Parliamentary Salaries, Allowances and Superannuation (Provision of Motor Vehicles) Regulations 2019

The Regulations introduce a small set of legal concepts and operational devices; each is defined or used in a particular statutory sense.

• Election process. The central procedural concept is the Member’s written election to be provided with a motor vehicle, delivered to the relevant Clerk. Timing rules govern when that election may be made: within one month of becoming a Member or within one month of the commencement of each subsequent term of Parliament (regulation 6(1)); alternatively, during the current term outside the final 12 months, a Member may also elect (regulation 6(2)). Elections must be in writing and lodged with the relevant Clerk.

• Deemed election. A transitional device treats an election made under the prior 2013 Regulations and not revoked before 16 September 2019 as an election under the new Regulations (regulation 6(3)). Also, a Member who was provided with a vehicle for the immediately preceding term is taken to have made an election for the new term unless they notify otherwise within one month of being declared elected (regulation 6(5)). These rules preserve continuity of entitlement across the revocation of the 2013 Regulations.

• Revocation and revocation timing. A Member can revoke an election in writing to the relevant Clerk, but revocation is limited to circumstances where the motor vehicle provided is due to be replaced in accordance with the Ministerial guidelines under section 9L (regulation 6(4)). That ties the Member’s exit rights to the replacement cycle set by administrative guidelines rather than giving an unconditional right to stop the entitlement at any time.

• Provision and funding. If a Member elects (or is taken to have elected), the Member will be provided with the use of a "fully funded motor vehicle" in accordance with the section 9L guidelines (regulation 7(1)). The Regulations therefore create an entitlement to a vehicle paid for by the State; the shape of that entitlement and the permitted uses are delegated to guidelines.

• Termination triggers. A person’s provision of a motor vehicle ends on the earliest of ceasing to be a Member, revoking under regulation 6(4), or notifying the Clerk under regulation 6(5) that the Member will not elect for that term (regulation 7(2)). These are the contract-end mechanics that convert membership status and administrative steps into the cessation of the State-funded benefit.

• Delegation to guidelines. The instrument repeatedly defers to Ministerial guidelines under section 9L of the parent Act for operational detail. The Note to regulation 7 explicitly lists topics that the Minister may cover in guidelines: the type of vehicles provided, permitted uses, authorised drivers, and Members’ responsibilities. The Endnotes’ reference to the Interpretation of Legislation Act 1984 confirms that such notes and similar material included in the Statutory Rule are part of the instrument.

These concepts create a framework in which a statutory entitlement exists but is heavily shaped by administrative choices in the guidelines. The Regulations set the timing, opt-in/out mechanics and termination events, but leave the crucial operational boundaries and usage conditions to delegated instruments.

Primary persons affected

• Members. The Regulations operate in respect of "a Member" and repeatedly address people who "become a Member", are "declared elected", or "cease to be a Member" (regulations 6 and 7). The Regulations do not define "Member" within their text; they operate in the context of the Parliamentary Salaries, Allowances and Superannuation Act 1968, so the relevant legal definition of Member will be found in the parent Act or other parliamentary instruments. For practical purposes the Regulations affect those members of Parliament who are eligible to make the written election described in regulation 6.

• Relevant Clerk. The Regulations make the "relevant Clerk" the formal administrative recipient of elections and revocations (regulation 6(1), (4), (5)). That person is the statutory point of interaction and a decision node for recording the Member’s election, revocation or notification not to elect.

Secondary and operationally affected parties

• Minister and departmental officers. The Minister is empowered under the parent Act to make guidelines under section 9L. The Regulations explicitly rely on those guidelines for the type of motor vehicles provided, permitted uses, authorised drivers and Members’ responsibilities (note to regulation 7). Consequently, the Minister and the relevant administrative branch will be responsible for procurement policy, the rules around personal use, maintenance of fleet, authorised drivers lists, replacement schedules and similar operational decisions.

• The State as funder. Regulation 7(1) grants Members the use of a "fully funded motor vehicle". That description conveys that public funds are the source of payment for the vehicles, including acquisition and likely operating costs, although the Regulations themselves do not detail procurement, accounting or budget lines. The Endnotes’ record of the Statutory Rule’s making and its sunset date implicate the State as principal actor.

