Nuclear Activities Regulation Act 1978

Definitions and scope: The Act’s controlling definitional provisions are in s 4. "Prescribed substance" is expressed to include radium, uranium, thorium or any other substance declared by regulation to be capable of producing nuclear energy or to be radioactive, and any derivative or compound of those substances (s 4, definition of "prescribed substance"). "Nuclear activities" is a deliberately broad, functionally-oriented concept encompassing extraction, production, milling, refining, treatment, processing, re‑processing, fabrication, enrichment, use in production of nuclear energy, construction/operation/decommissioning of related facilities, and connected or incidental operations including storage, handling and transport (s 4). The breadth permits a regulator to cover upstream mining through downstream handling and disposal activities.

Object and primacy: The statutory object is safety of people and environment from nuclear hazards (s 2). Section 5 gives the Act primacy over other State Acts and subordinate instruments to the extent of inconsistency on provisions relating to the protection of health, safety or the environment from nuclear activity risks; however, the Act expressly does not affect the Nuclear Waste Storage and Transportation (Prohibition) Act 1999 (s 5(2)). Section 5 was expressly amended to reflect interaction with that Commonwealth and State statutory landscape (amendment references in Notes).

Codes of practice and regulatory adoption: The Act establishes a two-tier model: codes of practice (formulated under s 6) and regulations made by the Governor (s 12). The Minister may arrange for codes to be formulated and propose variations (s 6(1)). Codes may be recommended or mandatory; s 6(6) states a code may "specify standards to be observed" and "recommend practices" that may be followed to further achievement of those standards. Regulations may adopt codes formulated under Commonwealth laws or state codes "either wholly or in part or with modifications and either specifically or by reference" (s 12(1)(i); s 6(4)-(5)). The Act therefore contemplates direct adoption of Commonwealth codes but permits the Minister to recommend state-specific variations where Commonwealth codes do not address special local conditions (s 6(5)).

Delegation of administration and enforcement architecture: The Governor assigns administration of regulations to a Minister by Order (s 7(1)). That Order can be varied. The Minister charged with administration must give consent before proceedings for an offence against regulations under their administration are commenced (s 7(3)). For offences against the Act generally, consent of the Minister charged with administration of the Act is required (s 7(3)-(4)). Inspectors are drawn from existing inspectorates under other Acts administered by the same Minister and, when designated, exercise the powers and protections of the Act under which they were appointed (s 8(1)-(3)).

Emergency control power: Section 9 creates a residual emergency power allowing the Minister to give directions and take action where the Minister is satisfied that health, safety or the environment are likely to be harmed and other State law does not provide or is inadequate. Directions last for 14 days unless the Governor, by Order, extends them for a further period not exceeding six months from the date of the original direction (s 9(3)-(4)). The Minister may recover costs of actions taken from any person whose act or omission caused the special situation (s 9(5)). Failure to comply with a direction or obstruct action under it is an offence punishable by a fixed statutory penalty of $1,000 (s 9(7)).

Information control: Section 10 imposes a secrecy offence for disclosure of information furnished or obtained under the Act or in connection with its execution, with limited exceptions (consent of the business operator, or disclosure made to give effect to the Act in performance of a duty) and a maximum penalty of a fine not exceeding $2,000 or imprisonment for 12 months, or both (s 10).

Regulatory instruments and penalties: Section 12 is the engines room for delegated lawmaking. It authorises regulations to create prohibitions, licensing regimes, exemptions, training and certification requirements, cost recovery and fees, ministerial directions in writing, and the adoption of codes. Regulations may prescribe penalty regimes for summary and indictable proceedings, including continuing offence penalties. Summary penalties may be up to $2,000 or imprisonment up to one year, while indictable penalties may be up to $50,000 or imprisonment up to five years, with continuing offence fines for each day of continuance (s 12(1), (2), (3)).

Reporting and parliamentary oversight: The Minister must cause an annual report on administration of the Act to be prepared and laid before both Houses of Parliament as soon as practicable after receipt (s 11). The Act therefore places a formal transparency obligation on the executive for oversight.

Crown exposure and limitation: Section 3 contains the Crown-binding rule. The Crown is bound by the Act except that possession, storage, use or disposal of any prescribed substance by a Minister, another Minister charged with administration of regulations under the Act, or a person authorised by that Minister in the performance of duties under this or any other Act, is not unlawful (s 3(1)-(2)). The provision is site- and role-sensitive: it immunises official performance of duties but otherwise binds the Crown.

