Norfolk Island (Service Delivery (Queensland) (Work Experience)) Rules 2022

The instrument operates by legislative adoption and modification rather than by drafting a standalone Norfolk Island statute. The central conceptual elements are adoption, temporal application, modified administrative responsibility, cross-jurisdictional coverage of placements, and insurance arrangements.

Adoption mechanism

• The instrument adopts an external statute and its subordinate legislation as a law of the Territory, but only to the extent set out in the instrument and its Schedule 1 modifications (s 4(1)). The adoption is conditional and time-limited. Subordinate legislation is brought in only if subject to disallowance in Queensland (s 4(2)), creating a filter for what secondary instruments become part of Norfolk Island law.

Temporal limitation and repeal

• The adoption is expressly temporary: the Queensland law, as adopted, is in force “until the end of 31 December 2026” (s 4(1)), and the instrument itself is repealed at the start of 1 January 2027 (s 5). The instrument therefore establishes working arrangements for a defined transitional period.

Administrative allocation

• The instrument substitutes the “responsible body” concept in the Queensland Act with a single officeholder: “the chief executive (education)” (Schedule 1, modification of subsection 8(2)). It also defines “insuring body” as the chief executive (education) for the purposes of insurance provisions (Schedule 1, modification of subsection 9(5)). This assigns statutory decision-making, contracting and insurance duties to a named administrative actor rather than to a composite or locally-defined responsible body.

Cross-jurisdictional placements

• The Schedule adds an express provision that premises and places for work experience may include locations outside Norfolk Island (Schedule 1, modification of section 4 by inserting s 4(2A)). That expands the geographic reach of student placements beyond the Territory’s physical borders.

Insurance mechanism

• The Schedule replaces the prior text of s 9(3) so a contract of insurance “may be entered into by the insuring body with the Queensland Government Insurance Fund (QGIF)” (Schedule 1, modification of subsection 9(3)). It adds an express power to indemnify students and work experience providers for personal injury or property damage arising from work experience provided outside Norfolk Island (Schedule 1, new s 9(4)). The Schedule also identifies “insuring body” as the chief executive (education) (Schedule 1, new s 9(5)).

Interpretive framework

• The instrument explicitly makes Queensland interpretation statutes apply to the adopted provisions (note to s 4(1)) and states that the usual Norfolk Island interpretation statute does not apply to the instrument (note to s 3). This establishes a Queensland statutory interpretive regime for the adopted law while the instrument is operative.

Definitions and omissions

• Several dictionary entries in the Queensland Act are omitted from the adopted law (Schedule 1, modification of Schedule (dictionary)): “enrolled in an educational establishment,” “home education,” “home education place,” “law,” and “non-State school.” Removing these terms alters how certain concepts in the adopted Act will be read, and shifts reliance onto the remaining text and the Queensland interpretive references.

Collectively, the instrument imports a Queensland statutory template but reassigns responsibility to a named chief executive, extends the operational geography for placements, creates a specified insurance pathway, and does so for a defined transitional period under Queensland interpretation rules.

This instrument restructures legal responsibilities and material conditions for several discrete sets of actors on Norfolk Island and potentially off-island entities that host students. The text itself identifies the categories and the statutory reallocations.

Students and families

• Students who participate in work experience arrangements on or outside Norfolk Island are within the operation of the adopted Education (Work Experience) Act 1996 (Qld) as modified (s 4(1); Schedule 1 insert s 4(2A) permits placements outside Norfolk Island). Families of students will be affected to the extent the Queensland provisions set consent, supervision and placement processes.

State schools and school administrators

• The modification of s 5 replaces the trailing text after “educational establishment” so that “for a student enrolled in a State school, the school” is the educational establishment (Schedule 1, modification of s 5). That places responsibility and legal relationships with the school for State-school-enrolled students and clarifies which institution is the “educational establishment” for those students. The omission of the definition “enrolled in an educational establishment” from the adopted dictionary (Schedule 1) also affects enrollment-based triggers.

Work experience providers (host employers)

• The Schedule expressly contemplates placements occurring outside Norfolk Island (Schedule 1, modification of section 4 by inserting s 4(2A)). Work experience providers on Norfolk Island and off-island hosts are affected because the adopted Act governs the arrangements. The added insurance text (Schedule 1, modified s 9) permits indemnity cover for providers for personal injury or property damage arising out of off-island placements.

