Nuclear Waste Storage (Prohibition) Act 1999

Definitions and territorial reach. The Act centres on three statutory concepts: nuclear waste, nuclear waste storage facility, and transport in the State. "Nuclear waste" is defined in s 3(1) as material that contains a radioactive substance and is either waste of a nuclear plant or results from the testing, use or decommissioning of nuclear weapons. The Act imports the definition of "radioactive substance" from the Radiation Safety Act 1975 (s 3(1)), so technical characterisation of what counts as radioactive will depend on that external statutory definition. The Act narrows what is included by excluding waste that arises from the use of products of a nuclear plant (s 3(2)). The term "nuclear waste storage facility" is defined as any installation for the storage or disposal of nuclear waste (s 3(1)).

Territorial coverage for transport is deliberately broad. Section 3(3) states that a person transports nuclear waste in the State whether or not the origin or destination of the waste is a place to which this Act applies. That is, transit through Western Australia is captured; the Act does not limit application to domestic origin or destination points. This has operational implications for cross-border shipments, port calls and overland transit.

Criminal, summary and officer liability. The Act establishes criminal offences for constructing or operating a nuclear waste storage facility or using any place in the State for storage/disposal (s 7(1)-(2)), and for transporting nuclear waste in the State (s 7A(1)-(2)). Maximum fines for both are $500,000 (ss 7(2), 7A(2)). Proceedings for contraventions are directed to a magistrates court (s 7(4), s 7A(4)). The Act makes clear that Criminal Code section 39, which deals with liability of officers of bodies corporate, applies to offences under ss 7(2) and 7A(2) (s 8). That attaches potential officer-level criminal liability where a corporate body commits an offence.

Injunctions and preventive relief. The Minister may apply for injunctions to prevent construction, operation, use or transport or activities that would facilitate or assist those matters (s 8A(1)). An unusual procedural feature is that the Minister need not prove that the act sought to be restrained has previously occurred or is likely to occur (s 8A(2)). Courts may grant interim injunctions and are not to require an undertaking as to damages or costs as a condition of granting interim relief (ss 8A(3)-(4)). The Act expressly provides that injunction proceedings do not affect criminal proceedings (s 8A(5)).

Public funding prohibition. Section 9 prohibits expenditure of public money or statutory authority money to be expended or granted or advanced to any person for the purpose of, or to encourage or finance, activities associated with development, construction or operation of a nuclear waste storage facility in the State or use of any place for storage or disposal. The Act thus blocks direct State financial support for such projects.

Relationship with other laws and Crown binding. Subsection 5(1) states that the Act has effect notwithstanding any other written law, subject to s 5(2) which preserves authorisations under s 41A of the Radiation Safety Act 1975 that were granted or effected with the consent of both Houses of Parliament under that section. The Act binds the Crown in right of the State and, so far as the State Parliament has competence, in all other capacities (s 6).

Emergency exceptions. Both the storage/use prohibition and the transport prohibition contain emergency exceptions where actions are taken in response to an emergency to prevent danger to human life or health or irreversible environmental damage (s 7(3), s 7A(3)). These are narrowly framed as situational defences or exemptions and are not expressed as general licences.

Statutory architecture summary. The Act combines definitional gates, criminal penalties, officer liability, injunctive remedies and a prohibition on public funding to create a comprehensive statutory barrier to establishment, operation and movement of nuclear waste storage and disposal activity within the State. It explicitly preserves a narrow path for parliamentary-granted authorisations under the Radiation Safety Act and sets emergency carve outs.

Direct regulated parties. The Act expressly regulates "a person", a term that includes the Crown in all its capacities (s 3(1) and s 6). That means private persons and corporations, government entities and statutory authorities can fall within its prohibitions. Specifically, entities proposing to construct, operate or use land in Western Australia as a nuclear waste storage facility are prohibited from doing so (s 7(1)). Entities or individuals involved in transporting nuclear waste through or within the State are also prohibited (s 7A(1)). The Act’s definition of "nuclear waste" (s 3(1)) delineates the materials covered; businesses handling materials that contain a "radioactive substance" and that fall within the listed categories will be affected.

