46 Effect of unsuccessful conciliation or mediation (1) If the conciliation or mediation process is unsuccessful: (a) the complaint must be treated as if the process had not taken place; and (b) the conciliator or mediator must not be further involved in dealing with the complaint. (2) However, subsection (1)(b) does not affect the Ombudsman's powers and functions under this Part in relation to the complaint.