• Suppliers and contractors. While procurement details are left for other processes, the existence of a statutory, fully funded vehicle scheme creates predictable demand. Vehicle suppliers, leasing companies and fleet-management contractors are the commercial actors likely to be engaged under whatever procurement framework the department adopts via the Minister’s guidelines.

Indirectly affected groups and processes

• Parliamentary administration and auditors. Compliance with the Regulations will require record keeping of written elections, revocations and notifications to the relevant Clerk. Internal audit, parliamentary accounting and public-sector procurement units will need to map the statutory rules to the operational processes that the guidelines establish.

• Constituents and private travel providers. That State-funded vehicles may be made available for permitted uses set by guidelines could displace some private car usage by Members and potentially alter contractual relationships Members have with private transport providers. The Regulations themselves do not set permitted uses, but they create the legal vehicle for such substitution to occur when the guidelines are implemented.

Who pays and who decides

• The Regulations create a Member entitlement funded from public money, with the Minister and the relevant Clerk as decision-makers for guidelines and administrative receipt of elections and revocations. The Regulations do not allocate budget lines or specify procurement methods; those are within executive and departmental processes guided by the parent Act’s section 9L.

Rights created by the Regulations

• Right to be provided with a fully funded motor vehicle. A Member who elects, or is taken to have elected, under regulation 6 will be provided with the use of a fully funded motor vehicle in accordance with the Ministerial guidelines under section 9L (regulation 7(1)). This is an affirmative entitlement: upon meeting the procedural condition (writing the election and lodging it with the relevant Clerk within the statutory window), the Member receives access to the State-funded vehicle.

• Deemed continuity right for prior electors. Members who had an ongoing election under the revoked 2013 Regulations that was not revoked before 16 September 2019 are taken to have made an election under the new Regulations (regulation 6(3)). A Member who was provided a vehicle for the immediately preceding term of Parliament is similarly deemed to have elected for the subsequent term unless they notify otherwise within one month of being declared elected (regulation 6(5)). These provisions preserve continuity of the right absent an express opt-out.

Duties and procedural obligations

• Duty to make election in writing and to the relevant Clerk. The use-right is contingent on a written election to the relevant Clerk within specified timing windows. The primary windows are: within one month of becoming a Member or within one month of commencement of each subsequent term (regulation 6(1)); or, for other times in the current term, an election may be made except during the last 12 months of the term (regulation 6(2)). The written form and delivery to the relevant Clerk are explicit procedural duties.

• Duty to abide by guidelines. The substantive bounds of the right , permitted uses, authorised drivers, responsibilities , are delegated to Ministerial guidelines under section 9L of the parent Act. Regulation 7(1) links provision to compliance with those guidelines. The Note to regulation 7 identifies types of matters the guidelines may regulate: type of motor vehicles provided, permitted uses, authorised drivers, and responsibilities of the Member. While the Regulations do not themselves list prohibitions or obligations, compliance with the Section 9L guidelines will be a condition of the entitlement.

• Limited revocation rights. A Member may revoke an election in writing to the relevant Clerk, but revocation is conditional: it may be made only if the motor vehicle provided is due to be replaced "in accordance with the guidelines made under section 9L" (regulation 6(4)). That creates a duty on the Member to time revocation to the replacement schedule or otherwise accept continued provision until replacement is due.

Termination mechanics and duties upon termination

• The duty to return or cease use. While the Regulations do not specify the physical steps on termination, regulation 7(2) states that provision ends when the person ceases to be a Member, revokes as permitted, or notifies they will not elect. The Ministerial guidelines are the likely source of any specific duties on return of keys, handover, or disposal; the Regulation’s termination triggers create the legal event that will activate those administrative duties.

• Record-keeping and notification duties on Members. The Regulations require Members to notify the relevant Clerk in specific ways to exercise or abandon rights: written election, written revocation, notification under reg 6(5) to decline an automatic deemed election. Thus Members have a duty to ensure timely, written communication to the relevant Clerk to shape rights and obligations.

Who decides and what the decision points are

• Member decisions. The core choices fall to Members: whether to elect to receive vehicle provision, whether to revoke under the limited revocation rule, and whether to notify not to be deemed to have elected under the transitional/deemed rule.

