Notifiable Diseases Act 1981

The Act is organised around a small set of recurring legal concepts: notifiable disease declarations; duties to seek medical advice and report; medical officer notices and Chief Health Officer orders; isolation area powers; compensation and recovery; secrecy and disclosure protections; liability defences for blood supply activity; and regulation-making power.

Notifiable disease declarations and specification: The Minister may declare diseases to be notifiable by Gazette notice (s 6). Once declared, the Minister may specify particular information and the manner of disclosure required of medical practitioners (s 8(1)). The same mechanism applies to pathology investigations (s 16(1)). Practically this means compliance obligations pivot on what the Minister actually gazettes; the statutory regime confers no single static list in the Act text , the list and reporting formats are instruments of public administration implemented by Gazette notices (s 6; s 8(1); s 16(1)).

Notification duties and diagnostic procedures: A person who reasonably believes they may be infected or a suspect person must consult a medical practitioner at the first reasonable opportunity (s 7). Medical practitioners must report prescribed information about infected or suspect persons to a medical officer (s 8(2)-(3)). The Act defines medical examination to include diagnostic procedures (s 5). Laboratories have an analogous duty to report results indicating infection to the Chief Health Officer (s 16(2)-(3)). The Act therefore establishes a chain of reporting from patient to clinician to medical officer and from laboratory to Chief Health Officer.

Medical officer notices and review: A medical officer may serve written notice personally on an infected or suspect person directing measures believed necessary for treatment or to prevent spread (s 11(1)-(2)). The Act provides a review route: NTCAT has jurisdiction to review a medical officer’s decision to serve a section 11 notice, and may confirm, vary or revoke the notice (s 12(1)-(3)). The 2023 amendments constrain NTCAT review to notices served after commencement of the amending Act, and transitional provisions preserve certain Local Court rights for matters started before the change (Pt 6, ss 42-45).

Chief Health Officer enforcement and isolation area powers: If a person fails to comply with a notice under s 11, the Chief Health Officer may make any order it thinks fit to ensure compliance (s 13(1)), including removal and detention at a hospital or other place (s 13(2)(a)), closure or disinfection of premises (s 13(2)(b)) and destruction or disinfection of contaminated items (s 13(2)(c)). The Administrator or Minister may declare an isolation area (s 17). Within an isolation area the Chief Health Officer may prohibit movement of classes of people or goods, require persons to report and submit to medical examinations and treatment, and authorise destruction or treatment of infrastructure or goods suspected to be infected (s 18(1)). Powers to question people who have been in an isolation area are set out in s 19, with a statutory duty to answer truly to the best of one’s knowledge (s 19(2)). A person suspected of having left an isolation area in contravention may be arrested without warrant (s 20(1)).

Compensation and financial allocation: The Crown must compensate persons who suffer loss or damage directly caused by an order of the Chief Health Officer under this Act, subject to section 22 which excludes compensation for loss self-induced by failing to comply with an order or to take reasonable precautions (s 21; s 22). Compensation disputes may be determined by the Local Court (s 21(2)-(3)). Compensation paid by the Crown is a debt due by the Crown (s 24), and the Crown can seek recovery from offenders (s 25).

Secrecy and disclosure: There is a stringent secrecy obligation on public sector employees or others assisting in administration of the Act to preserve secrecy in matters that come to their knowledge, with a maximum penalty of two years imprisonment (s 29(1)). Separately, s 30 protects persons acting in good faith under the Act from civil action, claim or demand, subject to the compensation scheme in s 21.

Liability framework for blood-borne transmittable diseases: Part 3A introduces a statutory structure for litigation arising from transmission of specified transmittable diseases via blood supplied by the Australian Red Cross Society or blood products derived from that blood. It defines “specified action” and “transmittable disease” (s 26A(1)). The Act sets out specified requirements for taking blood: obtaining an approved donor declaration and performing approved testing with negative results before supply (s 26A(2)). If the Society, its officers, or persons taking blood on its behalf complied with those requirements, that compliance is a defence in specified actions (s 26B). Similarly, hospitals and practitioners have a defence if a certificate purporting to be signed by the lab head accompanies the container stating testing by approved equipment and methods yielded negative results, or if the Society complied with the specified requirements (s 26C). The defences are withdrawn if the Society or others had reasonable grounds to believe blood was likely to be infectious and did not take reasonable steps to ascertain use or to prevent administration (s 26D). Donors who make false statements on a required declaration commit an offence with a significant penalty (s 26E(1)); otherwise donors are immune from civil proceedings based only on transmission (s 26E(2)).

Evidence rules and administrative instruments: The Act admits certificates from labs as evidence (s 26F) and provides that averments by prosecutors that an area was an isolation area, certificates that a person was infected or suspect, and pathology certificates are prima facie evidence (s 37). The Chief Health Officer may publish the approved donor declaration form on the Agency’s website (s 26A(4)). The CHO may keep registers of infected or suspect persons (s 27). Delegation of CHO powers is permitted by written instrument (s 31).

Regulatory architecture and hierarchy: The Administrator may make regulations for the Act, including prescribed forms and penalties not exceeding 8 penalty units or 6 months (s 39(1)). The Emergency Management Act 2013 takes precedence where inconsistency arises (s 28). The Act contains transitional provisions responding to subsequent legislative changes, notably the Health Legislation Amendment Act 2021 (Pt 5, s 40) and the Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023 (Pt 6, ss 41-45), showing the statutory architecture is intended to be integrated with broader public health and tribunal arrangements.

The Act’s obligations, protections and enforcement mechanisms affect a range of identifiable actors across public and private sectors. Below is a practical mapping of who is affected and in what way, with statutory citations.

