28 Mental health facility to notify NSW Trustee of certain events—the Act, s 128(1)

28 Mental health facility to notify NSW Trustee of certain events—the Act, s 128(1)

(1) This section applies if one or more of the following events occur for a patient who is or was a managed person—

(a) the patient’s discharge from a mental health facility,

(b) the patient’s transfer from a mental health facility,

(c) the patient’s absence with or without leave from a mental health facility,

(d) the patient’s return to a mental health facility from leave,

(e) the patient’s death at a mental health facility.

(2) The authorised medical officer of the relevant mental health facility must give the NSW Trustee written notice of the event as soon as practicable.

(3) If a patient has a leave plan, a copy of the plan may be given instead of the notice for an event referred to in subsection (1)(c) and (d).
