31 Resignation etc. of health and safety representative

(1) A person must cease to be the health and safety representative for the designated work group if: (a) the person resigns as the health and safety representative; or (b) the person ceases to be an employee included in the designated work group; or (ba) the designated work group is varied under subsection 24(6) and the variation results in a change to the membership of the group; or (c) the person’s term of office expires without the person having been selected, under section 25, to be the health and safety representative for the designated work group for a further term; or (d) the person is disqualified under section 32. (2) A person may resign as the health and safety representative for a designated work group by notice in writing delivered to the employer of the employees in the group. (3) If a person resigns as the health and safety representative for a designated work group, the person must notify the employees included in the group of the resignation.
