Nuclear Waste Storage and Transportation (Prohibition) Act 1999

The Act is driven by a small set of statutory concepts that determine its scope and operational effect.

• Nuclear waste. Defined as material that is or contains a radioactive substance and either (i) is waste of a nuclear plant or (ii) results from the testing, use or decommissioning of nuclear weapons, whether or not conditioned or reprocessed (s 3(1)). The definition explicitly excludes waste that merely results from the use of the products of a nuclear plant (s 3(2)).
• Nuclear waste storage facility. Defined as any installation for the storage or disposal of any nuclear waste (s 3(1)). The definition is functionally broad, focusing on the activity (storage or disposal) and the material (nuclear waste), rather than particular technologies or scales.
• Nuclear plant. Defined to include nuclear reactors, radioisotope enrichment plants involved in enrichment of uranium or plutonium, nuclear reprocessing plants, or nuclear weapons facilities , whether or not located within the State (s 3(1)). The definition therefore captures facilities outside Western Australia for purposes of defining waste that "is waste of a nuclear plant".
• Person. The Act adopts an expansive legal population by stating that "person includes, without limiting the Interpretation Act 1984, the Crown in all its capacities" (s 3(1)). That language brings public agencies and the Crown within the Act’s prohibitions and duties.
• Transport. The Act treats a person as transporting nuclear waste in the State whether or not the origin or destination is a place to which the Act applies (s 3(3)). This creates territorial effect for movement through the State: carriage occurring within the State falls within the prohibition regardless of whether the waste originates or is destined for locations outside State jurisdiction.
• Public money and statutory authority money. These terms are adopted by reference to section 3 of the Financial Management Act 2006 (s 3(1)), and are used to forbid governmental financial involvement in the subject activities (s 9).
• Radioactive substance. Defined by cross-reference to s 4 of the Radiation Safety Act 1975 (s 3(1)), tying the Act’s material scope to the radiation law vocabulary.
• Emergency exception. Both the construction/use and transport prohibitions contain an exception that applies where the conduct results from an emergency situation and is for the purpose of preventing danger to human life or health or irreversible environmental damage (s 7(3); s 7A(3)). The exception is expressed conjunctively, requiring both emergency origin and the specified protective purpose.

The Act’s operative prohibitions are criminal offences with monetary penalties and summary adjudication before a magistrate (s 7(2)-(4); s 7A(2), (4)). It also creates civil enforcement tools by giving the Minister standing to seek injunctions of potentially preventive character (s 8A). The Act asserts primacy over other written law (s 5(1)), but preserves an identified legislative exception: an authorisation given under s 41A of the Radiation Safety Act 1975 that had been granted or effected with the consent of both Houses of Parliament remains effective according to its terms (s 5(2)). The Crown is bound (s 6), so public agencies cannot use Crown immunity to avoid the prohibitions.

The Act’s language brings within scope a wide set of actors by using inclusive definitions and territorial criteria.

• Natural and corporate persons. The Act’s express definition of "person" includes the Crown in all capacities (s 3(1)). The term "person" therefore covers private individuals, companies, partnerships, other corporate bodies, and State agencies. Corporate officers are potentially liable in their personal capacity where the body corporate commits an offence, by operation of Criminal Code s 39 as applied by s 8.
• Corporations and their officers. Section 8 applies Criminal Code s 39 to offences under s 7(2) and s 7A(2). That provision makes officers criminally liable where the offence was committed with their consent, connivance or due to neglect; its application means companies and their senior personnel must manage governance and compliance to avoid personal criminal exposure.
• Transporters and logistics providers. The transport prohibition applies to transport "in the State" whether or not the origin or destination is a place to which the Act applies (s 3(3); s 7A(1)). Carriers , land, sea, and air that move material within Western Australia , are therefore regulated persons for the purposes of the Act where the goods being moved satisfy the nuclear waste definition. The territorial framing captures transit through WA borders.
• Generators and users of radioactive materials. Entities that produce, process, condition or hold material that is or contains a radioactive substance and which is waste of a nuclear plant or results from weapons testing/decommissioning fall within the statutory nuclear waste definition (s 3(1)-(2)). The Act therefore reaches a subset of materials and activities tied to those origins.
• Government agencies and statutory authorities. Because "person" includes the Crown (s 3(1)) and the Act forbids expenditure of public money or statutory authority money for purposes connected with nuclear waste storage (s 9), State departments, statutory authorities and agencies are directly constrained from financing or encouraging relevant activities.
• The Minister and courts. The Minister has an active enforcement tool: power to apply for injunctions to prevent the construction, operation, use, transport or assistance that would facilitate those activities (s 8A(1)). Matters under the Act are to be dealt with by a court constituted by a magistrate (s 7(4); s 7A(4)). The Minister’s standing and the summary jurisdiction affect who initiates enforcement and where proceedings occur.
• Third parties facilitating projects. The injunction power extends to preventing facilitation or provision of assistance in relation to the prohibited activities (s 8A(1)(c) and general tendency of s 8A). Persons providing financial, material or operational assistance to projects within the State that would involve storage, disposal or transport of nuclear waste fall within the scope of potential injunction relief.

