NORTHERN TERRITORY ABORIGINAL SACRED SITES REGULATIONS 2004

Authority Certificate: This is the principal instrument under the Act that allows work to proceed on or near a sacred site. The Regulations provide the fee schedule and classification rules for applications. A standard certificate costs between 1,092 and 2,357 revenue units depending on location (application fee plus certificate fee). Non-standard applications attract additional pass-through charges.

Standard application (Schedule 1, clause 1): The default classification for any application that does not fall into a non-standard category. The Authority can still reclassify it as non-standard if there are “exceptional circumstances”. The term is not defined, giving the Authority discretion to move an application into the costlier track even if none of the listed criteria apply.

Non-standard application (Schedule 1, clause 2): Eight enumerated categories. The most expansive are “substantial project” (clause 2.2) and “large area of land” (perimeter 20 km or more). The “substantial project” definition includes any work requiring environmental impact assessment under the Environment Protection Act 2019 , a broad hook that sweeps in many development activities. It also includes “complex development such as a resort, mine or major horticultural development” and any project involving acquisition or extinguishment of native title rights. The definition is not exhaustive; it uses the word “such as”, leaving further projects open to classification.

Charges for non-standard applications and conferences (Schedules 2 and 3): These allow the Authority to recover “costs reasonably incurred” across 12 categories. Notably, staff time for research (item i) and supervision/liaison (item j) are charged at the rate of staff wages plus 100% uplift. Administration costs (item k) are charged at a flat 20% of all other items combined. This structure creates an incentive for the Authority to allocate staff time and administrative overhead to non-standard applications, since the costs are fully recoverable. There is no cap or limit stated, and no independent review mechanism in the Regulations themselves.

Abstract of Authority’s records (regulation 7): A procedural mechanism to obtain information before making a full application. This is a due diligence tool for land purchasers, developers, or consultants. The abstract covers only registered or recorded sacred sites; it is not a guarantee that no sacred sites exist. Unregistered sites may still be present. The definition of “parcel of land” in regulation 7(5) ties the abstract to a single certificate of title under the Land Title Act 2000, meaning large holdings with multiple titles would require multiple applications and multiple fees (23 revenue units per parcel).

Revenue units: The fee amounts in Schedule 4 are expressed in “revenue units” rather than dollar amounts. The Regulations do not specify the value of a revenue unit; that value is presumably set by separate NT legislation (such as the Fees and Charges Act). This means the actual dollar fee may change without amendment to these Regulations, affecting budgeting certainty for applicants.

The Regulations directly affect any person or entity that needs an Authority Certificate under the Act to carry out work on land in the Northern Territory. This includes private developers, mining companies, pastoralists, government agencies, infrastructure operators, and individual landowners. The fee differential between standard and non-standard applications creates a financial distinction: a standard application for non-freehold land in remote areas costs 2,357 revenue units for the certificate component; a non-standard application attracts no fixed certificate fee in Schedule 4 but incurs potentially unlimited pass-through charges under Schedule 3.

Project proponents with large footprints, complex developments, or land near known sacred sites are disproportionally affected because they fall into the non-standard categories. For example, a mining company developing a remote mine in the Tanami Desert would almost certainly trigger the “substantial project” category (clause 2.2(b)) and the “remote location” category (clause 2.8), and possibly also “large area of land” (clause 2.1) if the perimeter of proposed areas totals 20 km or more. Such an applicant faces the full Schedule 3 charging structure: direct costs at actual expense, staff time at 100% uplift, and a 20% admin surcharge. The cumulative bill could be substantial and is difficult to estimate in advance because it depends on the Authority’s staffing allocation and internal cost allocation.

Aboriginal custodians and traditional owners may also be affected indirectly. The Regulations provide that consultants’ fees “including payments to custodians as consultants” (Schedule 2, item (a)) may be charged to the applicant. This creates a mechanism for custodians to be remunerated for their time and expertise in the application process. However, the charging framework is cost-recovery from the applicant, not a direct payment to custodians. If the Authority chooses to engage custodians, the cost is passed through to the applicant, which may increase the financial barrier for smaller developers or individuals.

Applicants for abstracts of Authority’s records (regulation 7) are typically prospective purchasers, land valuers, or legal representatives conducting due diligence. They pay a flat fee of 23 revenue units per parcel, plus additional map fees if needed. The definition of “parcel of land” means that a single large property held under multiple titles will require multiple abstract applications and fees, increasing transaction costs for subdivided or stratified land.

