What it does
This instrument, the Offshore Electricity Infrastructure (Declared Area OEI‑01‑2024) Declaration 2024, is a legislative instrument made under section 17 of the Offshore Electricity Infrastructure Act 2021 (the Act). It performs two mechanical functions. First, it formally declares a defined area of Commonwealth waters off the coast of Victoria (near the vicinity of Portland) as a declared area for the purposes of the Act. The area is specified by a table of coordinates in Schedule 1, using the Geocentric Datum of Australia (GDA94), and a simplified map is included in Schedule 2. The legal effect of declaring an area under section 17 is that it becomes available for the grant of licences under the Act: feasibility licences, research and demonstration licences, and commercial licences. Without such a declaration, no licence can be granted for offshore electricity infrastructure in that part of the Commonwealth offshore area. Second, the instrument imposes mandatory conditions on two categories of licences granted in respect of this declared area (or any part of it). For feasibility licences and research and demonstration licences, the licence holder must consult the Australian Maritime Safety Authority (AMSA) and the Department of Defence when preparing a management plan, and must address the outcomes of that consultation in the plan. For feasibility licences only, an additional condition requires consultation with holders of fishing concessions under the Commonwealth Fisheries Management Act 1991 or licences under the Victorian Fisheries Act 1995 that can be exercised in the licence area. If those concession or licence holders have nominated a representative organisation, consultation must be with that organisation; otherwise, directly with the holder. The management plan must then address the outcomes of the consultation, including how impacts on those holders may be avoided, mitigated, or offset. The instrument does not itself create any new rights or obligations for commercial licence holders; they are not subjected to these specific conditions by this declaration. The note to section 6 confirms that licences will also be subject to other conditions under sections 35, 45 and 54 of the Act, which are not elaborated here. The instrument commenced the day after registration (likely early March 2024). Its practical effect is to trigger the licensing framework for offshore renewable energy projects in a specific offshore zone, while imposing upfront consultation burdens on early‑stage licence holders that are not required for later commercial licences (at least not by this declaration).
