If: (a) the Regulator has given the operator of an activity a notice under subregulation 24(2) of the old Regulations of the Regulator’s intention to withdraw acceptance of the environment plan for the activity; and (b) the Regulator has not made a decision whether to withdraw acceptance of the environment plan; the notice has no effect.
