Plain English Summary
6/10 complexity
This Determination names the specific vocational certificates that qualify a person for each type of refrigerant handling licence and lists the Australian/ISO standards that must be followed as licence conditions. (ss 3, 5–6)
It affects technicians, employers, training providers and the regulator: applicants must hold the listed qualifications and work to the incorporated standards, and the regulator enforces compliance under the Regulations. Compliance requires verifying credentials and meeting published technical standards. (ss 5–6)
This instrument, titled the Ozone Protection and Synthetic Greenhouse Gas Management (Refrigerant Handling Licences,Qualifications and Standards) Determination 2024 (s 1), prescribes two things for the refrigerant-handling licensing regime created by the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995 (the Regulations). First, it determines which formal vocational qualifications satisfy the qualification requirement for specific classes of refrigerant handling licences under subregulation 131(3) of the Regulations (s 5). Second, it identifies standards that apply as licence conditions for work carried out under those licences for the purposes of subregulation 135(5) of the Regulations (s 6(1)).
Mechanically, the instrument operates by reference. Section 5 maps licence types (column 1) to an enumerated list of recognised qualifications (column 2). The mapping is expressed as “For the purposes of subregulation 131(3) … a qualification mentioned in column 2 … is determined for the licence mentioned in column 1” (s 5). The table in s 5 contains four licence categories with multiple listed certificate qualifications and, in some cases, supplemental unit requirements. Section 6 makes a table of standards that “applies in relation to work carried out under a licence granted under Subdivision 6A.2.2 (Refrigerant handling licences) of the Regulations” (s 6(1)). It also specifies that a reference to a standard in items 1 to 22 is to that standard as published by Standards Australia and as in force when the relevant item commenced (s 6(2)). Items 23-25 in the s 6 table identify codes of practice published by bodies other than Standards Australia and include their own “as in force on the day this item commences” language in the table entries.
The instrument is a statutory instrument made under express delegated authority: it is made under subregulations 131(3) and 135(5) of the Regulations (s 3). It does not itself create licencing or enforcement powers, nor does it set fees or penalties; instead it fixes the documentary criteria (qualifications and external standards) that the Regulations refer to when deciding whether an applicant meets the statutory requirements to be granted or to operate under a refrigerant handling licence.
The immediate legal effect is therefore narrow and concrete: if an applicant seeks a licence under the Regulations, the issuing authority will treat possession of one of the specified qualifications as the “determined” qualification for the relevant licence class (s 5); and work carried out under a licence is subject to the external standards listed in the s 6 table, with those listed editions fixed as set out in s 6(2) and in the table entries. The instrument does not itself define how compliance with the standards is to be audited, nor does it prescribe administrative processes for licencing decisions; those mechanisms rest in the Regulations and in the administrative practice of the licensing authority.
Main concepts
The instrument rests on two central delegated-authority concepts: “determined qualifications” and “licence conditions, standards”.
Determined qualifications. Section 5 implements subregulation 131(3) of the Regulations by naming specific vocational certificates that satisfy the Regulations’ qualification requirement for each class of refrigerant handling licence. The table in s 5 sets out four distinct licence categories: (1) Full refrigeration and air conditioning licence; (2) Automotive air conditioning licence; (3) Restricted heat pump installation and decommissioning licence; and (4) Restricted domestic refrigeration and air conditioning appliances licence. For each category the instrument lists one or more certificate qualifications by their training package codes and titles, for example MEM31319 Certificate III in Refrigeration and Air Conditioning for the full refrigeration and air conditioning licence (s 5, item 1). For the automotive licence, the table includes both certificate II and certificate III pathways and, in some entries, adds that specific unit(s) must also be completed (s 5, item 2, paragraphs (g) and (h)). The legal mechanism is purely declaratory: possession of a listed qualification is what the instrument “determines” to be the qualification required under the Regulations (s 5).
