Nuclear Activities (Prohibitions) Act 1983

This Act defines a compact set of technical and legal concepts that determine what is prohibited, what is permissible, and how other statutes interact with it.

• Nuclear activities and nuclear material. The Act defines “nuclear activities” broadly to include mining, milling, conversion, enrichment, fabrication, use, reprocessing or disposal of nuclear material (s 2). “Nuclear material” is likewise defined to include fertile and fissile material, spent fuel and waste (s 2). These definitions set the perimeter for the prohibitions in Parts II and IV.
• Exploration. “Exploration” for uranium or thorium is defined to include searching for uranium or thorium ore bodies using either radiometric or other survey techniques (s 2). That means the Act’s exploration prohibition in s 5 targets active searches specifically for those elements, not purely incidental findings (subject to s 6).
• Mining title. “Mining title” is defined expansively and updated by amendment to encompass leases, licences, permits or other authorities issued under several resource Acts (including the Geothermal Energy Resources Act 2005, the Greenhouse Gas Geological Sequestration Act 2008, the Mineral Resources (Sustainable Development) Act 1990 and the Petroleum Act 1998), whether obtained before or after this Act commenced (s 2). This definition captures a wide range of statutory land-authority instruments and thus identifies persons and activities within the Act’s reach.
• Facility. “Facility” is defined to include a reactor, critical facility, conversion plant, fabrication plant, reprocessing plant, isotope separation plant or separate storage installation (s 2). The construction or operation of such facilities is subject to an express ban in s 8.
• Thresholds for incidental recovery. The Act permits a mining title holder to avoid criminality for incidental recovery of uranium or thorium while mining other minerals, but only if uranium removed from the land is no more than 0.02 per cent by weight or thorium no more than 0.05 per cent by weight, the material is treated in the prescribed manner, and conditions imposed by the Governor in Council are complied with (s 6(1)(a)-(c)). These numeric thresholds are pivotal compliance triggers for mining operations and for determining whether the strict prohibition in s 5 applies.
• Licensing and exemptions link to Radiation Act 2005. Possession, use, sale, transport, storage and disposal of nuclear material are prohibited unless the person holds a “management licence” or “use licence” (as those terms are defined in the Radiation Act 2005), is covered by an exemption under s 16 of that Act, or has complied with s 113 of the Mineral Resources (Sustainable Development) Act 1990 (s 9(1)(g)-(i); s 9(1A)). This creates a legal cross-link so that radiation licensing and exemptions under the Radiation Act effectively permit otherwise-prohibited acts.
• Executive discretion over conditions. The Governor in Council can impose, vary or revoke conditions on permitted incidental mining under s 6 and the regulations-making power in s 15 permits prescription of matters necessary to give effect to the Act, including environmental protection measures for mining/quarrying for nuclear material.
• Enforcement mechanisms. The Act uses criminal sanctions (fines expressed in penalty units), injunctions (s 8(3)-(5)), daily penalties for continuing offences (s 8(4); s 9(2)), and administrative cancellation of mining titles upon conviction (s 5(3)). Jurisdictional rules designate the Magistrates’ Court for s 9 offences (s 9(3)) while the Supreme Court has power in relation to injunctions under s 8.

These concepts create the operational logic of the Act: determine whether an activity is a “nuclear activity” or involves “nuclear material”; if so, check whether any specific statutory exception or Radiation Act licence applies; if none applies, the activity is prohibited; if there is a conviction, administrative consequences (title cancellation) and civil remedies (injunctions) may follow. The Governor in Council and the licensing regime under the Radiation Act are the principal executive levers for controlling and, in narrowly defined circumstances, permitting activity involving trace amounts of nuclear material when it arises during lawful non-nuclear mining.

The Act’s reach extends to a handful of clearly identified groups and to the Crown itself.