Entities that might otherwise host waste-related activity, use sites within Western Australia, or act in supply chains that would bring nuclear waste into the State (even temporarily) are affected. Public funding bodies are specifically constrained from granting, advancing or expending public or statutory money to encourage or finance such activities (s 9). The Crown’s binding by the Act (s 6) means State decision-makers and agencies cannot rely on immunity to carry out, fund or permit the relevant activities.

The Act sets out a short list of prohibitions that operate as duties, and a limited set of rights or powers that public officials and affected persons possess.

Duties (legal prohibitions)

• Do not construct or operate a nuclear waste storage facility in the State, and do not use any place in the State for storage or disposal of nuclear waste (s 7(1)). This is expressed as a statutory prohibition and, on contravention, becomes a criminal offence (s 7(2)).
• Do not transport nuclear waste in the State (s 7A(1)); breach is an offence (s 7A(2)).
• Do not expend, grant or advance public money or statutory authority money for the purpose of, or for encouraging or financing any activity associated with, the development, construction or operation of a nuclear waste storage facility in the State or the use of any place in the State for storage or disposal (s 9). This duty applies to State funds and statutory authority funds as defined by the Financial Management Act 2006 (s 3(1); s 9).
• For corporate bodies, ensure officers do not consent to or negligently permit contraventions, because Criminal Code s 39 applies to the Act’s offences (s 8).

Rights, powers and exceptions

• Ministerial injunctive power. The Minister may apply to a court for injunctions to prevent construction, operation, use, transport or facilitation that would involve nuclear waste storage, disposal or transport in the State (s 8A(1)). The Minister does not have to prove prior occurrence or likelihood (s 8A(2)), may obtain interim injunctions (s 8A(3)), and the court may grant such interim injunctions without requiring undertakings as to damages (s 8A(4)). Proceedings for criminal offences under the Act do not affect injunction applications or outcomes (s 8A(5)).
• Emergency exception. The prohibitions do not apply where the construction, operation, use or transport results from an emergency situation and is for the purpose of preventing danger to human life or health or irreversible environmental damage (s 7(3); s 7A(3)). The exception is narrow and conjunctive , both the "results from an emergency situation" element and the specified protective purpose must be present.
• Parliamentary authorisation carve-out. An authorisation under s 41A of the Radiation Safety Act 1975 that has been granted or effected with the consent of both Houses of Parliament continues to have effect according to its terms (s 5(2)). The Act otherwise takes precedence over other written law (s 5(1)).

Process rights and forum

• Enforcement of criminal offences is to be handled in a magistrates’ court (s 7(4); s 7A(4)), which affects procedural format, evidence rules in practice, and sentencing options available to that court.
• The Act binds the Crown (s 6), which removes shelter from Crown immunity for actions within the Act’s prohibitions.

In short, private and public actors carry strict negative duties not to establish, use or transport nuclear waste in the State, with limited, tightly-specified exceptions and a preventive administrative enforcement mechanism vested in the Minister. Officers of bodies corporate carry potential criminal exposure through the application of Criminal Code s 39.

