235 Section 92 (contents of provisional improvement notice)

Section 92 of the Work Health and Safety Act applies as if it were substituted with the following section:

92 Contents of provisional improvement notice

A provisional improvement notice must state: (a) that the health and safety representative believes the person: (i) is contravening a provision of this Act, or a requirement of a management plan; or (ii) has contravened a provision of this Act, or a requirement of a management plan, in circumstances that make it likely that the contravention will continue or be repeated; and (b) the provision or requirement the representative believes is being, or has been, contravened; and (c) briefly, how the provision or requirement is being, or has been contravened; and (d) the day, at least 8 days after the notice is issued, by which the person is required to remedy the contravention or likely contravention.
