48Preservation of specified rights, titles and interests

#### 48 Preservation of specified rights, titles and interests (1) If a right, title or interest is specified in a notice given under section 47 as a right, title or interest which is to be preserved, the right, title or interest is preserved as a right, title or interest (as the case requires) in the land after that time. > Note: The right, title or interest can be terminated under section 49. (2) If: (a) a right, title or interest in land is preserved under subsection (1); and (b) the right, title or interest was granted by the proprietor of the land; the Commonwealth Minister may determine that the right, title or interest has effect, while the Commonwealth interest in the land exists, as if it were granted by the Commonwealth on the same terms and conditions as existed immediately before the time specified in the notice. (3) The Commonwealth Minister must give a copy of a determination under subsection (2) to the person who holds the right, title or interest. The Commonwealth Minister may also give a copy of the determination to any other relevant person. (4) The determination takes effect at the time specified in the determination (which must not be earlier than the day on which the determination is given to the person who holds the right, title or interest). (5) A determination under subsection (2) is not a legislative instrument. (6) In this section, a reference to a right, title or interest includes a reference to a licence.
