What it does
This Act establishes the NSW Self Insurance Corporation (the Corporation) as a statutory corporation representing the Crown (s 4). It vests operational control in a ministerially appointed chief executive who manages the Corporation’s affairs and acts under any directions of the Minister (s 5(1)-(3), sch 1A). The Corporation is to exercise a range of insurance and fund-management functions: operate Government managed fund schemes (s 8(1)(a)), provide insurance required by the Home Building Act 1989 (Part 6) and manage the Home Building Compensation Fund (s 8A(1)(a)-(b), s 12A), provide principal arranged construction insurance and manage the Construction Risks Insurance Fund for major capital works projects (s 8C(1)-(2), s 12C), and provide special liability insurance and manage the Special Liability Insurance Fund for certain Crown-contracted services (s 8D(1), ss 12DB-12DD). The Corporation also has general functions conferred by other Acts (s 7).
The Act establishes separate funds in the Special Deposits Account for these activities: the Self Insurance Fund for Government managed fund schemes (s 11), the Home Building Compensation Fund for home warranty insurance receipts and payments (s 12A), the Construction Risks Insurance Fund for principal arranged construction insurance (s 12C), and the Special Liability Insurance Fund for special liability insurance (ss 12DB-12DD). Each fund’s permitted receipts and permitted payments are specified, including premiums, re-insurer receipts, recoveries by subrogation, appropriations, investment proceeds and specified transfers between funds (ss 11(1), 12A(2), 12C(2), 12DC).
The Corporation may enter into agency, broker and other commercial arrangements for services, including appointing insurance agents and brokers (s 8A(1)(c), (4)); it may enter into insurance or indemnity arrangements to cover liabilities arising under Government managed fund schemes (s 8(1)(c)). The Act declares entering into such insurance or indemnity arrangements to be an excluded matter for Chapter 7 of the Corporations Act in New South Wales (s 8(4)). The Corporation has delegation powers limited to authorised persons (s 9), may invest fund money subject to the Government Sector Finance Act 2018 or Ministerial approval (ss 12, 12E), and the Treasurer may direct payment of surpluses from the Self Insurance Fund to the Consolidated Fund (s 11(4)-(5)). The Act gives the Minister and Treasurer specific controls and directs a parliamentary review of the special liability insurance amendments within a set period (s 18).