The Act thus operates as a skeleton statute that delegates detailed operational rules to regulations and codes, sets a priority rule for health and environmental protections within State law, equips the executive with emergency control powers and inspection arrangements, and imposes confidentiality and reporting obligations.

Principal regulated parties: The Act’s regulated population is defined by reference to "nuclear activities" and "prescribed substances" (s 4). Anyone engaged in mining or recovery of prescribed substances or minerals containing prescribed substances, production, milling, refining, processing, re‑processing, fabrication, enrichment, use of such substances in energy production, construction or operation of facilities used in those activities, or any operation connected, associated or incidental to these activities (including storage, handling, transportation, possession, acquisition, abandonment or disposal) falls within the scope of the statutory scheme (s 4, definition of "nuclear activities"). Practically, that captures miners, processors, transporters, facility operators, plant designers and constructors, waste handlers and contractors performing ancillary services to those activities once a substance is prescribed.

Persons who carry on or operate businesses that furnish information: Section 10 makes it an offence to disclose information obtained under the Act, subject to the consent of the person carrying on or operating the business to which the information relates. That provision obliges business operators involved in nuclear activities to control access to information supplied to regulators and gives them a direct formal role in consent to disclosure (s 10).

Ministers and the Crown: Ministers are both regulated actors and decision-makers. Section 3(1) explicitly permits a Minister, another Minister charged with regulation administration, or authorised persons acting in the performance of duties under this or another Act, to possess, store, use, handle or dispose of prescribed substances without being subject to the Act’s prohibitions. Otherwise, the Act binds the Crown (s 3). Ministers also exercise several regulatory functions: formulating codes (s 6), consulting and cooperating with Commonwealth or other States (s 6(3)), designating inspectors (s 8), arranging for administration of regulations via Governor’s Order (s 7), and giving emergency directions (s 9).

Inspectors and authorised officers: Inspectors under this Act will generally be persons already appointed as inspectors or authorised officers under other Acts administered by the Minister (s 8(1)). Once designated, they exercise the powers and protections conferred by their appointing Act when acting under this Act, and persons subject to inspection are subject to the same duties and liabilities as would apply under that appointing Act (s 8(2)-(3)). This design creates an intersection between multiple inspectorates and regulatory schemes.

Third parties and the public: The Minister is empowered to "make available, or arrange to make available, for public comment" proposed codes or proposed regulations (s 6(2)). That language indicates the public, including communities near nuclear activities, NGOs, local governments and other stakeholders, may be consulted but the Act uses permissive rather than mandatory language for public consultation. The annual reporting obligation (s 11) requires the Minister to cause reports to be laid before Parliament, providing at least formal parliamentary transparency.

Persons causing emergencies: Section 9(5) makes persons whose act or omission caused a "special situation" potentially liable for costs and expenses incurred by the Minister in controlling or eliminating the situation. That creates a potential direct financial exposure for operators or individuals whose conduct causes an emergency condition related to nuclear activity.

Regulated entities under future regulations: Many operational obligations, licensing requirements, fees, exemptions and offences are to be prescribed by regulation (s 12(1)). Until regulations are made, the Act’s application is definitional, enabling and contingent; the set of specific duties and licensing thresholds will depend on the scope of regulations and codes later promulgated under the Act.

Who decides and who enforces: The Governor (through regulations and Orders) and the designated Minister or Ministers are primary decision-makers for administration and delegated rule-making (s 7(1); s 12(1)). The administration Minister must consent to the commencement of proceedings for offences under regulations they administer (s 7(3)), giving the Minister a gatekeeping role over enforcement. Inspectors designated under s 8 exercise investigative and inspection powers, but their powers and protections are those granted under the Acts that appointed them so variance in inspector powers will reflect the underlying legislation.

In short, the Act affects a wide set of economic actors connected to activities involving prescribed radioactive substances, places certain confidentiality obligations on those who supply information, implicates Ministerial discretion in enforcement and regulation drafting, and creates a direct liability path for persons whose acts cause emergency situations requiring Ministerial intervention.

Express object and legal hierarchy: The Act’s central duty rationale is the statutory object in s 2, which the delegated regulators and Ministers must give effect to when making codes, regulations or exercising powers. Section 5 gives the Act precedence over other State Acts and regulations for provisions relating to protection of health, safety or environment from nuclear activity risks, meaning duties imposed under this Act or its regulations will displace inconsistent State laws (s 5(1)). However, the Act does not authorise anything prohibited by the Nuclear Waste Storage and Transportation (Prohibition) Act 1999 (s 5(2)).