Officers of corporations. The Act imports Criminal Code section 39 to apply to offences under ss 7(2) and 7A(2) (s 8). That subjects directors, company secretaries and other officers to possible criminal liability for corporate contraventions unless they can avail themselves of the defences provided by the Criminal Code. Practising lawyers and compliance officers advising corporate actors should note that organisational compliance failures may attract officer-level consequences.

Government decision makers and funders. The prohibition on public money or statutory authority money being used to fund or encourage development, construction or operation of a nuclear waste storage facility or the use of any place for storage/disposal affects public authorities, statutory agencies, and ministers with budgetary or grant-making powers (s 9). Procurement officers and grant administrators must ensure neither direct funding nor financial inducement occurs for these activities. Because the statute binds the Crown (s 6), state agencies are directly constrained in their actions. The Act preserves a path for authorisations granted under s 41A of the Radiation Safety Act 1975 only where those authorisations had parliamentary consent under that section (s 5(2)), which narrows possible State-endorsed exceptions to a formal parliamentary process.

Service providers and financiers. The Act’s injunction provision covers conduct that would "facilitate or provide assistance" in relation to construction, operation, use or transport (s 8A(1)). That language can reach a broad class of service providers, including engineering contractors, transport operators, insurers, consultants, financiers and ports and logistics businesses that might otherwise participate in or enable a storage, disposal or transport activity. The threat of injunctions and criminal penalties may therefore dissuade commercial parties from entering into contracts or providing services that could be characterised as facilitation within the State.

Emergency responders and health services. The Act contains emergency exceptions (s 7(3), s 7A(3)) that permit construction, operation, use or transport in response to emergency situations to prevent danger to human life or health or irreversible environmental damage. Emergency services, hospitals and agencies involved in receiving or moving radioactive materials in crisis situations must document the protective purpose of their actions to rely on these exceptions. The narrow wording suggests an exception limited to immediate emergency mitigation rather than planned movements.

Regulators and courts. Regulators administering the Radiation Safety Act 1975 will remain relevant because the definition of "radioactive substance" is imported from that Act (s 3(1)), and because s 5(2) preserves certain parliamentary-consented authorisations under that Act. Courts, specifically magistrates courts, are the primary forum for criminal proceedings under ss 7 and 7A (s 7(4), s 7A(4)), while superior courts will be the forum for injunctions sought by the Minister under s 8A.

Indirectly affected stakeholders. Landowners, local governments, ports, regional economies, waste generators and the broader supply chain in energy, mining and defence sectors may be indirectly affected by the prohibitions. The public-funding bar in s 9 affects public-private partnerships and any proposals that depend on State financial support. Because the Act applies notwithstanding other written laws (s 5(1)), proponents who might otherwise pursue projects under alternative statutory regimes must take this Act into account.

Duties created by the Act. The Act imposes affirmative prohibitions which operate as duties to refrain. The principal duties are to refrain from constructing or operating a nuclear waste storage facility or using any place in the State for storage or disposal of nuclear waste (s 7(1)), and to refrain from transporting nuclear waste in the State (s 7A(1)). There is also a statutory duty on public authorities and statutory bodies not to expend, grant or advance public money or statutory authority money to any person for the purpose of, or to encourage or finance, activities associated with the development, construction or operation of a nuclear waste storage facility in the State or the use of any place in the State for storage or disposal (s 9).

Obligations on corporate officers. The application of Criminal Code section 39 to offences under ss 7(2) and 7A(2) (s 8) places a compliance duty on corporate officers to take reasonable steps to prevent offences by their corporations. The Criminal Code provides for officer liability where they consented to or were negligent regarding the corporation’s conduct. The Act does not itself prescribe compliance programs, but officer liability will incentivise governance and risk controls.

Ministerial enforcement powers. The Minister has the explicit right to apply for injunctions to prevent conduct that would involve construction, operation, use or transport, and to prevent conduct that would facilitate or assist those matters (s 8A(1)). The Minister’s right to seek interim injunctions without the need to show past or probable future acts (s 8A(2)-(3)), and without the court requiring an undertaking as to damages for interim relief (s 8A(4)), enhances the State’s capacity to pursue preventive remedies quickly.