The Authority itself is affected as the administrator. It must classify applications, determine charges, arrange conferences where necessary, and provide abstracts. The Regulations give the Authority discretion in several places (e.g., “may give the applicant a written abstract” in reg 7(3); “may also give the applicant additional maps or spatial data” in reg 7(4)). This discretion means the Authority controls both the timing and scope of services provided.

Duty to pay fees and charges: Applicants have a duty to pay the application fee, certificate fee, and any additional charges for non-standard applications or conferences before or after the service is provided. The Regulations do not specify when payment is due, but the Act likely allows the Authority to require payment before processing. There is no express provision for refunds if an application is withdrawn or refused.

Right to apply for an abstract (regulation 7(1)): Any person may apply in writing for an abstract of the Authority’s records in relation to a parcel of land. The applicant must pay the applicable fee. The Authority may provide a written abstract containing advice on registered sacred sites, recorded sacred sites, and restricted work areas, plus a map. The applicant may request additional maps or spatial data, but the Authority may require the applicant to sign a use agreement and pay a further fee (50 revenue units for the agreement under Schedule 4 item 6). This right is conditional on the Authority’s discretion; it “may” give the abstract, not “must”.

Right to request a conference? The Regulations do not expressly create a right to request a conference. Regulation 5 refers to the Authority’s assessment of whether holding a conference “is likely to entail significant costs”. This implies the Authority can convene a conference as part of determining an application, but the Regulations do not set out who may request it. The parent Act likely governs the conference process.

Obligation to disclose proposed use for standard classification: Schedule 1 clause 2.7 classifies an application as non-standard if it does not “disclose the proposed use of the land or the nature of the work proposed to be carried out”. This creates an incentive for applicants to provide full disclosure to avoid the non-standard (and more expensive) classification. The duty is practical rather than legal: an applicant who withholds information faces higher charges and possibly a conference.

Right to have costs assessed under Schedule 3: For non-standard applications, the amount of charges is “to be determined as follows” (Schedule 3 clause 1). This offers a formulaic approach that provides some predictability. However, items (a) to (h) and (l) are charged at “the amount incurred by the Authority”, which gives the Authority control over the expenditure and no upper limit. The 100% uplift on staff time (items i and j) and 20% admin surcharge are fixed percentages, but the base hours are determined by the Authority.

No right to challenge charges in these Regulations: The Regulations do not provide an internal review mechanism for the amount of charges. Disputes would likely need to be resolved through the Act’s appeal provisions or judicial review, which is an additional cost and uncertainty for applicants.

The Regulations themselves do not contain penalty provisions for non-compliance. Penalties for offences under the Act (such as carrying out work on a sacred site without an Authority Certificate) are set out in the parent Act, not these Regulations. The Regulations focus solely on fees, charges, and administrative classification.

Enforcement of fee and charge obligations is not addressed in the text. There is no provision for late payment penalties, interest, or refusal of services for non-payment. However, it is reasonable to infer that the Authority can refuse to process or finalise an application until all fees and charges are paid, given the nature of a fee-for-service model. The absence of an express enforcement mechanism in the Regulations may create ambiguity: can the Authority demand payment before issuing a certificate? The Regulations do not say.

The Regulations do provide a mechanism to require an applicant to sign a use agreement for maps or spatial data before providing them (regulation 7(4)(b)). If the applicant refuses, the Authority may decline to supply the data. This is a form of enforcement through withheld service, not a penalty.

Compliance with the classification guidelines (Schedule 1) is a matter of administrative decision-making by the Authority. If the Authority incorrectly classifies an application as non-standard, the applicant could challenge that classification. The Regulations leave room for discretion: even a standard application may be reclassified if there are “exceptional circumstances” (Schedule 1 clause 1). This could be used defensively by the Authority to justify a non-standard classification even where none of the enumerated criteria are met, potentially increasing costs for the applicant.

The Regulations interact directly with the Northern Territory Aboriginal Sacred Sites Act 1989, under which they are made. They give effect to specific powers in sections 19C (classifying applications), 19G(4)(a) (conference costs), and 19K(1) (charges for non-standard applications). Any change to those sections of the Act would affect the Regulations’ operation.

The Environment Protection Act 2019 (NT) is referenced in Schedule 1 clause 2.2(a): a project requiring an environmental impact assessment under that Act is automatically a “substantial project” and thus a non-standard application. This creates a linkage where the sacred sites process is tied to the environmental assessment trigger. Developers who must undergo environmental impact assessment will automatically face the higher-cost sacred sites application track.

The Land Rights Act (NT) is referenced in Schedule 1 clause 2.3: applications on or partly on Aboriginal land as defined in that Act are non-standard. This recognises the added complexity and consultation required on Aboriginal land where land rights are held.