Licence conditions, standards. Section 6 implements subregulation 135(5) of the Regulations by listing standards that apply in relation to work carried out under refrigerant handling licences granted under Subdivision 6A.2.2 of the Regulations (s 6(1)). The table in s 6 lists 25 items. Items 1-22 are Australian Standards or joint Australian/New Zealand Standards, identified by their AS or AS/NZS number and publication year, together with short titles such as AS/NZS 5149.1:2016 Refrigerating systems and heat pumps,Safety and environmental requirements, Part 1 (s 6, items 17-20). Section 6(2) clarifies that a reference to a standard in items 1-22 is a reference to the version as published by Standards Australia and as in force when the item commenced, thereby fixing the edition that applies. Items 23 and 24 point to the Australia and New Zealand Refrigerant Handling Code of Practice, Parts 1 and 2, 2025 edition, published by the Australian Institute of Refrigeration, Air Conditioning and Heating, as in force on the day those items commence; item 25 points to the Australian Automotive Code of Practice for the Control of Refrigerant Gases during Manufacture, Installation, Servicing or Decommissioning of Motor Vehicle Air Conditioners, published by the Commonwealth, as in force on 1 August 2024 (s 6 table entries).
Other definitions and formalities. Section 4 provides a short definitional point: “Regulations means the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995.” The instrument is named in s 1 and the delegating provisions are identified in s 3. These structural elements show the instrument’s role as a subordinate legislative instrument that populates the Regulations’ delegated criteria, rather than replacing or amending the principal Regulations themselves.
Who it affects
The instrument affects three principal groups directly, and others indirectly through compliance chains.
Licence applicants and licence-holders. The primary affected group is any person who applies for, holds, or performs work under a refrigerant handling licence granted under Subdivision 6A.2.2 of the Regulations. Section 5 specifies which vocational qualifications are “determined” for each licence class. An applicant who wishes to qualify for a full refrigeration and air conditioning licence, for example, must hold one of the qualifications listed in s 5, item 1, such as MEM31319 Certificate III in Refrigeration and Air Conditioning. For the automotive air conditioning licence, some listed qualifications require completion of particular units as well, such as AURETU104 (s 5, item 2, paragraphs (g) and (h)). Therefore applicants must assess whether their existing qualifications and units match the precise items in s 5. The legal consequence is that the possession of one of the listed qualifications is what the instrument determines to meet subregulation 131(3) of the Regulations, so licence-granting decisions will rely on the presence or absence of these qualifications (s 5).
Training providers and trainees. Registered training organisations and individuals seeking vocational training are affected because the instrument names specific nationally recognised certificates and specified units. Those providers and trainees will need to ensure that the qualifications they deliver and obtain are those listed in the s 5 table if they intend to use them as the basis for a refrigerant handling licence under the Regulations. Where the table specifies completion of particular units alongside a qualification (for example AURETU103 and AURETU104 in s 5, item 2(h)), trainees must ensure those units are included in their training pathway.
Employers and industry operators. Employers who hire technicians to perform refrigerant handling tasks will be affected in recruitment and role allocation because the instrument fixes what qualifications are recognised for each licence type (s 5). Employers will also be expected to ensure that operational work complies with the standards listed in s 6. This may affect procurement, equipment selection, workshop practices, and maintenance regimes, because the standards address technical topics such as pressure vessels (AS 1210,item 1), gas cylinders (AS 2030.1,item 2), brazing and welding consumables (items 12 and 13), and refrigerating systems safety (AS/NZS 5149 series, items 17-20).
Standards publishers and code authors. Standards Australia, the Australian Institute of Refrigeration, Air Conditioning and Heating, and the Commonwealth as publisher of the Automotive Code are affected because the instrument incorporates their publications as legally relevant documents (s 6). The instrument also fixes particular editions as the operative editions when the item commences (s 6(2) for items 1-22; table entries for 23-25). That linkage creates demand for those specific documents and for clarity about their content at the fixed editions.
Key duties and rights
Duties created or clarified by this instrument are documentary and technical rather than procedural. The instrument identifies documentary prerequisites for certain licence types and technical standards that operate as licence conditions. Rights that are affected are largely evidentiary: possession of a listed qualification confers the right to be treated as meeting the qualification criterion under subregulation 131(3) of the Regulations; work performed under a refrigerant-handling licence is subject to the listed standards as licence conditions.
