111K Payment of child’s or orphan’s pension

(1) Where a contributor, a pensioner or a person referred to in Schedule 5 died or dies, pension is payable in respect of a child of the deceased contributor, pensioner or person with effect from such date, at such rate, and subject to such conditions, as the Commissioner, by instrument in writing, determines. (2) The date determined by the Commissioner: (a) shall not, unless special circumstances exist that justify an earlier date, be a date earlier than the date of the determination; and (b) shall not in any case be a date earlier than 1 July 1979.