Chief executive (education)

• The instrument centralises statutory functions in the office of “chief executive (education)” by replacing the “responsible body” with that office (Schedule 1, modification of subsection 8(2)) and by defining the insuring body as the chief executive (education) (Schedule 1, s 9(5)). The chief executive becomes the statutory decision-maker for functions previously carried by the responsible body and the party empowered to enter insurance arrangements with QGIF.

Insurer and funding bodies

• The Schedule allows a contract of insurance to be entered with the Queensland Government Insurance Fund (QGIF) by the insuring body (Schedule 1, modified s 9(3)). This engages a Queensland public insurer as the contemplated insurer for covered exposures arising from work experience placements, including those outside Norfolk Island (Schedule 1, new s 9(4)).

Regulatory and interpretive actors

• The Acts Interpretation Act 1954 (Qld) and the Statutory Instruments Act 1992 (Qld) are declared to apply to the adopted provisions as they apply in the Territory (s 4(1) note). That means courts, administrators and lawyers operating on Norfolk Island will use Queensland interpretive statute provisions when construing the adopted Education (Work Experience) Act and its subordinate instruments during the operative period.

Excluded or ambiguously affected classes

• The instrument omits certain definitions from the adopted dictionary, for example “non-State school” and “home education” (Schedule 1). Entities and persons whose status depends on those terms may find their legal position less directly defined by the adopted text, requiring reference to other adopted provisions or administrative practice.

Temporal audience

• The instrument’s effects are time-limited and affect relevant actors until 31 December 2026 (s 4(1)), with the instrument itself repealed at the start of 1 January 2027 (s 5). Any actor planning or operating placements must therefore factor in the transition of legal regimes at the end of 2026.

In short, the instrument affects students and their schools, providers both on Norfolk Island and outside it, the chief executive (education) who is assigned responsibilities and insurance contracting powers, and insurers such as QGIF. It also affects legal advisers and decision-makers because the adopted Queensland interpretive rules apply within the Territory for the adopted laws.

The instrument does not restate the full content of the Education (Work Experience) Act 1996 (Qld), but it imports that Act’s duties and rights into Norfolk Island subject to the Schedule 1 changes. The text creates, reallocates and clarifies a small set of duties and rights as follows.

Duty to facilitate work experience arrangements (inherited)

• By adopting the Queensland Act, the instrument imports duties attached to arranging and supervising work experience placements where those duties appear in the adopted Act. The Schedule does not remove the imported duty framework; it modifies certain roles and definitions. Practically, entities that previously had statutory functions under the Queensland Act will find those functions in force in the Territory as adopted (s 4(1)).

Chief executive (education): duties and powers

• The instrument replaces the “responsible body” with “the chief executive (education)” (Schedule 1, modification of subsection 8(2)). Consequently, any duty, power, or role assigned in the adopted Act to the responsible body now rests with the chief executive (education). That includes decision-making, contracting, approval, and oversight roles which the Queensland Act attributes to the responsible body. The Schedule also defines the “insuring body” as the chief executive (education) for insurance purposes (Schedule 1, modified s 9(5)), giving the chief executive the correlative power to enter insurance contracts with QGIF (Schedule 1, modified s 9(3)).

Insurance rights and duties

• The amended s 9(3) expressly permits the insuring body to enter into a contract of insurance with QGIF (Schedule 1). The newly inserted s 9(4) allows the contract to indemnify the student and the work experience provider against liability for personal injury or property damage suffered by the student, the provider or another person arising out of work experience provided outside Norfolk Island. That creates an express right for students and providers to be indemnified under the insuring contract if the chief executive obtains such cover with QGIF; the duty to enter such a contract is not mandatory in the instrument’s text, it is permissive (“may be entered into”), so the chief executive has discretion whether to procure the policy.

Geographic extension of duties

• The added subsection 4(2A) clarifies that premises and places where work experience may be provided “include premises and places outside Norfolk Island” (Schedule 1, modification of section 4). That makes it a duty of participating entities (schools, providers) to consider off-island locations within the statutory scheme; supervisory and safety duties that underlie the adopted Queensland Act will apply to such placements where the incident or arrangement falls within the adopted law.