Documentary duty to hold a listed qualification. Under s 5 the instrument declares what counts as the required qualification for the licence classes specified. For an applicant to satisfy the Regulations’ qualification requirement in relation to a particular licence class, the applicant must hold one of the qualifications listed in the corresponding s 5 item. For example, to meet the qualification requirement for a full refrigeration and air conditioning licence, one of the qualifications listed at s 5, item 1 must be held, such as MEM31322 Certificate III in Refrigeration and Air Conditioning. For the automotive air conditioning licence (s 5, item 2), some listed pathways require completion of specified units in addition to the core qualification, for example AUR32721 plus completion of AURETU104, or an alternative listed qualification plus completion of AURETU103 and AURETU104, whether those units are part of the qualification or completed separately.
Technical duty to comply with listed standards. Section 6(1) makes the table of standards applicable in relation to work carried out under the licences granted under Subdivision 6A.2.2 of the Regulations. The standards cover a broad set of technical topics including pressure vessels (AS 1210,item 1), gas cylinder requirements and filling procedures (AS 2030.1 and AS 2030.2,items 2-3), safety and environmental requirements for refrigerating systems and heat pumps (AS/NZS 5149 parts 1-4,items 17-20), performance testing and rating for air conditioners and heat pumps (AS/NZS ISO 5151:2023,item 15), and the designation and safety classification of refrigerants (AS/NZS ISO 817:2016,item 22). Where an item references an edition “as in force when the item commenced,” that edition is the operative one for licence purposes (s 6(2) for items 1-22; table entries for items 23-25).
Evidentiary right to rely on the listed qualifications and standards. Applicants and licence-holders have the right to rely on the instrument’s determinations when seeking and maintaining licences, because the Regulations incorporate these delegated determinations by reference (s 5, s 6(1)). The instrument provides clarity to both applicants and the licensing authority about which qualifications and which editions of standards are to be used to evaluate compliance.
Penalties and enforcement
The Determination itself does not create or specify criminal offences, civil penalties, or the enforcement procedures for unlawful conduct. The instrument is made under powers conferred by the Regulations (s 3) and operates to populate the Regulations’ delegated criteria for qualifications and licence conditions (s 5, s 6(1)). Consequently, penalties and enforcement mechanisms remain matters of the principal Regulations and any associated enforcement provisions they contain.
Division of responsibilities. The instrument fixes the documentary baseline, the precise qualifications and standards, used when the licensing authority under the Regulations assesses compliance. Enforcement actions such as refusal to grant a licence, suspension, cancellation, or other disciplinary measures would be taken under the authority and procedures set out in the Regulations and relevant administrative law, not under this Determination itself. Section 6(1) expressly links the standards to work carried out under a licence granted under Subdivision 6A.2.2, thereby making them relevant to licence-condition compliance and any enforcement that the Regulations empower.
Where the Determination affects enforcement. Although the Determination does not create penalties, it materially affects enforcement in two ways. First, because it determines which qualifications satisfy subregulation 131(3), it establishes the threshold evidence an applicant must present; failure to hold one of the listed qualifications will be a basis for regulatory refusal or condition under the Regulations. Second, by specifying standards that apply as licence conditions (s 6(1)), it shapes the technical benchmarks against which conduct will be assessed in any regulatory audit or compliance action. For example, if work is demonstrated to fall short of the AS/NZS 5149 series requirements that the Determination makes applicable (s 6, items 17-20), the licensing authority would have a basis under the Regulations to take action that is appropriate under the Regulations’ enforcement provisions.
Temporal fixation and enforcement. Section 6(2) fixes the edition of Standards Australia documents that applies (items 1-22). That temporal fixation matters because enforcement will evaluate conduct against the specific edition in force when the relevant item commenced. Items 23-25 in the table carry their own “as in force” formulations (including item 25’s “as in force on 1 August 2024”), which likewise fix the operative edition for enforcement. This reduces uncertainty about which technical standard will be used as the enforcement benchmark, but it also means that conduct is assessed against a fixed edition rather than an evolving standard unless the Determination is updated.