• Ministerial/administrative decisions. The Minister, via guidelines under section 9L, will decide the operational boundaries of the entitlement: what vehicles, permitted uses, authorised drivers and Members’ responsibilities apply. The relevant Clerk determines receipt and recording of written elections and revocations. The Regulations allocate the procedural portal to these actors but leave substantive rulemaking to the guidelines.

In short, the Regulations set the procedural duties on Members and administrative decision nodes, while substantive operational duties and limits on use are delegated to Ministerial guidelines. The right to a fully funded vehicle is conditional on following the procedural rules and complying with the guidelines.

The Regulations do not specify criminal or civil penalties, pecuniary sanctions, or administrative disciplinary measures. No penalty provision appears in regulations 1 through 7, and the Endnotes do not record any penalty schedules attached to this Statutory Rule. Consequently, the instrument itself delegates enforcement and behavioural control to administrative mechanisms rather than imposing statutory fines or offences.

Administrative enforcement mechanisms implicit in the text

• Administrative conditions and cessation triggers. The Regulations build enforcement into entitlement mechanics. Provision of a fully funded motor vehicle is expressly conditioned upon compliance "in accordance with the guidelines made under section 9L" (regulation 7(1)), and the instrument specifies events that terminate provision (regulation 7(2)). Those termination triggers are an enforcement lever: if a Member ceases to be eligible, the administrative entitlement stops.

• Control via guidelines. The Note to regulation 7 identifies matters the Minister may regulate in the guidelines (type of vehicle, permitted uses, authorised drivers, responsibilities of the Member). Enforcement of those rules is likely to be exercised through administrative controls within the guidelines: restricting authorised drivers, limiting permitted use, requiring return or payment for misuse, or setting conditions precedent to replacement or revocation. The Regulations themselves do not set those enforcement measures but delegate rulemaking that will include enforcement detail.

• Role of the relevant Clerk. The Regulations make the relevant Clerk the formal recipient of elections, revocations and notifications (regulation 6). That person will have a record-keeping and gatekeeping role for determining whether a Member has complied with procedural requirements. Procedural non-compliance may be enforced by refusing to record an election or to give effect to an entitlement if the writing is not lodged correctly, but the Regulations do not describe sanctions beyond that administrative effect.

Absence of express statutory sanctions and consequences

• No statutory offences or pecuniary penalties in the instrument. The Regulations are silent on statutory offences for misuse, unauthorised drivers, or failure to return vehicles. There is no express power in the Regulations to recover costs from a Member for breaches, nor is there express referral to parliamentary privilege or internal disciplinary regimes. Those matters, if intended, would have to be handled in the guidelines under section 9L or under other statutes or parliamentary rules.

• Enforcement risk rests in delegated instruments. Because the instrument relies on the Ministerial guidelines for permitted uses and responsibilities, any practical enforcement , for example, suspension of access, recovery of costs, or administrative discipline , must be supported by the guidelines and underlying administrative policy. The Regulations provide the entitlement and the procedural gates but not the detailed enforcement toolbox.

Consequences for compliance practitioners and auditors

• Auditors and compliance officers must look beyond these Regulations to the section 9L guidelines and any procurement, finance or parliamentary conduct instruments that give effect to enforcement. The Regulations provide no self-contained enforcement regime; they create events and obligations that the Minister and parliamentary administration will need to operationalise and back with procedural and, if intended, sanctioning mechanisms.

• Where disputes or non-compliance arise, the statutory machinery points to administrative resolution via the relevant Clerk and Ministerial processes unless other laws or parliamentary rules provide additional remedies. The Regulations themselves do not create a cause of action or specify dispute-resolution processes.

In summary, enforcement is administrative and delegated: the Regulations set entitlement, timing and termination events and leave the practical enforcement measures to the Minister’s guidelines and parliamentary administration.

Primary statutory parentage and delegation

• Parliamentary Salaries, Allowances and Superannuation Act 1968. The Regulations are made under section 9K of the Parliamentary Salaries, Allowances and Superannuation Act 1968 (regulation 2). They repeatedly refer to guidelines under section 9L of that same Act. Therefore the parent Act is the principal legal instrument that supplies the power to make detailed guidelines, to frame the broader scheme of parliamentary entitlements, and to supply definitions such as "Member". Any interpretation or scope questions about who may be a "Member" will turn to the parent Act.

