What it does
The Northern Parklands Regulations 2026 (SA) are the subordinate legislative instrument that operationalises the Northern Parklands Act 2025. They translate the framework provisions of the Act into specific duties, prohibitions, rates, and transitional arrangements. The regulations are structured in six Parts, covering preliminary interpretation, the Northern Parklands Trust’s financial and levy machinery, conduct rules for statutory trust parklands, miscellaneous administrative provisions, and transitional arrangements that bridge the gap between the Act’s commencement and full implementation.
Part 2 addresses the Trust’s annual business plan variation requiring Ministerial approval when council contributions change (regulation 4), the formula for interest accrual on unpaid council contributions at the Reserve Bank of Australia Cash Rate Target as at 1 July of the relevant financial year (regulation 5), and the prescription of nine land-use categories for the purpose of the levy that councils may impose under section 19(5) of the Act (regulation 6). The levy categories are tied to the Planning and Design Code under the Planning, Development and Infrastructure Act 2016, covering residential, commercial (shop, office, other), industrial (light, other), primary production, vacant land, and other uses. Regulation 6 also modifies two sections of the Local Government Act 1999 to extend the operation of separate rates to fixed charges and to relax the requirement for councils to grant a comparable rebate of the levy when they grant a general rates rebate.
Part 3 (regulation 7) prescribes a default 21-day period for the purposes of section 38(b) of the Act concerning damage to statutory trust property, with the trust able to authorise a different period. Part 4 (regulations 8-11) sets out the conduct rules for users of trust parklands, creating offences for disorderly behaviour, restricted activities (firearms, camping, fires, litter, structures, noise, advertising, selling, collections), animal control (only dogs permitted, with conditions on leashing and effective control), and motor vehicle use (speed limit of 15 kph unless signed otherwise, parking fees, compliance with directions). Maximum penalties range from $750 to $1,250 with expiation fees of $105 or $160.