Rights of defendants and procedural directions. Defendants have the ordinary criminal-law rights and protections in the magistrates court for proceedings under ss 7 and 7A (s 7(4), s 7A(4)). The Act does not alter evidentiary rules or penalties beyond specifying the fine ceiling and the forum. Regarding injunctions, the Act limits usual interim-relief conditions by removing the requirement for an undertaking as to damages (s 8A(4)), which changes the balance normally required to obtain interlocutory relief and affects potential defendants’ procedural positions in injunction applications.

Emergency exceptions. The Act confers a limited right to act in emergency situations. Both the storage/use prohibition and transport prohibition do not apply where the action "results from an emergency situation" and is carried out to prevent danger to human life or health or irreversible environmental damage (s 7(3), s 7A(3)). These carve outs create conditional rights to carry out otherwise prohibited acts, but the Act does not prescribe the procedures for recording or proving that an action qualifies as an emergency exception.

Interaction with other statutory authorisations. Section 5(2) preserves authorisations under s 41A of the Radiation Safety Act 1975 granted or effected with the consent of both Houses of Parliament. This provides a specific statutory right for those fortunate to have obtained that particular parliamentary consent; otherwise, s 5(1) gives this Act precedence over other written laws. Practically, that means ordinary permits or licences under other regimes will not be a defence to contravening this Act unless the narrow s 5(2) route has been followed.

Binding the Crown. The Act binds the Crown (s 6). That means government entities must comply with the prohibitions and the public-money ban in the same ways as private actors, except to the extent the Crown’s constitutional or statutory powers may otherwise permit. The inclusion of the Crown in the definition of "person" (s 3(1)) and the separate binding clause (s 6) reinforce that public authorities have the same duties as other actors.

Right to seek injunctive relief. The Minister's power to seek injunctions is framed as a right to apply to a court (s 8A(1)). The court has discretion to grant interim or final injunctions, and the Act relaxes two common requirements for interim relief: proof of prior acts or likelihood of future acts (s 8A(2)) and an undertaking as to damages (s 8A(4)). This confers a comparatively strong preventative enforcement tool in favour of the Minister.

Criminal penalties and forum. The Act prescribes criminal offences with monetary maximum penalties. A person who constructs or operates a nuclear waste storage facility in the State or uses any place for storage/disposal commits an offence punishable by a fine not exceeding $500,000 (s 7(2)). The same maximum penalty applies to transporting nuclear waste in the State (s 7A(2)). Proceedings for both contraventions are to be dealt with by a court constituted by a magistrate (s 7(4), s 7A(4)), which indicates summary jurisdiction and associated procedural rules will apply.

Officer liability. Section 8 expressly applies Criminal Code section 39 to offences under ss 7(2) and 7A(2). Criminal Code section 39 allocates criminal liability to officers of a body corporate where the offence was committed with their consent, connivance or wilful neglect, subject to available defences in the Criminal Code. This therefore expands enforcement beyond the corporate entity to reach responsible individuals, increasing enforcement leverage and compliance pressure on officers.

Ministerial injunction powers. The Minister may apply for injunctions to prevent construction, operation, use or transport, or to restrain facilitation and assistance relating to those matters (s 8A(1)). The Act reduces normal procedural hurdles in the Minister’s favour. The Minister need not prove that the act sought to be restrained has previously occurred or is likely to occur if not restrained (s 8A(2)). Interim injunctions may be granted and the court is not to require an undertaking as to damages or costs as a condition of granting interim relief (ss 8A(3)-(4)). Those provisions lower the practical threshold for obtaining interlocutory relief.

Concurrent remedies. Section 8A(5) states that taking injunction proceedings does not affect the bringing or continuation of criminal proceedings under the Act. That enables the State to pursue preventive civil remedies and subsequent criminal sanctions in parallel. The statutory architecture therefore supports both immediate preventive intervention and retrospective punitive enforcement.

