22  Transitional—hazardous substance—risk assessment

  A risk assessment, within the meaning of Part 2 of the old national standards regulations, that was:

 (a) undertaken before the commencement day in accordance with subregulations 2.15(3), (4) and (5) of those regulations (including a risk assessment as revised under subregulation 2.15(9) of those regulations); and

 (b) valid immediately before commencement day;

is taken, on the commencement day:

 (c) to be a risk assessment undertaken in accordance with subclause 13(3) of Schedule 1 to this instrument; and

 (d) for the purposes of subclause 13(8) of Schedule 1 to this instrument—to have been first completed on the day the risk assessment was first completed under the old national standards regulations.