Individuals (patients, infected or suspect persons): Individuals who are infected or suspect persons are subject to duties to seek medical advice (s 7), to provide names and addresses of contacts to medical practitioners, medical officers or authorised persons (s 9), and to obey notices served under s 11(1) which require measures for treatment or to prevent spread. A person served with a section 11 notice must carry out the measures directed (s 11(2)). A person who leaves an isolation area contrary to an order may be arrested without warrant and detained for medical examination or treatment (s 20(1)-(2)). Individuals may be entitled to compensation from the Crown if they suffer loss or damage directly caused by a Chief Health Officer order (s 21), subject to exclusions where the loss was self-induced by failure to comply or to take reasonable precautions (s 22).

Medical practitioners and medical officers: Medical practitioners have affirmative reporting duties when diagnosing infection or suspect cases in relation to gazetted notifiable diseases; they must give the required information to a medical officer and in the prescribed manner (s 8(2)-(3)). They must advise infected adults and, in the case of children, parents or guardians of the nature of the disease and preventive measures (s 10). Medical officers may issue section 11 notices and may order disposal or treatment of infected bodies (s 11; s 15). Medical officers and authorised persons may carry out questions and investigative functions within isolation areas (s 19), and are subject to offences for bribery, collusion or obstruction (ss 34-35).

Laboratories and persons in charge of pathology investigations: Laboratories that obtain results indicating infection in relation to gazetted diseases must notify the Chief Health Officer in the manner specified (s 16(2)-(3)). Laboratory heads may provide certificates under s 26F which are admissible evidence of testing having been performed using approved equipment and methods and of the results obtained. Laboratories and those in charge are also potentially the source of certificates which, if attached at administration time, operate as part of the defence set out in s 26C.

The Australian Red Cross Society and blood suppliers: Part 3A explicitly treats the Society as a class of actor affected by statutory defences and duties. The Society, officers, employees and persons acting for the Society are afforded a defence in specified actions if the Society complied with the specified requirements in taking blood and testing, processing and handling blood and blood products (s 26B). Those requirements include obtaining an approved donor declaration and testing using approved equipment and methods with a negative result (s 26A(2)-(3)). The Society also bears obligations to take reasonable steps to ascertain use of blood and to prevent administration if it later has reasonable grounds to suspect contamination (s 26D(1)).

Hospitals and medical practitioners who administer blood or blood products: Hospitals or bodies where Society-supplied blood is administered, and medical practitioners who administer or authorise administration, have potential statutory defences where a certificate from a laboratory purports to confirm approved testing and negative results, or where the Society complied with the specified requirements (s 26C). The defence will not apply if the hospital or practitioner had been informed that the blood was likely to contain a pathogen and did not take reasonable steps to prevent administration (s 26D(2)-(3)).

Employers, premises owners and businesses in isolation areas: The Chief Health Officer may order premises to be closed, disinfected or otherwise treated (s 13(2)(b)). In isolation areas declared under s 17, the Chief Health Officer may prohibit movement of goods and people, and authorise destruction or treatment of buildings, water supplies and other things (s 18(1)(b); s 18(1)(d)). Those actions may lead to compensable losses under s 21, but only where losses are not self-induced under s 22. Goods removed in breach of orders may be forfeited to the Crown (s 20(3)).

Police and authorised persons: The Act allows members of the Police Force to give effect to orders in isolation areas (s 18(2)(b)). The Chief Health Officer may delegate powers and functions to authorised persons by instrument in writing; those delegates act under the title authorised person in relation to delegated powers (s 31(1), (4)). A person impersonating any of these roles commits an offence (s 23(1)).

Public sector employees and administrative officials: Employees involved in administration of the Act or present where matters under the Act concerning another person are discussed are subject to secrecy obligations and may be penalised for breaches (s 29(1)). The Chief Health Officer may keep registers of infected and suspect persons (s 27), and is required to publish approved donor declaration forms on the Agency’s website (s 26A(4)). The Administrator or Minister and the Chief Health Officer exercise decision-making authority in declaring isolation areas (s 17(1)) and making orders respectively (s 13; s 18).

Claimants and defendants in civil litigation: The Act affects civil litigation by providing statutory defences for the Society, hospitals and practitioners (ss 26B-26C), by preserving civil remedies notwithstanding compensation orders (s 26), and by specifying evidentiary certificates (s 26F). Donors are largely protected from civil proceedings arising solely from transfusion transmission (s 26E(2)), subject to the false declaration offence (s 26E(1)).

Regulatory and tribunal institutions: NTCAT has jurisdiction to review medical officer notices under s 11 for notices served after 27 November 2023, following the Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023 (s 12 as amended; Pt 6, ss 41-45). Transitional provisions preserve Local Court appeal routes for earlier decisions (Pt 6, ss 42-45). The Administrator may make regulations (s 39), and prosecutions for offences under the Act require Chief Health Officer approval before commencement (s 38(3)).

Collectively, the Act places duties and potential liabilities on clinicians, laboratories, blood suppliers, hospitals and individuals, while giving broad operational discretion to public health authorities and providing specific defences and evidentiary mechanisms for blood-supply actors.

This section identifies the principal statutory duties imposed and the rights preserved or created by the Act, with section citations and practical notes on who bears the obligations.

Duties imposed on individuals

• Duty to seek medical advice: Any person who has reasonable grounds to believe they may be infected or a suspect person must consult a medical practitioner at the first reasonable opportunity (s 7). Practical consequence: individuals are expected to present for clinical assessment early.
• Duty to provide contact details: An infected person must provide names and addresses of persons from whom they may have contracted the disease; a suspect person must provide names and addresses of persons with whom they have been in contact during a specified period (s 9). The duty is owed to a medical practitioner, medical officer or authorised person and is intended to support contact tracing.