Duty to comply with regulations and codes: Operational duties are primarily to be set out in regulations and codes of practice. The Governor may make regulations prohibiting acts, making them conditional on licences, setting terms and conditions for licences, prescribing training and certification requirements, granting exemptions, fixing fees and cost recovery, issuing directions, adopting codes by reference and prescribing notice and service requirements (s 12(1)(a)-(j)). Codes of practice may "specify standards to be observed" and "recommend practices and procedures" to further those standards (s 6(6)). Once regulations and codes are adopted, operators will have a duty to comply with mandatory codes or statutory conditions of licences.

Duty to submit to inspections: Inspectors designated under s 8 have the powers conferred upon them by the Acts under which they were appointed. Persons subject to inspection are thereby subject to the same duties, obligations and liabilities as under the underlying Act when an inspector exercises powers under this Act (s 8(3)). The Act therefore imposes a duty to comply with inspection powers as elaborated in those underlying Acts.

Duty to obey emergency directions: Where the Minister issues a direction under s 9 to control or eliminate hazards associated with a special situation, persons must comply. Non-compliance or hindering action under such a direction is an offence carrying a $1,000 penalty (s 9(7)). Directions may specify terms and conditions (s 9(2)) and are time-limited to 14 days unless extended by Governor’s Order (s 9(3)-(4)).

Confidentiality obligation and limited exceptions: Section 10 creates a duty of secrecy: persons who disclose information furnished or obtained under the Act commit an offence unless the disclosure is made with the consent of the business operator concerned or for the purpose of giving effect to the objects of the Act and in performance of a duty under the Act (s 10). The penalty is up to $2,000 and/or up to 12 months imprisonment (s 10). This creates a right for business operators to control disclosure of information about their operations except where disclosure is necessary to implement the Act.

Minister’s duties and consultation obligations: The Minister has duties of administrative process in formulating codes: where proposing to formulate or vary codes or to recommend regulations, the Minister must consult with appropriate Ministers who may be affected and "may make available, or arrange to make available, for public comment" the proposed codes or regulations (s 6(2)). The Minister must also consult and cooperate with appropriate Commonwealth and other State Ministers as necessary (s 6(3)). The Minister is also required to cause an annual report to be prepared and laid before both Houses of Parliament (s 11).

Administrative consent for prosecutions: The Minister charged with the administration of any regulations must consent before proceedings for offences against those regulations are commenced (s 7(3)). Similarly, for offences against the Act, the consent of the Minister charged with administration of the Act is required (s 7(3)). Before giving consent to commence proceedings under regulations, the Minister administering those regulations must consult with the Minister charged with administration of the Act in respect of the intention to give such consent (s 7(4)). This inserts an administrative gatekeeper function into enforcement.

Rights to variation and adoption of Commonwealth codes: The Act recognises the adoption of Commonwealth codes; where a Commonwealth code is given effect, the State regulations "may adopt the code of practice" (s 6(4)). If the Minister is satisfied a Commonwealth code does not have regard to special conditions or adequate provision is not made for a particular nuclear activity, the Minister may recommend regulations adopting the Commonwealth code with specified variations, and the regulations shall have effect accordingly (s 6(5)). This gives the Minister a formal right to tailor adopted Commonwealth codes to local conditions through regulations.

Fees, resource recovery and cost allocation: Regulations may provide for the recovery of costs and expenses and fix fees in respect of any matters under the Act (s 12(1)(f)). Additionally, s 9(5) allows the Minister to recover costs incurred in controlling or eliminating special situations from any person whose act or omission caused the special situation. Those provisions allocate potential financial burdens to regulated persons through fee schedules, penalties for non-compliance and cost recovery in emergencies.

Right to administrative allocation: The Governor makes Orders allocating which Minister administers which regulations (s 7(1)). Such Orders may be varied or cancelled (s 7(2)). That is an administrative right that determines which Minister is responsible for consent to prosecutions and other administrative actions.

Criminal and civil enforcement tools: The Act contemplates both criminal sanctions and cost recovery in court (s 9(5); s 12(2)-(3)). Regulations may prescribe offences to be prosecuted summarily or on indictment and set penalties and continuing offence fines (s 12(2)-(3)). Section 10 criminalises improper disclosure. The Act therefore offers both pecuniary and custodial sanctions as enforcement mechanisms.

In summary, duties are derived largely from future regulations and codes, an obligation to comply with inspections, directions and secrecy rules, and exposure to criminal penalties and cost recovery. Rights include the Ministerial processes for consultation, a formal avenue for varying adopted Commonwealth codes, administrative allocation of ministerial responsibilities by Order, and an opportunity for parliamentary transparency through annual reporting.