• Guidelines under section 9L. The Regulations expressly defer substantive content to guidelines made under section 9L: regulation 7(1) ties provision to those guidelines, regulation 6(4) links revocation rights to replacement schedules "in accordance with the guidelines", and the Note to regulation 7 lists categories that the guidelines may regulate (type of vehicle, permitted uses, authorised drivers, responsibilities). The statutory relationship is therefore one in which these Regulations supply core procedural scaffolding and the guidelines supply operational detail.

Interaction with the Subordinate Legislation Act 1994

• Sunset obligation. The Endnotes record that the Statutory Rule will sunset 10 years after the day of making, on 3 September 2029, pursuant to section 5 of the Subordinate Legislation Act 1994. That statutory requirement for review/expiration interacts with long-term administrative planning: the scheme is not open-ended and must be reconsidered or remade before the sunset date if it is to continue.

Interaction with the Interpretation of Legislation Act 1984

• Notes and headings as part of the instrument. The Endnotes include a section titled "INTERPRETATION OF LEGISLATION ACT 1984 (ILA)" and record that examples, diagrams or notes included in a Statutory Rule made on or after 1 January 2001 form part of that Statutory Rule. The practical effect is that the Note to regulation 7, which lists matters the Minister may include in the guidelines, is part of the Statutory Rule as envisaged by the ILA. That affects statutory construction: the Note’s content can be treated as part of the instrument rather than extraneous commentary.

Interaction with procurement, public finance and parliamentary conduct instruments

• Procurement and finance. The Regulations create a demand for "fully funded motor vehicles" but do not themselves interact with procurement law. Procurement method, contract award, leasing versus purchase and budget allocation will therefore be managed under public-sector procurement, finance and accounting frameworks. Those rules will determine how the State acquires and funds the vehicles that the Regulations make available. The Regulations themselves do not set procurement requirements.

• Parliamentary conduct and entitlements. The Regulations set a vehicle entitlement but do not touch on broader parliamentary conduct regimes, conflicts of interest or fringe benefits taxation. If other statutes, internal parliamentary rules or tax laws impose obligations or limits on Members’ use of State-funded assets, they will operate concurrently. Questions about fringe benefits, taxation consequences, or conflict-of-interest compliance cannot be resolved from these Regulations alone and must be examined against the parent Act and relevant external law.

Deference, delegation and administrative law

• Delegation to guidelines creates administrative discretion. The Minister’s guidelines under section 9L will determine the detailed allocation of rights and restrictions. That creates an administrative law relationship where the legality, reasonableness and procedural fairness of guideline-making could be subject to judicial review or internal administrative processes, although the Regulations do not specify review mechanisms.

• Transitional interaction with previous regulations. The Regulations expressly revoke the 2013 Regulations (regulation 4) and create transitional deemed-election treatment for those who had elections under the old instrument (regulation 6(3)). That interaction requires administrative mapping between archived records under the 2013 Rules and new records under these Regulations.

Overall, the Regulations provide a procedural and enabling overlay that relies on the parent Act, the Minister’s guidelines under section 9L, and other public administration frameworks to effect a vehicle-provision scheme. The precise legal effects beyond timing and modality therefore depend on the content of guidelines and the operation of procurement and parliamentary rules.

Textual and empirical snapshot in the instrument

• Enactment and commencement. The Statutory Rule was made on 3 September 2019 by the Administrator of the State of Victoria on advice of Executive Council under section 9K of the Parliamentary Salaries, Allowances and Superannuation Act 1968 and came into operation on 16 September 2019 (Endnotes, General information; regulation 3).

• Revocation of earlier instrument. The Regulations expressly revoke the Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013 (regulation 4). The explanatory details in the Endnotes record that the 2013 instrument is S.R. No. 84/2013 (Explanatory details 1. Reg. 4: S.R. No. 84/2013).

• Version status. The publication is labelled Version No. 001 and as at 16 September 2019. The marginalia records in Table of Amendments that there are no amendments made to these Regulations by subsequent statutory rules, subordinate instruments or Acts (Endnotes: Table of Amendments). The document also records that there are no amendments Not in Operation at the date of publication (Endnotes: Amendments Not in Operation).

