Offshore Electricity Infrastructure (Regulatory Levies) Act 2021

The Act codifies a narrow set of statutory concepts and delegates detailed design to regulation. Primary concepts are:

• Offshore electricity infrastructure levy: defined in s 7 by reference to “levy imposed by section 8.” The Act therefore treats the levy as whatever obligations the regulations ultimately create under the authority of s 8 and s 9.

• Offshore electricity infrastructure licence holder: a person who is the holder of a licence within the meaning of the Offshore Electricity Infrastructure Act 2021 (s 7). The Act does not define licences itself; it refers to the other Act for that legal characterisation. That cross‑reference fixes administrative responsibility for identifying licence holders to the licensing regime established elsewhere.

• Offshore infrastructure activity: has the same meaning as in the Offshore Electricity Infrastructure Act 2021 (s 7). Again, the substantive scope of activity attracting levy liability depends on that separate Act’s definition or on regulations that may prescribe kinds of activities for levy purposes (s 8(1)(b)).

• Regulator and Registrar: both defined by reference to the Offshore Electricity Infrastructure Act 2021 (s 7). The Act contemplates that regulatory or compliance activity undertaken by the Commonwealth, the Regulator or the Registrar may be a base for levying amounts (s 8(3)(b)). That concept links the levy to the administrative activities connected to licensing and oversight in the parallel Act.

• Regulations as primary design tool: sections 8(2), 9 and 10 give the regulations power to differentiate levy kinds, prescribe amounts or methods, and address matters necessary or convenient to give effect to the Act. The Governor‑General makes regulations under s 10. The Act therefore establishes a framework that is intentionally light on operational detail and heavy on delegated rule‑making.

Structural limits and reach are also main concepts. The Act binds the Crown in right of the States and the self‑governing territories, but does not bind the Crown in right of the Commonwealth (s 3). It does not impose a tax on property of a State (s 4), which preserves the constitutional protection referenced in s 114 of the Constitution by cross‑reference (s 4(2)). Territorial application is affirmative: the Act extends to specified external Territories (s 5) and applies extra‑territorially (s 6).

Finally, commencement mechanics matter. The whole Act commences at the same time as the Offshore Electricity Infrastructure Act 2021 (noted as 2 June 2022 in the commencement table in s 2). This links timing and operability to the companion Act that establishes the licensing and regulatory regime to which the levy attaches.

The Act identifies two categories of persons who may be subject to levy liabilities. First, an offshore electricity infrastructure licence holder (s 8(1)(a)). Whether an entity is a licence holder is determined by the licensing regime in the Offshore Electricity Infrastructure Act 2021 because the Act imports that definition (s 7). Any person who holds such a licence therefore faces potential levy obligations once regulations prescribe applicable levies.

Second, the Act permits the regulations to impose levies on persons who engage in prescribed kinds of offshore infrastructure activity (s 8(1)(b)). The list of activities is not in the Act; it is left to the regulations to prescribe which offshore infrastructure activities attract a levy. That creates a category defined by delegated rule‑making rather than the primary statute.

Entities that are the Crown in right of a State, the Australian Capital Territory or the Northern Territory are bound by the Act (s 3). However, the Crown in right of the Commonwealth is not bound (s 3). Practically, this distinction affects whether Commonwealth entities , for example a Commonwealth agency that might be a licence holder under the companion Act , are subject to levy liability, because the Act explicitly does not bind the Commonwealth Crown.

The Act expressly excludes a tax on property of any State (s 4(1)) and clarifies that “property of any kind belonging to a State” carries the meaning given by s 114 of the Constitution (s 4(2)). That means State‑owned property, as constitutionally defined, is not to be subject to the levy if the levy would be a tax on such property.

Geography: the Act applies to the external Territories listed in s 5 (Norfolk Island; Christmas Island; Cocos (Keeling) Islands; Ashmore and Cartier Islands; Heard Island and McDonald Islands; Coral Sea Islands Territory). The Act also applies extraterritorially to acts and omissions outside Australia (s 6). That extends potential liability beyond mainland Australia and its internal territories, enabling the levies to attach to offshore activities that may occur outside ordinary territorial limits, subject again to how the companion Act and regulations define the relevant activity and persons.