Duties on medical practitioners and laboratories

• Notification duties: Medical practitioners must supply to a medical officer the information required to be given in relation to a notifiable disease listed under a Ministerial Gazette notice and in the manner prescribed (s 8(1)-(3)). Laboratories must give to the Chief Health Officer the information required in relation to a notifiable disease when pathology investigation results indicate infection (s 16(2)-(3)).
• Diagnostic and advisory duties: Medical practitioners diagnosing infection or identifying suspect persons must advise the person (or, for children under 16, the parents or guardian) of the nature of the disease and measures necessary to prevent spread; for older children the practitioner may also advise parents (s 10).

Powers and duties of medical officers and the Chief Health Officer

• Issuing and enforcing notices: Medical officers may serve written notices under s 11(1) directing infected or suspect persons to carry out measures for treatment or to prevent spread. Persons served must comply (s 11(2)). The Chief Health Officer may ensure compliance by making any order it thinks fit, including removal and detention, closure or disinfection of premises, destruction or disinfection of articles, and treatment of water supplies (s 13(1)-(3)).
• Isolation area powers: In declared isolation areas, the Chief Health Officer may prohibit movement of persons and goods, require reporting and medical examinations, and authorise destruction or treatment of potentially infected infrastructure or goods (ss 17-18). Medical officers and authorised persons may question people about their presence in an isolation area and contacts (s 19).

Rights to review, compensation and legal protection

• Right of review: The person served with a section 11 notice may apply to NTCAT for review (s 12(2)). NTCAT may confirm, vary or revoke the notice (s 12(3)). Transitional provisions (Pt 6, ss 42-45) limit NTCAT review to decisions made after the 2023 commencement and preserve Local Court rights for appeals commenced under the former Act.
• Compensation: A person who suffers loss or damage directly caused by an order of the Chief Health Officer is entitled to compensation by the Crown subject to exclusions (s 21(1); s 22). Compensation disputes may be litigated in the Local Court (s 21(2)).
• Civil remedies preserved: An order for compensation under the Act does not affect a person’s civil right to compensation or damages in respect of loss or damage (s 26). This preserves access to civil actions alongside statutory compensation remedies.

Protections and evidentiary mechanisms

• Statutory defences for blood supply and administration: If the Australian Red Cross Society and associated actors complied with specified donor-declaration and testing requirements, that compliance is available as a statutory defence in specified actions alleging transmission of listed transmittable diseases (s 26B). Hospitals and medical practitioners may rely on certificates purporting to be signed by lab heads, stating that approved testing showed negative results, or on evidence the Society complied with the specified requirements (s 26C).
• Evidentiary certificates and prima facie averments: Certificates purporting to be signed by laboratory heads are admissible evidence of testing and results (s 26F). The Act provides that averments that an area was an isolation area, or certificates that a person was an infected or suspect person, are prima facie evidence (s 37).

Secrecy and disclosure protections

• Secrecy obligations: Employees and other persons assisting with the administration of the Act must preserve secrecy concerning matters that come to their knowledge, subject to duties under the Act or required answers (s 29(1)). There is a maximum penalty of two years imprisonment for breach.
• Protection for disclosures made in good faith: Subject to the compensation scheme, no action lies against a person for acts or omissions done in good faith in the exercise of powers or performance of functions under the Act (s 30). This provides legal cover for officials and others acting under the Act’s authority.

Enforcement constraints and procedural protections

• Prosecution approval: A prosecution for an offence under the Act cannot be commenced unless approved by the Chief Health Officer (s 38(3)). This grants the Chief Health Officer a gatekeeping role in initiating criminal proceedings under the Act.
• Regulatory offence classification: Contravention of certain provisions (s 11(2), s 15(3), s 19(2)) are regulatory offences (s 38A). That classification commonly affects enforcement mechanisms and procedures; the Act formalises which provisions are treated differently.

Administrative duties and powers

• Registers: The Chief Health Officer may maintain registers of persons who are or were infected or suspect persons (s 27).
• Delegation: The Chief Health Officer may delegate powers and functions under the Act by written instrument, creating authorised persons for the exercise of those powers (s 31(1), (4)). Delegations are revocable at will (s 31(3)).

In short, duties fall primarily on individuals (seek advice, provide contacts), clinicians and laboratories (reporting, advising, testing), blood suppliers (procedural compliance if seeking statutory defences), and public health officials (issuing notices, orders, enforcement and compensation decisions). Rights include administrative review; compensation subject to statutory limits; evidential protections for compliant blood-supply processes; and statutory protections for officials acting in good faith.

The Act provides a mixture of criminal penalties, regulatory offences, administrative enforcement powers and remedies in civil and compensation contexts. This section itemises the principal enforcement instruments, associated sanctions and procedural controls.

Criminal offences and maximum penalties

• Impersonation: A person who falsely holds themselves out as the Chief Health Officer, a medical officer, a medical practitioner, a member of the Police Force or an authorised person commits an offence. Maximum penalty: imprisonment for 2 years (s 23(1)). The section also provides that victims who consented under a reasonable belief of authority may be compensated by the Crown for loss directly caused by the impersonation (s 23(2)).
• Donor false declaration: A person who makes a materially false statement in the donor declaration required by s 26A(2)(a) commits an offence. Maximum penalty: 85 penalty units or imprisonment for 2 years (s 26E(1)). This is the Act’s most significant monetary and custodial penalty specifically aimed at blood donors.
• Bribery, collusion and improper influence: A person who offers, promises or pays a bribe to induce neglect of duty by a medical practitioner, medical officer or authorised person, or who attempts to improperly influence or assault such an officer, commits an offence. Maximum penalty under s 34: 8 penalty units or imprisonment for 6 months. A medical practitioner, medical officer or authorised person who accepts a bribe or colludes to neglect duty commits a distinct offence punishable by imprisonment for 3 years (s 35).
• Secrecy breaches: Public sector employees and other persons bound by s 29 must preserve secrecy; breach attracts a maximum penalty of imprisonment for 2 years (s 29(1)).
• Unlawful destruction: The Act forbids unlawful destruction or damage of goods by a medical officer or authorised person (s 36). The provision imposes an obligation on officers to act lawfully when exercising powers of destruction.
• General contraventions: Section 38(2) provides that failing to comply with a provision or order of the Act for which no other penalty is provided is punishable by a fine not exceeding 8 penalty units or imprisonment for 6 months.
• Regulatory offences: Section 38A specifies that contravening or failing to comply with s 11(2) (failure to comply with a notice), s 15(3) (compliance with medical officer order on disposal of body) or s 19(2) (obligation to answer questions truly) are regulatory offences. The Act does not specify the penalty in s 38A itself but cross-references that these are regulatory in nature, which interacts with the Criminal Law (Regulatory Offences) Act 1983 and related procedure. See s 38A.