The Act combines criminal penalties, corporate officer liability, and preventive civil remedies to enforce its prohibitions.

Criminal penalties

• Construction/operation/use. Contravention of the prohibition against constructing or operating a nuclear waste storage facility or using any place for storage or disposal is an offence punishable by a fine not exceeding $500,000 (s 7(2)). Proceedings are to be dealt with by a magistrate (s 7(4)).
• Transport. Contravention of the transport prohibition is an offence with a penalty of $500,000 (s 7A(2)). Proceedings are to be dealt with by a magistrate (s 7A(4)).

The text does not specify imprisonment, disqualifications, per-day penalties, or alternative sentencing options; it specifies monetary fines up to the stated ceiling and summary jurisdiction. The fines apply to the person committing the offence; for bodies corporate the ordinary rules of corporate liability will apply, and Criminal Code s 39 is applied to extend potential criminal liability to relevant officers (s 8).

Corporate officer liability

• Section 8 applies Criminal Code s 39 to offences under s 7(2) and s 7A(2). Criminal Code s 39 (not reproduced in this Act) establishes circumstances in which officers of a body corporate can be criminally liable for offences committed by the corporate body, such as where the offence was committed with the officer’s consent, connivance, or due to the officer’s neglect. The Act therefore creates a potential path to personal criminal exposure for directors, managers or other officers if corporate conduct breaches the prohibitions.

Preventive civil enforcement

• The Minister may seek injunctions to prevent construction, operation, use, transport, or facilitation that would involve nuclear waste storage, disposal or transport in the State (s 8A(1)). The injunction powers are preventive in nature and include:
  • No necessity to prove prior occurrence or likelihood of the conduct sought to be restrained (s 8A(2)). This lowers the usual causation or imminence threshold for relief.
  • Interim injunctions may be granted before final determination (s 8A(3)).
  • The court is not to require an undertaking as to damages or costs as a condition of granting an interim injunction (s 8A(4)). That removes a common interlocutory hurdle for applicants.
  • The existence of criminal proceedings does not affect the Minister’s capacity to seek injunctions or their grant, refusal, variation or expiry (s 8A(5)).

Forum and procedure

• Proceedings for contraventions are to be dealt with by a court constituted by a magistrate (s 7(4); s 7A(4)). This places enforcement within summary jurisdiction. The Act does not set out specialised investigative powers, licensing regimes, or administrative sanctioning beyond injunctions and criminal prosecution.

Financial prohibition

• Section 9 forbids any public money or statutory authority money to be expended, granted or advanced to any person for the purpose of, or for encouraging or financing any activity associated with, development, construction or operation of a nuclear waste storage facility in the State or the use of any place in the State for storage or disposal. Enforcement of this financial prohibition would occur through internal public financial controls, audit, or legal challenge; the Act does not specify separate statutory penalties or administrative sanctions for breaches of s 9 itself.

Taken together, the Act combines a high-capacity preventive remedy (Ministerial injunctions with relaxed interlocutory conditions), monetary criminal penalties adjudicated in magistrates’ courts, and potential personal officer liability. The Act’s enforcement design concentrates authority in the Minister and criminal prosecutors, and establishes summary court jurisdiction for offences.

The Act expressly addresses interaction with other written laws and uses cross-references to attach meaning to key terms.

Primacy and carve-out

• Section 5(1) states that, subject to subsection (2), the Act has effect notwithstanding any other written law. That language establishes a general primacy: where provisions of other statutes might conflict, the prohibitions and obligations in this Act govern.
• Section 5(2) preserves a narrow exception: an authorisation within the meaning of section 41A of the Radiation Safety Act 1975 that has been granted or effected with the consent of both Houses of Parliament continues to have effect according to its terms. This is an explicit legislative carve-out for that specific statutory authorisation mechanism. The Radiation Safety Act 1975 is therefore the only identified statutory source able to trump the prohibitions, and even then only where the higher parliamentary consent mechanism under s 41A is engaged.

