71 Storage of records
(1) Subsection 52(1) of this instrument applies in relation to an environment plan for an activity that ceased to be in force before the commencement day.
Note: The subsection requires an environment plan to be stored for 5 years beginning on the day that it ceases to be in force.
(2) Subsection 52(3) of this instrument also applies:
(a) to a written record of a notification under regulation 26 of the old Regulations as if it were a written record of a notification under section 47 of this instrument; and
(b) to a written report submitted under regulation 26A of the old Regulations as if it were a written report given under section 48 of this instrument; and
(c) to a written report submitted under regulation 26AA of the old Regulations as if it were a written report submitted under section 49 of this instrument; and
(d) to a written report submitted under regulation 26B of the old Regulations as if it were a written report given under section 50 of this instrument; and
(e) to a written report submitted under regulation 26C of the old Regulations as if it were a written report submitted under section 51 of this instrument.
(3) Subsection 52(5) of this instrument applies in relation to records and reports created before, on or after the commencement day.
(4) If:
(a) a request was made for copies of records under regulation 28 of the old Regulations; and
(b) the request related to a document or record that section 52 of this instrument requires a titleholder to store; and
(c) the period during which storage of the document or record is required under section 52 of this instrument had not ended before the commencement day; and
(d) the requested copies were not made available before the commencement day;
the request is taken to have been made under section 53 of this instrument.