How it interacts with other laws
This instrument is explicitly a subordinate instrument to the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995. Section 3 states the instrument is made under subregulations 131(3) and 135(5) of those Regulations, and s 4 defines “Regulations” for the instrument’s purposes as the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995. Accordingly, the Determination operates by giving content to specific regulatory hooks in the principal legislation.
Interaction with the Regulations. Section 5 provides the list of “determined” qualifications for the purposes of subregulation 131(3) of the Regulations. That means the Regulations contain or require a qualification threshold (subregulation 131(3)) and this Determination fills in what constitutes that threshold. Section 6(1) operates “for the purposes of subregulation 135(5) of the Regulations,” supplying the standards that are to apply in relation to work carried out under refrigerant handling licences. Therefore any rights, obligations, and enforcement measures set out in the Regulations that depend on the qualification or standard content will now be applied using the specific qualifications and standards set out in this Determination.
Interaction with external standards regimes. The Determination imports external technical standards and codes as licence conditions. Section 6(2) explicitly ties standards in items 1-22 to their publication by Standards Australia and to the edition “as in force when the item commenced.” For items 23-25 the table entries identify codes published by the Australian Institute of Refrigeration, Air Conditioning and Heating and by the Commonwealth and fix their operative status as of the item commencement date or a specific date (item 25: “as in force on 1 August 2024”). Legally, the Determination does not create the technical content of those standards but makes them legally relevant by reference. That means changes to those external standards do not automatically alter the legal baseline unless the Determination is amended to adopt later editions.
Interaction with training and vocational regulation. Section 5 lists specific nationally-recognised vocational qualifications by training package codes and titles. These qualifications are parts of the nationally recognised training framework. The Determination therefore links the Regulations’ licencing regime to the national vocational qualification framework by naming particular certificates and units. Regulatory interactions therefore occur at the intersection of licensing law and the vocational education and training (VET) framework, with training providers and qualifications bodies supplying the qualifications the Determination recognises.
Amendment history
The instrument identifies itself as the Ozone Protection and Synthetic Greenhouse Gas Management (Refrigerant Handling Licences,Qualifications and Standards) Determination 2024 (s 1). The text supplied does not contain a record of prior versions, amendments, or commencement dates beyond the internal references to editions of standards and the specific “as in force” dates for particular items in the standards table.
What the instrument records. The only internal temporal fixings are within the s 6 table entries: items 1-22 are to be read as Standards Australia publications “as in force when the item commenced” pursuant to s 6(2). Items 23 and 24 specify the Australia and New Zealand Refrigerant Handling Code of Practice, Part 1 and Part 2, 2025 edition, published by the Australian Institute of Refrigeration, Air Conditioning and Heating, “as in force on the day this item commences.” Item 25 refers to the Australian Automotive Code of Practice for the Control of Refrigerant Gases during Manufacture, Installation, Servicing or Decommissioning of Motor Vehicle Air Conditioners, “as in force on 1 August 2024.” These table statements indicate the instrument contemplates staged commencements or different operative dates for certain items, but the instrument as provided does not include a schedule of commencements or an amendment log.
Absence of internal amendment record. The Determination text provided includes no marginal notes, schedules, or footnotes indicating prior amendments, repeal, or replacement of earlier determinations. It also does not include an express commencement provision for the Determination itself or for the items in the s 5 and s 6 tables, beyond the “as in force when the item commenced” or “as in force on 1 August 2024” formulations. Where editions are fixed by reference to the day an item commences, the instrument does not state that commencement date within the text provided.
Implications for practitioners seeking amendment history. Because the Determination text does not itself include an amendment history or commencement dates, practitioners who require an authoritative amendment history or commencement timetable will need to consult the official Federal Register of Legislation or the administrative source that publishes Commonwealth legislative instruments to obtain the instrument’s formal metadata, commencement dates, and any amendment instruments. The Determination points to fixed external editions in some items (for example item 25’s 1 August 2024 date), but it does not present a comprehensive administrative trail within its own text.
