Other Grants Guidelines (Research) Amendment (No. 2) 2020

The instrument introduces several new defined concepts and modifies existing ones. The RSP Funding Pool is the total funding for a given Grant Year for the Research Support Program minus the COVID-19 Supplementary Funding Pool. This is a departure from the previous framework which used “Funding Pool A” and “Funding Pool B”. The COVID-19 Supplementary Funding Pool is fixed at $1,000,000,000 for the 2021 Grant Year only. It is not indexed and does not carry over to later years. The RSP Base Grant Amount is the amount determined under the new formula in paragraph 1.4.15, which multiplies a HEP’s percentage share of competitive and engagement income (COMPETITIVEi and ENGAGEMENTi) by the RSP Funding Pool for the year, weighted 47 per cent competitive and 53 per cent engagement. The COVID-19 Supplementary Grant Amount is calculated using the same formula but substituting the COVID-19 Supplementary Funding Pool for the RSP Funding Pool. It is not subject to the transitional safety net. The Transitional Safety Net (paragraph 1.4.20) applies only for the 2021 Grant Year. It ensures that no HEP’s RSP Base Grant Amount falls below 95 per cent of its indexed RSP Grant Amount for the previous Grant Year. The mechanism works by first calculating each HEP’s notional indexed previous year amount (using an indexation factor derived from the change in the RSP Funding Pool), then comparing each HEP’s new base amount to that indexed amount. HEPs whose new base amount exceeds the indexed amount contribute the surplus to a notional safety net pool. HEPs whose new base amount is less than 95 per cent of the indexed amount receive a top-up from that pool to reach the 95 per cent floor. Any remaining funds in the pool are returned to contributing HEPs in proportion to their contributions. This is a zero-sum redistribution within the RSP funding allocation; it does not increase total funding. The Rounding Process (paragraph 1.4.35) rounds each HEP’s total grant down to the nearest dollar and then allocates leftover cents one dollar at a time to HEPs ranked by how close their remainder was to one hundred cents. This ensures all funds are distributed exactly. The Adjustments provision (paragraph 1.4.40) deals with incorrect HERDC data. If a HEP provides corrected data on or before 1 October in the year the data was first provided, the department uses it to recalculate the grant. If corrected data is provided after 1 October, it will not be used to adjust the grant, but the department will calculate what the grant would have been and, if the HEP was overpaid, the HEP must repay the overpayment. This creates a one-way correction mechanism: late corrections can only lead to recovery, not to an increase in the grant. The instrument also adds the AAHMS (Australian Academy of Health and Medical Sciences) to the list in subparagraph 2.5(3)(a) of the parent Guidelines, and increases the membership number in subparagraph 2.15(2) from four to five. That change likely relates to the composition of a committee involved in research block grant administration, such as the Research Block Grants Committee. The savings provision (section 5) means that the old section 1.4 (as in force before the amendment) continues to apply to RSP grants for the 2020 Grant Year, so the transition to the new rules does not affect that year.