• Mining title holders and prospective explorers. Persons holding any “mining title” as defined in s 2 , a definition that explicitly includes authorities under the Geothermal Energy Resources Act 2005, the Greenhouse Gas Geological Sequestration Act 2008, the Mineral Resources (Sustainable Development) Act 1990 and the Petroleum Act 1998 , are directly regulated. Section 5 forbids exploring, mining or quarrying for uranium or thorium; s 6 sets out the narrow exception for incidental recovery by such title-holders. Hence resource explorers, miners, and companies bidding for or operating under resource authorities in Victoria must structure activity to comply with the thresholds and treatment requirements in s 6 or avoid uranium/thorium recovery.
• Operators and constructors of infrastructure. Private sector entities or public bodies that might propose to construct or operate mills, conversion or enrichment plants, fuel fabrication plants, reactors, reprocessing plants or dedicated storage/disposal facilities are covered by the express prohibition in s 8(1)(a)-(f). That ban applies to any person , private, corporate or public , intending to build or operate such facilities within Victoria.
• Persons handling nuclear material. Any person who might possess, use, sell, transport, store or dispose of nuclear material (which the Act defines broadly, s 2) is regulated by s 9. That cohort will include resource handlers, transport companies, laboratories, industrial users of radioactive substances, and waste-handling or storage operators. They must hold the requisite licenses under the Radiation Act 2005, rely on exemptions under that Act, or meet the cross-referenced statutory compliance requirement in s 113 of the Mineral Resources (Sustainable Development) Act 1990.
• Government agencies and public bodies. The Act binds the Crown (s 4) and prohibits use of Consolidated Fund moneys or statutory body funds to encourage or finance exploring, mining or quarrying for uranium or thorium (s 11). Departments, statutory authorities, and Ministerial funds therefore cannot support proscribed activities unless those activities are lawful under the Act. The Minister also has an administrative role: s 5(3) requires the Minister to cancel a mining title where a person is convicted under s 5.
• Regulators and the Governor in Council. The Governor in Council has the power under s 6(1)(c)-(2) to impose, vary or revoke conditions on permitted incidental mining, and under s 15 to make regulations required to carry the Act into effect, including environmental prescriptions. The Radiation Act 2005 regulator is functionally integrated into this scheme through s 9’s licensing cross-reference.
• Legal and court actors. The Act contemplates enforcement by criminal prosecution (s 5, s 8, s 9), injunctive relief from the Supreme Court for convicted persons (s 8(3)), and daily penalties for injunctive non-compliance (s 8(4)). Prosecutions for possession offences under s 9 are to be taken in the Magistrates’ Court (s 9(3)).

Who pays and who decides: financial costs flow to defendants and regulated operators where prosecutions, fines, injunctions or title cancellations occur; compliance costs fall on mining title holders and anyone who handles nuclear material, in the form of monitoring assays to demonstrate compliance with the numerical thresholds, obtaining and maintaining Radiation Act licences, and meeting conditions imposed under s 6. Decision-making authority is concentrated with the Governor in Council for conditions and regulations, the Minister for mandatory title cancellations after conviction (s 5(3)), and the Radiation Act regulator for licensing determinations (via s 9 cross-reference).

Geographic scope: the statutory prohibitions apply within Victoria, and the mining title definition picks up titles issued under specified Victorian resource statutes. Activity outside Victoria or activity relocated interstate or offshore is not within the Act’s prohibitions; the Act does not, on its face, reach extraterritorial conduct.

The Act imposes clear prohibitions, identifies narrow permissions, and establishes duties for the executive and regulated parties. Those legal obligations and discretionary rights are the core compliance mechanics.

Duties imposed on private parties

• Do not explore, mine or quarry for uranium or thorium. Section 5(1) creates the primary prohibition; s 5(2) makes contravention a criminal offence.
• Do not construct or operate specified nuclear facilities. Section 8(1) prohibits construction or operation of mills for uranium/thorium concentrates (except to the extent allowed under s 6), conversion/enrichment facilities, fuel fabrication plants, nuclear reactors (including power reactors), reprocessing plants and storage/disposal facilities. A contravention is an offence punishable by fines (s 8(2)).
• Do not possess, use, sell, transport, store or dispose of nuclear material unless authorised. Section 9(1) makes these activities unlawful unless the person holds the relevant management or use licence under the Radiation Act 2005, is covered by an exemption under s 16 of that Act, or has complied with s 113 of the Mineral Resources (Sustainable Development) Act 1990.
• For holders of mining titles: ensure incidental recoveries of uranium or thorium while mining other minerals meet numeric thresholds (uranium ≤ 0.02% by weight; thorium ≤ 0.05% by weight), are treated “in the prescribed manner”, and comply with any Governor in Council conditions (s 6(1)(a)-(c)).
• Maintain compliance with cross-referenced statutory standards. The holder must understand and comply with licence conditions under the Radiation Act 2005 and any requirements under s 113 of the Mineral Resources (Sustainable Development) Act 1990 referenced in s 9(1)(i).

Duties and powers of government actors

• Minister to cancel mining titles after conviction. Section 5(3) imposes a mandatory administrative duty on the Minister to cancel the mining title(s) of a person convicted under s 5 , an automatic statutory consequence of criminal liability.
• Governor in Council may impose, vary or revoke conditions. Section 6(1)(c) and (2) give the Governor in Council discretion to impose conditions on incidental mining or to change them later. Section 15 confers regulation-making power more broadly, particularly for environmental protection relating to mining/quarrying for nuclear material.
• Courts: injunction and enforcement roles. The Supreme Court may grant injunctions restraining a person convicted under s 8 from repeating or continuing the offence (s 8(3)); breach of such an injunction carries a daily penalty (s 8(4)). The Act preserves the Supreme Court’s other powers to enforce injunctions (s 8(5)). Magistrates’ Court is designated for s 9 offences (s 9(3)).