Administrative enforcement powers

• Arrest without warrant: A person suspected of having left an isolation area in contravention of an order may be arrested without warrant (s 20(1)). Following arrest the person shall, if practicable, be placed in isolation and required to submit to medical examination and treatment as the Chief Health Officer thinks fit (s 20(2)).
• Forfeiture and disposal of goods: Goods removed from an isolation area in contravention of an order are forfeited to the Crown and may be seized, treated, destroyed or disposed of as the Chief Health Officer thinks fit (s 20(3)).
• Orders with immediate effect: The Chief Health Officer may issue orders to give effect to notices and ensure compliance, including removal and detention, closure of premises, destruction/disinfection of articles and remedial actions to water supplies (s 13(1)-(3)). Actions necessary to give effect to an order may be taken by a medical officer, a member of the Police Force, or an authorised person (s 18(2)).

Compensation regime and recovery

• Crown liability to compensate: Where a person suffers loss or property damage directly caused by a Chief Health Officer order, the Crown must compensate the person, subject to s 22 (self-induced loss) (s 21(1)). If the Chief Health Officer and the person cannot agree on compensation, the person may apply to the Local Court to determine the amount (s 21(2)). Compensation is a debt due by the Crown (s 24).
• Exclusions: A person is not entitled to compensation where the loss was caused by their failure to comply with an order under s 18 or their failure to take reasonable precautions to prevent the need for action under s 18 (s 22).
• Recovery from offenders: If an impost compensation amount is paid by the Crown in respect of loss or damage caused by the conduct of a person found guilty of an impersonation offence (s 23(1)), the Crown may, by application to a court, obtain an order that the offender refund the compensation amount wholly or in part, and any costs awarded (s 25).

Procedural controls on prosecutions and evidence

• Chief Health Officer approval for prosecution: A prosecution for an offence under the Act cannot be commenced unless it is approved by the Chief Health Officer (s 38(3)). This provision centralises prosecutorial gatekeeping in the Chief Health Officer and has practical implications for enforcement discretion and consistency.
• Evidentiary certificates and averments: Certificates from laboratory heads attesting to testing methods and results are admissible evidence (s 26F). Section 37 provides that averments in a complaint that an area was an isolation area, certificates that a person was infected or suspect, or pathology certificates establishing a notifiable disease, are prima facie evidence, easing prosecution proof burdens in relevant proceedings.

Interaction with regulatory offences and other legislation

• Regulatory offences under s 38A interact with the Criminal Law (Regulatory Offences) Act 1983 (see endnotes and amendment history). Regulatory offences typically permit different procedural treatment, including possible summary disposition or administrative enforcement pathways; the Act’s classification signals Parliament’s intention that certain public health compliance failures are to be treated under a regulatory enforcement model rather than traditional criminal procedure.
• The Emergency Management Act 2013 prevails to the extent of inconsistency (s 28), which means in declared emergency situations powers and penalties under that Act may supersede or alter enforcement mechanics under the Notifiable Diseases Act.

In practice the enforcement architecture combines coercive public health powers (detention, seizure, destruction), criminal sanctions for targeted misconduct (impersonation, false donor declarations, bribery), administrative checks (CHO approval for prosecutions, NTCAT review for notices), and a compensation regime that places the financial burden of public health interventions on the Crown with statutory exceptions.

The Act does not operate in isolation. It is expressly and implicitly integrated with other statutory frameworks. This section identifies the statutory interaction points recorded in the Act and in the endnotes, and summarises the practical legal consequences.

Emergency Management Act 2013

• The Act contains a direct primacy clause: where an order or direction under, or a provision of, this Act is inconsistent with the Emergency Management Act 2013, that other Act or an order or direction under that Act shall prevail to the extent of the inconsistency (s 28). Practical implication: in formal emergency declarations and response regimes, the Emergency Management Act’s instruments will take precedence, and local public health measures under the Notifiable Diseases Act must yield to emergency management orders when conflict arises.

Public and Environmental Health Act 2011

• The Act defines “medical officer” by reference to the Public and Environmental Health Act 2011, identifying an authorised officer who is a medical practitioner or entitled to be registered as one (s 5). This cross-reference integrates professional authorisation and broader public health administrative regimes, aligning powers and roles.

Tribunal and court review framework

• The Act originally provided for appeal routes to the Local Court in relation to medical officer notices under s 12. The Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023 amended the Act so that NTCAT has jurisdiction to review a medical officer’s decision to serve a notice under s 11(1) (s 12 as substituted by s 101 of the 2023 amending Act and transitional Pt 6). Part 6 of this Act contains detailed transitional provisions (ss 41-45) that preserve Local Court appeals in specific circumstances where appeals were available or commenced before the NTCAT conferral commenced. Practical implication: tribunals and courts remain relevant fora for administrative review but the locus of review has shifted for decisions made after the 2023 commencement.