Penalty structures in the Act are primarily delegated to regulations, but the Act contains express penalty provisions for specific situations and empowers the Governor to prescribe a wide range of penalties for regulatory offences (s 12).

Statutory offence for non-compliance with emergency directions: Section 9(7) creates a specific offence for failure to comply with a direction given under s 9 or for hindering or obstructing action taken in pursuance of such a direction. The penalty is specified at $1,000 (s 9(7)). That is the only offence and fixed penalty specified directly in the Act outside the secrecy offence.

Secrecy offence: Section 10 creates an offence for disclosing information furnished or obtained under this Act or in connection with its execution, with two statutory exceptions (consent of the relevant business operator or disclosure for purposes of giving effect to the Act and in performance of a duty under it). The penalty for an unauthorised disclosure is a fine not exceeding $2,000 or imprisonment for 12 months, or both (s 10).

Regulatory penalty ranges: Section 12(2) and (3) set out the maximum penalties that regulations may prescribe for offences. Regulations can allow offences to be prosecuted on indictment or summarily (s 12(2)). In respect of offences against regulations, the regulations may provide for:

• summary conviction penalties of a fine not exceeding $2,000 or imprisonment up to one year, or both, and for continuing offences a further fine not exceeding $2,000 for each day of continuance after the first (s 12(3)(a)(i)); and
• upon conviction otherwise than summarily (ie on indictment), a fine not exceeding $50,000 or imprisonment up to five years, or both, and for continuing offences a further fine not exceeding $50,000 for each day of continuance after the first (s 12(3)(a)(ii)).

Section 12(3)(b) also allows the regulations to specify that failure to do an act within a specified period constitutes a separate offence for each day it continues after conviction, with daily fines up to the amounts set for summary and indictable convictions.

Deemed offences for failure to comply with regulatory directions: Subsection 12(5) deems contraventions of or failures to comply with directions given under the regulations to be an offence against those regulations, enabling enforcement machinery to apply to written directions made under delegated powers (s 12(5)). Section 12(1)(h) also empowers the Minister administering regulations to make provision by written direction for matters within the regulations, and s 12(4) applies s 36 of the Interpretation Act 1918 to such directions as if they were regulations.

Enforcement gatekeeping by Ministers: Section 7(3) requires the consent of the Minister charged with administration of the relevant regulations before any proceedings for an offence against those regulations can be commenced. Proceedings for an offence against the Act generally may be commenced only with the consent of the Minister charged with administration of the Act. Before giving consent under s 7(3), the administering Minister must consult with the Minister charged with administration of the Act (s 7(4)). Practically this creates an administrative chokepoint that can influence whether, when and how enforcement action proceeds.

Inspectors and their powers: Inspectors designated under s 8 are persons appointed as inspectors or authorised officers under other Acts administered by the same Minister. When designated, they have the powers and protections granted by their appointing Act and may exercise those powers for the purposes of this Act (s 8(1)-(2)). The persons subject to inspection are subject to the same duties and liabilities as under the appointing Act (s 8(3)). Enforcement actions initiated from inspections will therefore typically rely on the investigatory and enforcement powers of the underlying inspectorate Acts.

Cost recovery: Section 9(5) provides a civil enforcement/compensation tool: costs or expenses incurred by the Minister in controlling or eliminating a "special situation" may be recovered in a court from any person whose act or omission caused the situation. Regulations may also provide for recovery of costs and expenses and fix fees in respect of matters under the Act (s 12(1)(f)). Those provisions provide a civil route to allocate financial responsibility for emergency response and regulatory oversight.

Prosecution modes and continuing offences: The Act allows regulations to specify prosecution modes (summary or indictable) and the consequences for continuing contraventions (s 12(2)-(3)). That means the intensity of enforcement, exposure to criminal records, and potential custodial sentences will depend on regulatory drafting.

Practical enforcement architecture: Enforcement therefore will involve a mixture of inspector-led investigation (with inspectors exercising powers under their appointing Acts), ministerial discretion over whether proceedings are commenced (s 7(3)-(4)), criminal sanctions specified either in the Act (s 9, s 10) or in regulations (s 12), and civil cost recovery avenues for emergency remedial costs (s 9(5)). The Act enables severe penalties to be prescribed for serious contraventions via regulations (up to $50,000 and five years imprisonment on indictment) while retaining lower summary options for less serious conduct.

Priority among State laws: Section 5 creates a statutory rule of precedence: where any provision of this Act relating to protection of health, safety or the environment from possible harmful effects associated with a nuclear activity is inconsistent with a provision of another Act or regulation, the provisions of this Act prevail to the extent of the inconsistency (s 5(1)). That establishes a clear intra-State hierarchy for nuclear safety-related provisions, making regulatory measures under this Act effective notwithstanding contrary State statutory provisions.