Who decides is implicit in the statute. The Governor‑General makes regulations under s 10. The Regulator and Registrar, defined by the companion Act, appear in the statutory test for certain levies under s 8(3)(b), which ties liability to regulatory or compliance activities those agencies undertake. In short, regulated parties (licence holders or prescribed activity participants) pay; administration and definitional detail are determined by the licensing regime in the Offshore Electricity Infrastructure Act and by regulations made by the Governor‑General.

Duties in this Act are primarily negative in formulation but imply affirmative compliance obligations once regulations are made. The central statutory duty is that an offshore electricity infrastructure levy is imposed on specified persons: offshore electricity infrastructure licence holders and persons engaging in prescribed offshore infrastructure activities (s 8(1)). That creates the legal obligation to pay whatever levies are prescribed. The Act permits differentiation of levies for licence holders (s 8(2)) and specifies that levies for licence holders may relate to the period the licence is held or to regulatory or compliance activities undertaken by the Commonwealth, the Regulator or the Registrar that relate to the licence (s 8(3)).

Rights in the Act are mainly negative or protective in character. Section 4 provides that the Act does not impose a tax on property of a State (s 4(1)). This is framed as an immunity that preserves the constitutional protection for State property (s 4(2) cross‑referring to s 114 of the Constitution). Section 3 binds the Crown in right of the States and territories but excludes the Crown in right of the Commonwealth from being bound (s 3). This creates an implicit right (or limitation) for the Commonwealth Crown that it will not be bound by the Act as written.

Because the Act leaves amounts and methods to regulation it does not itself define payment timelines, collection authorities, recovery methods, objection or review procedures, or penalties. Those procedural and enforcement rights and duties will depend entirely on what the regulations prescribe under s 10, and potentially on other statutes that the regulations rely on. The Act permits regulations to prescribe matters required or permitted by the Act, or necessary or convenient for carrying the Act into effect (s 10). Thus the duty to make payment, the timing of any payment, and any rights to review or object are rights and duties that will arise only once regulations are made.

Other procedural duties follow from the imported definitions. A person who is an offshore electricity infrastructure licence holder will have duties imposed by the licensing regime in the Offshore Electricity Infrastructure Act 2021; the levy is an additional statutory overlay tied to that licensing status (s 7). The Act therefore implies a duty on licence holders to monitor the regulatory environment to understand when and how levies will be applied, because levy kinds, amounts and methods are delegated to regulations (ss 8-10).

Finally, the commencement mechanism in s 2 links when duties start to the commencement of the companion Act. Stakeholders therefore have a statutory cue for when to expect levy obligations to become operable.

The Act text supplied contains no express offences, penalty provisions, collection mechanisms, interest provisions, debt recovery processes, or administrative appeal rights. The legislative architecture therefore separates substantive liability from enforcement mechanics. Sections 8 and 9 create the head of power to impose levies and to set amounts or methods via regulation, and s 10 authorises the Governor‑General to make regulations necessary or convenient to give effect to the Act. The absence of penalty or enforcement provisions in the primary Act means that any penalties, obligations to provide information, recovery mechanisms or sanctions will need to be created by regulation or exist under other statutes that the regulations invoke.

Because the Act does not itself prescribe collection or enforcement, several consequences follow from the statutory text:

• Enforcement depends on secondary legislation or administrative procedures. The Governor‑General’s regulation‑making power in s 10 is the available vehicle to prescribe enforcement details. Until such regulations exist, the Act alone does not specify how the Commonwealth will collect unpaid levies, whether levies will be a civil debt, whether non‑payment will attract penalties or interest, or whether the Regulator has power to suspend licences for non‑payment.

• Procedural safeguards and review rights are not set in the Act. Any rights of objection, review, or merits review must be found in regulations or in other statutes. The Act itself does not provide for judicial review exclusions, nor does it create statutory review channels.

• Division of administrative responsibility is not specified. The Act refers to the Regulator and Registrar (s 7) and to regulatory or compliance activities that may form the basis of a levy (s 8(3)(b)), which implies those agencies might be involved in identifying levy events. However, the Act does not designate the agency responsible for billing, collecting or enforcing payment. That operational allocation is a matter for regulations or administrative instruments.

• Constitutional limitations remain relevant. Section 3 and s 4 impose limits on who can be bound and on taxes on State property. Enforcement against State property potentially conflicts with s 4. Enforcement design must therefore be attentive to those protections.