Rights and regulatory entitlements

• Narrow permission for incidental recovery. A mining title holder has a conditional right to avoid criminal liability for incidental recovery of uranium or thorium when mining for other minerals, provided the threshold and treatment conditions in s 6 are met.
• Licensing under the Radiation Act. Persons who wish to lawfully possess, use, transport or store nuclear material must obtain management or use licences as defined in the Radiation Act 2005; such licences are the statutory pathway to lawful activity under s 9(1)(g)-(h), subject to compliance with that Act’s terms.
• Right to be regulated under the regulations. The regulation-making power in s 15 allows the Governor in Council to prescribe matters required by the Act. A regulated person has procedural rights under those regulations once they are made; however, the Act does not itself create private rights of appeal against executive condition setting under s 6 , any such remedies will flow from general administrative law or specific statutory appeal mechanisms in other Acts.

Other operational duties

• Record and demonstrate compliance with thresholds and treatment. The Act’s reliance on numerical thresholds and “prescribed manner” treatment implies a duty to collect and retain assays, process records, transport manifests and other documentary evidence to show compliance if challenged.
• Avoid receipt of public funds for proscribed activity. Section 11 bars government agencies and constitutional public money being used to fund or encourage prohibited exploration or mining. Recipients of public grants or bodies proposing to use statutory funds must check the Act before authorising disbursements relevant to uranium/thorium exploration or mining.

Scope limitations on rights

• The Act binds the Crown (s 4) and so public bodies do not enjoy immunity from prosecution under these prohibitions.
• The statutory exceptions are narrow and conditional; a breach subjects the actor to criminal liability, administrative cancellation of titles and injunctive remedies.

In sum, the Act creates strict negative duties (do not do X) with limited, conditional positives (certain incidental recoveries and Radiation Act licensing pathways). Decision-makers in the executive (Governor in Council, Minister) exercise significant condition-setting powers which affect the content and scope of permitted incidental activities.

The Act combines criminal sanctions, injunctive remedies and administrative consequences. It also allocates prosecutorial and judicial responsibilities between the Magistrates’ Court and the Supreme Court.

Criminal penalties

• Construction/operation offences: Section 8(2) states that a person who contravenes s 8(1) , that is, constructs or operates prohibited facilities , “shall be guilty of an offence and punishable by a fine not exceeding 500 penalty units.” The Act specifies the quantum in penalty units rather than a fixed monetary sum; determining the current monetary exposure requires reference to the prevailing value of a penalty unit under Victoria’s penalty units regime.
• Possession/use/sale/transport/storage/disposal offences: Section 9(2) provides for a maximum penalty of “not more than 50 penalty units” for offences under s 9(1), and in the case of a continuing offence a daily penalty of not more than 20 penalty units for each day the offence continues after conviction. Section 9(3) directs that proceedings for offences under s 9 shall be taken in the Magistrates’ Court.
• Injunction breach penalty: Section 8(4) prescribes that any person who does any act or thing in disobedience of an injunction under s 8(3) shall be guilty of an offence and liable to a penalty not exceeding 50 penalty units for each day during which the offence continues.

Civil and administrative enforcement

• Injunctions: Section 8(3) permits the Supreme Court to grant an injunction restraining any person convicted of an offence under s 8(1) from repeating or continuing the offence. The Act expressly preserves the Supreme Court’s other injunctive powers (s 8(5)).
• Cancellation of mining titles: Section 5(3) requires the Minister to cancel the mining title(s) affecting the land upon which exploration, mining or quarrying in contravention of s 5 took place, where a person is found guilty of the offence. This is an administratively automatic consequence of conviction and not left to Ministerial discretion once conviction occurs.
• Joint liability: Section 10 provides that where two or more persons commit or knowingly authorise or permit the commission of an offence under the Act, each person is liable and the liability of each is independent of the others. This rule increases exposure for corporate groups, directors and supervisors who authorise or allow proscribed conduct.
• Prosecution venues: Section 9(3) confers jurisdiction on the Magistrates’ Court for possession/use/etc offences under s 9, while the Act contemplates Supreme Court injunctive relief under s 8.

