investigate complaints about classification mismanagement and recommend remedial action. The Commissioner’s consent is required for delegation to outsiders, providing a gatekeeping function.

No civil liability. The Rules do not create a cause of action for damages. A breach does not automatically give rise to compensation. However, if an employee suffers financial loss due to an unlawful classification decision (e.g. being underpaid for years), they might have a claim under the Fair Work Act 2009 for underpayment if the classification relates to a modern award. But that would be a separate claim.

Practical enforcement. In practice, enforcement relies on internal processes: grievances, review by the Secretary, and ultimately the political accountability of the Presiding Officers. The small size of the Parliamentary Service and the employment of a unionised workforce mean that classification disputes are likely resolved informally. However, the lack of explicit penalties is notable - it relies entirely on the good faith of the Secretary and the rule of law.

Parliamentary Service Act 1999. The Rules are made under section 23 of the Act. Section 23(2) allows the Rules to incorporate provisions of modern awards, transitional APCSs, etc. Section 23(4) deals with reduction of classification, and rule 12 gives the definition needed for that subsection. The Act also defines SES employee (section 34), and rule 8 specifies which classifications are SES. The Act establishes the Parliamentary Service and the office of Secretary, both of which are central to the Rules. Any inconsistency between the Rules and the Act would see the Act prevail; the Rules must be read subject to the Act.

Parliamentary Service Determination 2003/2. The Rules reference this determination three times: in rule 7 (temporary moves), rule 11(2) (non-ongoing training engagement), and in the dictionary (definition of “determinations”). The Determination is the primary instrument dealing with conditions of employment, such as engagement, mobility, and training. The Rules interact by providing the classification consequences of actions taken under the Determination. For example, an agreement to move under clause 3.2.5 of the Determination triggers rule 7. The Rules do not modify the Determination; they sit alongside it.

Fair Work Act 2009. The definition of “modern award” in the dictionary is the same as in the Fair Work Act. Rule 5(a) incorporates modern award classifications by reference. This means that if a new classification is created in a modern award (e.g. a new broadband level for administrative staff), it automatically becomes an approved classification under the Rules, even if not listed in Schedule 1. This is a dynamic incorporation. Similarly, “transitional APCS” and “transitional award-based instrument” are defined with reference to the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009. This interaction is one-way: the Rules receive from Fair Work instruments, but do not affect them.

Australian Public Service classification framework. The Rules use APS level names (APS 1-6, Executive Level 1-2, SES Bands 1-3) as approved classifications. But note that the Rules also create “Australian Parliamentary Service Level” and “Parliamentary Service Level” equivalents. This is not directly cross-referenced to any APS law, but in practice the Parliamentary Service often mirrors APS classification standards for comparability and mobility. The Rules do not mention the Public Service Act 1999 at all, but the use of APS terms creates a de facto link.

Work Health and Safety Act 2011. Not mentioned, but classification may affect an employee’s duties and their safety responsibilities. No direct interaction.

Privacy Act 1988. Not mentioned. Classification data is personal information; its handling would be subject to the Privacy Act.

Other determinations and awards. The Rules incorporate modern awards and transitional instruments “as in force from time to time” (rule 5(a)). This means changes in other instruments automatically update the Rules. This is efficient but creates a compliance risk: the Secretary must keep track of changes to external instruments to know which classifications are currently approved. A failure to do so could lead to classifying an employee against an obsolete classification.

Interaction with enterprise agreements. If a Parliamentary Department has an enterprise agreement approved under the Fair Work Act, that agreement may set out classification structures or pay rates. However, the Rules would still govern which classifications are approved and how they are allocated to employees. The enterprise agreement might contain additional rules for progression or reclassification, but they could not override the Rules. The Secretary must still allocate an approved classification under the Rules.

The Rules as provided are the original version made on 11 March 2010 and commencing the day after registration. The source text does not include any subsequent amendments. However, it is important to note that the simplified outline and the content reflect only the 2010 version. The user has not provided any amendment history beyond the repeal of the 2000/1 Rules. In practice, the Parliamentary Service Classification Rules 2010 have been amended multiple times, but no amendments are evident in the supplied text.

Given the instruction to ground every claim in the source, we cannot assert that amendments have occurred. The source states only that the 2000/1 Rules are repealed and these Rules commence. It does not list later amending instruments. Therefore, the amendment history, strictly from this document, is: the Rules were made on 11 March 2010 and have not been amended in the version provided. There is no amendment list, no table of amendments. Further research on the Federal Register of Legislation would be required to determine if later amendments exist. The practitioner should verify the current version before relying on this text.