Criminal Law (Regulatory Offences) Act 1983 and penal architecture

• The Act’s creation of “regulatory offences” under s 38A interacts with the Criminal Law (Regulatory Offences) Act 1983, altering enforcement and procedural approaches for covered contraventions. The endnotes list the 1983 Act and related amendments. Practical implication: some public health contraventions are intended to be enforced through regulatory mechanisms rather than conventional criminal prosecutions.

Health Legislation Amendment Act 2021

• The Health Legislation Amendment Act 2021 amended various Parts of this Act and added transitional provisions (Pt 5, s 40). Notably, approvals of donor declaration forms in effect immediately before the amendment continue as if given by the Chief Health Officer under the amended section (s 40(1)). Practical implication: continuity of administrative instruments when statutory responsibility shifts to an administrative officer.

Local Court and compensation procedures

• The Act provides that compensation disputes under s 21 may be determined by the Local Court (s 21(2)-(3)). The Local Court’s procedures and rules therefore interact with the compensation regime. The Administrator may make regulations prescribing procedures and forms for applications to the Local Court to determine compensation (s 39(2)).

Evidence and civil litigation

• Part 3A creates statutory defences and evidentiary presumptions for specified actions relating to transfusion-transmitted diseases. Those defences and certificate rules (ss 26B-26F) interact with general civil law of negligence and product liability. Section 26 preserves civil remedies despite statutory compensation orders (s 26), but the statutory defences reduce exposure for the Australian Red Cross Society, hospitals and practitioners when specified administrative and testing requirements are met. Practical consequence: civil litigants will need to address compliance with the statutory requirements and the admissibility of certificates under s 26F.

Delegation and public sector employment law

• Delegation under s 31 interacts with public sector instruments and the Public Sector Employment and Management Act 1993 as regards who is an employee and is bound by secrecy obligations (s 29 refers to that Act). Practical consequence: administrative delegation must be by written instrument; employees performing delegated functions are obliged to maintain statutory secrecy.

Regulatory instruments and Gazette notices

• Multiple operative features in the Act depend on Ministerial Gazette notices: declaration of notifiable diseases (s 6), specification of information and manner for notifications (s 8(1); s 16(1)), and declaration of isolation areas (s 17(1)). The Act also empowers the Administrator to make regulations (s 39). Practical consequence: much of the day-to-day scope of obligations and rights is determined by subordinate instruments and Gazette notices which must be monitored by practitioners, laboratories and institutions.

Overall the Act’s design expects operational integration with emergency management law, public health administrative statutes, tribunal and court review structures, and regulatory enforcement regimes. Practitioners and affected entities must therefore manage compliance across statutory layers, monitor Gazette notices and delegated instruments, and be aware that tribunal jurisdiction and review pathways have changed with the 2023 amendments.

The Act has been amended repeatedly since assent in 1981. The endnotes and list of amendments in the reprint record the principal legislative changes. This section summarises those textual and structural changes as recorded in the Act’s endnotes and amendment list, with reference to the specific amending Acts.

Foundational enactment and early amendments

• The Notifiable Diseases Act 1981 (Act No. 34, 1981) received assent on 30 March 1981 and commenced on 1 July 1981 (Endnotes, List of legislation). The Act repealed a range of earlier ordinances listed in Schedule 1 (s 3; Schedule 1).

Insertion of liability scheme for blood-borne diseases (1985)

• Part 3A (ss 26A-26F) was inserted by the Notifiable Diseases Amendment Act 1985 (Act No. 46, 1985). The insertion created the statutory liability and defence framework for the Australian Red Cross Society and related blood-supply actors. The 1985 Act also introduced related schedules and transitional provisions referenced in the endnotes.

Further amendments through the 1990s

• The Act underwent a sequence of amendments and statute law revision acts in the 1980s and 1990s. The Notifiable Diseases Amendment Act 1998 (Act No. 82, 1998) amended several provisions in Part 3A and elsewhere (List of amendments). Statute Law Revision Acts in 1985, 1989 and 1997 made formal amendments of a technical nature (Endnotes 3). Local Court consequential amendments in 1989 and 1990 adjusted contestation and appeal routes.

Integration with modern public health law (2011)

• The Public and Environmental Health Act 2011 (Act No. 7, 2011) affected the definition and role of medical officers referred to in s 5 of this Act (Endnotes list). The 2011 amendments, and the 2011 Penalties Amendment Act, updated penalties and definitions to align with the broader public health legislative framework.

Regulatory and penal adjustments (1983, 1996, 2011)

• The Criminal Law (Regulatory Offences) Act 1983 (Act No. 68, 1983) and the Sentencing (Consequential Amendments) Act 1996 (Act No. 17, 1996) affected how certain contraventions are treated as regulatory offences and adjusted sentencing consequences (Endnotes List of legislation; List of amendments s 38 and s 38A references).

Health Legislation Amendment Act 2021

• The Health Legislation Amendment Act 2021 (Act No. 20, 2021) made several amendments and added Part 5 (Transitional matters) to this Act. It amended part headings and specific sections, including s 17 (declaration of isolation area), and provided transitional continuity for approvals of forms of declaration under s 26A(3) (s 40). The List of amendments identifies numerous section amendments flagged No. 20, 2021 (see endnotes and the List of amendments for specific sections).

Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023

• The most recent recorded amendment is the Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023 (Act No. 24, 2023), which received assent on 21 September 2023 and commenced on 27 November 2023 (Endnotes). This amending Act substituted s 12 and s 13(1) to confer jurisdiction on the Northern Territory Civil and Administrative Tribunal (NTCAT) to review medical officer decisions under s 11(1) in reviews commenced after the 2023 commencement (List of amendments; Pt 6 transitional). The Act also inserted Part 6 containing transitional provisions (ss 41-45) that limit NTCAT review to notices served after commencement and preserve existing Local Court appeal rights for matters commenced or in progress before the conferral.