If and when the Determination is amended, such amendments would be expected to appear as subsequent legislative instruments amending the qualification list in s 5 or the standards table in s 6. The instrument offers no transitional rules in its text for recognition of qualifications not listed, for grandfathering, or for recognition of future editions of standards. Any such transitional arrangements, or subsequent amendments that change the operative editions of standards, would appear in later instruments amending this Determination or in separate instruments made under the same delegated authority in the Regulations.
Litigation history
The Determination text provided contains no information about litigation, judicial review, or tribunal decisions that interpret or test the instrument. There are no cited cases, references to judicial determinations, or internal summaries of legal challenges in the text. The instrument is a subordinate legislative instrument that specifies qualifications and standards by reference; any litigation about its validity, application, or interpretation would necessarily arise in the context of disputes under the Regulations or in administrative law challenges to licensing decisions that apply the Determination.
What the instrument shows about potential litigation vectors. Because the Determination fixes documentary requirements that feed directly into licensing decisions, specifically by determining which qualifications satisfy subregulation 131(3) and which standards apply under subregulation 135(5),any dispute about whether an applicant or licence-holder complied with the Regulations could give rise to administrative review or judicial review. Examples of issues that could be litigated, depending on factual circumstances, include whether a particular qualification held by an applicant corresponds to an item in the s 5 table, whether a licence-holder’s conduct complied with the fixed edition of a standard listed in s 6, or whether the issuing authority correctly applied the Determination when making a licensing decision. None of these scenarios are described in the instrument; they are simply logical nodes where litigation could occur given the Determination’s legal function.
Absence of reported cases in the instrument. Because the Determination itself contains no litigation history or citations to judicial decisions, practitioners requiring information about any existing litigation must consult external sources: case law databases, administrative tribunal records, or the Federal Court/High Court lists. The Determination should be treated as an operative legal text that feeds into regulatory actions; the existence and shape of any litigation will depend on actions taken under the Regulations and on administrative decisions applying the Determination’s content.
In short, the provided text contains no litigation history. Any adjudicative history that pertains to the Determination will be found outside the instrument in judicial or tribunal records.
Gotchas
This Determination contains a number of technical and administrative points that create potential traps for applicants, employers, and compliance officers. The following items identify those specific textual features that deserve attention, with references to the relevant sections and table items.
Qualifications are specified narrowly by training package codes and titles, and some entries require completion of particular units in addition to the named qualification, not merely experience. See s 5, item 2(g) and 2(h). For the automotive air conditioning licence, paragraph (g) requires AUR32721 Certificate III in Automotive Electric Vehicle Technology plus completion of unit AURETU104; paragraph (h) requires one of a list of qualifications and completion of units AURETU103 and AURETU104, “whether as part of, or in addition to, the qualification.” Applicants must therefore check both the qualification code and unit completion status, not assume that an apparently equivalent qualification is sufficient.
Multiple versions and legacy codes are listed. The s 5 table contains a mixture of qualification codes, some of which may reflect older training package numbering conventions (for example MEM30298 and MEM30205 alongside MEM31319 and MEM31322). The instrument accepts each listed code as determinative; however, practitioners should not assume that similar but unlisted qualifications are acceptable. The instrument does not provide cross-referencing to superseded or equivalent qualifications, so reliance solely on colloquial qualification titles could be misleading. See s 5, item 1 and item 2.
Standards are external documents and, for items 1-22, are fixed to the edition “as in force when the item commenced” under s 6(2). That means later amendments to a Standards Australia document will not automatically apply. Practitioners must confirm which edition of an AS or AS/NZS standard is operative for their licensing context, because s 6(2) ties the applicable standard to the version in force at commencement for items 1-22.
Items 23-25 use different wording in the table entries to fix operative editions. Items 23 and 24 identify the Australia and New Zealand Refrigerant Handling Code of Practice, Parts 1 and 2, 2025 edition, and say “as in force on the day this item commences.” Item 25 fixes the Australian Automotive Code of Practice as “in force on 1 August 2024.” This variable phrasing means that different items in the s 6 table adopt their operative editions by different temporal triggers: some by the unspecified commencement day, one by a specific date. The instrument text as supplied does not list commencement dates for all items, so careful checking of the instrument’s published metadata will be required to determine the operative edition dates for items 23 and 24.
