Parliamentary Papers Act 1891

The Act embodies several repeatable legal concepts that determine who has effective immunity, how courts must respond, and what evidence is required.

Authority and publication: Central is the distinction between publications made “by order, or under the authority of the said Council or Assembly, or a Committee thereof” and other publications (s 1). The protection in s 1 is available only where publication can be shown to have occurred under that formal authority, evidenced by the specified certificate and affidavit. Section 2 covers publications of copies of authenticated reports, focusing on the presentation of the original report and a verified copy to the court.

Judicial stay and finality: The Act requires immediate judicial action. On presentation of the specified proofs the court “shall thereupon immediately stay such civil proceeding” and further the proceedings and every writ or process “shall be and shall be deemed and taken to be finally put an end to, determined, and superseded by virtue of this Act” (s 1). The statute thus replaces further judicial consideration of the substantive claim with statutory finality; it does not provide a discretion to the court to remand or continue the case once the statutory prerequisites are met.

Evidentiary simplification: Section 4 is an evidentiary shortcut: copies purporting to be printed by the Government Printer or by the authority of a House or committee are admissible in all cases without proof of their being such copies or of the printing authority. That removes the need for separate proof of the printing source in litigation involving parliamentary papers.

Qualified defamation protection: Section 3 addresses extracts and abstracts and permits evidence that the extract was bona fide and without malice, with a jury able to return a verdict of not guilty if they so find. Section 3A provides a statutory exception to civil liability as for defamation where a specified person publishes, on the written request of a member of either House, a written copy or extract of a parliamentary speech; it expressly includes material in Hansard that was not attributed to the member (s 3A(1)-(2)). The categories protected under s 3A are confined to persons employed as members of the Parliamentary Reporting Staff, employees of Parliament, the Government Printer and persons employed in the Government Printing Office (s 3A(3)).

Formality requirements: The procedural mechanisms require particular document types and formal acts: s 1 requires a certificate under the hand of President, Speaker or Clerk plus an affidavit verifying the certificate and a 24-hour notice to the plaintiff/prosecutor; s 2 requires the defendant to lay before the court the report and copy and an affidavit verifying them; s 3A requires a written request from a member before publication in the specified circumstances. Those formalities are prerequisites to the statutory protections.

Scope limitations: The Act’s protections apply to civil proceedings and civil liability. Section 3A speaks expressly of not incurring “any civil liability as for defamation”. The text does not create criminal immunities or address criminal prosecutions, nor does it create a general statutory indemnity for all publications; it is bounded by the statutory descriptions (reports, papers, votes and proceedings of the Legislative Council or Assembly, or copies, extracts and authorised publications).

Procedural interplay with jury verdicts: Section 3 contemplates jury findings where an extract or abstract is at issue; if the jury consider the publication bona fide and without malice a verdict of “not guilty” is to be entered. The Act therefore contemplates both judge-led stays under ss 1-2 and jury determinations under s 3.

The Act partitions affected parties into identifiable groups by legal role and potential exposure to civil proceedings.

Defendants in civil proceedings for publication: Any person sued in a civil proceeding “for or on account or in respect of the publication” of parliamentary reports, papers, votes or proceedings, or their servants (employees), are covered by ss 1 and 2 if the publication was by order or under the authority of the relevant House or committee, or if the dispute concerns publication of a copy of an authenticated report (s 1-2). Practically that includes printers and staff employed by Parliamentary authority or acting under its direction.

Plaintiffs/prosecutors in civil proceedings: Persons who commence civil proceedings (including defamation or other publication-based claims) against publishers of parliamentary papers are directly affected because ss 1-2 empower the defendant to obtain a court-ordered stay and to have the proceeding finally ended on presentation of statutorily prescribed evidence. The Act requires the defendant to give 24 hours’ notice of intention to present the certificate to the plaintiff or prosecutor (s 1), creating a short procedural interaction between parties.

Parliamentary officers who can certify authority: The President, the Speaker, and the Clerk of either House have defined roles in producing certificates that trigger the stay in s 1. Their signatures and the accompanying verifying affidavits are statutory triggers for the protective mechanism.

Persons covered by s 3A: The statutory defamation protection in s 3A applies only to defined categories: members of the Parliamentary Reporting Staff, employees of Parliament, the Government Printer, and persons employed in the Government Printing Office (s 3A(3)). These are the narrow class of people who, on a member’s written request, may publish a member’s speech or extract thereof without incurring civil defamation liability under the terms of this section.

