What it does
The Old Colonists' Association Act 1947 changes how certain future receipts to the Old Colonists' Association of Victoria (the Association) are treated for spending purposes. Mechanically, the Act does three things.
First, it declares that specified sums received after the Act's commencement may be applied to carrying out the Association's objects (s 2(1)). The specified sums are three categories: (a) donations, bequests and legacies received after commencement that are not directed by the donor to be specially applied; (b) donations made after commencement that entitle persons to be life governors; and (c) subscriptions paid after commencement to the Association by governors (s 2(1)(a)-(c)). The operative phrase is permissive , the sums "may be applied to the carrying out of the objects of the Association" , rather than mandatory or prescriptive about exactly how they must be paid out (s 2(1)).
Second, the Act provides an express override. Section 2(1) begins with a "notwithstanding" clause: "Notwithstanding anything in the Principal Act or in any other Act or enactment or in any trust" , which gives the section primacy over the Principal Act, other statutes and (to the extent the Parliament can) trust instruments, for the specified categories of future receipts (s 2(1)). That language is the instrument's chosen mechanism to change the default legal effect of future donations and related receipts.
Third, the Act preserves what already existed. Section 2(2) says nothing in this Act shall be construed as affecting the amount of the permanent fund of the Association as it existed immediately before the commencement of this Act. In other words, the standing permanent fund, as at commencement, is left intact and cannot be diminished by the new rule about future receipts (s 2(2)).
The Act also contains two housekeeping provisions. Section 1 makes the Act a statutory companion to the Principal Act (the perpetual-fund Act passed in the forty-sixth year of Queen Victoria), directing they be read as one (s 1). Section 3 repeals the Old Colonists' Association Act 1938 (s 3). The Act was assented to and came into operation on 24 June 1947 (endnotes).