School obligations as educational establishment

• Modification of s 5 narrows or clarifies the meaning of “educational establishment” in the context of students enrolled in State schools by inserting “is, for a student enrolled in a State school, the school” (Schedule 1, modification of section 5). That creates a specific duty on the school (as the educational establishment) with respect to State-school students’ work experience obligations under the adopted Act.

Omissions and interpretive gaps

• The Schedule omits certain dictionary definitions (Schedule 1, modification of Schedule (dictionary)), which may affect duties or rights that depend on those terms in the original Act. Where a duty or right in the adopted Act depends on an omitted definition, administrators and courts will need to resolve the meaning using the remaining text and the Queensland interpretive statutes (note to s 4(1)).

Limits on subordinate instruments

• The importation of subordinate legislation is limited to those provisions that are subject to disallowance in Queensland (s 4(2)). Duties and rights created by subordinate instruments that are not subject to disallowance will not be adopted. Practitioners must therefore check which subordinate instruments are within scope.

In summary, key duties and rights are inherited from the Queensland Act but reassigned in places to the chief executive (education), extended in geographic scope to include off-island placements, and are potentially supported by an indemnity mechanism if the chief executive elects to contract with QGIF.

The instrument itself does not create new criminal penalties or enforcement mechanisms; it brings the enforcement and penalty framework of the Education (Work Experience) Act 1996 (Qld) into Norfolk Island subject to the modifications listed. The precise penalties and enforcement procedures are therefore those contained in the adopted Queensland Act and any adopted subordinate instruments that are subject to disallowance (s 4(1) and s 4(2)). The instrument does, however, alter enforcement architecture indirectly through administrative reallocations and interpretive choices.

Delegation and enforcement actor

• The chief executive (education) is now the “responsible body” for purposes where the Queensland Act had used that concept (Schedule 1, modification of subsection 8(2)). That means enforcement powers, administrative decisions, approvals, notices and related regulatory functions that the Queensland Act allocates to the responsible body will fall to the chief executive (education) as the primary enforcement actor. The instrument does not itself list specific enforcement actions; those will be found in the adopted Queensland provisions.

Insurance and liability consequences

• The modified s 9 expressly contemplates indemnity for students and providers via a contract with QGIF (Schedule 1, modified s 9(3) and inserted s 9(4)). If the chief executive procures such a contract, the arrangements may diminish the practical consequences of civil liability for covered events arising out of off-island work experience, but the instrument leaves procurement discretionary (“may be entered into”) and does not itself abolish civil causes of action or statutory penalties in the adopted Act.

Application of Queensland enforcement mechanisms

• Because the adopted Act and adopted subordinate legislation operate under their own offence and penalty regimes, those offences and penalties would apply on Norfolk Island during the adopted period, unless specifically modified by the Schedule. The instrument does not enumerate or amend penalty provisions from the Queensland Act in Schedule 1 (aside from the modifications described), so enforcement relies on whatever offences, sanctions, or compliance measures the Queensland Act provides.

Interpretive and procedural consequences

• The note to s 4(1) states that the Acts Interpretation Act 1954 (Qld) and the Statutory Instruments Act 1992 (Qld) apply to the adopted provisions as they apply in the Territory (s 4(1) note 2). This affects how penalty provisions, time limits, service of notices and other procedural steps are to be construed and executed on the Territory.

Limits on subordinate enforcement instruments

• Because only subordinate instruments subject to disallowance in Queensland are adopted (s 4(2)), enforcement measures contained in subordinate instruments that are not disallowable remain outside the Territory’s adopted law. Practitioners must therefore verify which subordinate instruments (regulations, forms, codes) form part of the adopted suite when considering enforcement options.

In short, penalties and enforcement on Norfolk Island during the operation of this instrument will be those embedded in the adopted Queensland law, exercised principally by the chief executive (education) as the designated administrative actor, with certain civil liabilities potentially subject to indemnity contracts entered with QGIF where the chief executive chooses to procure such cover.

This instrument deliberately interacts with several statutory regimes and reassigns interpretive authority. The interaction is controlled by express textual statements in the instrument and by omission of certain Norfolk Island interpretive statutes.