Cross-references for definitions and financial scope

• Radioactive substance is defined, for the purposes of the Act, by reference to s 4 of the Radiation Safety Act 1975 (s 3(1)). That links the Act’s material scope to the radiation legislation vocabulary and technical definitions already in force.
• Public money and statutory authority money have the meanings given to them by s 3 of the Financial Management Act 2006 (s 3(1)). The Act’s prohibition on use of public and statutory authority funds (s 9) therefore relies on the financial management statute for scope and any procedural or accountability consequences attached to those terms.
• The Criminal Code is linked by s 8, which applies Criminal Code s 39 to the offences in this Act. The operation of officer liability therefore depends on the existing doctrines and tests in the Criminal Code.

Crown liability

• The Act is expressed to bind the Crown in right of the State and, so far as legislative competence extends, in all its other capacities (s 6). That provision ensures State agencies and the Crown fall within the Act unless other constitutional limits apply; the Crown is not excluded from the Act’s prohibitions by Crown immunity.

Procedural interaction

• The Act stipulates that offences are to be dealt with by a magistrate (s 7(4); s 7A(4)). That interacts with general criminal procedure law and the court rules governing magistrates’ courts.
• The Minister’s injunctive powers under s 8A interact with equitable principles and civil procedure norms, but the Act modifies interlocutory requirements (no need to prove prior occurrence or likelihood (s 8A(2)); no undertaking as to damages required for interim injunction (s 8A(4))). Those statutory directions displace ordinary interlocutory practice in restraint of the specified activities.

Omitted or changed provisions

• The compilation notes identify that provisions amending other Acts are omitted under the Reprints Act 1984 s 7(4)(e) and record amendments in 2004, 2006 and 2023. The Act’s cross-references thus tie it into the broader legislative framework governing radiation, financial management and criminal responsibility.

In sum, the Act is designed to operate as a legislative overlay with general primacy, while aligning its technical scope with radiation law definitions and financial-management definitions and importing criminal officer-liability rules and established court jurisdictions. The only expressly preserved countervailing statutory authorisation is the specific parliamentary-consent authorisation under the Radiation Safety Act 1975 s 41A.

The compilation table and internal annotation in the Act record three principal amendment events plus the original enactment.

Original enactment

• Nuclear Waste Storage (Prohibition) Act 1999, No. 54 of 1999, assented 7 December 1999 and commenced 7 December 1999 (s 2). The 1999 Act established the initial prohibitions and framework.

2004 amendments (No. 2 of 2004)

• The Nuclear Waste Storage (Prohibition) Amendment Act 2004 introduced multiple textual changes and insertions. The Act text shows specific amendment notations:
  • Section 1 (short title) amended by No. 2 of 2004 s 5.
  • Section 3 (interpretation) amended by No. 2 of 2004 s 6.
  • Section 4 (objects) amended by No. 2 of 2004 s 7.
  • Section 5 (relation to other laws) amended by No. 2 of 2004 s 8.
  • Section 7 (prohibition against constructing or operating) amended by No. 2 of 2004 s 9.
  • Section 7A (prohibition against transporting nuclear waste) was inserted by No. 2 of 2004 s 10.
  • Section 8A (injunctions) was inserted by No. 2 of 2004 s 12.
• The 2004 changes therefore expanded the Act to include a separate transport prohibition (s 7A) and a ministerial injunctive power (s 8A), among other amendments.

2006 amendments (Financial Legislation Amendment and Repeal Act 2006)

• The Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006) amended the Act, with s 17 of that amending Act noted in the compilation table. The enacted change was effective 1 February 2007. The Act’s notes reference that public money and statutory authority money have the meanings given in s 3 of the Financial Management Act 2006 (s 3(1)), reflecting the 2006 financial legislative package tying the Act’s financial prohibition to the Financial Management Act definitions. Section 9 is noted as amended by No. 77 of 2006 s 17.

2023 amendments (Directors’ Liability Reform Act 2023)

• The Directors’ Liability Reform Act 2023 (No. 9 of 2023) inserted s 8 into this Act (annotated in the Act as s 8 inserted: No. 9 of 2023 s 110). That provision applies Criminal Code s 39 to offences under s 7(2) and s 7A(2), thereby explicitly extending potential personal officer liability to contraventions of the Act.