Sunset clause effect and time-limited operation

• Statutory sunset. The Endnotes indicate the Statutory Rule will sunset 10 years after the day of making on 3 September 2029 pursuant to section 5 of the Subordinate Legislation Act 1994. That is an automatic expiry mechanism that will require either remaking, explicit extension or replacement if vehicle provision is to continue after that date.

Transitional and deemed-election provisions

• Carry-over from 2013 Regulations. The Regulations include transitional machinery: a Member who had made an election under the 2013 Regulations and had not revoked it before 16 September 2019 is taken to have made an election under the new Regulations (regulation 6(3)). Regulation 6(5) similarly deems a Member who was provided with a vehicle for the immediately preceding term to have elected for the new term unless they notify within one month of being declared elected that they will not elect. These provisions address continuity when instruments change.

No recorded subsequent amendments

• Clean amendment slate as at publication. The Endnotes’ Table of Amendments records no amendments to the 2019 Regulations. That means the text reproduced here is the original and, as of the version date, unchanged since enactment.

Implications for practitioners tracking change

• Key dates to monitor. The critical temporal points arising from the amendment history are the making date (3 September 2019), the commencement date (16 September 2019) and the sunset date (3 September 2029). Practitioners should track whether any guidelines under section 9L have been produced since the Regulations were made, and whether any subsequent Statutory Rules or Acts amend or replace the Regulations ahead of the sunset date.

• Transitional record checks. Because the Regulations preserve elections made under the 2013 instrument (regulation 6(3)), administrative records from the earlier regime remain relevant for determining present entitlements. Practitioners should therefore check archived elections under the 2013 Regulations when advising Members about current status.

In sum, these Regulations were introduced as a discrete instrument in 2019, revoked the earlier 2013 Rules, and have a built-in sunset in 2029; as of the version date, there have been no amendments to the instrument itself.

Documentary record in the Statutory Rule

• The Regulations and the Endnotes contain no record of litigation, case references, or judicial consideration of these Regulations. The instrument’s Endnotes list general information, the table of amendments (which is empty), and explanatory details; none include court decisions or references to judicial interpretation. The text does not name any cases.

Consequences of an absence of litigation history

• Lack of judicial interpretation. Because no cases are mentioned in the instrument and no litigation history is recorded, there is, within this document, no reported judicial guidance on interpreting the timing windows, the scope of the "fully funded motor vehicle" phrase, the limits of the revocation right in regulation 6(4), or the interplay between the Regulations and the section 9L guidelines. That absence means any ambiguities in wording will rely on primary statutory interpretation principles and potentially the content of the parent Act and guidelines until challenged in court.

• Administrative uncertainty remains untested. Where the Regulations depend heavily on delegated guidelines for operational detail, the lack of litigation suggests that the enforcement, replacement scheduling, and finer points of permitted use and authorised drivers have not been judicially tested. That increases the importance of careful administrative drafting and transparent guideline-making to minimise disputes.

Practical implication for risk assessment

• Administrative remedies and internal review. In the absence of litigation precedent, parties will typically seek administrative remedies first. The relevant Clerk and the Minister’s office are the administrative decision-makers identified in the Regulations. Any dispute about procedural compliance (for example, whether a written election was properly made or recorded) or entitlement status will be resolved initially within parliamentary administrative processes, and judicial review would be a later step if administrative remedies are exhausted.

• Monitoring for emerging case law. Practitioners should monitor for any judicial decisions that interpret the parent Act’s sections 9K and 9L, or that engage with disputes about the guidelines, revocation timing, or the meaning of "fully funded motor vehicle". Until such case law emerges, interpretation will turn to the ordinary tools of statutory construction, the parent Act, and the content of implemented guidelines.

In short, the Regulations record no litigation history; operational uncertainties that could give rise to legal challenges remain untested by courts and will likely be resolved first through administrative channels and subsequently by litigation only if contested.

Timing traps and the 12-month blackout

• Election windows are strict and asymmetric. A Member must elect in writing to the relevant Clerk within one month of becoming a Member or within one month of the commencement of each subsequent term of Parliament (regulation 6(1)). Regulation 6(2) permits elections during the current term but explicitly excludes the period of 12 months immediately before the end of that term. That creates a blackout period: a Member who has not already elected and who waits too long during a term will be barred from electing during the final 12 months, meaning a lost opportunity until the next term commences. Practitioners advising Members must calendar these deadlines carefully.

