Crimes at Sea Act 2000

The Act and its Schedule are built around a small set of interlocking concepts that determine legal effect in maritime spaces adjacent to Australian States. Those concepts are: adjacent area (inner and outer), application of State substantive criminal law, the distinction between “substantive” law and “law of criminal investigation, procedure and evidence”, administrative responsibility and the intergovernmental agreement, and flag‑state consent for prosecutions on foreign ships.

Adjacent area and baselines. The “adjacent area” for each State is defined by reference to Commonwealth statutory geographic instruments: the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) Schedule 1 and the Seas and Submerged Lands Act 1973 (Cth) baseline and continental shelf definitions (Schedule, cl 13-15). The Schedule distinguishes the inner adjacent area,on the landward side of the baseline and seaward within 12 nautical miles of the baseline (Schedule, cl 1(1) definitions and cl 2(1)),from the outer adjacent area, outside the inner adjacent area and extending to 200 nautical miles or the outer limit of the continental shelf, subject to the greater (Schedule, cl 2(2) and preamble). The Act therefore relies on Commonwealth maritime delimitation instruments for its spatial reach.

Substantive criminal law versus criminal investigation, procedure and evidence. The Schedule dichotomises law into substantive criminal law (offence creation, defences, confiscation, compensation, etc.; Schedule, cl 1(1)) and law of criminal investigation, procedure and evidence (investigation, arrest, bail, plea, preliminary examination, sentencing, evidence rules, appeals, etc.; Schedule, cl 1(1)). The substantive criminal law of a State applies in the inner adjacent area by force of State law and in the outer adjacent area by force of Commonwealth law (Schedule, cl 2). By contrast, the law of criminal investigation, procedure and evidence that applies depends on who acts: Commonwealth law applies to Commonwealth authorities; State law applies to State authorities acting within their area of administrative responsibility; and the law applied in a judicial proceeding is the law of the jurisdiction in which the proceeding began (Schedule, cl 3(2)).

Intergovernmental agreement and division of administrative responsibility. The Schedule contemplates an intergovernmental agreement, entered into under cl 5, under which the Commonwealth Attorney‑General and participating State Ministers may divide responsibility for administering and enforcing law in different parts of the adjacent area (Schedule, cl 5(1)-(2)). That agreement may provide for concurrent responsibilities. The agreement is legally significant: charges cannot be brought contrary to it (Schedule, cl 6(1)) and a court must permanently stay proceedings if a charge is brought in contravention and the Commonwealth Attorney‑General or a participating State Minister applies for the stay (Schedule, cl 6(2)).

Foreign‑flag ships and Attorney‑General consent. The Schedule requires written consent of the Commonwealth Attorney‑General before a charge will proceed to hearing or, for indictable offences, to preliminary examination, where (i) the alleged offence occurred on or from a foreign ship, (ii) the ship is registered under the law of a country other than Australia, and (iii) the country of registration has jurisdiction under international law (Schedule, cl 7(1)). The Attorney‑General must take into account any views expressed by the government of the flag state (Schedule, cl 7(2)). Absence of consent does not prevent immediate practical steps, arrest, charge‑laying, extradition or remand, but a refusal to consent requires a permanent stay of proceedings (Schedule, cl 7(3)-(4)). An apparently genuine written copy of consent is prima facie proof of consent in proceedings (Schedule, cl 7(5)).

Limits, exclusions and presumptions. The Schedule expressly excludes substantive criminal laws that are inherently territorial or expressly limited to within a State (Schedule, cl 2(3)(a)), and it disclaims any extension of a provision’s legal effect beyond what it has inside the State (Schedule, cl 2(3)(b)). It also permits regulations to exclude State and Commonwealth laws from the scheme’s ambit (Schedule, cl 9). For evidentiary purposes, an allegation that an element of a maritime offence happened in the adjacent area, inner adjacent area or outer adjacent area is taken to be proved if the act, omission or state of affairs that is the element is proved, absent proof to the contrary (Schedule, cl 4). The Acts Interpretation Act 1901 applies to the scheme (Schedule, cl 11).

Administrative law carve-outs and regulatory competence. The Schedule excludes the Administrative Decisions (Judicial Review) Act 1977 (Cth) from applying to decisions taken under a State law that applies to State investigations, procedures and acts under Schedule, cl 3(2)(b) (Schedule, cl 3(5)). Regulation‑making power is split: the Territory Administrator may make regulations not inconsistent with the Act but cannot make regulations for purposes of the cooperative scheme (s 7(1)-(2)), while the Governor‑General may make regulations for the scheme generally (Schedule, cl 12). For inner adjacent area matters, a regulation may affect the scheme only with the agreement of the participating State Minister for that State (Schedule, cl 12(2)).

Constitutional and federal limits. The Schedule recognizes constitutional limits and gives examples: for instance, procedural rules that would rely on a majority jury verdict may be incompatible with the Constitution in outer adjacent areas (Schedule, cl 3(2) example referencing Cheatle v The Queen). It also states that where State substantive law is limited by s 109 inconsistency, that limitation carries through to the outer adjacent area despite Commonwealth legislative authority to apply the State law there (Schedule, cl 2(3)(b) example).