Reprints and technical notes

• The compilation notes show a Reprint 1 as at 6 January 2006 that includes the amendments to that date.
• Note 10 of the Act was omitted under the Reprints Act 1984 s 7(4)(e), per the editorial notes in the compilation.
• The compilation table records dates of assent and commencement for each amending instrument: 1 April 2004 (No. 2 of 2004 commenced 1 Apr 2004), 1 Feb 2007 for the 2006 changes, and 5 April 2023 for the 2023 reforms.

Practical effect of amendments

• The 2004 amendments added transportation as an explicit statutory prohibition and created the Ministerial injunctive remedy, both material expansions of enforcement capacity.
• The 2006 amendments anchored the financial prohibition to contemporary definitions of public and statutory authority money contained in the Financial Management Act 2006.
• The 2023 amendment explicitly imported Criminal Code officer-liability rules, making the risk of personal criminal liability for officers express in this statute rather than relying solely on general criminal-law principles.

The compilation notes and marginal annotations in the Act identify precisely which provisions were altered and the sources for the definitional cross-references. There are no subsequent amendments recorded in the Act text beyond those listed in the compilation table.

The statutory text as provided contains no citations to cases, no annotated judicial decisions, and no parliamentary debates reproduced. The Act itself does not record litigation history. The compilation notes likewise do not list or summarise any cases under the Act.

Consequently, from the supplied source alone there is no statutory record of judicial interpretation, contested prosecutions, injunction applications, or appellate rulings under this Act. The Act’s enforcement mechanisms (magistrates’ court jurisdiction for offences (s 7(4); s 7A(4)) and the Minister’s injunctive power (s 8A)) create likely causes of action and potential litigation pathways, but the primary source contains no litigation instances or case law to describe.

Practitioners therefore must, for a litigation picture, consult court records and reported decisions outside of the statutory text. Any operational questions about how courts have interpreted the emergency exception (s 7(3); s 7A(3)), applied Criminal Code s 39 to corporate officers (s 8), or exercised discretion on Ministerial injunctions (s 8A) cannot be answered from the statute alone. The statute does, however, frame likely legal issues that litigation would address:

• The scope of "nuclear waste" under s 3(1) and interplay with the Radiation Safety Act 1975 definitions.
• The territorial reach of the transport prohibition under s 3(3) and s 7A(1), e.g., whether carriage that merely transits WA airspace or territorial waters triggers the prohibition.
• The meaning and evidential requirements of the emergency exception in s 7(3) and s 7A(3).
• The application of Criminal Code s 39 to individual officers under s 8, including what constitutes consent, connivance, or neglect.
• The standards for granting interlocutory injunctions under s 8A where the Act removes requirements ordinarily applied by courts.

Because the Act modifies interlocutory practice (s 8A(2)-(4)), judicial treatment of those modifications would be a central theme in any litigation history. None of that appears in the statutory compilation provided.

The Act contains several features that practitioners and compliance officers should watch for, owing to their capacity to produce unexpected legal constraints or enforcement dynamics.

Territorial reach of the transport prohibition

• Section 3(3) makes a person a transporter "in the State" whether or not the origin or destination is a place to which the Act applies. That means carriage that occurs within Western Australia can contravene the Act even if the waste is only transiting. The provision sweeps in movement occurring physically within the State’s borders, potentially including transit through ports, airspace, or roadways that are situated within Western Australia. The Act does not specify modes of carriage or precise territorial delimiters; judicial clarification would be required for borderline scenarios.

Emergency exception is conjunctive and narrow

• Both s 7(3) and s 7A(3) require that the construction/use/transport "results from an emergency situation" and is "for the purpose of preventing danger to human life or health, or irreversible damage to the environment." The conjunction implies both elements must be satisfied. The Act does not define "emergency situation," "danger," or "irreversible damage," leaving scope for legal dispute over what facts qualify. The exception appears narrowly tailored; reliance on it without contemporaneous documentation and clear causal links could pose evidentiary risk.

