#### 59 Failure to be sworn or to answer questions (1) A person appearing as a witness must not: (a) fail to comply with a requirement by a member of the Commission to be sworn or to make an affirmation; or (b) fail to answer a question that he or she is required to answer by a member of the Commission; or (c) fail to produce a document that he or she was required to produce by a summons served on him or her. > Note: A person who breaches section 59 may be subject to a criminal prosecution (see Schedule 2).