Taken together, these concepts make the scheme a cooperative legal matrix: State substantive law is extended extraterritorially; procedural law follows the acting authority and the forum; administrative responsibility is allocated by agreement and enforced by court stay remedies; and special interstate and international tensions (flag‑state jurisdiction, constitutional boundaries) are managed by consent, presumptions and regulatory limits.

The Act and Scheme allocate legal reach and procedural rules, and therefore affect several discrete groups and decision‑makers.

State, Territory and Commonwealth governments and ministers. Participating State Ministers and the Commonwealth Attorney‑General have decision‑making roles. Participating State Ministers may enter into the intergovernmental agreement and the agreement can allocate responsibility, including concurrent responsibilities, for administering criminal justice in parts of the adjacent areas (Schedule, cl 5). The Commonwealth Attorney‑General holds a gatekeeper role in prosecutions involving foreign‑flag ships where the flag state has international jurisdiction (Schedule, cl 7). The Territory is required to publish the intergovernmental agreement and amendments in the Gazette (s 6). The Act limits the Administrator’s regulatory competence by prohibiting Territory regulations for the cooperative scheme (s 7(2)).

Law enforcement, investigators and prosecutors. Commonwealth and State authorities investigating maritime offences operate under different procedural rules depending on who acts and where (Schedule, cl 3(2)). A Commonwealth authority’s investigations and acts are governed by Commonwealth law; State authorities’ acts are governed by State law within their designated area of administrative responsibility. Prosecutors will need to identify whether a matter is within the inner or outer adjacent area, whether the intergovernmental agreement allocates responsibility, and whether AG consent is required for foreign‑flag situations.

Courts and judicial officers. Courts are affected in multiple ways: procedural law applied in a judicial proceeding is the law of the jurisdiction where the proceeding was commenced irrespective of which substantive law is engaged (Schedule, cl 3(2)(c)). Courts must permanently stay proceedings brought contrary to the intergovernmental agreement if the Commonwealth Attorney‑General or a participating State Minister applies (Schedule, cl 6(2)). Courts are not to concern themselves with compliance with the intergovernmental agreement except where an application for stay is made (Schedule, cl 6(3)(b)). The Acts Interpretation Act 1901 applies to interpretation of the scheme (Schedule, cl 11).

Ship operators, masters, crews and passengers. The Act affects persons on Australian ships and foreign ships operating adjacent to Australian States. The “Australian ship” definition is broad (Schedule, cl 1(1)): registered in Australia, operated from a base in Australia and unregistered elsewhere, or belonging to an arm of the Defence Force. For foreign ships registered elsewhere, the Attorney‑General’s consent rule (Schedule, cl 7) may be triggered where the flag state has jurisdiction under international law, which affects whether prosecutions may proceed beyond preliminary stages.

Offshore industries and offshore installations. By tying adjacent areas to the areas in Schedule 1 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) and the continental shelf (Schedule, cl 14-16), the Act affects operators, contractors and personnel in offshore petroleum and other offshore operations, by subjecting them to State substantive offences and procedural processes while in those areas.

Defence and customs authorities. Defence vessels are explicitly captured by the “Australian ship” definition (Schedule, cl 1(1)(c)). The allocation between Commonwealth and State procedural laws for acts by Commonwealth authorities (Schedule, cl 3(2)(a)) is relevant where Commonwealth enforcement agencies (e.g., Defence, Customs, Border Force) operate in adjacent areas.

Foreign states. Where a ship is registered in another country and that country has jurisdiction under international law, that foreign state’s view must be taken into account before the Commonwealth Attorney‑General grants consent for proceedings to proceed (Schedule, cl 7(2)). The scheme preserves practical options for arrest and extradition even absent consent (Schedule, cl 7(3)), but a refusal to consent will result in a permanent stay (Schedule, cl 7(4)).

Defendants and accused persons. The scheme changes which law governs pre‑trial processes, how an offence is classified for trial purposes, and the presumption about the location element of an offence (Schedule, cl 3; cl 4). A defendant will need to assess whether charges are properly brought under the intergovernmental agreement, whether AG consent was required and obtained, and whether the procedural law applied by the investigating authority conforms to the scheme. The regime also affects available judicial review avenues, given the non‑application of the Administrative Decisions (Judicial Review) Act 1977 (Schedule, cl 3(5)) to State decisions that fall within the scheme.

Legal practitioners and compliance advisers. Lawyers advising on maritime incidents must consider cross‑jurisdictional application of substantive law, forum rules for criminal procedure, intergovernmental agreement allocations, and the AG consent requirement for foreign‑flag vessels. They must also consult the gazetted intergovernmental agreement (s 6) and the relevant statutory maps and baselines specified in Commonwealth instruments that define adjacent areas (Schedule, cl 13-16).

Overall, the Act affects the mix of governmental actors who investigate and prosecute, the legal exposure of persons and vessels in adjacent areas, and the procedural protections or limits that follow from whichever authority and court handle a matter.

The Act and Schedule create specific duties for public actors, and rights or procedural positions for defendants and States. Below are the principal, source‑based duties and rights.

Duties to publish and to enter agreements. The Territory Minister must publish the intergovernmental agreement and any amendments in the Gazette (s 6). Participating State Ministers and the Commonwealth Attorney‑General may enter into an intergovernmental agreement providing for the division of responsibility for administering and enforcing law in the adjacent area (Schedule, cl 5(1)). The agreement may contain provisions for concurrent responsibility (Schedule, cl 5(2)).