Effect on public financing

• Section 9 prohibits expenditure, grants or advances of public money or statutory authority money for the purpose of, or for encouraging or financing, activities associated with development, construction or operation of nuclear waste storage facilities or the use of any place in the State for storage/disposal (s 9). That phrasing covers direct funding, inducements, and financing. The term "encouraging" may capture a range of activities short of direct funding, such as incentives, guarantees or promotional programs. Because the Act links the meaning of "public money" and "statutory authority money" to the Financial Management Act 2006, agencies should audit funding mechanisms to ensure compliance; off-book or indirect support risks contravening s 9.

Ministerial injunctions with relaxed interlocutory requirements

• Section 8A(2) removes the necessity for the Minister to prove prior occurrence or likelihood of the conduct sought to be restrained. Section 8A(4) forbids the court from requiring an undertaking as to damages for interim injunctions. These provisions lower customary interlocutory thresholds and remove a typical protective condition for restrained parties. The practical effect is that the Minister can seek quick preventive relief with reduced procedural counterweights. Respondents should be prepared for expedited interlocutory proceedings where the Minister seeks to restrain projects or facilitation activity.

Corporate officer personal exposure

• The application of Criminal Code s 39 to offences under s 7(2) and s 7A(2) (s 8) creates direct personal risk for officers. The Act does not describe defences or safe-harbour mechanisms in this text; officers should assess governance, oversight, and decision logs to mitigate allegations that they consented to, connived in, or negligently permitted contraventions.

No specified administrative licensing or approvals mechanism

• The Act creates prohibitions and an exception tied to a separate regulatory authorisation mechanism available under the Radiation Safety Act 1975 s 41A where parliamentary consent is obtained (s 5(2)). The Act itself does not create an administrative licensing regime or statutory approval pathway for ordinary exemptions. That means parties seeking lawful activity must either qualify for the narrow emergency exception or obtain a separate parliamentary-consent authorisation under the Radiation Safety Act (if applicable).

Scope of "nuclear waste" tied to external definition of "radioactive substance"

• The Act defines "nuclear waste" by reference to material that is or contains a radioactive substance, and then references the Radiation Safety Act 1975 for the meaning of "radioactive substance" (s 3(1)). Interpretive disputes about whether particular materials are "radioactive substances" will therefore draw on the radiation statute and its technical definitions.

Summary jurisdiction and penalty ceiling

• Offences are to be dealt with by a magistrate (s 7(4); s 7A(4)). The statutory penalty ceiling is a monetary fine (s 7(2); s 7A(2)). Practitioners should note what is absent: the Act does not make imprisonment a named penalty in the provided text, nor does it specify ancillary orders such as forfeiture, remediation directions, or civil pecuniary penalty regimes beyond ordinary criminal fines and civil injunctions.

Parliamentary-consent authorisation

• The only explicit legislative exception to the Act’s primacy is a specific kind of authorisation under s 41A of the Radiation Safety Act 1975 that has both Houses’ consent (s 5(2)). Parties contemplating lawful activity based on a statutory authorisation must ensure it falls squarely within that mechanism and the authorisation remains effective according to its terms.

In short, the Act’s breadth and several cross-references create several points where operational facts and procedural choices can determine legal exposure. The territorial sweep for transport, the narrow emergency exception, the Minister’s injunctive power with reduced interlocutory safeguards, and the attachment of officer liability are the principal practical "gotchas" derived from the statutory text.

Compliance under this Act requires a combination of legal clearance, operational distancing from prohibited activities, financial controls, documentation for emergency responses, and governance measures for corporate officers. Key steps derived directly from the statute:

1. Know whether the material is "nuclear waste"

• Use the statutory definitions in s 3(1)-(2) together with the Radiation Safety Act 1975 s 4 definition of "radioactive substance" to classify materials. Only material that "is or contains a radioactive substance" and is waste of a nuclear plant or results from weapons testing/decommissioning falls within the Act’s nuclear waste definition (s 3(1)-(2)). Develop technical assessment protocols and obtain expert declarations where necessary to demonstrate non-applicability.

