This law sets 1 January 2009 as the date when the ban on deliberately releasing harmful industrial gases into the atmosphere takes effect.

Under the Ozone Protection Act, it is illegal to discharge (release) "scheduled substances" — these are ozone-depleting chemicals like refrigerants and fire suppressants, plus synthetic greenhouse gases. This Proclamation simply activates that ban, making it a punishable offence to vent these substances into the air from New Year's Day 2009 onwards.

Who it affects: Air-conditioning and refrigeration technicians, mechanics, and anyone handling industrial solvents or fire suppression systems. They must now capture and recycle these gases rather than letting them escape.

I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under subsection 45B (4) of the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989, fix 1 January 2009 as the startup date.