Duty to apply State substantive law extraterritorially. Subject to limits in the Schedule, a State’s substantive criminal law applies in the inner adjacent area by force of State law and in the outer adjacent area by force of Commonwealth law applying the State law as in force from time to time (Schedule, cl 2(1)-(2)). The operative duty is to give effect to State substantive offences in these marine zones, save for laws inherently incapable of extraterritorial reach or expressly localised (Schedule, cl 2(3)(a)-(b)).

Division of procedural law duties. The law of criminal investigation, procedure and evidence that must be applied depends on who acts and which court is seized. Commonwealth law governs investigations and acts by Commonwealth authorities (Schedule, cl 3(2)(a)). State law governs investigations and acts by State authorities operating within their area of administrative responsibility (Schedule, cl 3(2)(b)). In judicial proceedings, the law of the jurisdiction in which the proceeding commenced applies (Schedule, cl 3(2)(c)). Those duties allocate which procedural rules investigators and prosecutors must follow.

Right to require AG consent and effect of consent refusal. The Commonwealth Attorney‑General must provide written consent before a charge proceeds to hearing or preliminary examination where the alleged offence is on or from a foreign ship registered under another country and that country has jurisdiction under international law (Schedule, cl 7(1)). The Attorney‑General must take into account any views expressed by the flag state (Schedule, cl 7(2)). If consent is declined, the court must permanently stay proceedings (Schedule, cl 7(4)). However, arrest, laying charges, extradition and remand may proceed before consent is given (Schedule, cl 7(3)). A copy of a written consent purporting to be genuine is prima facie evidence of consent (Schedule, cl 7(5)).

Court duty to stay proceedings contrary to intergovernmental agreement. A charge of a maritime offence must not be brought contrary to the intergovernmental agreement (Schedule, cl 6(1)). If it is, a court must permanently stay the proceedings on application by the Commonwealth Attorney‑General or a participating State Minister (Schedule, cl 6(2)). Notably, a contravention of the agreement does not oust jurisdiction (Schedule, cl 6(3)(a)), and courts are not required to inquire into compliance with the agreement except on application for stay (Schedule, cl 6(3)(b)).

Evidentiary presumption about location. In proceedings for a maritime offence, proof of an element that is an act, omission or state of affairs permits an allegation in the information or complaint that the act etc occurred in the adjacent area (or inner/outer adjacent area) to be taken as proved in the absence of proof to the contrary (Schedule, cl 4). This shifts the evidentiary burden on the locus element, creating a rebuttable presumption in favour of the prosecution’s allegation about location.

Regulatory duties with consent for inner adjacent area. The Governor‑General may make regulations for the Scheme generally (Schedule, cl 12(1)), but regulations affecting the operation of the scheme in the inner adjacent area for a State require the agreement of the participating State Minister for that State (Schedule, cl 12(2)). Separately, the Territory Administrator may make regulations not inconsistent with the Act, but s 7(2) bars the Administrator from making regulations for the cooperative scheme specifically.

Duty to respect limits on courts and administrative review. The Schedule excludes the Administrative Decisions (Judicial Review) Act 1977 (Cth) from applying to decisions taken under State law that apply to State investigations, procedures and acts under Schedule, cl 3(2)(b) (Schedule, cl 3(5)). This reduces the availability of federal judicial review under ADJR Act over some State decisions taken in the adjacent area.

Right to have Acts Interpretation Act 1901 apply. The Schedule explicitly states the Acts Interpretation Act 1901 applies to the Scheme in the same way as to a Commonwealth Act (Schedule, cl 11), which affects statutory interpretation and savings.

Exclusion rights and regulatory carve‑outs. The scheme does not exclude other State extraterritorial legislative schemes that are capable of operating consistently with it (Schedule, cl 8). It also allows regulations to exclude State and Commonwealth laws from the scheme’s ambit (Schedule, cl 9), which preserves scope for targeted exclusion of particular laws by regulation.

Duty to accept certain proofs. A document that appears to be a genuine written consent from the Commonwealth Attorney‑General is to be accepted, in the absence of proof to the contrary, as proof of consent (Schedule, cl 7(5)). This evidentiary rule creates a practical procedural shortcut in litigation and charging processes.

Overall, the Act imposes duties on executive actors to coordinate and to follow procedural allocations, while conferring rights on accused persons through evidentiary rebuttals and on flag states through the Attorney‑General consent mechanism. It also limits certain avenues of federal judicial review and constrains Territory regulatory competence in relation to the cooperative scheme.

The Crimes at Sea Act 2000 (NT) does not itself create new criminal penalties; rather, its enforcement mechanics operate by extending State substantive criminal law into maritime adjacent areas and by allocating procedural and administrative responsibilities for enforcement. Enforcement therefore principally occurs under State criminal statutes applied extraterritorially and under Commonwealth legislation that implements State law in the outer adjacent area (Schedule, cl 2(1)-(2)). Below are the core enforcement‑related mechanisms and remedial provisions in the Act and Schedule.

Prosecution pathways. Substantive offences are prosecuted under the territorial law that applies to the place where the acts are said to have occurred: in the inner adjacent area, the substantive criminal law applies by force of the State; in the outer adjacent area, it is applied by the Commonwealth (Schedule, cl 2). The classification of offences as indictable or summary for the purposes of Territory prosecutions is governed by s 5, which maps the cooperative scheme’s references to indictable/summary offences to the Criminal Code definitions (s 5(1)(a)-(b)), while preserving judicial discretion on whether an offence is tried summarily or on indictment (s 5(2)).