Deemed elections and unintended continuity

• Automatic carry-forward can surprise Members. Regulation 6(3) deems elections under the 2013 Regulations that were not revoked before 16 September 2019 to be elections under the new Regulations, and regulation 6(5) deems Members who were provided a vehicle in the previous term to have elected for the new term unless they notify the relevant Clerk within one month of being declared elected that they will not elect. Those deemed-election rules can lead to Members remaining in the scheme by default unless they take timely written steps to opt out. Failure to notify within one month after being declared elected will leave the Member with an automatic entitlement they may later regret.

Revocation is conditional, not free

• Limited revocation rights linked to replacement cycles. Although a Member may "revoke in writing" under regulation 6(4), that revocation is only permitted if the vehicle provided to the Member is due to be replaced "in accordance with the guidelines made under section 9L" (regulation 6(4)). In effect, a Member cannot unilaterally terminate their entitlement at any time; they must align revocation with the replacement schedule determined by the guidelines. Members intending to exit the scheme must understand the guidelines’ replacement timetables.

Delegation of substantive limits to guidelines

• Key operational controls are not in the Regulations. The Regulations say little about permitted personal use, scorch-proof restrictions, authorised drivers, or sanctions for misuse. The Note to regulation 7 and regulation 7(1) indicate that those matters are for guidelines under section 9L. The substantive conditions and any penalties are therefore invisible in this text and will depend on rule-making by the Minister. Practitioners must not rely on the Regulations alone to understand permitted uses; they must obtain and review the section 9L guidelines.

"Fully funded" does not equal unlimited use

• Funding language can mislead. Regulation 7(1) promises a "fully funded motor vehicle". That phrase signals that the State funds the vehicle, but it does not specify what costs the funding covers (purchase, lease, insurance, fuel, maintenance, private use taxation consequences). Absent guideline detail, Members might assume broader coverage than actually provided. The funding term should be interpreted in light of the implementing guidelines and public finance policy.

Record-proofing obligations placed on Members

• Written notice and record-keeping are outcome-determinative. The Regulations require elections, revocations and notifications to be in writing and sent to the relevant Clerk (regulation 6(1), (4), (5)). Informal understandings or oral notices will not satisfy the statutory requirement. Practitioners advising Members should emphasise proof of service, date stamping and retention of written notices to avoid disputes about whether timely elections or opt-outs were made.

Interaction with other regimes is not explicit

• Taxation, procurement and conduct consequences lie elsewhere. The Regulations do not address potential fringe benefits tax, procurement compliance, or parliamentary conduct rules. A Member using a State-funded vehicle may face tax or conduct obligations under other regimes not mentioned here. Failure to check those external regimes is a common trap.

Sunset window and long-term planning

• Ten-year expiry could disrupt long-term arrangements. The Endnotes state that the Statutory Rule will sunset on 3 September 2029 pursuant to the Subordinate Legislation Act 1994. Any multi-year procurement contracts, replacement schedules or fleet leases should account for the sunset date and whether the instrument or its implementing guidelines will be renewed or replaced. Procurement commitments that outlast the statutory regime may create legal and financial friction if not anticipated.

Practical "gotchas" checklist

• Beware the one-month windows: initial election and opt-out are time-limited.
• Do not assume revocation is immediate: it depends on replacement under guidelines.
• Confirm what "fully funded" includes by inspecting the section 9L guidelines and departmental policies.
• Keep written, dated records delivered to the relevant Clerk; oral communications will not meet the statutory requirement.
• Check whether any other statutory or tax regime affects use or reporting; the Regulations are silent on that.
• Account for the statutory sunset when planning replacement schedules or entering into long-term procurement contracts.

These practical pitfalls arise directly from the Regulations’ structure: tight procedural timeframes, conditional revocation, and substantive delegation to guidelines.

Practical steps for Members and their advisers

1. Identify status and timelines. Determine the Member’s relevant dates: date of becoming a Member, date declared elected for the term, and the commencement date of each subsequent term of Parliament. These dates determine the one-month windows for making an election under regulation 6(1) and the one-month window for opting out of a deemed election under regulation 6(5).