The primary affected entities are all Higher Education Providers (HEPs) that are eligible to receive Research Support Program (RSP) grants under Part 2-3 of the Higher Education Support Act 2003. The RSP is a major source of Commonwealth funding for universities to support research infrastructure and indirect costs of research. Any HEP that participates in the RSP will have its grant amount calculated under the new formula for 2021 onwards. The change from the previous funding pool definitions (Funding Pool A and B) to the single RSP Funding Pool (minus the COVID-19 Supplementary Pool) alters the allocation formula. The introduction of the COVID-19 Supplementary Funding Pool provides an additional $1 billion exclusively for 2021, which will be distributed using the same formula as the base grant (competitive and engagement income share). This injection of funds is a one-off and does not recur. The transitional safety net in 2021 protects HEPs that would otherwise face a drop of more than 5 per cent in their base grant compared to the indexed previous year. HEPs with growing shares of competitive or engagement income will instead have their gain reduced because their surplus is used to top up others. The rounding process affects every HEP at the margins, potentially giving or taking a few dollars depending on remainder rankings. The data correction provisions affect all HEPs that submit HERDC data. The strict 1 October deadline means HEPs must ensure data is accurate at the time of submission, because later corrections can only reduce their grant (via overpayment recovery) and cannot increase it. This asymmetric rule creates a strong incentive to get the data right the first time and to review it carefully before the deadline. The addition of the AAHMS to the list in subparagraph 2.5(3)(a) means that the Australian Academy of Health and Medical Sciences is now recognised as a nominating body for membership on whatever committee or panel is being referenced (likely the Research Block Grants Committee or the Research Evaluation Committee). The increase in membership from four to five means that committee will have an additional member, likely from the AAHMS. This affects the Academy itself and the composition of that committee, but the practical impact on HEPS is indirect. The instrument also affects the Department of Education (now Department of Education, Skills and Employment at the time) which must administer the revised grant calculation, the safety net, rounding, and data correction processes. The savings provision ensures that for the 2020 Grant Year, the old rules continue to apply, so HEPs that received grants for 2020 are not retroactively affected. However, the transitional safety net uses 2020 grant amounts as a baseline, so 2020 figures matter for 2021 calculations. Overall, the direct financial stakes are high: the RSP distributes billions of dollars annually, and the extra $1 billion COVID-19 supplementary pool is a significant injection. HEPs with strong competitive and engagement income shares will receive larger shares of both the base and the supplementary pool.

The instrument imposes few new duties and confers some rights on HEPs. The main duty is the obligation to provide correct HERDC data and to correct it if it is incorrect. Under paragraph 1.4.40(1), a HEP that provided incorrect data must correct it. This is a mandatory duty, not merely an option. The department’s duty is to take corrected data into account if provided on or before 1 October in the year the data was first provided (subparagraph 1.4.40(2)). The HEP has the right to have its grant recalculated if it corrects data by that deadline. If the HEP corrects data after 1 October, the department will not use that data to increase the grant, but will use it to determine whether an overpayment occurred and, if so, the HEP must repay the overpayment (subparagraph 1.4.40(4)). That creates a duty to repay overpayments. The HEP does not have the right to a retroactive upward adjustment after the deadline. The instrument does not confer any new rights beyond the formula-based calculation of grants. HEPs have the right to receive an RSP Grant Amount calculated under the new method, including the base amount and, for 2021 only, the COVID-19 Supplementary Grant Amount. The transitional safety net gives HEPs that would otherwise drop more than 5 per cent a right to a top-up to 95 per cent of the indexed previous year grant. This is a protective right, but it is funded by HEPs whose grants would have increased more than the floor. That redistribution does not create a right to a specific amount; it is a formulaic outcome. The rounding process (paragraph 1.4.35) gives each HEP an equal chance at receiving a dollar from the remainder pool, but that is administrative, not a substantive right. The indexation note (under paragraph 1.4.1) states that the RSP Funding Pool is to be indexed in the same way as amounts under Part 5-6 of the Act. That gives HEPs a right to have the pool increased annually by indexation, though the instrument does not specify the method. The rollover provision (paragraph 1.4.45) confirms that a RSP grant is made for the relevant Grant Year under section 41-40 of the Act, which deals with grants payable. The addition of AAHMS to the list in subparagraph 2.5(3)(a) and the increase in membership give the Academy the right to nominate a member to a committee. For other HEPs and stakeholders, there are no new direct duties or rights. The instrument does not create any private rights of action; enforcement occurs through the department’s administrative processes and ultimately through the Act.