How to comply
Compliance under this Determination requires satisfying two linked documentary and technical obligations: hold a listed qualification for the licence class sought, and perform licensed work in accordance with the standards the Determination makes applicable to licence-holders.
Step 1, identify the licence class under the Regulations. The Determination operates in relation to licences granted under Subdivision 6A.2.2 of the Regulations (s 6(1)). Before applying the Determination, confirm which refrigerant handling licence class you require under the Regulations. The instrument’s s 5 table maps qualifications to licence classes; for example, a “Full refrigeration and air conditioning licence” is linked to the list at s 5, item 1.
Step 2, confirm the precise qualification and unit requirements. For the chosen licence class, consult s 5 and identify which specific certificate code(s) and unit requirements are listed. For instance:
Full refrigeration and air conditioning licence, s 5, item 1: acceptable qualifications include MEM30298, MEM30205, MEM31319, MEM31322, UTE30999, UEE31307, UEE32211, and UEE32220 Certificate III level qualifications.
Automotive air conditioning licence, s 5, item 2: acceptable qualifications include various Certificate II and Certificate III awards, and some entries require completion of specified unit(s) such as AURETU104, or both AURETU103 and AURETU104 (see s 5, item 2(g)-(h)).
Ensure the qualification document you plan to rely on matches the exact code and title used in the s 5 table, and where unit completion is specified, ensure the unit identifiers are included in your qualification record or are documented as completed separately.
Step 3, obtain authenticated evidence. The Determination itself does not set the form of evidence, so when applying to the licensing authority, provide authenticated copies of certificates, transcripts, and unit records that identify the exact qualification codes and units. Because the Determination fixes qualifications by code, ambiguous or informal evidence (for example mere job descriptions) will likely be insufficient.
Step 4, obtain and apply the listed standards. Section 6(1) makes a specific suite of standards applicable as licence conditions. For each standard you may need to:
Acquire the specific edition identified by the Determination. For items 1-22, s 6(2) specifies the edition is the Standards Australia publication “as in force when the item commenced.” For items 23-24 check the instrument’s commencement metadata to identify the “day this item commences.” Item 25 is explicit as of 1 August 2024. Confirm the operative edition dates before procurement.

6 Licence conditions—standards
6 Licence conditions—standards
(1) For the purposes of subregulation 135(5) of the Regulations, a standard set out in an item of the table in this section applies in relation to work carried out under a licence granted under Subdivision 6A.2.2 (Refrigerant handling licences) of the Regulations.
(2) A reference to a standard in item 1 to 22 of the table in this section is a reference to that standard:
(a) as published by Standards Australia; and
(b) as in force when the item commenced.
This is an opening excerpt, not the complete document.
Temporal fixation of external documents. Section 6(2) creates a temporal rule: applied standards are the editions published and in force when the item commenced. For items 1-22 this is explicit in s 6(2). For items 23-25, the table entries individually state “as in force on the day this item commences” or, for item 25, “as in force on 1 August 2024.” This means the instrument links regulatory compliance to particular editions of external standards and codes, rather than subjecting licence-holders automatically to later revisions.
In short, the main concepts are a mapping of licence types to specified vocational qualifications (s 5) and a list of specified external technical standards and codes that are to be treated as licence conditions for work carried out under those licences (s 6). The instrument does not define licencing procedures or sanctions; those remain in the Regulations.
Regulatory decision-makers and enforcement bodies. The issuing authority under the Regulations will use this instrument when evaluating whether applicants meet the statutory qualification requirements and when considering licence conditions that relate to technical standards. The instrument does not itself set enforcement powers or penalties, but it alters the documentary baseline used in regulatory decision-making (s 3, s 5, s 6).
