175 Offences against certain regulations (1) An offence against any of the following regulations that is committed on or after the commencement of this Part is not an indictable offence despite anything to the contrary in those regulations— (a) regulation 301, 304, 306 or 801 of the Occupational Health and Safety (Major Hazard Facilities) Regulations 2000; (b) regulation 9 of the Occupational Health and Safety (Manual Handling) Regulations 1999. (2) Despite the repeal of the old Act, section 47 of that Act continues to apply for the purposes of the regulations made under the old Act that are mentioned in sections 172 to 174. Section 47 of the old Act provides penalties that apply to offences for which no penalty is expressly provided.