Members of either House of Parliament: Members who make speeches are relevant because s 3A protects republication, on the member’s written request, of material from that member’s speech. The section also takes in material recorded in Parliamentary Debates (Hansard) that is not attributed to the speaker (s 3A(2)), making members de facto gatekeepers of written requests that activate protection.

Courts and judges: The Act prescribes judicial action when the specified documentary proof is presented: courts and judges “shall thereupon immediately stay such civil proceeding” (s 1; s 2) and must receive copies described in s 4 “in evidence in all cases whatever.” The judiciary is therefore the enforcing organ of the statutory protections and evidentiary simplifications.

Government Printer / State Law Publisher and Government Printing Office employees: The Government Printer (now referenced in the notes as the State Law Publisher) is identified in s 3A(3)(c) and (d) and in s 4; copies purporting to be printed by the Government Printer are treated as self-authenticating for evidentiary purposes. That places the Government Printer and its products in a privileged evidentiary position.

Third-party publishers and private entities: Not all publishers are covered. If a private publisher republishes parliamentary material but not “by order, or under the authority” of a House, or is not in the specified employment categories of s 3A, the Act’s protective mechanisms will not automatically apply. Plaintiffs may still bring civil actions against such publishers unaffected by the statutory stay provisions unless the formal prerequisites are satisfied.

Overall, the Act creates asymmetric effects: certain categories of persons and published copies obtain immediate procedural protections and evidentiary convenience, while plaintiffs and private republishers are constrained by the formal limits of the Act.

The Act establishes a compact of mandatory duties, rights to protection and evidentiary rules that parties and courts must follow.

Defendant rights to statutory stay and final termination: A defendant sued for publication of parliamentary material has the statutory right to present a certificate from the President or Speaker or Clerk together with an affidavit verifying the certificate and, after giving 24 hours’ notice to the plaintiff/prosecutor, to have the court immediately stay the civil proceeding and declare the proceedings finally ended (s 1). Alternatively, where the claim is about publication of a copy of a report, the defendant may lay the report, the copy and an affidavit verifying them before the court, with the same immediate stay and final termination result (s 2). These are substantive procedural rights enforceable in court.

Duties to provide specific documentary forms and notice: The defendant has the duty of giving 24 hours’ notice to the plaintiff or prosecutor before presenting the certificate in court (s 1). The Act also prescribes the form of evidence required: a certificate “under the hand of the President or Speaker ... or of the Clerk” together with an affidavit verifying the certificate must be produced (s 1). For s 2, the defendant must produce the report and the copy together with an affidavit verifying them.

Court duties: Upon presentation of the required material, the court or judge “shall thereupon immediately stay such civil proceeding” and deem the writs and process “finally put an end to, determined, and superseded by virtue of this Act” (s 1; s 2). The wording mandates action by the court; it is not couched as discretionary. Section 4 imposes an evidentiary duty on courts to receive specified parliamentary copies “in evidence in all cases whatever without proof of its being such copy.”

Right to present a bona fide, no-malice defence when extracts are involved: In proceedings for printing any extract or abstract, a defendant is entitled to put the original report in evidence and to prove that the extract was published bona fide and without malice; if a jury so finds the verdict is “not guilty” (s 3). That creates a specified avenue for defendants to avoid liability in extract cases, contingent on jury findings.

Statutory protection against civil defamation liability for particular persons: Section 3A provides that a person to whom it applies “does not incur any civil liability as for defamation” by publishing, on written request of a member, a copy in writing or extract of a speech made in Parliament by that member. The protection is explicit and categorical for qualifying persons when the written request requirement and other elements are satisfied (s 3A(1), (3)). The section further specifies that material in Hansard not attributed to the member is treated as part of the member’s speech for these purposes (s 3A(2)).

Evidentiary simplification right: Section 4 gives parties the right to have copies of Acts, ordinances and parliamentary papers purporting to be printed by the Government Printer or by authority of a House received in evidence without proof of authenticity or printing authority. This shifts the usual burden of proof and removes proof of printing authority as a precondition to admissibility.

Absence of criminal immunity or penalty provisions: The Act provides civil procedural protections and evidentiary rules; it contains no criminal immunity clauses, nor does it create criminal offences or penalties. The only criminal-law reference in the reprint notes is to an amending instrument, not to any penal provision in the Act itself.