Practitioners should therefore locate the regulations made under s 10 to identify the enforcement regime and any sanctions. If regulations have not yet been made, enforcement options under the Act are legally indeterminate from the Act text alone. The delegated nature of enforcement means compliance risk for affected parties will depend significantly on regulatory drafting choices and associated administrative practice.

The Act is deliberately short and designed to interact with at least two other legal instruments: the Offshore Electricity Infrastructure Act 2021 (referenced repeatedly) and any regulations made under s 10. The Act imports key definitions from the Offshore Electricity Infrastructure Act 2021: offshore electricity infrastructure licence holder, offshore infrastructure activity, Registrar, and Regulator (s 7). Consequently, the scope of levy liability, the identity of regulated parties, and the administrative bodies for oversight are contingent on the definitions and powers in that companion statute. The commencement of this Act is explicitly tied to the commencement of the Offshore Electricity Infrastructure Act 2021 (s 2), so the two Acts operate in tandem.

Constitutional law interaction is explicit. Section 4 protects property of a State from being taxed by this Act, aligning the Act with s 114 of the Constitution by cross‑reference (s 4(2)). Section 3 binds the Crown in right of the States and the territories but does not bind the Commonwealth Crown. This creates a legal interaction with Crown immunity rules and may require coordination between federal and State entities when the latter are licence holders.

Because the Act leaves amounts and enforcement to regulation, it will likely interact with general Commonwealth financial and revenue collection frameworks once regulations are made. Section 10 allows regulations to be made that are “necessary or convenient,” which could mean the Regulations may specify collection, remittance, accounting and audit treatment, and possibly interactions with general revenue Acts or the Public Governance, Performance and Accountability framework. The Act itself, however, does not incorporate such frameworks by text; any interaction will be enacted by regulation.

Administrative law and judicial review interactions are also implicated. The Act gives regulatory authorities (the Regulator and Registrar) a role in the factual matrix for some levies (s 8(3)(b)), which raises questions about administrative decision‑making powers. Procedural fairness, merits review, and judicial review principles will apply to decisions taken under the regulations, subject to any valid legislative exclusion. The Act does not itself limit judicial review or prescribe privative clauses.

The Act’s extra‑territorial application (s 6) suggests potential interaction with private international law and statutes governing extraterritorial jurisdiction. Where offshore infrastructure activity occurs partly outside Australian territorial limits, enforcement and applicability will depend on the companion Act’s jurisdictional tests and on the regulations’ design.

Finally, other taxation and surcharge laws may interact. Because the Act is framed as a levy and not a tax on State property (s 4), tax characterisation for other purposes including GST, income tax deductibility, or tariff treatment will depend on how regulations describe the levy and on existing tax laws. The primary Act does not itself settle those cross‑statute tax characterisations.

The Act as supplied contains a commencement table in section 2 that records the original enactment commencement arrangement. The table states that the whole of this Act commences at the same time as the Offshore Electricity Infrastructure Act 2021, and records the commencement date as 2 June 2022 in the table (s 2). The Act explicitly notes the table relates only to the provisions as originally enacted and will not be amended in the Act text to reflect later amendments (s 2 note). No other amendment history, later amendments, or subsequent legislative changes are recorded in the supplied text.

Section 2(2) contains a drafting note that any information in column 3 of the commencement table is not part of the Act and may be inserted or edited in published versions. That indicates the statute’s structure contemplates annotated commencement metadata but is not substantive law.

Because the supplied Act contains no schedules or transitional provisions beyond the commencement linkage to the companion Act, the text does not reveal any later amendments. The Act is short and delegation‑centric, so most operational change will occur through subordinate legislation (regulations) rather than frequent statutory amendment. For any concrete record of amendments after the original enactment, interested practitioners must consult an updated legislative history in an authorised legal database or the consolidated Act as published by the Commonwealth.

In the absence of any explicit amendment clauses in the Act text provided, the statutory mechanics for future change remain standard: Parliament may amend the Act by later statute; the Governor‑General may make regulations under s 10 within the Act’s delegated envelope. The Act as enacted creates the regulatory head of power but not a complex amendment schedule.