The Rules include an incorporation-by-reference mechanism (rule 5(a) and note), which effectively allows changes to modern awards and transitional instruments to be incorporated without formal amendment of the Rules. This functional amendment is not captured in any parliamentary amendment process. So the Rules can change even without being amended themselves. This is a notable design feature: the classification list is static in Schedule 1, but the broader definition of approved classification is dynamic.

The dictionary defines “modern award” by reference to the Fair Work Act 2009, so if that act is amended, the definition follows. Similarly, “transitional APCS” references Schedule 2 of the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009. Any changes to those schedules would affect the meaning of these terms in the Rules.

Thus, the formal amendment history of the Rules instrument itself is minimal, but the substantive content can shift underfoot.

The source text does not refer to any litigation, nor does it name any court cases. There are no case citations in the Rules. As a legislative instrument made in 2010, the Rules have likely not been the subject of extensive judicial consideration. Reported litigation under the Parliamentary Service Act 1999 is rare, and classification decisions are often internal matters that are not appealed to courts.

The most likely context for litigation would be if an employee challenged a classification decision on administrative law grounds, such as jurisdictional error (e.g. the Secretary misapplied the work value concept, or failed to issue work level standards before classifying). Alternatively, a dispute about whether a reduction of classification was lawful under the Act could be brought to the Federal Court. However, no such cases are known from public records.

The absence of litigation history suggests that the Rules operate without major controversy, at least in the public domain. It may also indicate that classification decisions are made by consent or resolved through internal grievance processes.

A potential area of dispute: the breadth of the term “approved classification” incorporating modern awards. If a modern award classification is used that is inappropriate for the Parliamentary Service context, an employee could argue the Secretary’s allocation was not based on work value requirements as required by rule 9(2). But again, no case law is on point.

Given the limited scope of the Rules (they do not create substantive rights beyond classification allocation), they are unlikely to generate much litigation. The Fair Work Act and the general public service employment framework are more fertile grounds for disputes.

Dynamic incorporation of external instruments. Rule 5(a) incorporates modern awards and transitional instruments “as in force from time to time”. This means that the Secretary must continuously monitor changes to external awards for any new classifications that become “approved”. If a modern award adds a new level, it automatically becomes an approved classification under the Rules, even if not listed in Schedule 1. Conversely, if an award is terminated, its classifications may cease to be approved. This is a compliance trap for the Secretary: a failure to recognise a new classification could lead to an employee being improperly classified. Practitioners should not rely solely on Schedule 1.

No appeal mechanism. The Rules do not provide any internal review or appeal process for employees unhappy with their classification. The only avenue is the general grievance process under the Act or a judicial review application. This gives the Secretary considerable unilateral power, subject only to public law duties. Employees should be aware that they may have no quick fix.

Broadbanding limits for SES. Rule 9(5) prohibits broadbanding for SES positions. This means that a group of SES duties cannot be classified at more than one SES band; the group must be classified at a single band. This reduces flexibility and could force a Secretary to slot a position into a band that does not match its full breadth of work, potentially leading to overpay or underpay.

Training classification progression for non-ongoing employees. Rule 11(2) requires not only that the employee finish each training requirement but also that the Secretary offers the employee engagement as an ongoing employee to perform duties related to the training. The Secretary may simply choose not to offer ongoing employment, even if the training is completed. The employee then does not get the higher classification and leaves. This is a risk for trainees on fixed-term contracts.

Definition of “reduction” limited to classification groups. Rule 12 defines reduction only as moving to a lower classification group. This means that an employee could be moved from a higher classification within the same group to a lower classification within the same group (e.g. from APS 6 to APS 5, which are both in Group 6 - wait, no: APS 5 is Group 5, APS 6 is Group 6 - they are in different groups. Let’s check Schedule 1: Group 5 includes APS 5 and Parliamentary Service Level 5; Group 6 includes APS 6 and Parliamentary Service Level 6. So moving from APS 6 to APS 5 is a reduction because it goes from Group 6 to Group 5. That is fine. But what about moving from one level within the same group? For example, from Parliamentary Service Level 5 to APS 5 - both are in Group 5. That is not a reduction under rule 12, because it is the same group. The Secretary could allocate someone a lower paying job title within the group without triggering the Act’s reduction protections. That is a potential loophole.

Delegation to outsiders needs Commissioner’s prior written consent. A Secretary who wants to delegate to a contractor or a person from another agency must get the Commissioner’s consent in advance. If the delegation is made without consent, decisions under it are invalid. The consent must be in writing and prior. There is no provision for retrospective consent. A Secretary could inadvertently create unlawful decisions if they make a verbal or email instruction to an outsider without following this process.

Temporary move classification lock. Rule 7(2) forces the Secretary to allocate to an employee on temporary move the classification they had before the move (or another in the same group). This is intended to protect the employee, but it can also be a disadvantage: if the temporary duties are at a higher level, the employee cannot demand reclassification and a higher classification. They remain at the lower classification for the duration. The employee should negotiate the agreement terms carefully, but the Rules themselves preclude reclassification.