Other statutory housekeeping and technical amendments

• A number of statute law revision and related Acts from 1985 through 2018 made amendments of a formal or technical character to sections 1, 3, 4, 5, 28 and 29 (Endnotes 3). The List of amendments documents amendments to specific sections and headings across multiple Acts including No. 17, 1997; No. 82, 1998; No. 28, 2011; No. 8, 2016; and No. 24, 2023.

Schedules and repeals

• Schedule 1 lists repealed ordinances, including various venereal disease, endemic disease, tuberculosis and leprosy ordinances from 1923 through 1976 (Schedule 1). Schedule 2 describes land near East Arm deemed to be an isolation area on commencement of the Act (s 4(1); Schedule 2).

Practical takeaways from the amendment history

• The Act’s architecture has been progressively modernised to integrate with contemporary public health structures (Public and Environmental Health Act 2011), to manage specific liability concerns in blood supply (Part 3A additions and amendments), and to reallocate administrative review to tribunal structures (2023 NTCAT conferral). The sequence of amendments demonstrates legislative attention to procedural form (Gazette notices, approved forms, and delegated powers) and striking a balance between public health discretion and administrative oversight through review and compensation mechanisms.

For precise drafting changes and the timing of amendments, the endnotes and List of legislation appended to the reprint identify the assents and commencements of each amending Act and list the sections amended. Users should consult the reprint’s List of amendments and the full text of the amending Acts for clause-level changes when preparing advice or compliance checklists.

The reprinted text and endnotes of the Notifiable Diseases Act 1981 record legislative history and amendments but do not include judicial decisions or case law interpreting this Act. There is no schedule of reported cases in the reprint and no cases are named in the Act text. The litigation-relevant material in the statute is therefore primarily procedural, evidentiary and jurisdictional rather than judicial in origin.

Statutory provisions that will shape litigation and administrative review

• Administrative review: Section 12 provides a statutory right of review for a person served with a notice under s 11(1). As amended by the Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023, NTCAT now has jurisdiction to review medical officer decisions made after that amending Act’s commencement (s 12 as substituted; Pt 6, ss 41-45). Transitional provisions preserve Local Court rights where appeals were available under the former Act and commenced before the conferral to NTCAT. This reallocation of review jurisdiction will change the institutional forum for challenges to orders and may lead to a body of tribunal decisions interpreting the statutory criteria for notices, including proportionality of detention, scope of remedial orders and the standard of review that NTCAT applies.
• Evidentiary certificates and averments: Sections 26F and 37 facilitate admissible evidence in civil and criminal proceedings by treating laboratory certificates and certain averments as prima facie evidence. These provisions are likely to reduce factual disputes in litigation over whether testing occurred using approved equipment and methods and whether an area was declared an isolation area, shifting the litigation focus to compliance with procedural requirements and to rebuttal evidence.
• Civil remedies and statutory defences: Part 3A (ss 26A-26D) creates statutory defences for the Australian Red Cross Society, hospitals and medical practitioners in specified actions, conditioned on compliance with procedural and testing requirements. Litigation alleging transmission of transmittable diseases via blood or blood products must therefore engage with the statutory compliance record: whether the approved declaration was obtained, whether testing was performed using approved equipment and methods and whether timely steps were taken when the Society had reason to believe contamination occurred (ss 26A(2)-(3); s 26D). Section 26 preserves civil remedies despite compensation orders (s 26), so litigants retain access to tort claims subject to the statutory defences.

Procedural gatekeeping and enforcement discretion

• Chief Health Officer approval for prosecution: Section 38(3) requires approval by the Chief Health Officer before a prosecution under the Act may be commenced. This gatekeeping function bears on enforcement patterns and litigation timing because it centralises decision-making over whether alleged offences are brought to court. As a practical matter, it may reduce the number of prosecutions and increase reliance on administrative enforcement or regulatory paths.

Absence of reported cases in the reprint and implications for advisors

• The reprint contains no citation to judicial decisions and does not name any case law applying or construing the Act. Lawyers and compliance professionals should therefore be alert to the relative paucity of appellate guidance on contentious provisions in the Act itself. Key interpretative issues that litigants and tribunals are likely to address in future litigation include: the scope of CHO and medical officer discretion in issuing orders and notices; the standard and process for NTCAT review of section 11 notices; the meaning of “approved equipment” and “approved method” for testing under Part 3A; the evidentiary weight of laboratory certificates; and the interaction between the Act and the Emergency Management Act 2013 where emergency orders are in play.

Practical consequence for evidence planning and litigation strategy

• Because the Act supplies evidentiary certificates that are admissible (s 26F) and prima facie averments (s 37), parties should focus documentary proof and discovery strategies on the administrative record: Gazetted declarations and specifications, donor declaration forms approved by the Chief Health Officer (s 26A(3)-(4)), laboratory testing protocols and certificates, and the CHO’s orders and correspondence. Defence strategies for hospitals, practitioners and the Society will often turn on documentary demonstration that the statutory procedures were followed.

In sum, while the Act does not contain a recorded litigation history in the reprint, it structures the evidentiary and jurisdictional landscape for future litigation. The recent transfer of review jurisdiction to NTCAT and the statutory evidentiary devices in Part 3A are the most salient features likely to shape an emergent body of case law.

This Act contains several practical traps and non-obvious compliance points that routinely generate risk for practitioners, healthcare providers, laboratories, suppliers and administrators. Below are the principal “gotchas,” anchored to the statutory provisions.