Finality of stays: The Act’s language creates a right to permanent termination of civil proceedings once the statutory prerequisites are satisfied: the proceedings are “deemed and taken to be finally put an end to, determined, and superseded by virtue of this Act” (s 1; s 2). This is a strong procedural right for defendants who can access the s 1 or s 2 pathways.

The Act does not create direct criminal penalties or civil fines. Instead it enforces its protections and evidentiary rules through the courts and by statutory finality of civil litigation.

Court-ordered stay and final termination: The primary enforcement mechanism is judicial. Sections 1 and 2 command that when the prescribed documentary evidence is presented the court or judge “shall thereupon immediately stay such civil proceeding” and treat the proceedings and every writ or process issued therein as “finally put an end to, determined, and superseded by virtue of this Act” (s 1; s 2). The court’s role is mandatory; compliance with the statute is enforced by judicial action. That judicial action functions as an enforcement device in the sense that it removes the plaintiff’s legal remedy in the civil proceeding concerned.

Jury findings under s 3: Section 3 prescribes a remedial outcome in extract-and-abstract proceedings. If, on evidence presented, the jury are of the opinion that the extract or abstract was published bona fide and without malice, “a verdict of ‘not guilty’ shall be entered for the defendant or defendants.” The entry of a verdict of “not guilty” is the operative remedy in those proceedings and is the enforcement mechanism for the bona fide/no-malice defence in such cases.

Statutory immunity for specific re-publications (s 3A): Section 3A enforces immunity from civil defamation liability for protected categories of persons when they publish, on a member’s written request, a written copy or extract of a member’s speech. The section states the legal effect , the person “does not incur any civil liability as for defamation” , and so statutory non-liability is the enforcement result when the section’s conditions are satisfied.

Evidence admissibility (s 4) as an enforcement-related rule: By requiring courts to receive certain documents in evidence without proof of their being such copies, s 4 enforces a streamlined evidentiary practice that reduces litigation costs and evidentiary disputes. The effect on enforcement is indirect: the statute removes a procedural impediment to proving the content of Acts and parliamentary papers in court by deeming certain copies admissible.

No express penalty for non-compliance with procedural prerequisites: The Act prescribes that defendants must give 24 hours’ notice before presenting the certificate (s 1) and that certificates be provided by specified parliamentary officers, accompanied by affidavits. The text does not spell out a remedy or sanction if a defendant fails to give the 24 hours’ notice, or if the certificate or affidavit are defective. The enforcement provisions in the Act are focused on what courts must do when the statutory conditions are satisfied, not on penalising non-compliance with the preconditions.

No statutory appeal or review procedure expressed in the Act: The statute states that proceedings shall be “finally put an end to” on the court’s staying of them under its provisions (s 1; s 2). The Act does not itself provide for a statutory mechanism to challenge the receipt or validity of the certificate or affidavit within its text. Any procedural contest would therefore need to take place within established judicial processes and rules of civil procedure outside the text of the Act, or by other statutory or common law means.

The Act intersects with civil procedure, defamation law and evidentiary rules by displacing or simplifying specific requirements for litigation concerning parliamentary materials.

Interaction with civil claims for publication and defamation: Sections 1 and 2 operate as procedural shields in civil proceedings concerning publication of parliamentary papers. They operate by allowing a defendant to obtain an immediate judicial stay and final termination once the statutory documentary proof is produced (s 1; s 2). Section 3A explicitly states that a qualifying person “does not incur any civil liability as for defamation” when the specified conditions are met. That language places the Act directly within the field of defamation litigation: where the prerequisites of s 3A apply, defamation claims are foreclosed (insofar as the Act’s terms are satisfied). The Act therefore amends the substantive reach of civil defamation liability as applied to defined actors republishing parliamentary speeches.

Effect on evidentiary law and proof burdens: Section 4 operates across all litigation by declaring that copies purporting to be printed by the Government Printer or by authority of either House are admissible “in evidence in all cases whatever without proof of its being such copy” and without proof of printing authority (s 4). That provision displaces routine evidentiary burdens and simplifies proof in any court. It therefore interacts with rules of evidence and admissibility by creating a statutory category of self-authenticating documents.

Interplay with parliamentary privilege and legislative function: The Act’s preamble and substantive mechanics indicate an intent to remove “obstructions or impediments” to publication of parliamentary reports, papers, votes and proceedings. While the Act does not explicitly cite or incorporate doctrines of parliamentary privilege, its protective mechanisms align with legislative interests in facilitating and protecting official parliamentary publications. The text positions the Houses’ authority (and the officers authorised by them) as decisive for triggering civil-procedure protections.