Enforcement process and practical considerations

• Evidential and procedural aspects. Prosecutions require proof beyond reasonable doubt of the elements of the offence in question. For s 5 offending, there will also be the administrative consequence of mandatory title cancellation. For s 6 exceptions, prosecutions may hinge on contested assay results (whether thresholds were exceeded), proof of removal from the land, whether material was treated in the “prescribed manner” and compliance with Governor in Council conditions.
• Penalty unit valuation. The Act quantifies fines in penalty units. Because the value of a penalty unit is set elsewhere and can change over time, the precise monetary exposure should be calculated at the time of assessment or sentencing by reference to the applicable penalty unit statute; the Act itself gives the quantum only in penalty units.
• Remedies are cumulative. The Act contemplates both criminal penalties and civil injunctive relief. A convicted person may face fines, daily continuing penalties, injunctions and administrative loss of title.
• Enforcement actors. Police and prosecuting authorities will bring offences; courts will impose penalties and grant injunctions. The Governor in Council’s conditions may influence both compliance obligations and the factual questions in any prosecution.

Enforcement risk and uncertainty

• Interpretive disputes over thresholds, the meaning of “removed from the land” and what constitutes treatment “in the prescribed manner” create litigation risk. The Act leaves technical detail to the regulations and to cross-referenced statutes (notably the Radiation Act 2005 and provisions in the Mineral Resources (Sustainable Development) Act 1990), which may shift interpretive battles to those instruments.
• The Act’s mandatory title cancellation on conviction (s 5(3)) imposes a severe administrative consequence that may deter marginal or borderline exploratory activity and creates strong incentives for conservative operational planning among mining title holders.

In sum, enforcement is structured to deter prohibited nuclear-related activities through criminal fines, continuing penalties, injunctive and administrative remedies, while the Governor in Council and radiation licensing regimes provide executive levers for limited, conditioned permissibility. Parties at risk should plan for prosecution exposure, administrative loss of title, and collateral civil enforcement.

The Act is designed to operate in a statutory ecosystem and includes explicit cross-references to a number of other Victorian statutes. Those cross-links allocate licensing authority, prescribe the content of “mining titles”, and provide exemptions and technical standards.

Statutory cross-references and their practical consequences

• Radiation Act 2005. Section 9(1)(g)-(h) and s 9(1A) make the possession/use/etc prohibitions subject to licensing and exemptions under the Radiation Act 2005. The Act requires persons to hold a “management licence” or “use licence” (as defined by the Radiation Act 2005) to lawfully have, use, sell, transport, store or dispose of nuclear material (s 9(1)(g); s 9(1A)). It also recognises exemptions under s 16 of the Radiation Act 2005 (s 9(1)(h)). Practically, this means the Radiation Act and its delegated regulations are the principal instrument for licensing and technical controls on lawful handling of radioactive material within Victoria; this Act imposes a prohibition that is disapplied only to the extent the Radiation Act authorises the conduct.
• Mineral Resources (Sustainable Development) Act 1990. The definition of “mining title” in s 2 expressly includes authorities under the Mineral Resources (Sustainable Development) Act 1990. Section 9(1)(i) requires compliance with s 113 of that Act as a condition for lawfully handling nuclear material. Although the 1983 Act does not set out the content of s 113, the cross-reference means that holders of mining titles must understand and comply with relevant sustainable development requirements under the mineral resources regime.
• Geothermal Energy Resources Act 2005, Greenhouse Gas Geological Sequestration Act 2008, Petroleum Act 1998. The mining title definition (s 2) was amended to include authorities issued under these Acts, expanding the population of licences and permits to which the prohibitions and conditional exceptions apply. That means operators under geothermal, greenhouse gas sequestration, petroleum and similar licences are brought within the Act’s scope where uranium/thorium might be encountered.
• Penalty unit regime. The Act uses “penalty units” to express fines but does not define the monetary value; the applicable valuation is supplied by the Victorian penalty units legislation. Consequential enforcement practice requires reference to that instrument to ascertain the monetary cost of a contravention.
• Administrative law and judicial remedies. The Act contemplates courts granting injunctions (s 8(3)-(5)). General administrative law principles (judicial review, natural justice) will apply to the exercise of executive discretion (for example, condition setting by the Governor in Council under s 6) to the extent those principles are engaged and to the extent appeals or review pathways exist in other Acts.
• Funding and public bodies. Section 11 restricts the use of Consolidated Fund or statutory body funds to encourage or finance uranium/thorium exploration or mining. This interacts with public finance statutes and departmental grant-making policies and may require public bodies to test proposed grants or incentives against the Act prior to disbursement.