Stay remedy for intergovernmental agreement breaches. If a charge is brought contrary to the intergovernmental agreement, the court must permanently stay proceedings on application by the Commonwealth Attorney‑General or a participating State Minister (Schedule, cl 6(2)). The stay is mandatory on that application. The Schedule also provides that a contravention of the intergovernmental agreement does not affect a court’s jurisdiction (Schedule, cl 6(3)(a)), and courts are not to inquire into compliance with the intergovernmental agreement except where an application for a stay is made (Schedule, cl 6(3)(b)).

Commonwealth Attorney‑General consent and stays. Where an alleged offence occurred on or from a foreign ship registered under the law of another country and that country has jurisdiction under international law, written consent of the Commonwealth Attorney‑General is required before the charge proceeds to hearing or a preliminary examination for indictable offences (Schedule, cl 7(1)). If consent is refused, the court must permanently stay the proceedings (Schedule, cl 7(4)). However, practical enforcement actions, arrest, laying charges, extradition, remand, are not prevented by the absence of consent (Schedule, cl 7(3)). The Schedule also creates a pragmatic evidentiary rule accepting an apparently genuine copy of written consent as proof of consent, unless proved otherwise (Schedule, cl 7(5)).

Investigative and procedural enforcement. The law of criminal investigation, procedure and evidence applicable to an investigation or act determines how enforcement proceeds: Commonwealth law applies to Commonwealth authorities; State law applies to State authorities acting within their area of administrative responsibility; and the procedural law of the court where a proceeding begins applies in judicial proceedings (Schedule, cl 3(2)). That allocation affects admissibility of evidence, arrest powers, bail, committal proceedings and sentencing procedures,i.e., the practical steps of enforcement.

Evidentiary presumption on locus. The Schedule provides that in proceedings for a maritime offence proof of an element that is an act, omission or state of affairs permits an allegation that the act etc occurred in the adjacent area (or inner/outer) to be taken as proved absent proof to the contrary (Schedule, cl 4). This rebuttable presumption assists the prosecution on the locus element, thereby easing proof burdens for enforcement, unless the defence adduces contrary proof.

Administrative and regulatory enforcement constraints. The scheme permits the Governor‑General to make regulations and reserves a role for State Ministers in respect of regulations affecting inner adjacent areas (Schedule, cl 12). The Territory Administrator is not authorised to make regulations for purposes of the cooperative scheme (s 7(2)). Regulations can exclude particular State and Commonwealth laws from the scheme’s ambit (Schedule, cl 9), which can affect which offences are capable of enforcement under the scheme.

Judicial procedural constraints and constitutional limits. The Schedule recognizes constitutional limits on procedural aspects of trials in outer adjacent areas (Schedule, cl 3(2) example referring to Cheatle v The Queen). The Schedule also requires courts to apply jurisdiction‑specific procedural rules even where substantive law derives from another State. These constraints shape how enforcement can be carried out, for example by limiting available sentencing or jury rules in particular forums.

Non‑application of ADJR Act to State acts in adjacent area. The Schedule excludes the Administrative Decisions (Judicial Review) Act 1977 (Cth) from applying to decisions under State law that apply to State investigations, procedures and acts under Schedule, cl 3(2)(b) (Schedule, cl 3(5)). This narrows federal administrative review options for decisions taken by State authorities in the adjacent area.

In sum, enforcement under the Act operates through existing State and Commonwealth enforcement regimes, modified by the scheme’s allocation of substantive and procedural law, evidentiary presumptions, AG consent thresholds for foreign ships, and intergovernmental agreement enforcement via a mandatory stay mechanism. Penalties, where applicable, are those prescribed by the State substantive criminal laws applied in the relevant adjacent area; the Act does not prescribe additional penalties itself.

The Act and its Schedule are expressly designed to operate in a federal environment and therefore cross‑reference and interact with multiple Commonwealth and State instruments and constitutional principles.

Commonwealth maritime statutes and baselines. The Scheme’s spatial definitions for adjacent areas rely on Commonwealth maritime instruments. The “baseline of Australia’s territorial sea” and “territorial sea” references are those in the Seas and Submerged Lands Act 1973 (Cth) (Schedule, cl 13-15). The “adjacent area” definitions refer to the area described in Schedule 1 to the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) for each State or Territory (Schedule, cl 14). The Schedule explicitly identifies Appendix 1 to Schedule 1 of the Crimes at Sea Act 2000 (Cth) as containing an indicative map (Schedule, cl 16). Practitioners must therefore consult these Commonwealth instruments to determine precise geographic scope.

State criminal statutes and the Criminal Code. The Scheme applies State substantive criminal law extraterritorially (Schedule, cl 2). For prosecutorial classification in relation to Territory prosecutions, s 5 requires references in the cooperative scheme to “indictable” and “summary” offences to be read in light of the Criminal Code definitions (s 5(1)(a)-(b)). The scheme also incorporates State procedural rules into the Commonwealth context where State authorities exercise functions in their area of administrative responsibility, and it allows State law provisions to be applied by Commonwealth law in the outer adjacent area (Schedule, cl 2(2), cl 3(2)(b)).