The supplied Act text contains no recorded litigation history. There are no references to judicial decisions, no transitional disputes noted in the statutory text, and no annotations reporting litigation. Because the Act is a short, enabling statute that leaves most operational matters to regulation, litigation plausibly will arise in relation to the regulations or to actions taken under the companion Offshore Electricity Infrastructure Act 2021, but none is recorded in the Act itself.

Where litigation might later arise, it would likely hinge on some of these points that are visible from the Act:

• Characterisation of the levy as a tax or fee, and whether particular charges fall within the constitutional prohibitions on taxing State property (s 4). Section 4(2) explicitly links the concept to s 114 of the Constitution. Any dispute about the levy’s character as a tax on State property could attract constitutional litigation.

• Whether persons are properly within scope as licence holders or as engaging in prescribed offshore infrastructure activities, because those definitions are imported from the Offshore Electricity Infrastructure Act 2021 (s 7). Disputes would likely involve interpretation of that companion Act.

• Enforcement actions taken under regulations made pursuant to s 10, particularly if those regulations include penalties or administrative sanctions that parties challenge as beyond the delegated power or inconsistent with the parent Act.

• Extra‑territorial application (s 6) could prompt jurisdictional challenges if the Commonwealth seeks to enforce levies in relation to activities entirely outside Australia or on entities without sufficient connection to the Australian legal order.

The Act’s silence on collection and enforcement mechanics makes it likely that initial litigation would centre on the validity of regulations and administrative actions rather than on interpretations of substantive levies in the Act itself. For current case law or decisions, consult up‑to‑date legal databases because the Act text provided does not record any judicial determinations.

The Act is compact but has several drafting features that create practical pitfalls for regulated parties and advisers. These are matters to note and to monitor, referenced to the Act clauses:

• Reliance on definitions outside the Act. Key terms , offshore electricity infrastructure licence holder, offshore infrastructure activity, Regulator, Registrar , are defined in the Offshore Electricity Infrastructure Act 2021 (s 7). You must consult that companion Act to determine scope. Treat the levy as inseparable from the licensing regime; do not assume the meaning of “licence holder” from this Act alone.

• No enforcement machinery in the primary Act. The Act does not set out collection procedures, enforcement powers, interest for late payment, or penalties (there are no penalty provisions in the supplied text). Enforcement will depend on regulations made under s 10 or on other statutes. Absent regulations, liability and practical collection are indeterminate.

• Broad delegated regulation‑making power. Section 10 allows regulations to be made for matters necessary or convenient to give effect to the Act. Section 8(2) explicitly permits the regulations to prescribe different kinds of levy. That breadth enables significant operational design in subordinate instruments. The regulatory drafting choices will materially determine compliance burden, administrative costs and rights to review. Practitioners should not assume limited regulatory scope.

• Levies can be linked to regulatory or compliance activities. Section 8(3)(b) allows a levy to relate to regulatory or compliance activities undertaken by the Commonwealth, the Regulator or the Registrar that relate to the licence. That is a potentially expansive base: it allows levies reflecting administrative costs, oversight work, or compliance monitoring tied to a licence. The practical effect will depend on how regulations define and measure those “regulatory or compliance activities.”

• Differentiated levy kinds for licence holders. Section 8(2) permits different kinds of levy imposed on licence holders. This creates complexity in billing and forecasting because multiple levy types could apply to a single licence holder in different circumstances, including some tied to time periods (s 8(3)(a)).

• Crown and State limits. Section 3 does not bind the Commonwealth Crown, but it does bind the Crown in right of each State and of the self‑governing territories. Section 4 precludes the Act imposing a tax on property of a State. These constitutional carve‑outs may produce asymmetric treatment of government bodies and require specific drafting in regulations to avoid unconstitutional imposition.

• Extra‑territorial reach and external territories. Sections 5 and 6 extend application to specified external Territories and to acts, omissions, matters and things outside Australia. This breadth may create jurisdictional complexity. The companion Act and regulations must be examined to determine how offshore activities beyond territorial limits are captured and enforced.

• Timing dependency. The Act’s commencement depends on the commencement of the Offshore Electricity Infrastructure Act 2021 (s 2). Levy obligations will therefore follow licensing regime commencement. Practitioners should not assume levies are in force independently of the licensing regime.