Regulatory division of labour

• This Act sets prohibitions and thresholds but relies on the Radiation Act 2005 for licensing and technical regulation of radioactive materials in industry and medicine. It also relies on environmental and resource regulation instruments for technical rules , for example, “prescribed manner” treatment referenced in s 6(1)(b) and the regulations the Governor in Council may make under s 15.
• Enforcement is split: Magistrates’ Court handles s 9 offences (s 9(3)), while the Supreme Court is invoked for injunctions in relation to s 8 convictions (s 8(3)). Prosecutions and sentencing will draw on court rules and sentencing principles established under general criminal law and the sentencing regime in Victoria.

Consequence: integrated compliance

• Entities operating in the resource or industrial sectors must manage compliance across several statutes: the 1983 Act for prohibitions and thresholds, the Radiation Act for licences and exemptions, the Mineral Resources (Sustainable Development) Act for sustainable development obligations, and any applicable resource-specific Acts under which their mining title was issued.
• The Governor in Council’s power to impose or vary conditions (s 6) and to make regulations (s 15) means that much operational detail is provided outside the 1983 Act itself. Compliance therefore requires monitoring and engaging with subordinate instruments and other statutes.

Missing statutory detail to be sought elsewhere

• “Prescribed manner” treatment referred to in s 6(1)(b) is not defined in the 1983 Act itself; the content of that prescription, if any, will be found in regulations or other statutory instruments made under s 15 or in the cross-referenced Acts.
• The Act does not itself set out the technical content of “management” and “use” licences; the Radiation Act 2005 contains those definitions and licencing conditions. Persons and advisers must consult the Radiation Act for licence criteria, application processes and compliance obligations.

In sum, the 1983 Act is a prohibitory overlay that leverages the Radiation Act 2005 and resource statutes for detailed licensing, environmental and operational regulation. Effective compliance requires concurrent attention to those cross-referenced regimes.

The Act has been amended repeatedly since assent in 1983. The endnotes in the version provided list the amending instruments, the relevant assent dates, commencement dates and which provisions were affected. The material amendments and their concrete effects are as follows.

• Health (Radiation Safety) Act 1983, No. 9889/1983 (assent 17.5.83). This early amendment substituted portions of s 9 including s 9(1)(g) and s 9(1)(h). The Health (Radiation Safety) Act amendments linked possession/use/etc permissions to radiation licensing and to exemptions under a later Radiation Act regime (see s 9(1) as it now reads).
• Health (Amendment) Act 1985, No. 10262/1985 (assent 10.12.85; s 4 commencement 1.3.86). This instrument made further changes to the provisions amending the 1983 Act; it is recorded in the endnotes as affecting the Nuclear Activities (Prohibitions) Act.
• Courts (Amendment) Act 1986, No. 16/1986 (assent 22.4.86; relevant commencement 1.7.86). This amended courts’ jurisdictional provisions affecting enforcement references in the 1983 Act (notably the venue and enforcement mechanics).
• Mines (Miscellaneous Amendments) Act 1987, No. 90/1987 (assent 1.12.87). The endnotes record that s 11 of the 1983 Act was amended by s 22(2) of this 1987 Act. That relates to the prohibition on public funding in s 11.
• Magistrates' Court (Consequential Amendments) Act 1989, No. 57/1989 (assent 14.6.89; commencement 1.9.89 for parts). This Act amended s 8(3) (recorded in the text as s 8(3) amended by No. 57/1989 s 3(Sch. item 140.1)). These amendments align injunctive enforcement language with changes to the Victorian courts architecture.
• Mineral Resources Development Act 1990 / Mineral Resources (Sustainable Development) Act 1990, No. 92/1990 (assent 18.12.90; s 128(Sch. 1 items 21.1, 21.2) on 6.11.91). This Act amended the definition of “mining title” in s 2 and added cross-references to sustainable development provisions (s 113) that are referenced in s 9(1)(i).
• Extractive Industries Development Act 1995, No. 67/1995 (assent 17.10.95; commencement 1.6.96). Listed in the endnotes as having amended the 1983 Act , part of the incremental expansion and update of resource law during the 1990s.
• Public Sector Reform (Miscellaneous Amendments) Act 1998, No. 46/1998 (assent 26.5.98; commencement 1.7.98 for certain items). This Act effected consequential amendments to the 1983 Act for administrative alignment with public sector reforms.
• Petroleum Act 1998, No. 96/1998 (assent 24.11.98; s 257(5) commenced 1.12.99). This amendment extended the “mining title” definition in s 2 to capture petroleum titles, bringing petroleum licence-holders within the Act’s ambit where relevant.
• Statute Law Revision Act 2000, No. 74/2000 (assent 21.11.00; schedule item relevant to Pt 3 and ss 12-14). This instrument repealed Part III (heading and ss 12-14) of the 1983 Act.
• Geothermal Energy Resources Act 2005, No. 7/2005 (assent 27.4.05; s 172 commenced 4.4.06). This added geothermal authority instruments into the definition of “mining title” in s 2.
• Radiation Act 2005, No. 62/2005 (assent 20.9.05; s 144 commenced 1.9.07). This Act substituted s 9(1)(g) and s 9(1)(h) and inserted s 9(1A), formally cross-linking the 1983 prohibitions to the Radiation Act licensing and exemption regime and defining “management licence” and “use licence” as those terms are used in the Radiation Act (s 9(1A)).
• Mineral Resources Development (Sustainable Development) Act 2006, No. 63/2006 (assent 29.8.06; commencement 30.8.06 for schedule item). This is recorded as affecting the definition of “mining title”.
• Greenhouse Gas Geological Sequestration Act 2008, No. 61/2008 (assent 5.11.08; s 321 commenced 1.12.09). This added greenhouse gas sequestration titles into the “mining title” definition.
• Resources Industry Legislation Amendment Act 2009, No. 6/2009 (assent 3.3.09; s 55 commenced 1.1.10). This further amended the mining title definition.

