#### 46 Liability for offences not affected 46 Liability for offences not affected > > (1) A decision to take disciplinary action against a person under this Part does not affect the liability of the person for any offence against a provision of this or any other Act or of a regulation made under this or any other Act. > > > (2) The Secretary is not prevented from taking disciplinary action under this Part merely because the holder of a permit concerned is subject to criminal or civil proceedings that relate to the same matters or incident to which the disciplinary action relates.
