62  Offshore project proposal submitted before commencement day but no decision made  (1) This section applies in relation to an offshore project proposal if:  (a) the proposal was submitted to the Regulator under the old Regulations before the commencement day; and  (b) the Regulator had not decided before the commencement day to either accept the proposal or refuse to accept the proposal; and  (c) the proponent had not withdrawn the proposal before the commencement day. Submission of proposal  (2) If the proposal was submitted to the Regulator under regulation 5A of the old Regulations, it is taken to have been submitted to NOPSEMA under section 6 of this instrument.  (3) If the offshore project proposal was submitted to the Regulator under subregulation 5F(2) of the old Regulations, it is taken to have been submitted to NOPSEMA under subsection 15(2) of this instrument. Request for further information after submission  (4) If:  (a) the Regulator made a request for further information to the proponent under regulation 5B of the old Regulations; and  (b) the proponent had not provided the information before the commencement day; and the request is taken to have been made by NOPSEMA under section 8 of this instrument. Notice inviting public comment on proposal  (5) If the Regulator published a notice in relation to the offshore project proposal under paragraph 5C(3)(b) of the old Regulations, the notice is taken to have been published by NOPSEMA under paragraph9(5)(b) of this instrument. Resubmission of proposal after public comment  (6) If the proponent gave the Regulator another copy of the proposal in accordance with paragraph 5D(1)(b) of the old Regulations, the proponent is taken to have resubmitted the proposal to NOPSEMA in accordance with paragraph 11(b) of this instrument.  (7) If the proponent gave the Regulator the material mentioned in paragraph 5D(1)(c) of the old Regulations, the proponent is taken to have given that material to NOPSEMA in accordance with paragraph 11(c) of this instrument. Request for further information after resubmission  (8) If:  (a) the Regulator made a request for further information to the proponent under subregulation 5D(2) of the old Regulations; and  (b) the proponent had not provided the information before the commencement day; and the request is taken to have been made by NOPSEMA under section 12 of this instrument.
