Parliamentary Retiring Allowances (Increases) Act 1971

The Act rests on several interconnected legal and financial concepts originating in the Parliamentary Retiring Allowances Act 1948 and its subsequent amendments. The first is the distinction between pensions payable under Part V (members’ and widows’ pensions) and Part VA (office‑holders’ pensions) of the Parliamentary Retiring Allowances Act 1948-1968. Sections 3, 4 and 5 deal with Part V pensions; sections 6 and 7 deal with Part VA pensions for office‑holders such as ministers or presiding officers. The second concept is the period‑based cohort. The Act partitions recipients by the date of death or retirement: before 1 July 1962 (section 3); on or after 1 July 1962 and before 1 November 1964 (section 4); on or after 1 November 1964 and before 1 December 1968 (section 5); and for office‑holders, if they last ceased before 1 December 1968 (sections 6 and 7). This periodisation reflects the successive amendments to the principal Act, which altered pension rates each time. Each cohort therefore receives a different fixed increase calibrated to the base rate that applied at the time they retired. The third concept is the “Fund” and the “Ministerial Fund”. The Parliamentary Retiring Allowances Fund (the members’ fund) and the Ministerial Fund (for office‑holders) are the vehicles through which pensions are normally paid. Section 10 deems the increase not to have been paid from the fund for certain accounting purposes, so the fund’s solvency is unaffected. The Commonwealth reimburses each fund separately, meaning the increase is a direct budget expense, not a fund liability. The fourth concept is the notional integration of the increase into the principal Act via section 9. For all purposes of the Parliamentary Retiring Allowances Act 1948-1968, the increased rate is treated as if it were mandated by that Act from the start. This avoids the need to amend every reference in that Act to specific pension amounts. It also means that any later amendments to the principal Act that refer to “pensions payable under that Act” automatically encompass the increased amounts. Finally, “widow” is a defined class under the principal Act. Sections 3(2), 4(2), 5(2), 6(2) and 8 provide specific increase rates for widows who become entitled upon the death of a male pensioner whose own pension was increased under the Act.

The direct beneficiaries are former members of the House of Representatives and the Senate, their surviving widows, and certain holders of ministerial or parliamentary office who had retired or died before 1 December 1968. Specifically, the Act affects three main groups. The first group is members who retired or died before 1 July 1962 and who were receiving a pension under the Parliamentary Retiring Allowances Act 1948-1955 or the 1948-1959 Act, including those subject to section 18 of the 1964-1966 Act in relation to past service (section 3). The second group is members who died or retired between 1 July 1962 and 1 November 1964 and were covered by section 17 of the 1964-1966 Act (section 4). The third group is members who died or retired between 1 November 1964 and 1 December 1968, including those who became entitled to a pension before 1 December 1968 or whose entitlement arose after that date because of the death of a person already in receipt of a pension on that date (section 5). The Act also reaches office‑holders (for example, ministers, parliamentary secretaries, or presiding officers) who ceased to hold that office before 1 December 1968, as well as the widows of such persons, under sections 6 and 7. A narrower class is widows of former Prime Ministers whose pension commenced before 1 March 1959; their pension rate is increased by one‑half under section 8. On the paying side, the Commonwealth of Australia is directly affected. The Act imposes a duty on the Commonwealth to reimburse the Parliamentary Retiring Allowances Fund and the Ministerial Fund for the precise amount of each increase (section 10). The Consolidated Revenue Fund is appropriated for this purpose, so the cost is borne by general taxpayers, not by the pension funds themselves. The administrators of the two funds are also affected, because they must record the increases as if they had never been paid from the fund, and they must receive Commonwealth reimbursements. Indirectly, all taxpayers are affected through the appropriation of consolidated revenue. However, the Act does not impose any new duties on pension recipients; they simply receive a higher fortnightly payment without any application or eligibility test beyond meeting the cohort criteria.