Constitutional limits and s 109. The Schedule recognises that if a State provision is constitutionally limited within the State (for example by an inconsistency under s 109 of the Constitution), the same limitation applies when that provision is applied in the outer adjacent area under Commonwealth legislative power (Schedule, cl 2(3)(b) example). The Schedule’s example also references Cheatle v The Queen to illustrate limits on changing trial procedures (Schedule, cl 3(2) example). This reflects an interaction with constitutional law that may constrain how State law can operate once applied extraterritorially by the Commonwealth.

Judiciary Act 1903 and federal application of State law. The Schedule states that the “law of criminal investigation, procedure and evidence of the Commonwealth includes provisions of State law on the relevant subjects applied under the Judiciary Act 1903 (Commonwealth)” (Schedule, cl 1(2)). This explicitly links the cooperative scheme to the mechanism used under the Judiciary Act for applying State laws in federal courts or as Commonwealth law, affecting how procedural rules are imported and enforced.

Administrative law and judicial review. The Schedule expressly removes the Administrative Decisions (Judicial Review) Act 1977 (Cth) from applying to certain State decisions that govern investigations and acts by State authorities under Schedule, cl 3(2)(b) (Schedule, cl 3(5)). This interacts with federal administrative law by narrowing availability of ADJR review over some State actions in the adjacent area.

Regulations and regulatory competence. The Act and Schedule split regulation‑making power across offices. The Administrator may make regulations not inconsistent with the Act (s 7(1)) but cannot make regulations for the purposes of the cooperative scheme (s 7(2)). The Governor‑General may make regulations for the scheme (Schedule, cl 12(1)), and regulations affecting inner adjacent areas need the agreement of the participating State Minister (Schedule, cl 12(2)). Additionally, the Schedule permits regulations to exclude State and Commonwealth laws from the scheme’s ambit (Schedule, cl 9). In practice this requires attention to which instrument is the appropriate vehicle for any regulatory change.

Repeal and savings. The Act repeals the Criminal Law (Offences at Sea) Act 1979 (s 9) but preserves its operation in relation to acts and omissions that occurred before commencement day (s 10(2)-(3)). Practitioners must check timing to determine which regime applies to conduct spanning the commencement day.

Intergovernmental agreement and legal effects on courts. The intergovernmental agreement entered under Schedule, cl 5 becomes enforceable in practice through the Schedule’s rules: a charge must not be brought contrary to the agreement (Schedule, cl 6(1)), and a court must stay proceedings on application of the Commonwealth Attorney‑General or a participating State Minister (Schedule, cl 6(2)). The court’s role is limited: it need not examine compliance with the agreement except when a stay application is made (Schedule, cl 6(3)(b)), which interacts with judicial process and forum strategy.

International law and flag states. The Schedule requires the Commonwealth Attorney‑General to take account of any views expressed by the government of the flag state before granting consent to proceed in cases where the flag state has jurisdiction under international law (Schedule, cl 7(2)). The scheme thus interacts with international law principles of flag state jurisdiction and comity, and creates an executive check on prosecutorial progress where international jurisdictional claims exist.

Interpretation and Acts Interpretation Act. The Schedule confirms that the Acts Interpretation Act 1901 applies to the Scheme as it would to a Commonwealth act (Schedule, cl 11). This interacts with standard statutory interpretation principles and affects how provisions such as definitions, commencement and savings are read.

In short, the Act is a coordinating instrument that weaves State criminal law, Commonwealth maritime delimitation statutes, the Judiciary Act mechanism for applying State procedural law, constitutional limits, administrative law carve‑outs and international law considerations into a single cooperative framework. Work across the relevant Commonwealth schedules, State statutes, the intergovernmental agreement and constitutional doctrine is necessary to determine precise legal consequences in any incident.

The Endnotes and text provide a discrete amendment history within the source. Key amendments and legislative events affecting the Crimes at Sea Act 2000 (NT) are as follows, including dates and the nature of amendments recorded in the source.

Enactment and commencement. The Act was Assented to on 14 December 2000 and commenced 31 March 2001 (Gaz G11, 21 March 2001, p 3), as recorded in the Endnotes (Endnotes, item 2).

Statute Law Revision Act 2014. The Schedule was amended by the Statute Law Revision Act 2014 (Act No. 38 of 2014), s 2. The Endnotes note that the Schedule was amended by No. 38, 2014, s 2 (Endnotes, List of amendments). The Statute Law Revision Act is typically formal in nature and the Endnotes also note general amendments made by the Interpretation Legislation Amendment Act 2018 to ss 1, 9 and 10 and the long title (Endnotes, item 3), indicating some housekeeping changes not specified in detail in the main table of amendments.

Local Court (Related Amendments) Act 2016. Section 5 of the Crimes at Sea Act was amended by No. 8, 2016, s 45 (Endnotes, List of amendments; and Endnotes, item 2 lists the Act). The Local Court (Related Amendments) Act 2016 had Assent date 6 April 2016 and commenced 1 May 2016 (Endnotes, item 2). The Endnotes record s 5 amendment specifically as No. 8, 2016, s 45.