Relation to acts amending or re-titling provisions: The compilation table and notes show that s 1-3 were amended by the instrument identified as 1 and 2 Edwardi VII No. 14 (Criminal Code Act 1902) and that s 3A was inserted by the Parliamentary Papers Amendment Act 1985 (No. 46 of 1985) (compilation table). The short title provision was inserted by the Statute Law Revision (Short Titles) Act 1966 (No. 81 of 1966) (compilation table). Those entries indicate how this Act has been edited and aligned with later statutory schemes, but the operative protections remain as framed in the reprint.

No express displacement of criminal law: The Act confines its operation to civil proceedings and civil liability for defamation as applied to the specified circumstances (s 3A). It does not expressly abrogate criminal provisions nor provide criminal defences. Any interaction with criminal law would therefore be a matter for separate statutory or common-law analysis; the text does not purport to create criminal immunities.

Practical interaction with litigative procedure: Because the Act requires courts to receive certain documents in evidence without proof and to stay and finally end proceedings on presentation of specified documentary evidence, the Act displaces parts of ordinary civil procedure in this specialised context. Parties and courts must therefore apply the statute’s mandatory directions before applying other procedural rules in cases concerning parliamentary publications.

The Act was originally passed in 1891 and has been amended and reprinted in specified forms. The compilation table in the provided text sets out the following milestones.

Original enactment: The untitled Act was assented to on 26 February 1891 and commenced the same day (54 Vict. No. 3 1891). That is the Act reproduced as the Parliamentary Papers Act 1891.

Early amendment (1902): Sections 1-3 were amended by an instrument recorded as 1 and 2 Edwardi VII No. 14, listed in the compilation table as related to the Criminal Code Act 1902. The compilation table cites assent to that instrument on 19 February 1902 with commencement on 1 May 1902 (see s 2 of that instrument). The reprint notes indicate s 1, s 2 and s 3 carry an annotation “[Section 1 amended: 1 and 2 Edwardi VII. No. 14 s. 3(2).]” and similar for s 2 and s 3. Section 5 of the original Act was deleted by that instrument: the text indicates “[5. Deleted: 1 and 2 Edwardi VII. No. 14 s. 3(2).]”.

Short title insertion (1966): The short title provision that permits citation as the Parliamentary Papers Act 1891 was inserted by the Statute Law Revision (Short Titles) Act 1966, No. 81 of 1966 (s 2). The compilation table records assent on 12 December 1966, commencing the same day.

Insertion of s 3A (1985): Section 3A , the protection concerning speeches in Parliament and the categories of persons covered , was inserted by the Parliamentary Papers Amendment Act 1985 (No. 46 of 1985), with assent recorded 17 September 1985 and commencement 15 October 1985 (compilation table). The insertion is annotated in the Act: “[Section 3A inserted: No. 46 of 1985 s. 2.]”

Reprints: The compilation table records a reprint of the Parliamentary Papers Act 1891 as at 8 August 1986, which included the above amendments, and a reprint 2 as at 14 November 2003 that includes the amendments listed. The reprint notes state the current consolidation is as at 14 November 2003.

Notation on institutional names: The notes indicate that what is referred to in s 3A as the “Government Printing Office” is now known as the State Law Publisher (note 3). The Act’s text still refers to the Government Printer and Government Printing Office in inherited terminology.

Taken together, the amendment history shows limited substantive additions: early amendments in 1902 adjusted several sections and deleted s 5; the short title was added mid-20th century; and s 3A was added in 1985 to address re-publication of parliamentary speeches and to extend protection to specific categories of parliamentary staff and official printers.

The statute as provided does not include reported judicial decisions or a catalogue of litigation applying its provisions. The printed text contains no case law citations and the reprint notes do not list any judicial interpretation. Therefore, the Act’s application in particular disputes is not recorded in the source material supplied.

Nonetheless, the statute itself prescribes how litigation must proceed in the specified circumstances, and so it creates an observable litigation dynamic where it applies.

Operation of litigation mechanisms under the Act: Where a defendant qualifies under s 1 or s 2 and produces the specified documentary proof , a certificate under the hand of the President, Speaker or Clerk plus an affidavit, or the report and a copy with an affidavit verifying correctness , the court “shall thereupon immediately stay such civil proceeding” and the proceeding “shall be deemed and taken to be finally put an end to” (s 1; s 2). Practically that means in cases where the statutory conditions are satisfied, litigation will not proceed to trial or judgment on the substantive claim, and no adjudicated civil liability on the claim will be entered because the proceedings are terminated by the statutory command.