• No transitional or savings provisions in the primary Act. The Act includes no express transitional arrangements for existing activities or licences. If that is to be addressed, regulations or the companion Act will need to provide transitional rules; absent them, legal uncertainty can arise at the outset.

• Ambiguity on administrative responsibility. Although the Act references the Regulator and Registrar, it does not allocate collection, billing or audit functions to them expressly. The delegation of those tasks will be a regulatory design choice.

• Interactions with tax law unresolved. The Act calls the instrument a “levy” and expressly excludes taxation of State property (s 4), but the tax treatment for other purposes (GST treatment, income tax deductibility, etc.) is not addressed. That may create secondary tax compliance issues.

These “gotchas” are not assertions of illegality. They are structural features in the Act that create compliance and implementation risk until regulations and administrative practice clarify operational detail.

Compliance is largely a forward‑looking exercise in regulatory monitoring, administrative preparedness and contractual allocation because the Act delegates most operational detail to regulations. The following are practical steps grounded in the Act’s provisions:

1. Determine licence status under the Offshore Electricity Infrastructure Act 2021. The Act imposes levies on offshore electricity infrastructure licence holders (s 8(1)(a)). The definition of licence holder is imported from the companion Act (s 7). Practitioners must examine the companion Act and any licences issued under it to confirm whether an entity is a licence holder liable to pay levies.

2. Monitor regulations under s 10. Amounts and methods are set by regulation (s 9). The regulations may also prescribe kinds of offshore infrastructure activity that attract levies (s 8(1)(b)), differentiated levy kinds (s 8(2)), and enforcement mechanisms (s 10). Subscribe to official legislative instruments, notifications from the Regulator/Registrar, and government gazettes to capture regulation drafts and final instruments.

3. Budget and contractual allocation. Because levies will be imposed on licence holders or on persons engaging in prescribed activities (s 8), entities should model potential levy exposure and consider contract clauses that allocate levy costs between project parties, suppliers and customers. The Act allows levies to be related to licence holding periods and regulatory/compliance activities (s 8(3)), which means charges may be ongoing or event‑based and could be passed through under commercial arrangements. Review existing and future contracts for express or implied allocation of statutory levies.

4. Check Crown status and State property issues. If the entity is the Commonwealth Crown, note s 3 that the Act does not bind the Crown in right of the Commonwealth. If State property is involved, s 4 may provide immunity from taxation. Seek legal advice where government entities are parties or where property is State‑owned to avoid misapplied levy obligations.

5. Prepare administrative systems. Anticipate that regulations will specify payment schedules, reporting obligations and possible record keeping. Establish invoicing and accounting workflows that can accommodate multiple levy kinds and different calculation methods (s 9). If the Regulator or Registrar is likely to be involved in identifying levy triggers (s 8(3)(b)), ensure communications and compliance points of contact are established.

6. Engage in consultation on regulations. Section 10 empowers the Governor‑General to make regulations. Regulatory instruments are typically subject to a consultation process. Participate in statutory or administrative consultation to shape definitions, calculation methods and enforcement design, and to highlight practical compliance burdens and costs.

7. Plan for enforcement and dispute resolution. The Act does not set enforcement rules. When regulations are made, they will indicate collection and remedies. Until then, prepare to use ordinary dispute resolution mechanisms and administrative review pathways that will apply to decisions made under the regulations, including judicial review if necessary.

8. Review tax and accounting treatment. Because the Act does not specify whether the levy is a tax, fee or charge for other statutory purposes, consult tax advisers to determine deductibility, GST treatment and reporting requirements once the regulations specify the levy character and amounts.

9. Document compliance-related costs. The Act contemplates levies that may relate to regulatory or compliance activities (s 8(3)(b)), which potentially reflects a cost recovery approach. Keep records of regulatory interactions and compliance costs to engage with cost allocation discussions or if challenged on levy amounts.

10. Watch commencement linkages. The Act commences with the Offshore Electricity Infrastructure Act 2021 (s 2). Coordinate compliance readiness with the companion Act’s implementation timeline.

These steps reflect the Act’s heavy reliance on subordinate regulation for operational detail. The immediate compliance need is therefore informational: know whether you fall within the levy base under the companion Act and regulations, and be ready to adjust commercial, accounting and administrative systems once regulations promulgate precise levy mechanics.