Public funding prohibition as an enforcement tool. Section 9 creates a non-criminal but enforceable constraint on public expenditure, barring public money or statutory authority money being expended, granted or advanced to any person for the purposes of, or to encourage or finance, activities associated with development, construction or operation of a nuclear waste storage facility or use of any place for storage/disposal. While s 9 does not specify administrative penalties or criminal sanctions, the provision operates as a binding constraint on public decision makers and budgets; contraventions by public officers could trigger administrative remedies, review or internal disciplinary action. The Act's binding of the Crown (s 6) means that government expenditure decisions are governed by this statutory prohibition.

Emergency exception and evidential burden. The Act provides an exception for emergency situations where otherwise prohibited activities are undertaken to prevent danger to human life or health or irreversible environmental damage (s 7(3), s 7A(3)). The Act does not set out evidentiary or procedural requirements for invoking the emergency exception; in enforcement proceedings a defendant would bear the task of establishing the exception applies, which would create litigation on factual thresholds in prosecutions or civil defences.

Magistrates’ court jurisdiction implications. The choice of magistrates’ court for criminal proceedings (s 7(4), s 7A(4)) likely means cases are processed under summary procedures, with limits on maximum penalties and evidential processes calibrated for that forum. Prosecutors must weigh the choice of summary jurisdiction against strategic objectives, but the Act fixes the forum. Injunction proceedings, by contrast, will be brought in the appropriate court capable of granting equitable relief; the Act does not specify a forum for injunctive relief, so superior courts will generally be the venue.

Interaction with other written laws and parliamentary authorisations. Section 5(1) states the Act operates notwithstanding any other written law. That confers a legislative trump card in enforcement contexts where other statutory regimes might otherwise authorise storage, disposal or transport. Section 5(2) preserves a particular exception for authorisations under s 41A of the Radiation Safety Act 1975 that were granted with consent of both Houses of Parliament. Enforcement agencies should check for any such parliamentary-consented authorisations when considering a prosecution or injunction.

Statutory primacy. Section 5(1) of the Act provides that it has effect notwithstanding any other written law, subject to the narrow exception in s 5(2). This gives the Act primacy in the Western Australian statutory hierarchy, meaning that authorisations, licences or regulatory permissions granted under other Western Australian written laws will not provide a defence to contravening this Act, unless they fall within the specific parliamentary-consented authorisation route preserved by s 5(2). Practically, proponents cannot rely on, for example, planning approvals or other regulatory permits under Western Australian law to legitimise activities that the Act prohibits.

Radiation Safety Act interplay. The Act imports the meaning of "radioactive substance" from s 4 of the Radiation Safety Act 1975 (s 3(1)). Moreover, s 5(2) preserves authorisations within the meaning of s 41A of the Radiation Safety Act 1975 that have been granted or effected with the consent of both Houses of Parliament. Therefore the Radiation Safety Act is the technical underpinning for what constitutes radioactive material for the purposes of this prohibition, and a narrow parliamentary-consent route under that Act can override the blanket effect of the prohibition. Users must consult both statutes together when assessing legal risk.

Crown obligations and constitutional constraints. The Act binds the Crown in right of the State and in other capacities within the State’s legislative competence (s 6). That ensures State agencies are subject to the same prohibitions. The Act’s operation "notwithstanding any other written law" does not address possible Commonwealth legislative powers or federal constitutional matters. The Act, as presented, does not supply express interaction rules with Commonwealth law; practitioners must consider potential Commonwealth jurisdictional issues, including areas where federal law may authorise activities, although the Act preserves a narrow parliamentary-consent path only for the Radiation Safety Act authorisation.

Criminal Code interface. Section 8 makes Criminal Code section 39 applicable to offences under ss 7(2) and 7A(2). That imports into the enforcement regime general principles concerning officer liability, defences and modes of culpability established in the Criminal Code. Liability of officers for corporate offences will be assessed under the Criminal Code’s framework.

Funding and financial legislation. Section 9 prohibits the expenditure or grant of public money or statutory authority money for the purpose of, or to encourage or finance, development, construction or operation of nuclear waste storage facilities or use of any place for storage/disposal. This intersects with public-sector financial management regimes. The Act refers to definitions of "public money" and "statutory authority money" as those given in s 3 of the Financial Management Act 2006 (s 3(1)), introduced by amendment (see compilation table). That cross-reference means definitions in financial legislation determine the scope of the funding prohibition. Agencies handling budgets and grants must reconcile the Act with public finance statutes.