Concrete effects of amendments

• The repeated amendments to the definition of “mining title” (noted in s 2 annotations) materially expanded the class of statutory authorities that count as mining titles for the purposes of the prohibitions and exceptions. Over time, geothermal, petroleum, greenhouse gas and other resource tenure instruments were added.
• The Radiation Act 2005 reforms rewired the licensing pathway, creating a contemporary licensing regime under which lawful possession or use of nuclear material is assessed. The 2005 insertion of s 9(1A) expressly adopts the Radiation Act’s licence vocabulary and therefore transfers the technical regulation of radioactive materials to that more modern regime.
• Administrative and courts-related amendments aligned enforcement mechanisms with changes to the court system and prosecution practice.

For legal practice: when advising clients, consult both the substantive text of s 2, s 5-9 and the current versions of the Radiation Act 2005, the Mineral Resources (Sustainable Development) Act 1990 and any resource-specific Act under which a mining title is held. The endnotes provide a roadmap of which Acts to check and where amendments were made.

The version of the Act provided does not cite any judicial decisions, and the endnotes contain no references to reported litigation under the Act. The statutory text names no cases and the amendments listed are legislative only. Therefore, within the source material supplied there are no judgments or reported cases to summarise.

Practical implications of the absence of litigation in the source

• Lack of jurisprudential guidance. Where courts have not interpreted the Act in reported decisions in the materials provided, statutory terms such as “prescribed manner”, “removed from the land”, and the precise application of the numeric thresholds in s 6 remain to be authoritatively construed. That increases legal uncertainty and creates litigation risk when contested.
• Administrative decisions likely crucial. Given the Act depends on executive condition setting (Governor in Council under s 6) and licensing under the Radiation Act 2005, much of the operative detail that will govern behaviour may arise in administrative decisions and delegated instruments rather than court judgments. Those decisions can be reviewable under administrative law, but without reported judicial decisions in the supplied material we cannot summarise case law on review grounds.
• Advisers should search external sources. Practising lawyers, compliance officers and corporate counsel will need to perform a jurisdictional search of Victorian case law databases, administrative tribunal determinations and regulatory guidance to identify any decisions that interpret the Act or its cross-referenced provisions. The Act’s endnotes point to key companion statutes (Radiation Act 2005; Mineral Resources (Sustainable Development) Act 1990) where litigation might have arisen; those statutes are plausible loci for contested regulatory decisions that bear on how the 1983 Act is applied in practice.

If a user requires case law, the next step is an external legal database search (AustLII, Victorian Law Reports, Supreme Court judgments, Magistrates’ Court records, and tribunal determinations) for decisions citing the Nuclear Activities (Prohibitions) Act 1983, the Radiation Act 2005, and relevant resource Acts.

Several operational and interpretive traps arise from the Act’s drafting, cross-references and delegated discretion. These are practical issues that routinely catch practitioners and operators.

1. Thresholds are very small and the Act’s trigger is “removed from the land” (s 6(1)(a)). The permitted incidental recovery thresholds , uranium ≤ 0.02% by weight and thorium ≤ 0.05% by weight , are numerically low. Questions will arise about sampling methodology, assay tolerances, and whether material is “removed from the land” in a way that triggers criminal liability. The Act leaves those technical details to regulation and evidence; absence of statutory assay protocols increases exposure to prosecution where sampling or laboratory methods are disputed.

2. “Treated in the prescribed manner” is undefined in the Act (s 6(1)(b)). The phrase imposes an obligation without stating the required treatment. The content and enforceability of the obligation therefore depend on regulations or other instruments made under s 15 or under cross-referenced Acts. Until prescribed measures are published, operators face uncertainty as to what treatment will avoid offending.