Indirectly affected parties include manufacturers and suppliers of refrigerant-handling equipment, because standards such as AS/NZS ISO 5151:2023 (item 15) and AS/NZS 60335.2.40:2019 (item 21) address equipment performance and safety; compliance with these standards may influence which products are deployable by licence-holders. Consumers hiring refrigeration technicians may also be affected insofar as the defined standards shape the technical conduct of repair, installation, and decommissioning work.
The instrument does not itself create new criminal offences or impose fees, and it does not prescribe the detailed process by which the issuing authority verifies qualifications or audits compliance with standards; those procedural and enforcement arrangements are left to the Regulations and administrative practice (s 3, s 6(1)).
No direct procedural rights in the instrument. The instrument does not itself set out procedural rights such as review or appeal mechanisms, nor does it stipulate who audits compliance or how evidence is to be presented; these procedural elements are within the scope of the Regulations and the administrative arrangements of the licensing authority (see s 3, s 6(1)). Similarly, the instrument does not itself prescribe timeframes for transition, grandfathering, or continued recognition of previously held qualifications; it simply lists the qualifications that are “determined” under subregulation 131(3).
Ancillary duties and compliance steps implied by the instrument. Because the s 6 table refers to external standards and codes, licence-holders have the practical duty to obtain, read, and apply those documents to their work as they are licence conditions. Section 6(2) fixes the applicable edition in relation to items 1-22. Items 23-25 contain their own “as in force” language in the table. Consequently, licence-holders must ensure they are compliant with the particular editions specified rather than with any later revision unless and until the instrument is amended to adopt a later edition.
In sum, the instrument creates clear documentary duties (hold one of the listed qualifications) and technical duties (comply with the listed standards as licence conditions), while rights are primarily evidentiary: applicants may rely on the instrument’s lists when applying for licences under the Regulations.
No enforcement procedures, evidentiary rules or penalties in the text. The Determination contains no text about evidentiary standards, inspection powers, administrative penalties, criminal sanctions, or appeal procedures. These procedural and penal aspects remain in the Regulations and in the wider administrative and judicial framework. The instrument’s effect on enforcement is therefore indirect and documentary: it defines what is required, while the Regulations define what happens if requirements are not met.
Limits of interaction. The Determination does not purport to override or amend the Regulations. It is a delegated instrument that supplies details the Regulations require. It does not, for example, substitute different enforcement powers, create offences, change the scope of the Regulations, or amend other Commonwealth, state or territory legislation. Any procedural, enforcement or regulatory interplay beyond documentary recognition of qualifications and standards remains governed by the Regulations and the applicable laws referenced therein.
Potential cross-jurisdictional effects. The listed standards include Australian Standards, joint Australian/New Zealand Standards, and codes published by national bodies. If state or territory occupational licensing regimes also reference these standards or the same vocational qualifications, overlap may occur in practice between federal refrigeration handling licence requirements and state/territory occupational regulation or building codes. The Determination itself does not address intergovernmental conflict or inconsistency; those matters must be resolved within the broader legal framework.
In summary, this Determination operates as a textually narrow but legally consequential bridge between the Regulations and external vocational qualifications and technical standards. It integrates external documents into the statutory licencing framework by reference, and the principal Regulations continue to provide enforcement and procedural scaffolding.
In sum, the text identifies itself as the 2024 Determination and fixes particular editions for certain items, but it contains no embedded amendment log or complete commencement schedule. For a formal amendment history and dates of effect, consultation of the legislative register where the Determination is published will be required.
The Determination does not detail administrative proof or documentary formats required by the licensing authority. It determines that certain qualifications are required (s 5) but it does not state how evidence must be presented, authenticated, or verified. Practitioners should not infer from the Determination itself that any particular form of evidence will be accepted; those procedural details are governed by the Regulations and by the authority’s administrative processes.
The Determination does not specify transitional arrangements for technicians who hold related but unlisted qualifications, or for those holding older versions that might have been superseded in the VET system. Because the instrument lists specific qualifications and does not provide transitional rules, things like recognition of prior learning, grandfathering or equivalent assessments are not addressed in the Determination’s text.
