49Appointment of inspectors

#### 49 Appointment of inspectors (1) The Secretary may, by instrument in writing, appoint as an inspector a person who is: (a) an officer or employee of an authority of the Commonwealth; or (b) a person engaged under the Public Service Act 1999; or (c) an officer or employee of the Public Service of a State or Territory; or (d) a member of the Police Force of a State or Territory. (2) The Secretary must not appoint an officer or employee of the Public Service of a State or Territory, or a member of the Police Force of a State or Territory, as an inspector unless the appointment is in accordance with an arrangement made by the Minister with a Minister of that State or Territory. (3) The Secretary must not appoint a person as an inspector unless the Secretary is satisfied that the person has suitable qualifications and experience to properly exercise the powers of an inspector.