Planning, environmental and transport laws. The Act does not expressly amend or revoke planning, environmental approvals or transport safety statutes. However the "notwithstanding" clause in s 5(1) indicates that even where other written laws would permit an activity, this Act nevertheless prohibits it. Therefore a proponent with planning approval, environmental licence or transport permit must still comply with this Act. Conversely, the Act does not alter technical compliance requirements under other laws; entities must still observe transport safety and radiation regulation where applicable, subject to the Act’s prohibitions.

Emergency operations and health law. The Act allows for emergency exceptions (s 7(3), s 7A(3)). Those interacting statutes that govern emergency response, health services and hazardous-materials handling will remain relevant when activities are undertaken for emergency remediation, medical response or environmental protection. Practitioners should align statutory emergency powers, incident logs and communications with the evidential thresholds implicit in the Act’s exceptions.

International and interstate movement. Section 3(3) extends coverage of the transport prohibition to movements that occur “in the State” regardless of origin or destination. That means interstate or international shipments that pass through Western Australia will be subject to the Act. The Act does not address international obligations or treaties; where Commonwealth law authorises activity or international agreements are engaged, there may be legal interface issues not resolved within the Act text.

Legislative timeline in the compilation table. The compilation table in the Act provides the explicit amendment history. The original statute, titled Nuclear Waste Storage (Prohibition) Act 1999, was assented to on 7 December 1999 and commenced the same day (Compilation table). It was amended by the Nuclear Waste Storage (Prohibition) Amendment Act 2004 (No. 2 of 2004), assented 1 April 2004, which effected changes commencing 1 April 2004 (Compilation table). Financial Legislation Amendment and Repeal Act 2006 (s 17) amended the Act with assent 21 December 2006 and a commencement date of 1 February 2007 (Compilation table). More recently, the Directors’ Liability Reform Act 2023 (Pt 3 Div 43) amended the Act; it received assent 4 April 2023 and commenced on 5 April 2023 (Compilation table). The reprint cited captures changes as at 6 January 2006 and incorporates the 2004 amendments (Compilation table).

Textual amendments reflected in the Act provisions. The Act text itself notes where sections were inserted or amended. Section 7A (the transport prohibition) and section 8A (injunctions) were inserted by the 2004 amendment (see marginal notes to ss 7A and 8A). Section 8, applying Criminal Code section 39 to officer liability for offences under ss 7(2) and 7A(2), was inserted by the Directors’ Liability Reform Act 2023 (noted in the source: "Section 8 inserted: No. 9 of 2023 s. 110"). The Financial Legislation Amendment and Repeal Act 2006 introduced the cross-reference to the Financial Management Act 2006 in the definitions (s 3(1) definitions of "public money" and "statutory authority money" reference s 3 of the Financial Management Act 2006), as reflected in the compilation table and marginal amendment notes.

Omitted provisions and reprints. The compilation notes that some provisions of other Acts amended by this Act have been omitted under the Reprints Act 1984 (Other notes). Also, the Act’s short title changed at some point (Other notes), and a reprint incorporating earlier amendments was prepared as at 6 January 2006.

Practical effect of amendments. The 2004 amendments materially broadened the statutory scheme by adding a specific prohibition on transportation within the State (s 7A) and by adding an express injunctive power for the Minister (s 8A). These changes moved enforcement mechanics beyond the original facility-construction and use prohibition to cover movement and to give the executive a preventive civil remedy. The 2006 financial amendments clarified the reach of the public-expenditure prohibition by tying the "public money" and "statutory authority money" phrases to the Financial Management Act 2006 definitions. The 2023 amendment adding application of Criminal Code section 39 (s 8) explicitly created officer liability for corporate offences under the Act.

No further amendment record in the compilation. The compilation table lists the principal amending Acts and their dates. The Act's notes show which sections were altered by the named amending Acts; those marginal notes are the authoritative pointers to legislative change. Users should consult the compilation table entries and marginal notes when determining how the Act’s content evolved over time.