Exception for the Nuclear Waste Storage regime: Section 5(2) contains an express carve-out: the Act does not affect the operation of the Nuclear Waste Storage and Transportation (Prohibition) Act 1999 and nothing in this Act authorises doing anything prohibited by that Act (s 5(2)). That identifies a specific cross-Act limitation and ensures this Act cannot be used to circumvent prohibitions under the 1999 Act.

Adoption of Commonwealth codes: The Act contemplates formal interaction with Commonwealth law. "Commonwealth law" is defined as the Environment Protection (Nuclear Codes) Act 1978 and any amendment or substituting Act (s 4). Section 6(4) allows the State regulations (subject to s 6(5)) to adopt codes of practice given effect under Commonwealth law. If the Minister considers a Commonwealth code inadequate for special State conditions, the Minister may recommend that State regulations adopt the Commonwealth code with specified variations or modifications and the regulations shall then have effect accordingly (s 6(5)). This provides a mechanism to align State and Commonwealth regulatory standards while permitting state-specific tailoring.

Inspectors under other Acts: Inspectors designated for this Act are persons already appointed as inspectors or authorised officers under other Acts administered by the Minister (s 8(1)). When exercising powers under this Act, they are subject to the duties and protections of their appointing Act (s 8(2)). Persons dealt with by an inspector are subject to the same duties and liabilities as may be imposed by the appointing Act (s 8(3)). Thus enforcement activity under this Act is integrated with existing inspectorate regimes, with cross-application of powers and liabilities.

Delegated instrument interactions: The Governor’s power to specify which Minister administers regulations (s 7(1)) and to make regulations and Orders (s 12(1); s 9(4)) brings the Act into administrative interoperation with the machinery of Orders in Council and the Interpretation Act provisions on how instruments operate (s 9(6); s 12(4) applying s 36 of the Interpretation Act 1918). The Act therefore interacts procedurally with general statutory rules about the making, publication and effect of regulations and Orders.

Criminal procedure and summary conviction options: Section 12(2) allows offences against regulations to be prosecuted on indictment or, with consent of the parties and court approval, summarily. This interacts with the wider criminal procedure framework governing whether matters go to magistrates’ courts or higher courts. The Compilation Table notes later consequential amendments to criminal procedure laws (eg Criminal Procedure and Appeals (Consequential and Other Provisions) Act 2004), which have been incorporated into the Reprint (Notes), reflecting historical interactions when those procedural statutes were amended.

Financial and administrative regimes: Regulations may provide for recovery of costs and fixing of fees (s 12(1)(f)). That mechanism will intersect with State Treasury and public finance rules for fee-setting, revenue collection and cost-recovery, and with procedures for civil recovery of costs in courts (s 9(5)). The Act itself does not set fee levels or administrative procedures, but it creates the legal authority to establish such financial interfaces.

Parliamentary oversight: The annual reporting duty (s 11) interacts with parliamentary processes for oversight and the budgetary cycle, creating an accountability interface between the administration of this Act and parliamentary scrutiny functions.

Limited Crown exemption: Section 3(1) exempts certain official conduct of Ministers, other Ministers charged with administering regulations under this Act, or authorised persons performing duties under this or another Act, from being unlawful in respect of possession, storage, use, handling or disposal of a prescribed substance. Otherwise, the Act binds the Crown (s 3). This interacts with Crown immunity principles and clarifies the extent to which Ministers’ official acts will not be contraventions.

In summary, the Act is designed to integrate with Commonwealth nuclear codes, existing inspectorates and general statutory machinery for regulations, criminal procedure and administrative Orders, while asserting State-level primacy for nuclear-related health and environmental protections. It explicitly preserves the prohibitions in the Nuclear Waste Storage and Transportation (Prohibition) Act 1999 and links Ministerial enforcement discretion into the broader administrative law and criminal procedure context.