The instrument itself does not specify penalties; enforcement mechanisms arise from the Higher Education Support Act 2003 and the parent Guidelines. The most immediate enforcement tool is the overpayment recovery provision in paragraph 1.4.40(4). If a HEP provides corrected data after 1 October and the department determines an overpayment was made for a Grant Year, the HEP must repay the amount of the overpayment. The phrase “must repay” indicates a mandatory debt owed to the Commonwealth. The Act likely contains provisions for recovery of overpaid grants, including possible interest or administrative charges (though those are not referenced in this instrument). There are no criminal penalties mentioned. The instrument does not create any criminal offences or civil penalties for non-compliance, aside from the repayment obligation. The obligation to provide corrected data is a duty, but there is no explicit penalty for failing to correct data beyond the fact that the department may later discover the error and recover overpayments anyway. The Act itself (not amended here) provides the general enforcement framework, including powers to suspend or terminate grants for non-compliance with guidelines, or to require repayment under section 41-45 or similar. The instrument does not alter those provisions. The rounding process (paragraph 1.4.35) is self-executing and does not involve enforcement. The transitional safety net is mechanical and does not require enforcement by HEPs; the department applies it. The indexation of the RSP Funding Pool is stipulated but the instrument does not set a penalty if the department fails to index correctly; that would be a matter of administrative law. The addition of AAHMS to the committee membership does not involve penalties. In summary, the primary enforcement consequence is financial: a HEP that provides incorrect data after the deadline faces a mandatory repayment of any overpayment. There is no provision for bonuses or additional funds for early correction. The instrument does not create any audit or inspection powers. The department’s reliance on self-reported HERDC data means that the accuracy of data is crucial. The risk of overpayment recovery acts as a deterrent against sloppy or fraudulent reporting, though the instrument does not impose penalties for deliberate misrepresentation beyond repayment (the Act may have separate provisions for false statements). The instrument does not specify time limits for repayment or interest on overpayments. The rounding process may result in slight variations of a few dollars per HEP, which is not a penalty but a technical allocation.

This instrument is made under section 238-10 of the Higher Education Support Act 2003 (Cth) for the purposes of Part 2-3 of that Act. The parent Act governs Commonwealth funding for higher education, including research block grants. The Other Grants Guidelines (Research) 2017, as amended, are legislative instruments that sit beneath the Act. They must be consistent with the Act; any conflict would render the guideline provision invalid to the extent of inconsistency. The instrument explicitly notes that indexation of the RSP Funding Pool is to be done in the same way as amounts are indexed under Part 5-6 of the Act (see note under paragraph 1.4.1). That ties the guideline to the Act’s indexation mechanism. The instrument also references HERDC (Higher Education Research Data Collection) data, which is collected under a separate administrative framework not specified in this instrument but likely governed by other guidelines or the department’s research data collection procedures. The grant amounts are determined for the purposes of paragraph 41-30(a) of the Act, which allows the Minister to determine grant amounts in guidelines. The rollover provision (paragraph 1.4.45) references section 41-40 of the Act, which provides for the payment of grants. This instrument does not amend the Act itself; it only amends the guidelines. Therefore, it interacts with the Act by filling in the details that the Act leaves to ministerial determination. The savings provision (section 5) ensures that the repealed section 1.4 continues to apply to 2020 Grant Year grants, preserving the prior regulatory framework for that year. This is a standard transitional provision to avoid retrospective effect. The instrument does not interact with any other Commonwealth legislation explicitly. It may indirectly interact with the Taxation Administration Act 1953 if grant payments have tax implications, but that is not mentioned. The deletion of the old definitions of “Funding Pool”, “Funding Pool A” and “Funding Pool B” means those terms no longer appear in the Guidelines. Any cross-references in other instruments or policy documents that rely on those definitions may become orphaned, though that is unlikely. The addition of AAHMS to the list in subparagraph 2.5(3) and the increase in membership from four to five in subparagraph 2.15(2) amend only the Guidelines, not the Act. The committee or body being referenced is not named in the instrument, but it is presumably established under the Guidelines themselves. The instrument does not affect the Privacy Act 1988 or Freedom of Information Act 1982, though data corrections may involve personal information. Overall, the interaction is narrow: the instrument refines the grant calculation within the existing statutory framework, and does not touch other legislation.