No cases listed in the source. The statutory compilation provided does not include any reported litigation history or references to judicial decisions. The Act’s notes and compilation table record legislative amendments but do not record any cases decided under the Act. Therefore the source contains no adjudicated examples of application, interpretation or enforcement.

Types of litigation the Act would generate. Based solely on the Act’s text, several categories of litigation are likely to arise if disputed facts or enforcement actions occur. First, criminal prosecutions under s 7(2) and s 7A(2) would arise where the Crown decides to proceed against persons alleged to have constructed, operated, used or transported nuclear waste in contravention of the statutory prohibitions. Those prosecutions are to be dealt with by a magistrates court (s 7(4), s 7A(4)). Second, the Minister’s exercise of the injunction power in s 8A(1) would generate civil proceedings in which courts would determine whether to grant interim or final injunctive relief. The Act reduces some procedural hurdles for such relief (ss 8A(2)-(4)), and litigation is likely to focus on whether the alleged conduct falls within the statutory prohibitions or the emergency exceptions.

Potential issues for judicial interpretation. Absent case law in the source, courts would likely be asked to interpret core statutory phrases. These include: what constitutes "nuclear waste", a question which imports the meaning of "radioactive substance" from the Radiation Safety Act 1975 (s 3(1)); the scope of "transport in the State" under s 3(3), including whether specific transits, temporary storage during transit or multimodal transfers fall within the prohibition; what acts qualify as "facilitating or providing assistance" such that injunctions may be sought under s 8A(1); the meaning of "emergency situation" and when it satisfies the exception in s 7(3) and s 7A(3); and the proper application of Criminal Code section 39 to corporate officers in prosecutions under ss 7(2) and 7A(2) (s 8).

Procedural and constitutional challenges. Potential litigation might also involve challenges to the Act’s operation vis-à-vis other written laws given s 5(1)’s "notwithstanding" clause, and whether s 5(2) correctly preserves only certain parliamentary-consented authorisations under the Radiation Safety Act 1975. Although the source does not supply cases, litigants could question the interaction with Commonwealth law or the application of the Act to the Crown, given s 6 binds the Crown "so far as the legislative competence of the Parliament of Western Australia extends." Any such constitutional questions fall outside the source content but are foreseeable litigation topics.

Evidence and emergency exceptions disputes. In prosecutions or injunction proceedings, disputes of fact will arise about whether a defendant’s conduct fell within the emergency exception in s 7(3) or s 7A(3). Because the Act does not delineate procedural protocols or evidentiary standards for establishing an emergency, courts would need to address what constitutes adequate proof of emergencies and the necessary causal links to the preventive purpose.

Remedies and interlocutory posture. The Act enables interim injunctions without an undertaking as to damages (s 8A(4)). Litigation around interlocutory relief would therefore engage judicial discretion about whether to grant interlocutory relief under a statutory regime that relaxes two common protections for defendants. Courts will likely consider equity principles, public interest factors and statutory context in adjudicating such applications.

Absence of recorded appellate or reported decisions in the Act. Because the source does not list cases, practitioners must search external legal databases and court records for any prosecutions, injunction applications or appellate rulings applying the Act. The Act’s compilation table and marginal notes do not provide litigation references.

Broad definition of transport in-State. Section 3(3) states a person transports nuclear waste in the State whether or not the origin or destination of the waste is a place to which this Act applies. Practically, that means mere transit through Western Australia, including temporary presence in port or on road/rail corridors, is captured. Users planning interstate or international shipments that might pass through WA ports or road links should not assume extraterritorial origin/destination prevents application of the transport prohibition.

Facilitation reaches service providers. The Minister’s injunction power includes acts that would "facilitate or provide assistance" in relation to construction, operation, use or transport (s 8A(1)). This language broadens the scope of potentially actionable conduct beyond primary actors to ancillary service providers, financiers, insurers, infrastructure operators and consultants. Contracts, letters of intent, financing arrangements, or preparatory work that might be characterised as facilitation could attract injunctions even absent direct construction or transport activity.