The Land Title Act 2000 (NT) is referenced in regulation 7(5) to define “parcel of land” for the abstract service. This ties the abstract to the Torrens title system, meaning it is a land title based query rather than a geographic or physical boundary query.

The A New Tax System (Goods and Services Tax) Act 1999 (Cth) is referenced in regulation 2: all fees and charges under the Regulations are exclusive of GST, and GST is added where required under Commonwealth law. This ensures consistency with Australia’s GST regime and means the effective cost to applicants is 10% higher than the stated fee or charge.

No other Commonwealth or NT laws are mentioned. The Regulations do not interact with native title legislation aside from the reference in clause 2.2(d) (acquisition or extinguishment of native title rights as a non-standard trigger). There is no reference to the Native Title Act 1993 (Cth), but the concept of native title rights is clearly drawn from it.

The Regulations were originally made as SL No. 14, 2004, notified on 28 April 2004 and commenced on 28 April 2004. They have been amended six times:

• Fees and Charges Amendment Regulations 2009 (SL No. 34, 2009): Amended regulation 4 and Schedule 4, effective 1 January 2010. Regulation 4 was later repealed.
• Northern Territory Aboriginal Sacred Sites Amendment Regulations 2011 (SL No. 31, 2011): Substituted regulation 7 (abstract of Authority’s records), substituted Schedule 1 (classification guidelines), amended Schedule 3, substituted Schedule 4 (fees), and amended regulation 2 (GST). Commenced 3 August 2011.
• Local Government Amendment Act 2013 (Act No. 28, 2013): Amended Schedule 4, commenced 8 November 2013.
• Environment Protection Act 2019 (Act No. 31, 2019): Amended Schedule 1 to update the reference to the Environment Protection Act 2019 (replacing an earlier reference to the Environmental Assessment Act). Commenced 28 June 2020.
• Statute Law Revision and Repeals Act 2019 (Act No. 33, 2019): General formal amendments not specifically listed but included.
• Northern Territory Aboriginal Sacred Sites Legislation Amendment Act 2025 (Act No. 11, 2025): Amended Schedule 4, commenced 30 May 2025. This is the most recent amendment, effective from the date shown in the source (30 May 2025).

The endnotes also note general amendments of a formal nature made by the Interpretation Legislation Amendment Act 2018 affecting regulations 1 and 7 and Schedule 1.

Notable changes include the substitution of the entire Schedule 1 in 2011, which created the current eight non-standard categories. The 2011 amendments also introduced the current abstract regime and restructured fees significantly. The 2025 amendment is the most recent, affecting fee amounts.

The Regulations themselves contain no discussion of litigation history, and no cases are cited in the text. As subordinate legislation, they are unlikely to have been the direct subject of litigation; disputes would more likely concern the parent Act or specific decisions of the Authority under the Act.

It is reasonable to infer that the classification guidelines and charging provisions have been the subject of administrative challenges or judicial review under the Act, but the source provides no information to support any such claim. The Regulations’ litigious history is therefore best described as not disclosed in the instrument itself. Practitioners should check the NT Supreme Court and the Northern Territory Civil and Administrative Tribunal for decisions relating to the Act, which may involve interpretation of the Regulations, particularly on the meaning of “substantial project”, “exceptional circumstances”, and the calculation of charges.

Revenue units float: Fees are stated in “revenue units” but their dollar value is not in the Regulations. The actual cost to an applicant depends on the current value of a revenue unit as set by other NT legislation. This creates uncertainty for budgeting, especially for multi-year projects where the unit value may change.

No cap on non-standard charges: Schedule 3 allows the Authority to pass through “costs reasonably incurred” with a 100% uplift on staff time and a 20% admin surcharge. There is no statutory cap or independent cost assessment. The Authority sets its own costs, and whether they are “reasonably incurred” is subject only to later judicial review. This gives the Authority a strong financial position and creates a deterrent effect for complex applications.

Conferences are potentially very expensive: Under Schedule 3 clause 2, if a conference is arranged, charges are calculated the same way as for a non-standard application. That means the conference itself triggers the full charging structure, including the 20% surcharge on all other costs. If the Authority determines that the conference is likely to entail significant costs (regulation 5), it can set that in motion. Arranging the conference may duplicate efforts already expended (regulation 5(b)), which would increase costs without necessarily adding value.

Abstracts are limited to registered or recorded sites: The abstract under regulation 7(3)(a)(i) and (ii) only covers sites that are registered or actually recorded in the Authority’s records. Unrecorded sacred sites will not appear. The abstract is not a certification that no sacred sites exist. It is a best-efforts information product. Relying on an abstract as conclusive due diligence could be risky.