Justice and Licensing Legislation Further Amendment Act 2022. The Schedule was amended by No. 21, 2022, s 4. The Justice and Licensing Legislation Further Amendment Act 2022 (Act No. 21, 2022) had Assent date 31 October 2022 and commenced (part 3: 1 February 2023; remainder: 21 December 2022) with a Gazette reference (Endnotes, item 2). The Endnotes list the Schedule amendments as No. 21, 2022, s 4.

Interpretation Legislation Amendment Act 2018. The Endnotes state that general amendments of a formal nature to ss 1, 9 and 10 and the long title are made by the Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) and that these are not referred to in the table of amendments to the reprint (Endnotes, item 3). These are described as formal amendments.

Summary table from the source. The Endnotes contain a “List of amendments” indicating:

• s 5 amended by No. 8, 2016, s 45;
• Schedule amended by No. 38, 2014, s 2; No. 21, 2022, s 4 (Endnotes, item 4).

Repeal of earlier Act. The Act repealed the Criminal Law (Offences at Sea) Act 1979 (s 9). The Endnotes also mark the repeal in the text and the saving/transitional provisions preserve the earlier Act’s application to pre‑commencement conduct (s 10).

Commencement particulars. The Endnotes supply commencement detail: Assent date 14 December 2000; commencement 31 March 2001 (Gaz G11, 21 March 2001, p 3) (Endnotes, item 2). Additional Acts with later assents and commencement dates are listed in the Endnotes (e.g., Statute Law Revision Act 2014; Local Court amendments 2016; Justice and Licensing 2022).

What the amendments changed in substance. The source identifies which provisions were amended (s 5 and the Schedule), but does not provide full textual history in the reprint. Practitioners must inspect the specific amending Acts to determine the precise textual changes. The Endnotes indicate that s 5 was amended by the Local Court (Related Amendments) Act 2016 (No. 8, 2016, s 45), and the Schedule has been amended by the Statute Law Revision Act 2014 and the Justice and Licensing Legislation Further Amendment Act 2022. The Endnotes also note other formal amendments effected by the Interpretation Legislation Amendment Act 2018.

Practical consequence of amendments. The amendments identified in the source include procedural classification mapping (s 5 amendments) and Schedule adjustments; the precise operational changes require inspection of the 2014, 2016 and 2022 amending Acts for textual detail. The reprint’s Endnotes provide the trail to those Acts and commencement dates which determine when specific textual changes took effect (Endnotes, items 2-4).

In short, the Act has been amended several times since enactment in ways recorded in the Endnotes. For precise historical wording or to confirm whether a particular provision was altered substantively or only formally, practitioners should consult the cited amending Acts and the legislative history available in official reprints or the Gazette notices cited in the Endnotes.

The source provided contains no reported decisions specifically interpreting the Northern Territory Crimes at Sea Act 2000 itself. The Schedule, however, cites Cheatle v The Queen (1993) 177 CLR 541 as an illustrative constitutional limit on changing trial procedures (Schedule, cl 3(2) explanatory example). That is the only case named in the text.

The Schedule uses Cheatle v The Queen to exemplify how constitutional constraints may limit the procedural law that can be applied in judicial proceedings in outer adjacent areas. The example describes a scenario where convicting a defendant on a majority jury verdict would be contrary to the Constitution, and therefore a court could not convict on that basis even if State procedural law were applied in an outer adjacent area under Commonwealth power (Schedule, cl 3(2) example). The Schedule therefore anticipates constitutional litigation around procedural changes applicable extraterritorially.

Beyond this single example, the reprinted Act and Schedule include no catalogue of cases decided under the NT Act itself. The absence of litigation history in the source means that, within this document, there is no statutory interpretation jurisprudence recorded. Practitioners must therefore rely on general constitutional and federal jurisprudence, the cited example in the Schedule (Cheatle), and any subsequent case law not contained in the provided text.

If litigation has since occurred, the source does not record it; users should search case law databases and subsequent reprints or annotations for decisions interpreting issues such as: the reach of the evidentiary presumption about locus (Schedule, cl 4), the scope and legal effect of intergovernmental agreements and stays (Schedule, cl 6), the Attorney‑General consent requirement for foreign‑flag ships (Schedule, cl 7), and disputes about which procedural law governs particular investigative acts or judicial proceedings (Schedule, cl 3). The Schedule anticipates potential legal conflict points where litigation is likely to occur, notably in jurisdictional disputes, constitutional limits on procedural rules, and situations where the intergovernmental agreement allocation is contested.

In summary, the Act as reprinted does not include an internal litigation history beyond the explanatory reference to Cheatle v The Queen. For authoritative case law applying or construing the NT Act and its Schedule, independent case law research is necessary.

The Scheme contains a number of practical and technical traps for practitioners, investigators and policymakers. These “gotchas” derive from the text and are described here with specific clause references.

1. Spatial complexity and dependence on other statutes (Schedule, cl 13-16). The definition of adjacent areas is not self‑contained. You must consult the Schedule 1 area maps in the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) and the Seas and Submerged Lands Act 1973 (Cth) to determine whether conduct occurred in an inner or outer adjacent area and which State’s adjacent area is concerned. Failure to verify baselines and scheduled areas may lead to incorrect application of substantive or procedural law.