Officer liability for corporate offences. The Act applies Criminal Code section 39 to offences under ss 7(2) and 7A(2) (s 8). That brings into play officer liability exposure for directors and senior managers. Corporate officers should not assume that an entity-only offence immunises them. The Criminal Code’s tests for consent, connivance or wilful neglect may be engaged, and officer-level criminal exposure can arise even where the corporation is the primary offender.

Public funding prohibition is broad and cross-referenced. Section 9 prohibits expenditure or grant of public money or statutory authority money to any person for the purpose of, or to encourage or finance, development or use of a nuclear waste storage facility (s 9). The Act cross-references Financial Management Act definitions for "public money" and "statutory authority money" (s 3(1)), which may extend across diverse funding mechanisms. Public-private partnerships, grants, loans, guarantees, subsidies or in-kind support might fall within the bar. Agencies that fund research, infrastructure, or community projects should check whether proposed support could be characterised as encouraging or financing a prohibited activity.

Narrow emergency exception requires close factual fit. The emergency exceptions in ss 7(3) and 7A(3) allow otherwise prohibited activities only where they "result from an emergency situation" and are for the purpose of preventing danger to human life or health or irreversible environmental damage. The drafting suggests a narrow, purpose-limited exception. Parties relying on this defence should expect factual and legal scrutiny about whether an action genuinely arose from an emergency and whether it was strictly for the stated protective purpose.

Parliamentary-consent carve out is narrow. Section 5(2) preserves authorisations under s 41A of the Radiation Safety Act 1975 only when effected with the consent of both Houses of Parliament. That is a high threshold and is unlikely to be satisfied except in very specific cases. Practitioners should not assume ordinary regulatory authorisations under radiation safety law will suffice to override the Act.

Magistrates’ court for criminal proceedings. Both criminal offences are to be dealt with by a magistrates court (s 7(4), s 7A(4)). That limits the forum and may constrain penalty ranges or appellate pathways. Defendants and prosecutors must account for summary procedure timelines and evidential expectations. The magistrates’ court venue also affects evidentiary practice and sentencing exposure.

Ministerial injunctions reduce procedural protections. The Act removes two usual procedural protections for defendants when the Minister seeks interim injunctions: the Minister does not need to prove prior wrongdoing or likelihood of future wrongdoing (s 8A(2)), and courts are not to require an undertaking as to damages for interim relief (s 8A(4)). Defendants should be prepared for the possibility of swift interlocutory restraints without the usual interim security.

Overlap with other regulatory regimes. The Act has a "notwithstanding" clause (s 5(1)). Proponents holding planning, environmental or transport permits must still contend with the Act. Failure to cross-check with this Act could lead to costly contractual or investment mistakes where a project allowed under another regime is nonetheless unlawful under this statute.

Technical definitions sit outside the Act. The meaning of "radioactive substance" is imported from the Radiation Safety Act 1975 (s 3(1)). Interpreting what materials fall within the Act’s prohibitions thus requires consultation of that external statute and possibly technical guidance. Mischaracterising material as outside the Act because it is a product of a nuclear plant rather than waste could be a risk, given s 3(2) excludes "waste that results from the use of the products of a nuclear plant" from the "waste of a nuclear plant" definition.

State-only legislative scope. The Act binds the Crown "so far as the legislative competence of the Parliament of Western Australia extends" (s 6). Projects involving Commonwealth control, defence facilities, or matters under Commonwealth jurisdiction may raise intergovernmental legal complexities that the Act itself does not resolve. Practitioners should assess federal overlap and potential constitutional questions outside the scope of this text.

Due diligence and project scoping. Before any proposed activity that could involve storage, disposal or transport of material containing radioactive substances, parties should conduct a statutory screening using the Act’s definitions in s 3. That requires checking whether the material is a "radioactive substance" as defined in the Radiation Safety Act 1975 (s 3(1)) and whether the material constitutes "nuclear waste" as defined in s 3(1) (including whether it is waste of a nuclear plant or arises from nuclear weapons testing/use/decommissioning). The exclusion in s 3(2) for waste from the use of products of a nuclear plant should be examined closely with technical advice to determine whether material is a product-derived waste or falls within the covered categories.

