What it does
This Act imposes and structures a royalty regime for petroleum recovered under certain offshore instruments connected to the North West Shelf. Mechanically, the Act: (a) makes the registered holder of a North West Shelf exploration permit, a North West Shelf retention lease or a North West Shelf production licence liable to pay royalty on petroleum recovered in a royalty period (s 5); (b) prescribes the rates and the mechanism for setting rates for the different classes of instrument (ss 6-8); (c) creates processes for determining the point of valuation (the wellhead), the value at that point, and the quantity of petroleum recovered (ss 11-13); (d) provides for provisional valuation and subsequent adjustments, refunds or further demands where provisional values are replaced by agreed or determined values (ss 15-16); (e) allows the Joint Authority to direct and the State Minister to comply about how the State Minister exercises powers under the valuation and measurement provisions (s 14); and (f) preserves transitional arrangements from the repealed Petroleum (Submerged Lands) (Royalty) Act 1967 and re-enacts that legislation with modifications as set out in Schedule 1 (Schedule 1 cl 2-6).
Who pays and when is clear in the Act: the "registered holder" of the specified North West Shelf permits, leases or licences is "liable to pay a royalty on all petroleum recovered by the holder in the permit area, lease area or licence area in a royalty period beginning at or after the commencement of this section" (s 5). The primary point for calculation is the value at the wellhead, measured and agreed or determined under ss 11-13 and 12 respectively. The Act delegates certain decision-making roles to the Joint Authority and the State Minister: the Joint Authority decides royalty rates for secondary petroleum production licences within a statutory band (s 6(2)-(4)), and it issues directions to the State Minister about how the State Minister is to exercise powers under ss 11-13 (s 14); the State Minister certifies or determines wellhead, value and quantity where parties have not agreed or the State Minister is not satisfied with measurement (ss 11-13), and may make provisional values (s 15) pending agreement. The Act also provides for reductions for wells that would otherwise be uneconomic because of reduced rates of recovery (s 9).
