23A Right of certain spouses or de facto partners to convert part of pension entitlement to lump sum entitlement
> > (1) In this section, pensioner means a spouse or de facto partner who is, after the commencement of the [Parliamentary Contributory Superannuation (Amendment) Act 1979](/view/pdf/asmade/act-1979-132), entitled to a pension under section 19C (2) (a) or 23 (2) or, where that pension is suspended under section 26, entitled to a pension under section 26 (2).

> > (2) The provisions of this Part (except section 19AA) apply to and in respect of a pensioner in the same way as they apply to and in respect of a former member.

> > (3) For the purposes of subsection (2), a reference in section 20 to a former member ceasing to be a member shall be construed as a reference to a pensioner becoming entitled to a pension.