The Act’s compilation notes and table record a series of amendments and reprints. The compilation table included in the text of the Act identifies the following legislative changes and associated reprints:

• Original enactment: Nuclear Activities Regulation Act 1978, No. 104 of 1978, assented 30 November 1978, commenced 30 November 1978 (Compilation table).
• Amendment reflecting the Nuclear Waste Storage (Prohibition) Act 1999: Section 5 was amended by No. 54 of 1999, s 10(1), with assent 7 December 1999 and commencement 7 December 1999 (Compilation table; s 5 amended note).
• Sentencing and penalty-related amendment: The Sentencing Legislation Amendment and Repeal Act 2003, No. 50 of 2003, s 81, assented 9 July 2003 and commenced 15 May 2004 (Compilation table), appears as an amendment recorded against s 9 (s 9 amended note referencing No. 50 of 2003 s 81(2)).
• Nuclear Waste Storage (Prohibition) Amendment Act 2004: No. 2 of 2004, s 13, assented 1 April 2004 and commenced 1 April 2004 (Compilation table), with s 5 amended note referencing No. 2 of 2004 s 13(2).
• Criminal procedure-related amendment: Criminal Procedure and Appeals (Consequential and Other Provisions) Act 2004, No. 84 of 2004, s 82, assented 16 December 2004 and commenced 2 May 2005 (Compilation table). Section 12 was amended by No. 84 of 2004 s 82, as noted in the text (s 12 amended).
• Reprint: Reprint 1 of the Nuclear Activities Regulation Act 1978 as at 27 August 2004 is noted in the compilation table and includes amendments listed above up to that date (Compilation table).

The text contains inline amendment notes for specific sections:

• Section 5 amended: No. 54 of 1999 s 10(1); No. 2 of 2004 s 13(2).
• Section 9 amended: No. 50 of 2003 s 81(2).
• Section 12 amended: No. 84 of 2004 s 82.

The Notes also explain that the Interpretation Act 1918 references applying to Orders under s 9 and directions under s 12(1)(h) are preserved (s 9(6); s 12(4)), with the Interpretation Act 1918 later repealed by the Interpretation Act 1984 as noted in the footnote of the compilation. The compilation table records the legislative provenance of those changes without elaborating on substantive policy shifts.

No further amendment chronology, commencement variations or schedules are included in the provided text beyond the compilation table and the specific section amendment notes. The Reprint 1 note indicates that statutory text as at 27 August 2004 incorporates the amendments listed in the table. The Act references the Commonwealth Environment Protection (Nuclear Codes) Act 1978 in its definition of "Commonwealth law" (s 4).

Practitioners should treat the Act as having been subject to the above listed amendments and reprint at the dates given. The compilation table is the only historical record included in the provided material, and the Act itself contains the specific amendment annotations described above.

The legislation text provided contains no case law citations, reported decisions or references to specific litigation under the Act. The Act’s compilation notes list the statutes that have amended it and a reprint but do not identify any judicial proceedings, appellate decisions or legal challenges relating to interpretation or enforcement. The Act therefore does not, in the provided material, document any litigation history.

Given the Act’s structure, potential litigation streams that would typically arise (not documented here) include challenges to administrative decisions made under regulations once operative, judicial review of Ministerial or Governor-in-Council Orders or directions under s 9 or regulations, prosecution of offences under regulations or the secrecy offence, and civil actions for cost recovery under s 9(5). However, none of that appears in the provided text as settled judicial authority. Users should therefore treat litigation history as absent from the statute text and, where necessary, search court databases and law reports for any cases interpreting this Act, its regulations, or its enforcement, as the Act itself does not record such cases.

If litigation exists, it could, for example, address questions such as: the reach of the definition of "nuclear activities" in s 4; the limits of Ministerial discretion under s 6 and s 9; the procedural adequacy of adoption of Commonwealth codes under s 6(4)-(5); the validity of Orders allocating administrative responsibility under s 7; the scope of inspector power when exercised under s 8; or the proper invocation of secrecy exemptions under s 10. The statute provides the legal hooks for such disputes but contains no reported outcomes within the provided material.

1. Broad, functional definitions create wide regulatory reach: "Nuclear activities" is defined expansively in s 4 to reach extraction, production, processing, fabrication, enrichment, use in energy production, construction/operation/decommissioning of facilities, and any operation connected, associated or incidental to these activities. That includes storage, handling, transportation, possession, acquisition, abandonment or disposal connected to counted activities. Operators and contractors in ancillary roles may unexpectedly fall within the regime because the definition is activity- and function-centred rather than substance- or site-limited (s 4).

2. Many obligations depend on regulations and codes that are not in the Act: The Act delegates almost all operational obligations, licensing regimes, fee structures and offence specifications to regulations (s 12) and codes of practice (s 6). Until regulations and codes are in place, the statutory framework establishes principles and delegations but not the detailed rulebook. This creates regulatory uncertainty for operators until subordinate instruments are promulgated.

3. Ministerial and administrative discretion is concentrated and may affect enforcement timings: The Minister administering regulations must consent before proceedings for an offence under those regulations can be commenced (s 7(3)). For offences under the Act more generally, consent of the Minister charged with administration of the Act is required. Before giving consent, the administering Minister must consult with the Minister charged with administering the Act (s 7(4)). This introduces a non-judicial gatekeeping step for prosecutions that can delay or shape enforcement action.

