133 Additional considerations for costs in review jurisdiction Before making a costs order in a review proceeding, the Tribunal must take into account: (a) whether the party genuinely attempted to enable and assist the decision maker to make the original decision on its merits; and (b) whether the decision maker genuinely attempted to make the original decision on its merits.