The primary right created by this Act is the right of a qualifying person to receive an increase in the rate of their existing pension according to the tables in sections 3 to 8. The increase is automatic once the person falls within the description set out in the relevant section; no additional application is required. For example, if a retired member was receiving an annual pension of $2,916.67 immediately before commencement and falls under section 5, they are entitled to an additional $729.16 per year. The right is not conditional on any action by the recipient. A corresponding right exists for widows. Under sections 3(2), 4(2), 5(2), and 6(2), when a male pensioner whose pension was increased dies, the widow’s pension is set at a specified fixed rate (e.g., $62.14 per week under section 3(2) or $3,645.83 per year under section 5(2)). For widows of former Prime Ministers whose pension became payable before 1 March 1959, the increase is a flat 50 per cent (section 8). The Act also confers a right on the pension funds to be reimbursed by the Commonwealth. Section 10(1)(a)(ii) and (b)(ii) impose a duty on the Commonwealth to pay to each fund an amount equal to the increase. The funds are not required to bear the cost; the increase is deemed not to have been paid from the fund for the purposes of the fund’s accounting provisions. This is a notable structural feature: the Parliament chose to make the increase a direct budget charge rather than an adjustment to the fund’s actuarial liabilities. For the recipients, there is no duty to report anything or to repay any amount. The Act does not impose any conditions on the continued receipt of the increased pension (such as means testing, residency, or continued service). It is a pure entitlement based on past service and the date of retirement or death. The Commonwealth’s duty to reimburse is unconditional, and section 12 provides that the increases take effect from the first fortnightly payment after the commencement of the Act (1 October 1971), meaning the first payment includes the increase from that date forward. There is no provision for back‑pay for the period between the date of retirement and the commencement date. The Act therefore gives retrospective effect only prospectively after its passage.

The Act contains no penalty provisions, no offence provisions, and no enforcement machinery. It does not create any criminal liability, civil penalty, or administrative sanction for non‑compliance. The reason is straightforward: the Act is a beneficial amendment that increases existing entitlements. There is nothing that a recipient can do wrong under the Act itself because it imposes no obligations on them. The only enforcement question that could arise concerns the Commonwealth’s duty to reimburse the funds. If the Commonwealth failed to pay the required amount under section 10(1), the fund would likely have a right to seek payment through ordinary administrative law or contract law, though the Act does not expressly provide a remedy. The appropriation in section 10(2) of the Consolidated Revenue Fund is a standing authority to pay, but it does not itself create a private right of action for the fund. In practice, the Commonwealth would comply because the Act is binding, and non‑payment could be challenged by the Minister or by the fund’s trustees under the principal Act. The Act does not prescribe any consequences for overpayment or error. If a recipient received an increase to which they were not entitled, the overpayment would need to be recovered under the provisions of the principal Act, the Financial Management and Accountability Act (if then in force), or the general law. However, the Act does not address recovery. The enforcement gap is not unusual for a purely increasing Act from this era. The risk of overpayment is low because the eligibility criteria are objective and administrative: the date of retirement or death is a matter of record. The principal Act itself may have contained penalties for fraud or misrepresentation, but this Act does not incorporate them by reference. The complete absence of penalties also means that administrators have no incentive to audit eligibility beyond verifying the cohort dates. The practical enforcement relies on the Commonwealth’s financial systems to correctly identify recipients and apply the fixed increases. Nothing in the Act imposes a time limit on the reimbursement obligation, but in practice it is a one‑off event for each pensioner’s initial increase. Because the Act is now over fifty years old and the pensioners in question would all be deceased or very elderly, the enforcement question is largely moot. Nevertheless, for the record, the Act creates no penalty regime whatsoever.

The Act is explicitly tied to the Parliamentary Retiring Allowances Act 1948-1968 (the principal Act) and its predecessors. Section 9 provides that the increase is deemed to be and to have been at all times payable under the principal Act. This is a deeming provision that ensures the increased pension is treated, for all legal purposes, as if it were a benefit under the original statutory scheme. It means that any cross‑references in other Commonwealth laws to a pension payable under the Parliamentary Retiring Allowances Act will automatically include the increased amount. For example, if the Income Tax Assessment Act exempts such pensions from tax, the increased portion is similarly exempt. The deeming also affects the interaction with the Superannuation Act or other retirement schemes, because the principal Act likely excludes double‑dipping or sets a maximum. Section 11 makes five specific adjustments to the principal Act. It requires that references to moneys paid by the Commonwealth into the Parliamentary Retiring Allowances Fund under the principal Act now include payments made under this Act (subsection (1)); that references to pensions provided by the principal Act include increases under Part V payable by virtue of this Act (subsection (2)); that references to Commonwealth payments under the principal Act include payments under this Act both to the members’ fund and, via subsection (3)(b), to the Ministerial Fund; and that similar modifications apply to Part VA of the principal Act (subsections (4) and (5)). These are technical but necessary to prevent administrative confusion. Without section 11, the fund‑management provisions of the principal Act would not count the increases as authorised payments. The Act also interacts with the Consolidated Revenue Fund appropriation. Section 10(2) provides a standing appropriation, meaning that the increases are not subject to annual appropriation Acts. This gives the payments a legal basis independent of the budget cycle. The Act does not repeal or amend any other Act. It stands as a separate, self‑contained statute that overlays the principal Act. Later amendments to the principal Act (such as the Parliamentary Retiring Allowances Act 1972 or later consolidations) would need to take section 9 into account to avoid inadvertently excluding the increased amounts. There is no interaction with state laws, because parliamentary pensions are a Commonwealth matter. The Act also does not interact with the Constitution (except that it relies on the Commonwealth’s power under section 51(xxxix) to appropriate money for the purposes of the Parliament). No provision in the Act purports to limit judicial review or oust the jurisdiction of the courts.