This instrument is the Other Grants Guidelines (Research) Amendment (No. 2) 2020. That numbering indicates it is the second amendment to the Other Grants Guidelines (Research) 2017 in the 2020 calendar year, but the text does not disclose the contents of Amendment No. 1. The original Guidelines were made in 2017, likely shortly after the Higher Education Support Act was amended to create the RSP and other research block grants. The instrument repeals section 1.4 of the 2017 Guidelines in its entirety and substitutes a new section 1.4. This is a significant structural change, replacing the previous grant amount determination method with the new formula, pools, safety net, and correction mechanism. The instrument also removes the definitions of “Funding Pool”, “Funding Pool A” and “Funding Pool B” and inserts new definitions. Those old definitions presumably dated from the original 2017 Guidelines or earlier amendments. The instrument adds a new body (AAHMS) to the list in subparagraph 2.5(3)(a) and increases the membership count in subparagraph 2.15(2) from four to five. This suggests that the committee in question previously had four members and now has five, reflecting the inclusion of AAHMS. The instrument does not include a table of amendments or explanatory statement, but it is self-contained. The instrument was made on 15 November 2020 and commenced the day after registration. It was registered on the Federal Register of Legislation on an unspecified date. There is no sunset clause; the amendments remain in force until further amended or repealed. The instrument does not amend any other schedules or provisions of the parent Guidelines. The savings provision preserves the old rule for 2020, indicating that the change was intended to apply only to 2021 onwards. The repeal of the old section 1.4 is effective from commencement, but the savings provision ensures continuity. The instrument’s impact is therefore limited temporally: the COVID-19 Supplementary Funding Pool is only for 2021, and the safety net only for 2021. From 2022, only the base formula without the safety net applies. The rounding and adjustment provisions are ongoing. The addition of AAHMS is permanent unless later removed. Future amendments could modify or remove the COVID-19 Supplementary provisions. The instrument does not amend the Act itself.

The source text does not mention any litigation related to this instrument or the parent Guidelines. The instrument is a legislative instrument made in late 2020, and as of the date of the instrument (November 2020), no court cases have yet arisen. The substantive changes are recent and it is unlikely that significant litigation has occurred in the short period between commencement and the date of this deep dive (the instrument would have commenced around November/December 2020). However, there is potential for future disputes. The most likely grounds for litigation would be: (a) disputes over the calculation of grant amounts under the new formula, particularly the application of the transitional safety net or the definition of “competitive” and “engagement” income; (b) disputes over the data correction deadline and overpayment recovery, where a HEP may argue that the department misinterpreted “corrected data” or the calculation method; (c) judicial review of the minister’s decision to make the guidelines if a HEP argues that the formula is ultra vires the Act (though the Act gives broad discretion); (d) administrative law challenges to the application of the rounding process if a HEP claims the process is arbitrary or unfair. There is no mention of any previous cases under the 2017 Guidelines. The instrument’s provisions are detailed and formulaic, which may reduce the scope for interpretive disputes, but the threshold for data correction deadlines and the indexing of previous year grants could be contested. The instrument does not include a review mechanism or merits review. HEPs could seek judicial review in the Federal Court under the Administrative Decisions (Judicial Review) Act 1977, but decisions under guidelines may be non-statutory and thus not reviewable. The Higher Education Support Act provides some internal review mechanisms for grant decisions, but those are not amended here. Given the high financial stakes (the RSP pool is over $1 billion annually, and the COVID-19 supplementary is $1 billion), the risk of litigation is non-trivial, but there is no reported litigation to date on this specific instrument. The instrument itself does not create any new rights of appeal. Practitioners should monitor any potential challenges, particularly from HEPs that may be disadvantaged by the safety net redistribution or the data correction rules.