3. Governor in Council conditions create administrative uncertainty (s 6(1)(c)-(2)). The Governor in Council’s power to impose, vary or revoke conditions means permitted incidental operations can be subject to ad hoc conditions that change over time. There is no express private right of appeal in the 1983 Act itself against such condition-setting; remedy will depend on general administrative law or specific appeal routes in other statutes.

4. Cross-references to the Radiation Act shift licensing detail outside the 1983 Act (s 9(1)(g)-(h); s 9(1A)). Lawful handling of nuclear material is permitted only through licences or exemptions under the Radiation Act 2005 (or compliance with s 113 of the Mineral Resources (Sustainable Development) Act 1990). That requires operators to navigate a separate, potentially complex licensing regime; failing to secure or maintain the Radiation Act licences exposes operators to prosecution under s 9.

5. Mandatory title cancellation on conviction is automatic (s 5(3)). The Minister “shall cancel” the mining title(s) of a person convicted under s 5. This automatic administrative consequence is severe and may extend to third parties or corporate groups if liability is proven. Clients should be aware that plea bargaining or mitigation strategies in criminal proceedings may need to address the practical consequence of title loss.

6. Funding prohibition has broad reach (s 11). Section 11 bars use of Consolidated Fund and statutory body monies to encourage or finance exploring, mining or quarrying for uranium or thorium unless the activity is lawful under the Act. Public grant-makers and public bodies must clear proposed funding against the Act, and recipients of public funds must ensure their activities do not fall foul of the prohibition.

7. “Mining title” is a moving target (s 2). The definition of mining title has been amended multiple times to include titles under various Acts (geothermal, petroleum, greenhouse gas sequestration, etc.). Operators under those regimes may not realise they are captured until they consult the consolidated statutory definition.

8. Penalty units require fresh calculation. The Act specifies penalties in penalty units (s 8(2), s 9(2), s 8(4)). The monetary exposure therefore depends on current penalty unit valuations. Failure to check the current rate risks miscalculation of potential fines.

9. Jurisdictional split for proceedings may complicate enforcement strategy (s 9(3); s 8(3)). Possession offences go to the Magistrates’ Court; injunctions are exercised by the Supreme Court in relation to convictions under s 8. Strategic choices about proceedings, appeals and venue may be constrained by these statutory allocations.

10. Proof of knowledge and joint liability issues (s 10). Section 10 makes each person who commits, knowingly authorises or permits an offence liable, with independent liabilities. This raises exposure for directors, managers and contractors who may have authorised or permitted proscribed conduct, and increases the importance of internal compliance controls and delegation protocols.

11. The Act is silent on extraterritorial transfer and interstate relocation. The statute applies within Victoria; moving activity interstate or offshore can avoid the Victorian ban but may trigger other Commonwealth or interstate regulatory regimes. That substitution effect is a compliance reality though not directly addressed by the Act.

12. No detailed environmental or waste standards in the Act. Although s 15 contemplates regulations “in relation to mining or quarrying for nuclear material, for or in respect of the preservation of the environment”, the Act itself does not contain technical environmental standards for waste, storage, transport or disposal of radioactive materials. Operators need to consult regulations and related statutes.

These “gotchas” indicate that compliance often turns on technical evidence (assays and treatment records), regulatory instruments made under s 15 or under other statutes, and administrative decision-making by the Governor in Council and radiation regulators. Parties should not assume the Act’s prohibitions can be navigated without contemporaneous attention to delegated instruments and cross-referenced licensing regimes.

Complying with the Act requires a practical, multi-step approach that addresses statutory prohibitions, threshold monitoring, licensing under the Radiation Act 2005 and interaction with resource tenure conditions.

1. Legal and regulatory mapping

• Identify whether the operation involves exploration, mining, quarrying or handling of materials that could contain uranium or thorium. The Act’s exploration definition (s 2) includes radiometric or other survey techniques searching for uranium or thorium, so planned geophysical work should be reviewed to ensure it is not targeted at those elements.
• Check that any mineral title held by the operation falls within the definition of “mining title” in s 2. That definition incorporates titles under several modern Acts (Geothermal Energy Resources Act 2005; Greenhouse Gas Geological Sequestration Act 2008; Mineral Resources (Sustainable Development) Act 1990; Petroleum Act 1998). If your title is issued under any of these Acts, the 1983 Act’s prohibitions and conditional exceptions will apply.

2. Avoid prohibited exploration

• Do not intentionally explore for uranium or thorium (s 5). Where exploration activities are being planned, ensure prospecting protocols and geophysical surveys are scoped to avoid being construed as searches for uranium or thorium. If radiometric surveys are used, ensure they are directed to materials other than uranium or thorium where you rely on s 7’s permissive language.