4. Inspectors’ powers vary depending on the appointing Act: Inspectors designated under s 8 are inspectors or authorised officers under other Acts administered by the same Minister and exercise the powers and protections of their appointing Act when acting under this Act (s 8(1)-(2)). That means enforcement powers and protections will vary according to the underlying legislation that created the inspectorship, potentially producing inconsistent enforcement tools or protections across different inspectors.

5. Short emergency direction period unless Governor intervenes: A Minister’s direction to control or eliminate a special situation lasts for only 14 days unless the Governor extends it by Order for a further period not exceeding six months from the date of the original direction (s 9(3)-(4)). This tight timeframe requires quick escalation for prolonged responses. Cost recovery from responsible persons is available (s 9(5)), but the Act imposes a relatively short automatic duration for Ministerial directions.

6. Confidentiality offence with limited statutory exceptions: Section 10 criminalises disclosure of information obtained under the Act, subject only to the consent of the person operating the business to which the information relates, or a disclosure for the purpose of giving effect to the Act in performance of a duty. The exceptions are narrow, and the penalty includes imprisonment of up to 12 months and/or a fine not exceeding $2,000 (s 10). Businesses and regulators must manage information flows carefully because routine disclosures may fall foul of s 10 unless they fit within the exceptions.

7. Regulations may prescribe severe penalties: Although many penalties are to be prescribed in regulations, s 12(3) permits regulations to specify indictable-level penalties up to $50,000 and five years imprisonment and daily continuing offence fines at that level for serious contraventions. Conversely, summary penalties may be much lower. The eventual regulatory drafting will determine exposure, but the Act contemplates both modest summary fines and substantial indictable sanctions (s 12(3)).

8. Crown exemption for Ministers and authorised persons: Section 3(1) provides that possession, storage, use, handling or disposal of any prescribed substance by a Minister, another Minister charged with administering regulations, or a person authorised by such a Minister in the performance of duties under this or any other Act is "not unlawful". That narrow exemption affects how the Act binds government actors and may affect perceived parity between private operators and government operations (s 3(1)-(2)).

9. Public consultation is permissive, not mandatory: When the Minister proposes codes or recommends regulations, the Minister "may make available, or arrange to make available, for public comment" the proposed instrument (s 6(2)). The use of "may" rather than "must" means public consultation is at the Minister’s discretion and not statutorily guaranteed.

10. Adoption of Commonwealth codes can be varied: While adoption of Commonwealth codes can provide harmonisation (s 6(4)), s 6(5) allows the Minister to recommend variations if the Commonwealth code does not address special local conditions. That flexibility is useful but introduces potential divergence between State and Commonwealth standards, depending on Ministerial assessment and regulatory drafting.

11. Administrative allocation of responsibility can be changed by Order: The Governor may direct which Minister administers regulations under s 7(1) and vary or cancel that Order (s 7(2)). Administrative responsibility can therefore shift, altering which Minister controls enforcement consent and resource allocation.

12. Absence of litigation record in the statute: The provided Act text contains no litigation history. Practitioners cannot rely on statutory annotations for judicial interpretation and must search case law databases for any relevant decisions.

Each of these points follows from the text of the Act and indicates operational details that regulatory lawyers, compliance professionals and operators should flag and plan for.

Step 1 , Determine whether your activity falls within the Act: Start with the statutory definitions. If your business involves radium, uranium, thorium or any substance declared by regulation as capable of producing nuclear energy or as radioactive, or any derivative or compound of those (the definition of "prescribed substance" in s 4), then assess whether any of your activities fall within the broad definition of "nuclear activities" (s 4). That definition captures mining/recovery, production, milling, processing, fabrication, enrichment, use in energy production, construction/operation/decommissioning of facilities, and any operations connected, associated or incidental to those activities including storage, handling and transport (s 4).

Step 2 , Monitor and obtain relevant regulations and codes of practice: Because the Act delegates operational detail to regulations and codes (s 12; s 6), the immediate compliance task is to obtain and scrutinise the current regulations and any adopted codes of practice. Identify which regulations have been made under s 12 and whether any Commonwealth codes have been adopted under s 6(4) or adapted under s 6(5). Regulations will define licensing regimes, exemptions, fees, training and certification requirements, and the precise offences and penalties. Treat the absence of regulations on a particular matter as creating ongoing regulatory uncertainty and engage with the administering Minister’s office to clarify expected timelines and draft content.

