#### 108 Commonwealth‑State offshore area—provisional renewal of an exploration licence (1) The Joint Authority for a Commonwealth‑State offshore area must provisionally renew an exploration licence if: (a) the Designated Authority refers the renewal application to the Joint Authority under section 107; and (b) the applicant has complied with: (i) this Act; and (ii) the regulations; and (iii) the licence conditions. > Note 1: Under section 89, the renewal of the licence cannot be effective before it is registered (see section 334 for registration). The renewal will not be registered until it has been properly accepted (see section 114 for proper acceptance). > Note 2: Under section 118, new conditions may be imposed on renewal. (2) If subsection (1) does not require the Joint Authority to provisionally renew the licence, the Joint Authority may: (a) provisionally renew the licence; or (b) refuse to renew the licence.