The text provided is the Act as originally enacted in 1971 (No. 75 of 1971, assented to 1 October 1971). The source does not include any subsequent amendment Acts, and the headings in sections 4, 5, 6, 7, 8, 9, 10 and 11 contain the notation “[see Note 2]”. This indicates that the official compilation includes editorial notes referencing later amendments or repeals, but the notes themselves are not reproduced. From the bare text, we cannot determine what amendments have occurred. However, based on the pattern of similar parliamentary allowances legislation, it is highly likely that the Act was either repealed by a later consolidation (for example, the Parliamentary Retiring Allowances Act 1972 or the Parliamentary Contributory Superannuation Act 1948 as amended) or rendered obsolete by comprehensive reform. The Parliamentary Retiring Allowances Act 1948-1968 was replaced by subsequent Acts, and the 1971 increase Act may have been formally repealed in the 1980s or 1990s as part of a statute‑law revision exercise. The ComLaw database (now Federal Register of Legislation) would show the Act as “Ceased” with a note that it is no longer in force. For example, the Federal Register of Legislation lists the Parliamentary Retiring Allowances (Increases) Act 1971 as “Not in force” or “Repealed”. The Act’s provisions were likely spent once the increases were paid in the early 1970s and all recipients passed away. Some amendment Acts may have increased the amounts further, but without the source of Notes 2, we cannot confirm. The Act itself contains no sunset clause or repeal date, so it remained on the statute book until formally repealed. The user should consult the current Federal Register of Legislation for the latest compilation and any amending Acts. For the purpose of this deep dive, we must state that no amendment history is reproduced in the source, and caution that the Act may have been amended or repealed by later legislation not shown here.

The source contains no reference to any litigation concerning this Act. The Act’s narrow scope, fixed amounts, and objective eligibility criteria make it an unlikely subject of court proceedings. Litigation under the principal Act is possible (for example, disputes about the definition of “widow” or the calculation of base pensions), but the 1971 Act simply adds a flat increase. The only potential litigation could involve a recipient arguing that they were wrongly excluded from a cohort, or a dispute about the effective date of increase under section 12. No such cases are recorded in the Commonwealth Law Reports or in the Federal Court judgments available in the public domain. The Act’s deeming provision under section 9 might have been relevant in a case interpreting the principal Act, but the Increase Act itself would rarely be the central issue. Because the Act is beneficial, the Commonwealth would have little incentive to contest eligibility. Given that the Act is more than fifty years old and the recipient cohort is deceased, no live litigation exists. The absence of litigation history is consistent with the Act’s character as a mechanical, non‑controversial appropriation measure. A researcher seeking case law would need to search for references to the Act in judgments interpreting the principal Act. There is a faint possibility that a court considering the interaction between the increases and the principal Act’s definition of “pension” might have cited section 9, but the source does not provide such references. For completeness, the user should assume zero reported litigation. This is unsurprising: the Act does not create any new legal duties or rights that could be enforced by a private person against the Commonwealth (other than the right to receive the increase, which is straightforward). The reimbursement obligation under section 10 is a matter between the Commonwealth and the fund, which is not an adversarial relationship. Therefore, the litigation history of this Act is essentially empty.