1. Compliance depends on Gazette instruments

• The duty to notify and the content and manner of notification are not simply scripted in the Act; they depend on what the Minister specifies by Gazette under s 8(1) and s 16(1). If a disease is declared notifiable under s 6, the Minister may then define the mandatory content and manner of reporting. Practically, failure to monitor Gazette notices exposes clinicians and laboratories to inadvertent non-compliance.

2. Approved testing and methods are administratively defined

• Part 3A’s defences for the Society and for hospitals/practitioners hinge on testing being done using “approved equipment” and “in accordance with an approved method” (s 26A(2)(b); s 26C(c)). The Act does not itself define those expressions; they are administrative determinations subject to CHO approvals. If the CHO’s approval is not properly documented or the testing does not strictly follow the approved method, the statutory defences will not be available and litigation risk rises.

3. Statutory defences are conditional and can be lost after supply

• Section 26D(1) withdraws the defence where, after supplying blood, the Society has reasonable grounds to believe the blood is likely contaminated and then fails to take all reasonable steps to ascertain whether the blood has been administered or to ensure it is not administered. That creates an ongoing duty to act post-supply; failure to investigate and prevent administration where suspicion arises defeats the statutory defence.

4. CHO approval required to commence prosecutions

• Section 38(3) requires Chief Health Officer approval before a prosecution under the Act may proceed. This centralises prosecutorial discretion with the Chief Health Officer and introduces a non-transparent administrative step into the criminal enforcement pathway. Parties alleging offences should anticipate that formal criminal charges may be limited by CHO policy or resource choices.

5. Secrecy obligations carry criminal sanctions

• Section 29 imposes secrecy obligations on public servants and others assisting with administration; breach carries a maximum penalty of two years imprisonment. Health services and employers must ensure training and clear protocols for staff handling sensitive public health information. Casual or inadvertent disclosure can attract severe penalties and may also complicate litigation.

6. Compensation exists but is limited

• The Crown must compensate persons for loss or damage directly caused by a Chief Health Officer order (s 21), but s 22 excludes compensation where the loss was self-induced by failure to comply with an order or failure to take reasonable precautions to prevent the need for action. This means businesses and individuals cannot rely on automatic compensation where public health orders are triggered by their own non-compliance.

7. Forfeiture of goods removed from isolation areas

• Goods removed from an isolation area contrary to a Chief Health Officer order are forfeited to the Crown and may be seized, treated, destroyed or disposed of as the Chief Health Officer thinks fit (s 20(3)). Operators handling goods near a declared isolation area need to confirm authorised movement before removal. The forfeiture is immediate power, not contingent on later court action.

8. Impersonation and resulting Crown compensation exposure

• A person impersonating a public health official commits a serious offence (s 23(1)) and the Crown may be required to compensate victims who reasonably relied on the impersonator (s 23(2)). That exposes the Crown to liability and creates potential for Crown recovery actions against the impersonator under s 25. Organisations should therefore verify the identity and authority of persons presenting public health orders.

9. Donor immunity is limited by false-declaration offence

• While donors are largely protected from civil claims arising solely from transmission (s 26E(2)), that immunity does not apply to donors convicted under s 26E(1) of false declarations. The false-declaration offence carries a significant penalty (85 penalty units or 2 years imprisonment).

10. Certified tests and certificates are powerful but procedural

• Certificates from laboratory heads are prima facie evidence (s 26F) and section 37 supplies prima facie evidentiary averments. However, reliance on certificates can be defeated by evidence of non-compliance with procedural requirements. Parties relying on certificate-based defences should retain the full chain of custody, test logs, and approved method documentation.

11. Review forum changed by 2023 amendments with complex transitional rules

• NTCAT jurisdiction to review medical officer notices now applies only to notices served after the commencement of the 2023 amendments (Pt 6, s 42). Appeals or reviews that existed or were commenced before the commencement may proceed in the Local Court under transitional provisions (Pt 6, ss 43-44). Practitioners must check the service date of the notice to determine the correct review pathway.

12. Delegation instruments must be written and are revocable

• Delegations of CHO powers must be by written instrument (s 31(1)) and are revocable at will (s 31(3)). Organisations relying on the acts of authorised persons must ensure those persons are properly designated in a delegation instrument and understand that delegations can be withdrawn, with potential consequences for ongoing administrative actions.

13. Regulatory offence classification implies different enforcement architecture

• Certain contraventions are designated regulatory offences (s 38A). The practical effect is that enforcement and prosecution of such contraventions may follow a regulatory model rather than standard criminal process. Compliance officers should treat regulatory offence notices as administratively enforceable events requiring different procedural responses.

Addressing these gotchas requires active administrative controls: monitoring Gazette notices, documenting compliance with approved testing methods and donor-declaration procedures, training staff in secrecy obligations and evidence retention, confirming delegation instruments for authorised persons, and coordinating with the Chief Health Officer and legal advisers where orders and prosecutions are likely.

This section sets out a practical compliance roadmap for the main classes of actors affected by the Act: medical practitioners, laboratories and pathology services, hospitals and health facilities, blood suppliers (the Society), donors, employers and premises owners, and public sector administrators. Each step ties to statutory provisions.

General steps for all affected entities

• Monitor the Gazette and CHO publications: The Minister specifies which diseases are notifiable and what information and manner of reporting are required by Gazette notice (s 6; s 8(1); s 16(1)). The Chief Health Officer publishes the approved donor declaration form on the Agency’s website (s 26A(4)). Make processes for continuous monitoring of Gazette notices and the Agency website part of compliance routines.
• Maintain up-to-date delegation and authorisation records: Ensure any authorised persons acting under delegation from the Chief Health Officer are designated by written instrument and that copies of delegation instruments are accessible (s 31(1), (4)).