In extract/abstract disputes under s 3 the Act contemplates jury resolution on the question of bona fides and malice: if the jury conclude the extract was “published bona fide and without malice” then “a verdict of ‘not guilty’ shall be entered.” That prescribes a litigation outcome in those fact-specific cases to be handled at trial with jury findings.

Section 3A removes civil defamation exposure for qualifying persons who publish, at a member’s written request, a member’s speech or extract; it will therefore dispose of defamation claims in those cases as a matter of law where the prerequisites are satisfied. This statutory clearance would typically arise at a preliminary stage of defamation proceedings.

Absence of recorded appellate or trial decisions in the supplied text: Because the Act’s text and reprint notes do not supply judicial interpretations or litigation histories, no specific cases can be cited from this source. Any assessment of how courts have applied or construed the Act, or how litigants have attempted to circumvent or challenge its operation, would require reference to external case law and doctrinal materials not present in the provided text.

Where litigation history matters for practice: Practitioners should be aware that the Act mandates particular procedural forms that, if met, produce immediate and final litigation outcomes. How courts have applied those requirements in contested circumstances , for example, challenges to the validity of a certificate, the sufficiency of an affidavit, issues of whether a publication was truly “by order, or under the authority” of a House, or the meaning of “bona fide and without malice” in s 3 , is a matter outside the Act’s text and would be found only in judicial decisions.

The Act contains specific formalities and narrow scopes that can produce traps for both plaintiffs and defendants if not observed carefully.

Strict formality requirements to trigger protection (s 1-2): The stay and final termination in s 1 only arise if the defendant brings a certificate signed by the President or Speaker or by the Clerk, together with an affidavit verifying the certificate, and gives 24 hours’ notice to the plaintiff/prosecutor. Failure to obtain the certificate from precisely those officers, to produce the requisite affidavit, or to provide the 24 hours’ notice could prevent the court-ordered stay from being triggered. Section 2 similarly requires that the defendant lay before the court the report and the copy together with an affidavit verifying their correctness; absence of that verified documentary form may leave litigation to proceed.

Finality of stays: The statute expressly declares that proceedings stayed under ss 1-2 are “finally put an end to, determined, and superseded by virtue of this Act” (s 1; s 2). That language signals final extinguishment rather than a temporary stay pending other steps. Practitioners should not assume the Act contemplates remittal or reopening of the case under the same cause of action once the certificate or verified copy is accepted by the court. The Act does not in its text provide for a mechanism to re-open or appeal that statutory termination, so the practical consequence is permanent termination in respect of that proceeding.

Narrow class of persons protected under s 3A: Section 3A’s protection for republication of parliamentary speeches on written request is limited by s 3A(3) to persons employed as members of the Parliamentary Reporting Staff, employees of Parliament, the Government Printer, and persons employed in the Government Printing Office. Private commercial publishers, media organisations, or independent printers who are not within those categories will not attract the statutory non-liability under s 3A merely because they publish a member’s speech following a request unless they fall within one of the enumerated categories.

Written request prerequisite under s 3A: The immunity in s 3A only applies to publications made “upon the written request of a member of either House of Parliament.” Oral requests do not suffice on the face of the text. Practitioners must ensure that a written request exists and can be produced if the immunity is to be invoked.

Hansard inclusion extends scope but does not broaden protected actors: Section 3A(2) takes in material not attributed to the member but included in the official report of the speech in Parliamentary Debates (Hansard). That means material in Hansard that was not the member’s words may be treated as falling within the ambit of what a member can request to be republished without civil liability. However, that expansion concerns the content, not the class of persons who enjoy immunity under s 3A(3).

Evidentiary self-authentication under s 4 is narrow but broad in consequence: Section 4 provides that copies “purporting to be printed by the Government Printer or by the authority of either House” are to be received in evidence “in all cases whatever without proof of its being such copy.” The “purporting to be” formulation means a party may tender a document that appears to be an official copy; the Act removes the need to prove printing authority. Practitioners should be attentive to the wording used; the provision does not require the document to be accompanied by any certificate in the Act itself to be admissible , the document need only purport to be an authorised copy.

Potential for mismatch between actual practice and statutory formality: The statute relies on officers of the Houses to supply certificates and on the Government Printer to be the source of purporting copies. In modern administrative practice the names and institutional arrangements may have changed (the notes identify the modern name State Law Publisher). Ensuring the certificate comes from the correct contemporary office-holder and that the Government Printer/State Law Publisher is recognised in that capacity will be necessary in practice.

