66  Environment plan submitted before commencement day but no decision made  (1) This section applies in relation to an environment plan (including a proposed revision of an environment plan in the form of a revised environment plan) if:  (a) the plan was submitted to the Regulator under the old Regulations before the commencement day; and  (b) the Regulator had not decided before the commencement day to either accept the plan or refuse to accept the plan; and  (c) the titleholder who submitted the plan had not withdrawn it before the commencement day. Submission and checking completeness  (2) The environment plan is taken to have been submitted to NOPSEMA under section 26 of this instrument.  (3) If the Regulator published the plan under regulation 9AB of the old Regulations, the plan is taken to have been published under section 28 of this instrument.  (4) If the Regulator gave the titleholder a notice under regulation 9AC of the old Regulations, the notice is taken to have been given by NOPSEMA under section 29 of this instrument. Public comments on seismic or exploratory drilling environment plan  (5) If the Regulator published an invitation under subregulation 11B(1) of the old Regulations, the invitation is taken to have been published by NOPSEMA under subsection 30(1) of this instrument.  (6) If the titleholder resubmitted the plan to the Regulator in accordance with paragraph 11B(3)(b) of the old Regulations, the titleholder is taken to have resubmitted the plan to NOPSEMA in accordance with paragraph 30(3)(b) of this instrument.  (7) If the titleholder gave the Regulator a written statement in accordance with paragraph 11B(3)(c) of the old Regulations, the titleholder is taken to have given NOPSEMA the statement in accordance with paragraph 30(3)(c) of this instrument.  (8) If the titleholder resubmitted the plan to the Regulator under subregulation 11C(2) of the old Regulations, the titleholder is taken to have resubmitted the plan to NOPSEMA under subsection 31(2) of this instrument. Request for further information  (9) If:  (a) the Regulator made a request for further information to the titleholder under regulation 9A of the old Regulations; and  (b) the titleholder had not provided the information before the commencement day; and the request is taken to have been made by NOPSEMA under section 32 of this instrument. Notice giving opportunity to resubmit  (10) If the Regulator gave the titleholder a notice under subregulation 10(2) of the old Regulations, the notice is taken to have been given by NOPSEMA under subsection 33(5) of this instrument. Sensitive information  (11) Information given in relation to the environment plan before the commencement day that is sensitive information within the meaning of the old Regulations is taken to be sensitive information within the meaning of this instrument.