Step 3 , Identify the administering Minister and inspectorate: Use the Governor’s Orders made under s 7(1) (and any subsequent variation) to confirm which Minister administers which regulations. That Minister’s consent will be required before any prosecution under those regulations (s 7(3)). Also confirm which inspectorates have been designated under s 8; inspectors will be persons appointed under other Acts administered by the same Minister, and their powers when acting under this Act will be those of their appointing Act (s 8(1)-(3)). Adjust compliance procedures to the inspection powers and record-keeping requirements appropriate to those underlying Acts.

Step 4 , Review and implement mandatory requirements: Once regulations and codes are in force, create a compliance matrix linking statutory duties in the Act (inspection cooperation, emergency directions, secrecy) to specific regulatory obligations (licence conditions, training and certification, storage and transport standards, reporting and record-keeping). Implement documented procedures to meet licence terms and code standards; ensure employee training and certification systems are in place where regulations require them (s 12(1)(d)).

Step 5 , Prepare for inspections and information management: Given inspectors may exercise powers under their appointing Acts (s 8), put in place routine procedures for producing documents, granting access and managing site inspections in accordance with the powers likely to be used. Establish strict internal protocols for handling information obtained under the Act: unauthorised disclosure is a criminal offence under s 10, with limited statutory exceptions. Ensure confidentiality clauses, legal review procedures for disclosure requests, and documented consent processes with business operators are in place to avoid contravention.

Step 6 , Emergency preparedness and response plans: The Minister has powers to issue directions and take action in special situations (s 9). Businesses should develop emergency response plans that can be executed in the event of a nuclear-related incident, including internal incident reporting procedures, immediate containment and remediation steps, and legal coordination to address potential Ministerial directions. Maintain insurance, documented cost accounting, and evidence trails because the Minister may recover costs from persons whose acts caused a special situation (s 9(5)). Understand that Ministerial directions initially last 14 days and may be extended by Governor’s Order up to six months (s 9(3)-(4)).

Step 7 , Licensing, fees and cost recovery: Expect that regulation will require licences, approvals and fees (s 12(1)(b), (f)). Build budgeting and compliance-checking systems to manage licence renewals, fee payments and potential regulatory cost recovery. If your activity may result in state intervention under s 9, ensure financial capacity or insurance is available to meet potential cost recovery claims.

Step 8 , Engage in consultation and code formulation processes: The Minister "may" make proposed codes or regulations available for public comment (s 6(2)). Where consultation is offered, participate to influence code content. The Minister may also consult with Commonwealth, State and Territory Ministers (s 6(3)), so coordinate advocacy and technical submissions to ensure local conditions are reflected, particularly where Commonwealth codes might otherwise be adopted (s 6(4)-(5)).

Step 9 , Legal governance and consent management: Ensure internal governance to manage legal risks. Because the Minister administering regulations must consent before proceedings commence (s 7(3)), establish rapid legal reporting protocols to the administering Minister’s office and maintain records that could be relevant to any enforcement decision. Appoint a designated compliance officer to liaise with inspectors, the administering Minister and to prepare submissions or mitigation evidence in case of alleged contraventions.

Step 10 , Reporting and parliamentary transparency: While the Act requires the Minister to prepare and lay an annual report (s 11), businesses should nevertheless consider their own public reporting and disclosure practices consistent with the Act’s secrecy rules (s 10) and any regulatory reporting requirements. Maintain robust record systems to respond to inspectors, Ministerial requests and potential parliamentary inquiries.

Step 11 , Seek early legal advice on Crown interactions and exemptions: If dealing with government projects or providing services to government, check s 3 carefully. Possession, storage, use or disposal of a prescribed substance by a Minister or authorised person in the performance of duties under this or another Act is not unlawful (s 3(1)), but otherwise the Crown is bound (s 3(2)). Legal advice is necessary to understand the application of that provision to ensure compliance and to avoid mistakenly relying on an inapplicable Crown exemption.

Step 12 , Monitor penalty regimes and prosecution risk: As regulations will set penalties and prosecution modes (s 12(2)-(3)), stay informed of any changes in regulatory penalty scales, particularly because continuing offence fines can be large on indictment (s 12(3)(a)(ii)). Put compliance-rated governance features in place to reduce the risk of breaches that might lead to summary or indictable charges.

These steps map directly from the statutory text. The core practical tasks are to confirm whether the Act applies to your activities, to obtain and implement regulations and applicable codes, to prepare for inspection and emergency direction dynamics, to manage information flows to comply with the secrecy provision, and to engage administratively with the processes for consultation and enforcement consent.