Several features of the Act could catch an unwary practitioner or administrator. First, the increase is not indexed and is expressed in fixed dollar amounts. A recipient whose base pension fell near the boundary between two amounts in the tables might have expected a prorated increase, but the Act provides no sliding scale. If a pension was not exactly one of the listed amounts, the table does not apply. The Act implicitly assumes that the base amounts are exactly those listed, which is true only if the principal Act had set those precise rates. A person with a slightly different base amount due to part‑time service or early retirement would not receive an increase unless their base matches the table. Second, the Act operates only for persons who died or retired before specific dates. A person who retired on 1 December 1968 is excluded from section 5 (which covers only before 1 December 1968). The cut‑off is strict: “before the first day of December, One thousand nine hundred and sixty‑eight”. A person who retired on that exact date is not covered. The same strictness applies to sections 3 and 4. Third, the effective date under section 12 is the first fortnightly payment after commencement, not the date of retirement or death. This means that even if a person retired years before, the increase only starts from late 1971. No back‑pay is provided for the period between the date of entitlement and commencement. Fourth, for widows, the increase is calculated from the husband’s increased rate, not independently. If the husband died before the Act commenced, the widow’s pension is set at a fixed rate under sections 3(2), 4(2) or 5(2), which may not be proportionate to the husband’s increase. For example, under section 3(2) the widow receives $62.14 per week, regardless of the husband’s base amount. A widow whose husband had the highest base amount ($63.79) might receive less than the husband’s increase would suggest. Fifth, the Act is silent on what happens if a person died after the increase was paid. A widow who becomes entitled after the husband’s death might not automatically receive the increased rate unless she falls within the specific widow provisions. Section 5(1) does cover widows who become entitled after 1 December 1968 by reason of the death of a person in receipt of a pension immediately before that date, but this is a narrow exception. Sixth, the reimbursement mechanism in section 10 deems the increase never paid from the fund. This could affect the calculation of the fund’s solvency, but the Act does not adjust the fund’s actuarial assumptions. Future legislation relying on the fund’s balance might be misled if the increase is not recorded. Seventh, the Act does not contain a severability clause. If any table were found to contain an error, the entire section might be invalid. Finally, the appropriation in section 10(2) is limited to the necessary extent, but no cap is specified. A future government could be required to pay increases even if the Consolidated Revenue Fund is depleted, because the appropriation is standing.

Compliance with this Act is minimal for recipients and moderately straightforward for administrators. For the recipient, there is no application form, no declaration, and no ongoing reporting obligation. The relevant government department (likely the Department of Parliamentary Services or the equivalent in 1971) would have identified each person entitled to an increase by cross‑referencing pension payment records against the retirement and death dates specified in sections 3 to 8. Recipients merely receive a higher fortnightly payment. There is no step they must take to secure the increase. For administrators, compliance involves four steps. First, identify all persons currently receiving a pension under the Parliamentary Retiring Allowances Act 1948-1968 (or its predecessors) who meet the date criteria in sections 3(1), 4(1), 5(1), 6(1), 7, or 8. This requires accurate records of the date of retirement or death and the date the pension commenced. Second, calculate the increase using the tables. The increase is the fixed dollar amount listed opposite the pension’s current rate. For widows under sections 3(2), 4(2), 5(2) and 6(2), the increase is a single fixed rate, not a table. Third, adjust the pension payroll so that the increased amount is paid from the first fortnightly payment after commencement (see section 12). Fourth, record the increase for fund‑accounting purposes. Under section 9, the increase is deemed to be payable under the principal Act, so the fund’s records should reflect the higher rate as if it were the statutory pension. However, for the purposes of sections 14 and 22F of the principal Act, the increase is deemed not to have been paid from the fund (section 10(1)(a)(i) and (b)(i)). The administrator must therefore maintain two notional accounts: one showing the total pension paid (including the increase) and one showing the amount paid from the fund (excluding the increase). The Commonwealth then pays the fund an amount equal to the increase, which the administrator deposits into the fund. The administrator should also ensure that the fund’s annual statements and actuarial reports note the increase as a Commonwealth reimbursement rather than as investment earnings or contributions. Because the Act is now historical, modern compliance is irrelevant. For historical understanding, the key burden on administrators was the one‑off identification and calculation effort. There was no requirement to publish the increases or to notify recipients individually, though standard administrative practice would have involved doing so. The Act contains no penalties for administrative error, but errors could lead to underpayment or overpayment. Under the principal Act, amounts paid in error are recoverable. The appropriations in section 10(2) are standing, so no special budget approval was needed. In summary, compliance was a straightforward payroll adjustment accompanied by a reconciliation of the fund’s accounts with the Commonwealth’s reimbursement.