Compliance requires access to potentially paywalled standards and codes. The standards listed in s 6 are published documents external to the Regulations. Although s 6(2) defines the applicable editions, the Determination does not provide the substance of the standards, so licence-holders will need to obtain and rely on those documents to ensure compliance. The instrument does not allocate responsibility for purchasing or disseminating the documents; that is a practical compliance cost to be managed by businesses and individuals.
The Determination is silent on enforcement mechanics and penalties. While it sets substantive criteria, it does not themselves prescribe enforcement pathways or penalty scales. Enforcement actions will be taken under the Regulations. This separation can lead to practical uncertainty about administrative processes that practitioners must resolve by consulting the Regulations and the licensing authority.
Narrow subject-matter scope. The Determination is narrowly focused on qualifications and standards for refrigerant handling licences. It does not cover related licencing regimes or occupational safety laws, but those other legal regimes may still apply in practice. Failure to consider other applicable requirements could lead to compliance gaps.
Multiple standards cross-referencing. Several standards in the s 6 table are parts of multi-part series (for example AS/NZS 5149 parts 1-4, items 17-20) and other items reference ISO-origin documents with “MOD” modifications. Practitioners must ensure they identify and apply the correct part(s) for the work at hand and be alert to any interdependencies among parts.
These are not normative critiques but textual points grounded in the instrument that create compliance and administrative friction if overlooked. Each “gotcha” follows directly from how the Determination specifies qualifications, unit requirements, edition fixation, and its incorporation of external technical documents.
Review the applicable parts that relate to the specific work you perform, for example, installation site requirements under AS/NZS 5149.3:2016 (s 6, item 19) or operation and maintenance under AS/NZS 5149.4:2016 (s 6, item 20).
Implement workplace procedures, testing regimes, equipment selection and labelling consistent with the standards’ requirements, and keep records evidencing such compliance.
Step 5, integrate qualification and standards compliance into operational processes. Employers and licence-holders should ensure that recruitment, training, and operational manuals reference the Determination’s lists so that only appropriately qualified personnel perform work that triggers licence conditions. Equipment procurement and maintenance schedules should be reviewed against the standards listed in s 6 (for example AS 1210 for pressure vessels, item 1; AS 4041 for pressure piping, item 6).
Step 6, monitor commencement dates and instrument publications. Because the instrument fixes editions by reference to commencement timing, check the legislative publication (Federal Register of Legislation or equivalent) for the Determination’s formal commencement date and any staged commencement for items 23-24. If the Determination is subsequently amended, confirm whether later editions of standards or different qualifications are prescribed. The instrument provides no automatic update mechanism for changing Standards Australia editions (s 6(2)).
Step 7, coordinate with the licensing authority on procedural requirements. Because this Determination does not set out the administrative format for evidence or the processes for verification, contact the issuing authority to confirm their documentary requirements, application forms, fees (if any), audit procedures and record-keeping expectations. The practical compliance approach is to treat the Determination’s lists as the substantive checklist and the licensing authority’s administrative guidance as the procedural checklist.
Step 8, keep records and be audit-ready. Maintain copies of qualifications, unit completions, certificates of competency, and records showing adherence to the listed standards (inspection reports, maintenance logs, testing certificates). Because the Determination ties licence conditions to technical standards, records demonstrating compliance with those standards will be the primary evidence in any regulatory review.
Step 9, plan for missing or borderline qualifications. If an employee or applicant holds a related but unlisted qualification, seek early advice from the licensing authority about equivalence processes, recognition of prior learning, or the need to complete specific units to meet the s 5 table requirements. The Determination does not itself provide equivalence or transitional rules.
Step 10, confirm the treatment of multi-part standards and ISO-based materials. Where the s 6 table lists parts or ISO-derived standards with “MOD” modifications (for example the AS/NZS 5149 parts that note ISO 5149 parts MOD), ensure technical staff refer to the correct part and to any national modifications when applying the standard.
Following these steps, grounded in s 5 and s 6 of the Determination, aligns documentary preparation and technical practice with the Determination’s content and reduces the risk that a licensing authority will find an application or licensed activity non-compliant with the qualification and standard criteria the Regulations require.