3. Monitoring, sampling and thresholds

• Implement rigorous geological sampling and laboratory protocols to detect uranium and thorium content in ore and overburden. Because the incidental recovery exception in s 6 is threshold-based, maintain statistically robust sampling regimes, chain-of-custody documentation, and certified laboratory assays demonstrating whether uranium ≤ 0.02% by weight or thorium ≤ 0.05% by weight.
• Establish decision rules based on assay results. If assays suggest thresholds may be exceeded, cease removal or handling of the suspect material until licensing under the Radiation Act or prescribed treatment measures are obtained.

4. Treatment and prescribed manner

• Identify the “prescribed manner” referred to in s 6(1)(b) by consulting applicable regulations, subordinate instruments under s 15, and the Radiation Act 2005. If no regulations exist setting out the treatment, engage early with the relevant regulator or the Department responsible for radiation safety to obtain guidance and, if necessary, an administrative determination or licence that documents acceptable treatment.
• Implement documented treatment processes as required by the Radiation Act licences or by any regulations made under s 15; ensure records are kept to demonstrate compliance.

5. Licensing and exemptions under the Radiation Act 2005

• For any activity that involves the possession, use, sale, transport, storage or disposal of nuclear material, obtain the necessary “management licence” or “use licence” under the Radiation Act 2005 as required by s 9(1)(g)-(h) and s 9(1A). Determine whether exemptions under s 16 of the Radiation Act apply for particular low-level or routine uses.
• Ensure license conditions are complied with continuously. Licence holders should put in place compliance systems, periodic audits and reporting procedures aligned with Radiation Act obligations.

6. Environmental and resource-act compliance

• Check and satisfy the requirements of s 113 of the Mineral Resources (Sustainable Development) Act 1990 where s 9(1)(i) cross-references it. Obtain environmental approvals where required, and ensure disturbing works meet any rehabilitation, waste management and monitoring requirements in the sustainable development regime.
• Monitor for regulations made under s 15 that might impose specific environmental prescriptions for mining/quarrying for nuclear material and adopt compliant environmental management plans.

7. Public funding and procurement practices

• If seeking public grants or assistance, verify that proposed uses of Consolidated Fund or statutory body funds do not contravene s 11. Public bodies and grant applicants should include a statutory compliance checklist to ensure that no funds are used to encourage or finance prohibited activities.

8. Internal governance and training

• Implement internal compliance policies that cover: sample collection and assay protocols; thresholds and action triggers; controlled handling and transportation protocols; documentation and record-keeping; and escalation procedures for suspected exceedances.
• Train operational staff, contractors and management on the obligations under the 1983 Act, the cross-referenced Radiation Act licensing requirements, and the consequences of non-compliance (criminal fines, injunctions, title cancellation).

9. Contracting and supply-chain control

• Include contractual warranties and indemnities in supply and services agreements with contractors and third parties to ensure they comply with the Act and related licences. Require contractors to provide evidence of assays, licences and treatment records relating to any material that may contain uranium/thorium.
• Establish manifesting and transport controls to ensure that any movement of potentially radioactive material is performed only under appropriate licences and with traceable documentation.

10. Engage with regulators early

• Where there is any risk of encountering uranium or thorium, engage early with the relevant regulatory agencies (radiation safety regulator, Department responsible for mining titles, environmental regulators) to obtain clarity on required licences, treatment standards, and potential Governor in Council conditions under s 6.
• Where necessary, seek formal administrative determinations or written guidance confirming whether specific activity will be treated as incidental and lawful under s 6 or whether a Radiation Act licence is required.

11. Litigation and dispute preparedness

• Given the potential for criminal proceedings and mandatory title cancellation on conviction (s 5(3)), prepare contingency plans including legal representation, evidence preservation procedures (sampling logs, chain-of-custody), and communication strategies.
• Consider insurance cover where available for environmental liability and regulatory enforcement; assess whether professional indemnity or directors and officers insurance can assist with legal costs arising from enforcement actions.

12. Regular legal review

• Because key parts of the compliance landscape depend on delegated instruments and evolving cross-referenced statutes (notably the Radiation Act 2005 and mineral resources legislation), schedule periodic legal reviews to monitor changes in regulations, policy guidance, and penalty unit valuations.

In concise terms, compliance is a mixed technical-legal exercise: ensure assays and treatment protocols are robust; secure and maintain Radiation Act licences where required; comply with Governor in Council conditions and environmental prescriptions; document everything; and avoid intentional exploration or extraction of uranium or thorium. When in doubt, pause operations and seek regulatory or legal clearance before moving material or continuing activity that risks breaching the Act.