2. Avoid construction, operation, or use for storage/disposal in Western Australia

• Do not construct or operate a "nuclear waste storage facility" as defined (s 7(1)). That requires project planning, land-use assessment and procurement filters that screen out proposals involving storage or disposal of nuclear waste in the State. Contracts and development approvals should include clauses prohibiting use for nuclear waste storage or disposal.

3. Avoid transporting nuclear waste through the State

• Because s 3(3) and s 7A(1) treat any transport carried out "in the State" as within the prohibition irrespective of origin/destination, carriers and consignors must ensure that route planning excludes carriage of nuclear waste through WA territory. Logistics contracts, bills of lading, shipment declarations and routing instructions should explicitly prohibit carriage of materials that meet the nuclear waste definition through WA.

4. Public funding controls

• Agencies and statutory authorities must ensure that no public money or statutory authority money is expended, granted or advanced for the purpose of, or for encouraging or financing, development, construction, operation, or use of places in the State for storage or disposal of nuclear waste (s 9). Financial controls should include due diligence on grant applicants and project applicants, approval gates that check alignment with s 9, and audit trails to evidence compliance.

5. Emergency response documentation

• Where transport, construction or operation might be necessary under an emergency exception, ensure rigorous contemporaneous documentation: record the emergency situation, the nexus between the event and the need for storage/transport, and the purpose of preventing danger to human life or health or irreversible environmental damage (s 7(3); s 7A(3)). Establish incident-response protocols that capture decision-makers, times, factual bases, expert advice and alternative measures considered. The emergency exception is conjunctive and narrowly framed, so high-quality records will be essential to justify reliance on it.

6. Governance and officer risk mitigation

• Because Criminal Code s 39 is applied to offences under the Act (s 8), boards and senior officers should implement oversight policies, compliance reporting, and delegations that reduce the risk of being able to be shown to have consented to or neglected to prevent contraventions. Maintain documentation of approvals, legal advice, risk assessments and compliance steps for projects and transport arrangements that touch on radioactive materials.

7. Contract and procurement clauses

• Insert express warranties and indemnities into contracts that shipments or activities do not involve nuclear waste as defined. Include compliance obligations for subcontractors and suppliers to avoid inadvertent facilitation that could attract injunctions per s 8A(1). For public contracting, ensure clauses prevent the use of public money in contravention of s 9.

8. Regulatory authorisation pathway (if seeking an exception)

• If a lawful path is sought via the Radiation Safety Act 1975 s 41A mechanism, ensure any authorisation has been granted or effected with the consent of both Houses of Parliament to fall within the s 5(2) carve-out. The Act itself does not create an ordinary administrative override.

9. Prepare for ministerial injunction proceedings

• Because the Minister may seek injunctive relief with reduced interlocutory constraints (s 8A(2)-(4)), parties should be prepared for expedited proceedings. Maintain legal readiness: injunctive-defence templates, factual affidavits, environmental and technical reports, and counsel available to respond on short notice.

10. Liaise with technical regulators

• Given the Act’s cross-reference to the Radiation Safety Act 1975 for key terms (s 3(1)), work with radiation regulators to obtain clarity on whether particular materials qualify as radioactive substances. Where there is uncertainty, obtain written technical advice from recognised experts.

11. Audit and training

• Implement compliance training for procurement, logistics, port operators and legal teams to ensure staff recognise situations that could involve nuclear waste and know the steps to avoid contraventions. Keep audit trails for funding decisions to demonstrate adherence to s 9.

12. Seek legal advice when in doubt

• Because the statutory definitions and exceptions hinge on technical and contextual facts (for example, what constitutes an "emergency situation" or whether material "contains a radioactive substance"), obtain specialist legal and technical advice before undertaking activities that might fall within the Act’s scope.

Following these steps aligns with the Act’s prohibitions (s 7; s 7A), the emergency exception framework (s 7(3); s 7A(3)), the financial constraints (s 9), the definitions (s 3), and the applied officer-liability rule (s 8). Documentation, due diligence, conservative routing and finance choices, and governance to manage officer risk are the principal compliance levers available under the statutory text.