No express sanction for defective certificates or affidavits: The Act does not specify the legal consequences if a certificate or verifying affidavit proves defective, false, or fraudulent. The text describes what the court “shall” do when a certificate and affidavit are presented; the Act does not itself set out remedial steps for perjury, false certification or fraud beyond what general law provides. Parties reliant on the statutory stay may therefore need to address contests over authenticity or veracity through broader civil or criminal law channels.

Scope confined to civil liability: The Act operates against civil proceedings and civil defamation liability (s 3A). It does not create criminal defences or speak to criminal prosecutions. Parties should not assume the Act immunises conduct from criminal exposure.

Deleted provisions and historical amendments: Section 5 was deleted in the 1902 amendment; the Act’s present text omits it. Historical or procedural expectations based on older drafts or pre-amendment practice may not apply. Practitioners relying on secondary or historical commentary should check the current statutory text.

Compliance under this Act is primarily documentary and procedural. The protections available to defendants and to those protected under s 3A are conditional on precise formal steps; parties should adopt administrative practices that ensure those steps can be taken reliably.

For organisations printing or publishing parliamentary materials under House authority:

• Maintain a clear written authorisation trail evidencing that the publication was made “by order, or under the authority of the Legislative Council or Legislative Assembly, or a Committee thereof,” so that a certificate can be obtained from the President, Speaker or the Clerk if needed (s 1).
• Ensure there is a process to obtain from the President, Speaker, or Clerk a certificate “under the hand” of the relevant officer stating that the report, paper, votes or proceedings were published by order or under authority, and to obtain a verifying affidavit to accompany the certificate (s 1). Record-keeping of the chain of authority and signatory delegation is important.
• If the publication is a copy of an authenticated report, keep the authenticated original and any copies, and be prepared to lay the original and the copy before the court with an affidavit verifying correctness (s 2). Preserve the original chain of custody and any printing records.

For persons seeking protection under s 3A in respect of republication of parliamentary speeches:

• Obtain and retain a written request from the member of either House before publishing a copy in writing or an extract of that member’s speech (s 3A(1)).
• Confirm that the publisher qualifies under the categories in s 3A(3): parliamentary reporting staff, an employee of Parliament, the Government Printer, or an employee of the Government Printing Office (now State Law Publisher). If the publisher is outside those categories, s 3A does not supply statutory non-liability.
• If the intended publication includes material not attributed to the member but that appears in Hansard, record that the material is included in Hansard so as to fall within s 3A(2).

For defendants who are sued:

• If sued for publication of parliamentary materials that were printed by order or under House authority, before presenting the certificate to the court give 24 hours’ notice to the plaintiff or prosecutor as required by s 1. Prepare the certificate and accompanying verifying affidavit and be ready to present them in court to obtain the immediate stay and termination.
• If sued in respect of a copy of an authenticated report, prepare to lay the report and the copy before the court together with an affidavit verifying their correctness under s 2. That can be done at any stage of the proceedings, and will oblige the court to stay and end the proceedings.
• If the claim concerns an extract or abstract, collect and be ready to adduce the full report and evidence that the extract was published bona fide and without malice; where a jury determines these facts in favour of the defendant a verdict of “not guilty” shall be entered (s 3).

For plaintiffs and claimants:

• Be cognisant that defendants can terminate civil proceedings by producing the prescribed documentary proof; anticipate the possibility of a stay and consider whether evidence exists to contest whether the publication was truly under the authority of a House or whether the certificate or affidavits are authentic.
• If asserting defamation claims against publishers of parliamentary material, test whether the defendant asserts protection under s 3A and whether the statutory preconditions (written request; the publisher’s status) are met.

For courts and registry staff:

• Be prepared to accept certificates and verified affidavits and to effect immediate stays and final termination where the statutory requirements are met (s 1; s 2), and to receive copies purporting to be printed by the Government Printer or by authority of a House without proof of their being such copies (s 4).
• Ensure administrative processes allow for the filing and verification of the specific documents identified in the Act and for the 24-hour notice procedure to be observed and recorded.

Record-keeping and chain-of-authority documentation are the practical compliance priorities. The Act’s protections hinge on formal documentary proof and specified officer signatures; maintaining those documents, originals and authenticated copies, is the mechanism by which publishers, parliamentary staff and printers secure the Act’s rights.