2. Prepare written election documents. Elections, revocations and notifications must be in writing and addressed to the "relevant Clerk" (regulation 6(1), (4), (5)). Draft concise written forms that clearly state the Member’s intention to elect, revoke, or decline to elect, include the Member’s name, elector details, and date, and sign them. Maintain copies and obtain date-stamped acknowledgment from the relevant Clerk.

3. Avoid the 12-month blackout. If not electing within the one-month windows, Members seeking to elect during a term must do so before the final 12 months of that term (regulation 6(2)). Where the term’s end date is uncertain or early election is possible, plan early to avoid losing the right to elect in the current term.

4. Review prior election status. For Members who had elections under the 2013 Regulations, verify whether an election was carried forward under regulation 6(3). If a Member does not wish to be taken to have elected under the new instrument, they must revoke or opt out according to the timing rules, particularly the one-month notice after being declared elected (regulation 6(5)).

5. Obtain and review the section 9L guidelines. The substantive conditions, permitted uses, authorised drivers, replacement schedules and Member responsibilities are to be set out in guidelines under section 9L of the parent Act (regulation 7(1) and the Note to regulation 7). Compliance requires obtaining the current guidelines and understanding: what vehicles are offered, whether private use is permitted, who may drive the vehicle, replacement cycles (which affect revocation rights under regulation 6(4)), documentation or inspection requirements, and any reporting obligations.

6. Align revocation plans with replacement schedules. If considering revocation, confirm when the Member’s current vehicle is due for replacement under the guidelines. Revocation under regulation 6(4) can only occur at replacement points set in the guidelines. Plan financial and operational arrangements accordingly.

7. Maintain accurate records with the relevant Clerk. Given that the written election/revocation/notification determines entitlement, ensure that all correspondence is date-stamped and that the parliamentary administration’s receipt is confirmed in writing. Keep copies for audit and compliance purposes.

8. Coordinate with parliamentary finance and procurement units. Because regulation 7(1) provides for a "fully funded motor vehicle", liaise with parliamentary finance officers to confirm what funding the scheme covers and whether additional approvals or declarations are required to reconcile the Member’s personal commitments with parliamentary budgeting.

9. Check for external legal and tax implications. The Regulations do not address taxation or other statutory consequences of receiving a State-funded vehicle. Members should consult their tax advisers and check relevant statutes or parliamentary conduct rules that may impose disclosure, fringe benefits tax obligations, or limits on personal use.

10. Plan for the instrument’s sunset. The Endnotes note the sunset date of 3 September 2029. For Members and administrative planners involved in multi-year arrangements (for example, leasing arrangements that extend beyond the sunset), ensure that contracts and budgets account for the possibility of the scheme being amended or discontinued, and seek clarity from the Minister’s office on continuity plans.

Operational controls for administrators and Ministers

• Publish and publicise the guidelines. Because the Regulations rely on section 9L guidelines for substantive regulation, the Minister should ensure guidelines are published, readily accessible, and provide clear notice about replacement cycles, permitted uses, authorised drivers, and revocation procedures.

• Implement robust record systems. The relevant Clerk’s office should establish a reliable process for recording written elections, revocations and notifications with date stamps and confirmations back to Members, facilitating audit and dispute resolution.

• Coordinate procurement timelines with revocation and replacement rules. Fleet-acquisition schedules should be synchronised with revocation mechanics so Members understand when they may lawfully revoke, and procurement commitments do not lock the administration into unintended long-term subsidies.

• Define enforcement measures in the guidelines. Since the Regulations do not prescribe sanctions, the guidelines should include clear administrative remedies for misuse, such as deauthorising drivers, requiring restitution for private use contrary to policy, or other proportionate measures. These should be consistent with broader parliamentary conduct and administrative law considerations.

Checklist for compliance reviews and audits

• Confirm existence and content of section 9L guidelines.
• Verify that Members’ elections are in writing and recorded by the relevant Clerk.
• Ensure revocations align with replacement schedules in the guidelines.
• Check how "fully funded" is interpreted for accounting and tax purposes.
• Audit the authorised drivers’ lists and permitted-use records against actual vehicle logs where applicable.
• Plan for sunset and contractual exposures arising from procurement commitments.

By following these steps and linking procedural compliance under the Regulations to the content of the section 9L guidelines and broader administrative processes, Members and administrators can operationalise the entitlement while managing timing, financial and legal risks identified in the instrument.