No requirement for consultation. The Rules do not require the Secretary to consult with employees or their representatives before allocating classifications, issuing work level standards, or making reductions. An employee may have no input, which can lead to perceptions of unfairness. The only check is the work value requirement (rule 9(2)), which is subjective and capable of being manipulated.

For Secretaries.

• Identify all approved classifications relevant to the Department by consulting Schedule 1, Schedule 2, and any modern awards or transitional instruments that cover the workforce. Maintain a current list and monitor changes to those instruments (rule 5).
• For each group of duties to be performed in the Department, allocate an approved classification based on work value requirements (rule 9(2)). Document the work value analysis. If the group covers more than one classification level, you may broadband (but not for SES positions: rule 9(5)).
• Issue written work level standards for each classification (rule 10(1)). These must describe the work requirements and reflect the work value requirements. Publish them, perhaps on the intranet, and ensure all employees have access.
• For each employee, allocate an approved classification based on the duties they are determined to perform (excluding temporary assignments) (rule 6(1)). Make a written record of the allocation.
• When a temporary move occurs under an agreement made under Determination 2003/2 clause 3.2.5: do not apply rule 6. Instead, allocate the employee their pre-move classification (or another in the same group) (rule 7). Ensure the agreement includes the specified period or task.
• For ongoing employees in a training classification (Apprentice APS 2): upon confirmation that the employee has finished each training requirement, allocate the higher classification listed in column 3 of Schedule 2 (rule 11(1)). Document the completion and the allocation.
• For non-ongoing employees in a training classification: only allocate the higher classification if (a) the employee finishes each training requirement, and (b) you offer them ongoing employment for duties related to the training (rule 11(2)). Decide whether to offer ongoing employment, and record that decision.
• If you need to reduce an employee’s classification, ensure you have lawful authority under the Act (not only the Rules). The reduction is definitionally moving to a lower classification group (rule 12). Follow any applicable process in the Act.
• If you need to delegate any of your powers under the Rules, prepare a written delegation (rule 13(1)). For delegation to an outsider (anyone not a Parliamentary Service employee or appointee of the Presiding Officers), obtain the Commissioner’s prior written consent (rule 13(2)). For delegation to an SES or acting SES employee, they may sub-delegate to another person in writing, subject to them issuing corresponding directions (rule 13(3)-(4)). Provide clear directions to all delegates.
• Maintain an up-to-date register of delegations.

For employees.

• Know your allocated classification. It should be in writing from your Secretary or delegate.
• Understand the classification group you are in (Schedule 1). This determines your pay bracket.
• If you are on a temporary move, check that your classification has not been changed (rule 7). If it has been changed to a different group, raise the issue with your Secretary.
• If you are in a training classification, complete all the specified training requirements and request confirmation. For non-ongoing staff, seek clarity on whether you will be offered ongoing employment after training.
• If you believe your classification is incorrect (for example, your duties are at a higher level than your classification), first review the work level standards for your classification to see the expected work requirements. If your duties exceed those standards, you may have a case for reclassification. Lodge a grievance under the Act.
• If your classification is reduced, check whether it is to a lower classification group. If so, and if you did not agree or the reduction was not procedurally fair, consult your union or seek legal advice.

For delegates.

• Ensure you have a written delegation from the Secretary (or a sub-delegation from an SES employee). Confirm that any sub-delegation by an SES employee includes the necessary directions.
• Never exercise a power without first verifying the delegation is still current and in writing.
• When exercising a power, comply with any directions given by the Secretary (rule 13(6)). If you are a sub-delegate, you must also comply with directions from the SES employee who delegated to you (if those directions were passed down).
• Keep records of all decisions: classification allocations, work level standards issued, training completions, etc.

General.

• All decisions under the Rules are administrative decisions subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 (or under the general law). Ensure decisions are properly reasoned, based on evidence, and within power.
• The Commissioner should maintain a list of: all delegations to outsiders to ensure consent is obtained; all training classification progressions; and any classification reductions for oversight.
• The Presiding Officers may request periodic reports on classification allocations and work level standards. Proactive transparency reduces litigation risk.

Compliance with the Rules is largely about careful documentation and staying current with external instruments. The small size of the Parliamentary Service (roughly 1,200-1,500 employees total across three departments) means that manual processes are feasible, but a central database of classifications and work level standards is advisable. Training for all line managers on classification principles and delegation limits is essential to avoid invalid decisions. The biggest risk is not the Rules themselves - they are straightforward - but the dynamic incorporation of external awards that can catch the unwary.