Avoid prohibited conduct. Entities should structure activities to avoid construction, operation or use of any place in WA for storage or disposal of nuclear waste (s 7(1)) and to avoid transporting nuclear waste in WA (s 7A(1)). That includes planning shipments so they do not transit Western Australia and ensuring storage and disposal activities are located outside the State’s jurisdiction. Because s 3(3) captures transit through the State, logistical plans must avoid physical presence of covered material within WA.

Contract drafting and service provision. Service providers, financiers, insurers and contractors should add contractual representations, warranties and indemnities to exclude activities that would amount to facilitation of construction, operation, use or transport within WA. Given s 8A(1) extends to conduct that facilitates or provides assistance, contracts should explicitly prohibit acts that would enable prohibited activities in WA and require immediate notice and cessation if potential WA exposure is identified. Contract clauses should also require proper legal and regulatory confirmation that any suggested acts do not risk contravening the Act.

Public funding and grant compliance. Public bodies and statutory authorities must not expend, grant or advance public money or statutory authority money for the purpose of, or to encourage or finance, activities associated with development, construction or operation of nuclear waste storage facilities or use of any place for storage or disposal in WA (s 9). Agencies must insert compliance checks in grant assessment processes to ensure proposed projects do not contravene s 9 and should develop approval workflows that flag any proposal involving nuclear-waste-related activities.

Corporate governance and officer controls. Because Criminal Code s 39 applies to offences under ss 7(2) and 7A(2) (s 8), corporations should implement corporate governance measures and compliance frameworks to prevent breaches. That includes board-level oversight, compliance training, internal controls on engagements that touch on radioactive materials, transaction clearance processes, and incident-response procedures. Documentation showing active steps taken to prevent contraventions will be relevant in any enforcement context.

Emergency procedures and incident reporting. Organisations that may need to move or handle nuclear-waste-type material in emergency situations should prepare clear procedures to record the nature of the emergency, the decision-making rationale for the activity, and the protective purpose aligning with s 7(3) and s 7A(3). Detailed contemporaneous records will be critical to establish that actions resulted from an emergency situation and were taken to prevent danger to human life or irreversible environmental damage.

Engage early with regulators and legal counsel. Because "radioactive substance" is defined externally in the Radiation Safety Act 1975 and s 5(2) preserves certain parliamentary-consented authorisations under that Act, parties should obtain regulatory advice to confirm whether any existing authorisation applies, and whether the narrow s 5(2) pathway has been used in any particular project. Legal counsel should be engaged early to map the statutory landscape, identify potential authorisations and to design compliance measures tailored to the specific facts.

Risk management for transactions. Purchasers, investors and lenders contemplating involvement in projects that touch on nuclear materials should include statutory compliance warranties, escrow arrangements, and conditionality clauses to manage exposure. Due diligence should include searches for any authorisations under s 41A of the Radiation Safety Act 1975 with Parliamentary consent, examination of transport routes for WA transit risk, and assessment of public-funding implications under s 9.

Responding to Ministerial injunction risk. Entities that receive a notice of intended injunction under s 8A should move promptly to assess whether the threatened conduct falls within the statutory prohibitions or the emergency exceptions. Because the Minister need not prove prior or probable acts for interim relief (s 8A(2)) and courts are not to require an undertaking as to damages (s 8A(4)), swift legal response is necessary to preserve commercial options and to prepare evidence contesting facilitation or to negotiate immediate remedial steps.

Recordkeeping and auditable trails. Maintain comprehensive records that demonstrate compliance steps, decision-making, technical assessments regarding the nature of materials, transport itineraries avoiding WA, and internal approvals. Where emergency exceptions are relied upon, contemporaneous documentation explaining the emergency, the necessity of the action, and the link to preventing harm will be crucial.

Continuous monitoring of statutory environment. Given the Act’s amendment history and the cross-references to other statutes (e.g. Radiation Safety Act 1975 and Financial Management Act 2006), parties should monitor legal developments and seek updated legal advice when project parameters change. Legislative or regulatory shifts elsewhere, including at Commonwealth level, may affect risk profiles even though this Act operates with a "notwithstanding" clause over other written laws in WA.