Parcel of land is a single title: The definition in regulation 7(5) means one abstract application covers only one separate certificate of title. If a property comprises multiple titles (common in strata subdivisions or large pastoral leases with multiple folios), each title requires a separate application and fee. This adds up quickly for large landholders.

Undisclosed work triggers non-standard classification: Schedule 1 clause 2.7 treats an application that does not disclose the proposed use as non-standard. This is a trap for applicants who are in early planning stages or who wish to keep their intentions confidential. To avoid the higher cost, they must disclose the nature of the work, which may itself be commercially sensitive.

Standard application reclassification: Even if an application does not meet any non-standard criterion, the Authority may still classify it as non-standard in “exceptional circumstances” (Schedule 1 clause 1). “Exceptional circumstances” is not defined, giving the Authority wide discretion. An applicant who expects a standard fee could be surprised.

GST is extra: Regulation 2 states all fees and charges are exclusive of GST. The actual cost is quoted fee plus 10%. This is clearly stated but could be overlooked by overseas applicants or those unfamiliar with Australian tax treatment.

Transfer and addition applications cost 100 revenue units each: Schedule 4 items 1A and 1B require fees for transferring a certificate or adding parties. These are separate from the original application fee, adding ongoing compliance costs for projects that change ownership or involve multiple contractors.

Spatial data may require a use agreement: The Authority may require the applicant to sign an agreement (regulation 7(4)(b)) governing use of maps or spatial data, with an additional fee of 50 revenue units. This agreement may contain restrictions on further disclosure or use, limiting how the applicant can share or rely on the information.

A proponent intending to carry out work on land in the Northern Territory should start by determining whether the land may contain sacred sites. The first step is to apply for an abstract of the Authority’s records under regulation 7. The applicant must submit a written application identifying the parcel of land by its certificate of title (as defined in regulation 7(5)). The fee is 23 revenue units per parcel (Schedule 4 item 4). The Authority will provide advice on registered sites, recorded sites, and any restricted work areas from previously issued Authority Certificates. If additional maps or spatial data are needed, the applicant must pay further fees and, if required, sign a use agreement (fee 50 revenue units).

If the abstract indicates that no sacred sites are present on the parcel, the proponent may decide to proceed with an application for an Authority Certificate. The application must be classified as either standard or non-standard using the guidelines in Schedule 1. The applicant should self-assess against the eight non-standard criteria: perimeter of land areas (if 20 km or more aggregate), whether the project is a “substantial project” (requiring environmental impact assessment under the Environment Protection Act 2019, or a resort, mine, major horticulture, use of sea area, or native title acquisition/extinguishment), whether the land is Aboriginal land, whether it encompasses a registered sacred site or previous restricted work area, whether the determination requires specialised equipment or expert advice, whether the survey is comprehensive and unusually wide, whether the proposed use is not disclosed, and whether the location is remote requiring special travel arrangements.

If none of these criteria apply, and there are no exceptional circumstances, the application is standard. The applicant pays 57 revenue units for the application and either 1,035 or 2,300 units for the certificate depending on the land type and location (Schedule 4 items 1(a), (b), (c)). For freehold land anywhere in the Territory, or non-freehold land within the Darwin/Palmerston/Litchfield municipal boundaries or within 25 km of Alice Springs Post Office, the certificate fee is 1,035 units. For non-freehold land outside those areas, the certificate fee is 2,300 units.

If the application falls into any non-standard category, the applicant must be prepared to pay all reasonable costs incurred by the Authority in determining the application, calculated under Schedule 3. That means paying direct costs (consultants, travel, equipment, translation, etc.) at actual cost; staff time for research and liaison at the rate of wages plus 100%; and a flat 20% administration fee on all other items. The applicant should request a cost estimate from the Authority before proceeding, though the Regulations do not require the Authority to provide one. The applicant should also be aware that if a conference is arranged, the same charging structure applies unless no new costs are incurred.

If the project changes during the application process (e.g., the scope expands and triggers a non-standard category), the classification may be revisited. Applicants should fully disclose the proposed use and nature of work to avoid the “undisclosed work” category and to reduce the risk of reclassification.

For projects that already have a certificate and later need to transfer it to another entity or add a recorded party, there are separate applications with fees of 100 revenue units each (Schedule 4 items 1A and 1B).

All fees and charges are exclusive of GST. The applicant must add 10% GST where required under Commonwealth law.

After receiving the Authority Certificate, the proponent must comply with any conditions on the certificate and ensure that work does not encroach on registered sacred sites or restricted work areas as described on the certificate.

Finally, the applicant should monitor the value of NT revenue units, as the actual dollar cost may change without direct amendment to these Regulations.