2. Substantive law applies “as in force from time to time” (Schedule, cl 2). This imports future State legislative changes into extraterritorial application absent exclusion. That means a State’s subsequent amendments, including decriminalisation or increased penalties, could take effect in the adjacent area unless expressly excluded by regulation (Schedule, cl 9). Practitioners should check the current State statute at the time of alleged conduct and at the time of proceedings.

3. Procedural law depends on which authority acts and forum (Schedule, cl 3). Investigators from different agencies operating at the same incident could be subject to different procedural rules (Commonwealth law for Commonwealth authorities, State law for State authorities). This can complicate evidence collection, custody, and admissibility, particularly where Commonwealth and State officers use different powers in parallel.

4. Evidentiary presumption about location (Schedule, cl 4). If an element of an offence is proved, an allegation that it occurred in the adjacent area, inner or outer, is taken to be proved unless disproved. This places a rebuttable evidential burden on defendants to show the offence did not occur in the alleged adjacent area. Practitioners should plan for proof challenges and forensic evidence to rebut the presumption.

5. Intergovernmental agreement as a jurisdictional gate. Charges “must not” be brought contrary to the intergovernmental agreement and courts must stay proceedings on application (Schedule, cl 6(1)-(2)). However, the court’s jurisdiction is not ousted by non‑compliance (Schedule, cl 6(3)(a)), and courts will not, absent application, enquire into compliance (Schedule, cl 6(3)(b)). This creates a tactical point: an authority could bring charges inconsistent with the agreement and force a political application for a stay. Defence lawyers should monitor whether an authorised minister has, or will, apply for a stay.

6. AG consent for foreign‑flag ships has limited interim effect (Schedule, cl 7). The absence of Attorney‑General consent does not prevent arrest, laying of charges, extradition, or remand (Schedule, cl 7(3)). That means a defendant could be physically detained and charged even where ultimate prosecution is stayed for lack of consent. A refusal to consent mandates a permanent stay once raised (Schedule, cl 7(4)), but that does not prevent interim disruption.

7. Evidentiary acceptance of apparent consent (Schedule, cl 7(5)). An apparently genuine document purporting to be AG consent is accepted, in the absence of proof to the contrary, as proof of consent. This can create authentication issues in contested prosecutions where the provenance of consent documents is in dispute.

8. Exclusion of ADJR Act for State acts (Schedule, cl 3(5)). Decisions taken under State law that apply to State investigations and acts in the adjacent area are not subject to the Administrative Decisions (Judicial Review) Act 1977 (Cth). This may limit federal judicial review avenues for affected persons, pushing challenges into State administrative law pathways or constitutional remedies.

9. Regulations are split across offices and constrained (s 7; Schedule, cl 12). The Territory Administrator may not make regulations for the cooperative scheme (s 7(2)), yet the Governor‑General can make regulations for the scheme (Schedule, cl 12). Regulations affecting inner adjacent areas require agreement of the participating State Minister (Schedule, cl 12(2)). This fragmentation can cause delays and complexity in regulatory responses or clarifications.

10. Constitutional limitations on procedural changes (Schedule, cl 3(2) example). Applying a State’s procedural rules in the outer adjacent area via Commonwealth power may be curtailed by constitutional constraints. The Cheatle example highlights that procedural differences that conflict with constitutional guarantees (e.g., jury trial composition) could invalidate particular applications. Lawyers must check constitutional compatibility when relying on procedural rules carried from States into the outer adjacent area.

11. Non‑exclusion of other State extraterritorial schemes (Schedule, cl 8). The Schedule does not exclude State laws that operate extraterritorially if those laws can operate consistently with the cooperative scheme, producing potential overlap and conflicts that require negotiation or regulatory exclusion under Schedule, cl 9.

12. Timing and transitional issues (s 9-10). The repeal of the 1979 Act is saved for pre‑commencement conduct (s 10). Conduct occurring around commencement day may require careful chronological analysis to determine which legislative regime applies (s 10(3)).

13. Difference in offence classification and procedural classification (s 5 and Schedule, cl 3). The classification of an offence as indictable or summary for Territory purposes is mapped to the Criminal Code (s 5(1)), but which procedural rules will apply depends on where the proceeding is commenced and which authority is acting (Schedule, cl 3). That can lead to strategic complexity for pleading, committal and trial routes.

These “gotchas” are procedural and jurisdictional in nature. They arise from the Scheme’s design to coordinate different jurisdictions, the need to import multiple other statutory instruments for geographic scope, and the interaction with constitutional and international law. Practitioners and agencies should check the governing intergovernmental agreement, the precise area maps, current State statutes, the provenance of any AG consent, and applicable regulations before proceeding.

Compliance under the Crimes at Sea Act 2000 requires attention to spatial boundaries, the appropriate substantive and procedural laws, administrative agreements, and ministerial consents. Below is a practical compliance checklist and workflow for prosecutors, investigators, legal advisers and regulators, grounded in the Act and Schedule.

1. Determine the geographic location and relevant adjacent area. Consult the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) Schedule 1 and the Seas and Submerged Lands Act 1973 (Cth) baseline and continental shelf definitions to identify whether the incident occurred in: (a) inside State limits; (b) the inner adjacent area (landward of baseline and within 12 nautical miles seaward, Schedule, cl 1 definitions and cl 2(1)); (c) the outer adjacent area (outside inner area up to 200 nm or continental shelf limit, Schedule, cl 2(2)); or (d) outside the adjacent area. The Act imports these definitions (Schedule, cl 13-16), and precise compliance depends on accurate mapping.

