What it does
The North Melbourne Lands Act 1966 is a single purpose Victorian statute that reorganises the legal status and management of a specific parcel of Crown land at North Melbourne, being the site of a cricket and football ground and a swimming pool complex. The Act performs six mechanical tasks in relation to the land delineated on the plan in the Schedule.
First, it revokes the Order in Council of 20 November 1883 and the associated Crown grant (volume 1551 folium 310078) that had permanently reserved the land known as allotment 1 of section 75A for municipal purposes (s 3(1)(2)). That land becomes unalienated Crown land freed from all trusts, encumbrances, reservations, limitations and exceptions (s 3(3)). Second, it closes the part of Munster-terrace shown hatched on the plan, extinguishing all public and private rights, easements or privileges arising from dedication or user, and deeming that land also to be unalienated Crown land (s 4). Third, it redefines the existing permanent reservation for public recreation (the Order in Council of 17 October 1885 and Crown grant volume 1792 folium 358388) to include allotment 1 of section 75A and the hatched and cross-hatched lands, so that the recreational reservation now covers the entire consolidated parcel (s 5(1)). Fourth, it confirms the council of the City of Melbourne as committee of management of the expanded recreational land, but the North Melbourne Lands (Amendment) Act 1967 later replaced the council with the corporation of the City of Melbourne as committee of management (s 5(2)(3)). Fifth, it empowers the corporation, as committee of management, to grant leases of the whole or any part of the lands for sport, recreation or social activities, including the erection of buildings (s 6(1)). Leases cannot exceed 21 years and, if over three years, require approval by the Governor in Council; the corporation may impose any covenants, conditions, exceptions and reservations it thinks fit (s 6(2)). Rent must be applied to maintenance and improvement of the lands or to such other purpose as the Minister approves (s 6(3)). Sixth, a 1969 amendment (section 6A) allows the corporation to make loans from the municipal fund to lessees for erecting buildings or otherwise improving the lands, capped at $95,000 per lessee or project, on terms the corporation determines. Section 7 directs the Registrar of Titles to make all necessary cancellations and entries to give effect to the Act. Section 8 absolutely excludes any compensation from the Crown for any act, matter or thing under the Act.