Several features of the instrument carry potential pitfalls for HEPs and other stakeholders. The strict data correction deadline (1 October) is asymmetric: data corrected after that date will not be used to increase a grant, but can still lead to an overpayment recovery. A HEP that discovers an error after 1 October cannot revise its grant upward; it can only avoid or reduce a future debt. This creates a strong incentive to submit accurate data by the deadline and to audit data internally well before 1 October. The duty to correct incorrect data is mandatory, so a HEP cannot simply ignore the error. The department may later discover it and recover overpayments anyway. The transitional safety net only applies to the 2021 Grant Year. From 2022, there is no floor. HEPs that anticipate a drop in their share of competitive or engagement income after 2021 could face significant reductions in base grant without any safety net. The 2021 safety net may mask underlying trends. HEPs should model their shares under the new formula for 2022 and beyond. The COVID-19 Supplementary Grant is not subject to the transitional safety net. The instrument explicitly states that the safety net will not be applied to those amounts (paragraph 1.4.30). So the supplementary distribution is purely formulaic: HEPs with higher shares get more, and lower-share HEPs get less, with no floor. For 2021, a HEP could receive a small base grant after the safety net top-up but a small supplementary grant if its share is low. The combination may still be beneficial overall given the extra $1 billion, but the distribution may not match the distribution of need. The rounding process (paragraph 1.4.35) can produce slightly different results from purely mathematical rounding. The remainder system means a HEP with a remainder of 99 cents is very likely to receive an extra dollar, while a HEP with remainder 1 cent almost certainly will not. This is trivial in absolute terms but could be material if a HEP is near a threshold. The indexation method is not fully specified. The note says the RSP Funding Pool is indexed “in the same way as amounts are indexed under Part 5-6 of the Act”, but that Part refers to indexation of grants, not pools. There may be ambiguity in applying that to the pool. The safety net indexation uses the ratio of the current year pool to previous year pool, which is not standard indexation but a budget-driven adjustment. The deletion of the old definitions of Funding Pool A and B may cause confusion if any other documents refer to them, but that is unlikely. The instrument does not define “competitive” and “engagement” income beyond the formula in paragraph 1.4.10. The categories (Category 1, 2, 3, 4 income) are likely defined in the parent Guidelines or elsewhere. HEPs need to ensure they understand those definitions and that their data is classified correctly. The savings provision applies only to RSP grants for the 2020 Grant Year. It does not preserve the old rules for any other purpose. Any reference to the old section 1.4 in other contexts (e.g., audit) may become outdated. The instrument does not include a review mechanism for grant amount decisions. HEPs may need to rely on the Act’s provisions or general administrative law. Practitioners should be aware that the instrument is completely silent on dispute resolution.

Compliance for HEPs under this instrument centres on accurate and timely reporting of HERDC data and understanding the grant calculation formulas. The most critical compliance step is to submit correct competitive and engagement income data to the department before the 1 October deadline each year. Because the data from previous years (y1 and y2) is used to calculate the percentage shares, a HEP should also ensure that its historical data is accurate. Errors discovered after 1 October cannot be used to increase the grant but can lead to overpayment recovery, so proactive auditing is wise. HEPs should establish internal processes to verify Category 1, 2, 3 and 4 income figures before submission. For the 2021 Grant Year, HEPs need to be aware of the transitional safety net and the COVID-19 Supplementary Grant. The safety net calculation uses the RSP Funding Pool for the current year and previous year. A HEP should calculate its own RSP Base Grant Amount under the new formula and compare it to 95 per cent of its indexed previous year grant. It may need to inform the department if data corrections are required before 1 October to benefit from the safety net. The COVID-19 Supplementary Grant is calculated by substituting the $1 billion pool into the same formula. There is no compliance step for HEPs other than ensuring data accuracy. The department will compute the amounts. HEPs should verify the department’s calculations once published. The rounding process is automatic, but HEPs can check their remainder ranking to understand the small adjustments. The data correction provisions at paragraph 1.4.40 require that if a HEP becomes aware of incorrect data, it must correct it promptly. The instrument does not prescribe a form or method; presumably the department has a process. HEPs should comply with any departmental instructions on data submission and correction. The addition of AAHMS to the committee and the increase in membership do not impose compliance obligations on HEPs, but HEPs interacting with that committee should update their records. The parent Guidelines may require HEPs to report other information. This instrument does not affect those obligations. In summary, the key compliance action is accurate data management. HEPs should also budget for the fact that the safety net ends after 2021, so future grant amounts may be more volatile. There is no requirement to apply for the grants; they are determined automatically under the formula. Last, HEPs should retain records of the data submitted and any correspondence with the department regarding corrections, as overpayment recovery could arise years later. The instrument does not impose record-keeping obligations, but prudence suggests keeping such records for at least the statutory limitation period (generally six years from the grant year).