2. Identify which State’s adjacent area applies. The Schedule assigns adjacent areas to specific States and the Territory and excludes areas inside State/Territory limits (Schedule, cl 14(5)). For incidents near boundaries or overlapping zones, verify the relevant State designation and any proclamations (e.g., Queensland island proclamations, Schedule, cl 14(2)(c)).

3. Ascertain whether the substantive offence is one that can operate extraterritorially. Confirm the State substantive provision is not inherently territorial or expressly limited to within the State (Schedule, cl 2(3)(a)-(b)). If the offence includes localising elements (example given: driving on a road), it is not capable of application in the adjacent area.

4. Determine which substantive and procedural laws apply. If the matter is in the inner adjacent area, the State’s substantive criminal law applies by force of State law (Schedule, cl 2(1)). If in the outer adjacent area, the State substantive law applies by force of Commonwealth law (Schedule, cl 2(2)). For procedural matters: Commonwealth law applies to Commonwealth authorities (Schedule, cl 3(2)(a)); State law applies to State authorities acting within their area of administrative responsibility (Schedule, cl 3(2)(b)); in judicial proceedings the law of the jurisdiction where proceedings commence applies (Schedule, cl 3(2)(c)). For Territory prosecutions, classify offences as indictable or summary per Criminal Code definitions (s 5(1)).

5. Check the intergovernmental agreement. Locate and read the intergovernmental agreement published in the Gazette as required by s 6. That agreement allocates administrative responsibility and may create exclusive or concurrent jurisdictional arrangements (Schedule, cl 5). Ensure the intended charging decision is consistent with the agreement; if not, a minister may apply for a permanent stay (Schedule, cl 6).

6. If a foreign ship is involved, obtain AG pre‑consent where required. If the offence is alleged to have been committed on or from a foreign ship registered in another country and that country has jurisdiction under international law, do not proceed to hearing or to preliminary examination for indictable offences without written consent from the Commonwealth Attorney‑General (Schedule, cl 7(1)). Before deciding, seek any views from the flag state and forward them to the Attorney‑General (Schedule, cl 7(2)). Note that arrest and charge‑laying may proceed before consent, but a refusal to consent requires a permanent stay (Schedule, cl 7(3)-(4)).

7. Document consent and authenticate. If consent is granted, ensure a properly authenticated written copy is obtained and preserved; the Schedule treats an apparently genuine copy as prima facie proof of consent (Schedule, cl 7(5)).

8. Tailor investigative procedure to the acting authority. Ensure agency investigators are trained on which procedural rules govern their actions (e.g., arrest powers, warrants, evidence rules) depending on whether they are Commonwealth or State officers and on where within the adjacent area they operate (Schedule, cl 3(2)(a)-(b)). Where operations involve multiple agencies, coordinate to ensure compatibility of procedures and admissibility of evidence.

9. Anticipate evidentiary issues about locus (Schedule, cl 4). Be prepared to establish or rebut the Schedule’s rebuttable presumption that, once an act is proved, the allegation that it occurred in the adjacent area is taken to be proved unless contradicted. Defence counsel should plan evidence to displace the presumption; prosecutors should be ready to rely on it and to adduce corroborating location evidence.

10. Be mindful of ADJR exclusion and other review paths (Schedule, cl 3(5)). For State acts that fall within Schedule, cl 3(2)(b), the Administrative Decisions (Judicial Review) Act 1977 (Cth) will not apply. Identify appropriate State administrative review or judicial review options instead.

11. Check regulatory instruments. Be aware that the Governor‑General may make regulations for the scheme (Schedule, cl 12(1)), and regulations affecting the inner adjacent area require agreement of the participating State Minister (Schedule, cl 12(2)). The Territory Administrator may not make regulations for purposes of the cooperative scheme (s 7(2)). Confirm whether any regulations or exclusions under Schedule, cl 9 affect the substantive law in question.

12. Record interagency agreements and chain of responsibility. Maintain clear records showing which authority assumed or was allocated responsibility by the intergovernmental agreement and which authority investigated, charged and conducted proceedings. This record is crucial if a stay application or jurisdictional dispute arises under Schedule, cl 6.

13. Consider constitutional constraints on procedural adaptations. If planning to use procedural rules that differ materially from constitutional guarantees (e.g., jury composition, sentencing forms), check for possible constitutional limits illustrated in the Schedule’s example referencing Cheatle v The Queen (Schedule, cl 3(2) example).

14. Time AG/Ministerial processes into charging decisions. Given that an application for a stay may be made by the Commonwealth Attorney‑General or participating State Minister (Schedule, cl 6(2)), coordinate with prosecuting authorities and government legal advisers before charging where there is any risk of contravening the intergovernmental agreement or flag‑state jurisdiction.

15. Ensure publication obligations are met. For the Territory, publish the intergovernmental agreement and amendments as required by s 6, and confirm that the up‑to‑date intergovernmental agreement is available in the Gazette.

By following this workflow,in particular, mapping the geography, confirming the applicable substantive and procedural law, checking the intergovernmental agreement, and observing AG consent rules, prosecutors and investigators will align operational decisions with the statutory scheme. Defence counsel should probe the same points to test jurisdiction, procedural compliance and evidentiary presumptions.