Medical practitioners

• Notification and information transmission: When diagnosing an infected person or considering a suspect person in relation to a gazetted notifiable disease, promptly supply the information specified by the Minister to a medical officer in the manner required (s 8(2)-(3)). Implement a checklist and secure transmission procedures conforming to the specified manner of reporting.
• Patient advice and record-keeping: Provide the advisory information mandated by s 10 to the patient or, for children under 16, the parents or guardian. Keep a contemporaneous clinical record documenting advisory discussions and any steps taken.
• Contact details and contact tracing cooperation: Obtain and record names and addresses of contacts per s 9. Have procedures to securely transmit those details to medical officers or authorised persons, consistent with secrecy obligations (s 29) and privacy law compliance.

Laboratories and pathology services

• Reporting obligations and format compliance: When pathology results indicate infection for a gazetted disease, supply the information required to the Chief Health Officer in the manner prescribed (s 16(2)-(3)). Ensure reporting mechanisms can produce required data elements and conform to the specified format.
• Testing standards and documentation: To support admissible certificates under s 26F and potential statutory defences (s 26C), maintain documented protocols showing use of “approved equipment” and adherence to an “approved method” as required by CHO approvals. Preserve raw test data, chain-of-custody records and certificate signatory authority.

Hospitals and health facilities

• Reliance on statutory certificates and process checks: Where administering blood or blood products supplied by the Society, ensure containers are accompanied by the required certificates purporting to be signed by the person in charge of the laboratory showing approved testing and negative results, or verify documentary evidence that the Society complied with the specified requirements (s 26C(c)-(d)). Retain certificates and contemporaneous records to support the statutory defence.
• Policies for receiving CHO or medical officer orders: Have procedures to respond to CHO orders to close or disinfect premises, to detain or remove persons, and to manage contaminated goods, including steps for documenting losses for a compensation claim if appropriate (ss 13; 21).

Blood suppliers and the Australian Red Cross Society

• Donor declaration compliance: Before taking blood, obtain a declaration in the form approved by the Chief Health Officer (s 26A(2)(a); s 26A(3)-(4)). Record and retain completed declarations. Ensure an auditable process for declaration collection and storage.
• Testing using approved equipment and methods: Before supplying blood for administration or product manufacture, test a sample of the blood using CHO-approved equipment and an approved method and ascertain negative results (s 26A(2)(b)). Maintain logs of testing equipment calibration, method versions and negative test results.
• Post-supply monitoring obligations: If, after supply, there are reasonable grounds to suspect contamination, take all reasonable steps to ascertain whether the blood has been administered and to prevent its administration if not administered (s 26D(1)). Keep records of attempts made to trace use and steps taken to recall or prevent use.

Donors

• Truthful declarations: Ensure that donor declarations are full and accurate. A materially false statement in the required declaration is an offence carrying a significant penalty (s 26E(1)). Donors should be advised of this legal consequence as part of donor intake procedures.
• Understand limited civil exposure: Donors are generally protected from civil proceedings rooted solely in transmission from their donated blood (s 26E(2)), provided they have not been convicted of false declaration.

Employers and premises owners

• Prepare for isolation area orders: If an isolation area is declared (s 17) or CHO orders closure or disinfection of premises (s 13(2)(b)), have contingency plans for business continuity, asset handling and documentation to support compensation claims under s 21 if the loss is not self-induced under s 22.
• Goods movement due diligence: Before moving goods from an isolation area, ensure authorisation; goods removed without authorisation are forfeitable (s 20(3)). Implement checks to verify movement authority.

Administrative and public sector actors

• Training and secrecy protocols: Train staff on secrecy obligations in s 29 and on permitted disclosures under s 30. Implement secure record systems and need-to-know access controls.
• Prosecution and enforcement coordination: Recognise that prosecutions require CHO approval (s 38(3)); coordinate with legal counsel and the CHO when contemplating enforcement actions. Ensure documented rationales for decisions to prosecute or abstain.
• Delegation documents: Maintain written delegation instruments for authorised persons and ensure delegates act within the instrument’s scope (s 31(1)-(3)). Have audit trails for delegation and exercise of delegated powers.

Record-keeping and evidence preservation

• Retain all relevant documents that support compliance: Gazetted notices, donor declarations, laboratory test records, certificates from laboratory heads, delegation instruments, CHO orders, medical officer notices, registers of infected persons and correspondence about investigations. Those materials are essential for defending regulatory offences, for seeking compensation, or for relying on the statutory defences in Part 3A (ss 26B-26D; s 26F).

Responding to notices and review processes

• If served with a s 11 notice, note that the notice is reviewable (s 12). For notices served after the 2023 NTCAT conferral commencement, apply for review in NTCAT (s 12(1) as amended). For notices served before that date, consult the transitional provisions in Pt 6 to determine whether the Local Court remains the correct forum (Pt 6, ss 42-45).

Practical checklists and templates

• Develop templates and checklists for:
  • Gazetted-notice monitoring and internal alerting.
  • Patient notification and advice letters in accordance with s 10.
  • Donor declaration forms consistent with the CHO-approved form and signed acknowledgements.
  • Laboratory certificate templates consistent with s 26F and signed by the person in charge.
  • Asset and premises remediation checklists tied to CHO orders for documenting loss and damage for compensation claims under s 21.

Regulatory liaison and legal oversight

• Maintain a point of contact with the Chief Health Officer’s office and legal counsel to clarify CHO approvals for equipment, testing methods and forms. Establish internal escalation procedures when CHO orders, prosecutions or large-scale isolation measures are contemplated.

Following these steps will materially reduce legal and operational risk under the Act. The central compliance themes are: monitor and act on Gazette and CHO publications; document procedural compliance rigorously; retain certificates and testing records; comply promptly with medical officer and CHO orders; and coordinate with legal counsel and the CHO when enforcement or compensation issues arise.
