What it does
This instrument, the Ozone Protection and Synthetic Greenhouse Gas Management (Extinguishing Agent Handling Licences,Qualifications and Standards) Determination 2024, performs two discrete legal functions under the Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995 (the Regulations). First, it specifies, for the purposes of subregulation 322(3) of the Regulations, the units of competency that are to be treated as the qualifications for each named extinguishing agent handling licence (s 5). Second, it prescribes, for the purposes of subregulation 326(5) of the Regulations, the technical standards that apply as licence conditions in relation to work carried out under those licences (s 6(1)). The instrument was made by the Minister for the Environment and Water (signature dated 30 July 2024) and is expressly made under subregulations 322(3) and 326(5) (s 3).
Mechanically, s 5 contains a table mapping six licence types to specific units of competency (by unit code and short title) drawn largely from the CPPFES and UEEEC training packages and a common unit CPPCMN2002. Section 6 contains a table listing Australian Standards and ISO standards (with edition years) that apply as licence conditions, and s 6(2) clarifies each listed standard is the Standards Australia publication as in force when the item commenced.
The instrument’s commencement provision (s 2(1)) fixes the legal commencement as the later of two events: (a) the start of the day after registration of the instrument and (b) immediate commencement after Schedule 3 to the Ozone Protection and Synthetic Greenhouse Gas Management Amendment (2024 Measures No. 1) Regulations 2024 starts. Section 2(2) explicitly states that any information put in column 3 of the commencement table is not part of the instrument. The instrument itself contains no operational text about licensing processes, fees, enforcement mechanisms, or training delivery; it supplies only the prescribed competencies (s 5) and standards (s 6) to be applied under the cited subregulations of the Regulations.