Hierarchy and interpretive rules

• The instrument is made under subsection 7(2) of the Norfolk Island Applied Laws and Service Delivery (Queensland) Ordinance 2021 (s 3). The instrument’s notes state explicitly that the Interpretation Act 1979 (NI) does not apply to the instrument (s 3 note) and that the Acts Interpretation Act 1901 applies because the instrument is a legislative instrument (s 3 note). Furthermore, the note to s 4(1) makes the Queensland Acts Interpretation Act 1954 and the Statutory Instruments Act 1992 applicable to the adopted provisions as they apply in the Territory. These cross-references mean that when construing the adopted Education (Work Experience) Act provisions on Norfolk Island, one must use Queensland statutory interpretation rules rather than local Norfolk Island interpretation rules.

Interaction with Norfolk Island Applied Laws and Service Delivery (Queensland) Ordinance 2021

• The instrument is a “service delivery rule” under that Ordinance (s 3 note). The adoption mechanism and the temporal suspension referred to in the instrument are designed to operate within the framework of that Ordinance. The instrument makes clear that, absent its adoption, the Education (Work Experience) Act would have been suspended in the Territory until the end of 31 December 2026 (s 4(1) note 1). Practitioners should therefore read the instrument alongside the parent Ordinance to understand the broader legal shift of Queensland laws into the Territory.

Relationship with Norfolk Island Act 1979 post-2026

• The instrument includes a note that from 1 January 2027 the adopted provisions will, “so far as they are in force in the Territory in accordance with section 18A of the Norfolk Island Act 1979” apply in the Territory (s 4 note). That signals a planned transition of applicability from the temporary adoption mechanism to the statutory mechanism provided in the Norfolk Island Act 1979 after the instrument’s expiry. The instrument itself does not effect that later transition; it merely records the intended continuity via s 18A of the Norfolk Island Act 1979.

Subordinate legislation and disallowance

• The adoption of subordinate legislation from Queensland is limited to those provisions that are subject to disallowance in Queensland (s 4(2)). This means some subordinate Queensland instruments will form part of Norfolk Island law and others will not, depending on whether they are disallowable in Queensland. This interaction creates a patchwork import where primary Act provisions may operate with a subset of their typical subordinate rules.

Gaps caused by omitted definitions

• The Schedule omits certain dictionary definitions from the adopted Act (Schedule 1: “enrolled in an educational establishment”; “home education”; “home education place”; “law”; “non-State school”). Those omissions create interactions (or non-interactions) with other local laws that relied on those definitions for cross-referencing. For instance, where other Norfolk Island laws use any of the omitted terms, their relationship with the adopted Queensland Act may be less direct and require interpretive linkage under the Queensland interpretation acts.

Insurance interaction with Queensland public insurance scheme

• By permitting the chief executive to contract with the Queensland Government Insurance Fund (QGIF) (Schedule 1, modified s 9(3)), the instrument creates a direct interaction between Norfolk Island work-experience arrangements and a Queensland public insurer. That introduces Queensland public-insurance processes (claims handling, coverage terms) into the operation of Norfolk Island work-experience law when the chief executive exercises the permissive power.

Non-adoption of existing Norfolk Island in-force Queensland provisions

• The instrument expressly does not adopt or incorporate a provision of the law of Queensland so far as the provision is in force in Norfolk Island apart from this instrument (s 4(3)). This avoids double-adoption and requires practitioners to examine which Queensland provisions are already in force in Norfolk Island by other means.

In short, the instrument makes the adopted Queensland work-experience law operate under Queensland interpretive and subordinate-instrument rules, centralises administrative responsibility in a specified Norfolk Island official, links insurance possibilities to a Queensland insurer, and limits the subordinate legislation adopted. These interactions create interpretive, administrative and procedural linkages that require users to consult both the adopted Act and the relevant Queensland interpretation and subordinate instruments to assess legal effect on the Territory.

The instrument itself contains a brief, clear amendment and repeal schedule embodied in its operative text and Schedule 1. The instrument is the source of the modifications; there is no further amendment history recorded within the text provided.

Original instrument and commencement

• The instrument identifies itself as the Norfolk Island (Service Delivery (Queensland) (Work Experience)) Rules 2022 (s 1). It commences the whole instrument “the day after this instrument is registered” (s 2(1), commencement table). That is the only commencement mechanism stated in the instrument.

Authority and enabling provision

• It is made under subsection 7(2) of the Norfolk Island Applied Laws and Service Delivery (Queensland) Ordinance 2021 (s 3). The notes to s 3 and s 4 explain the instrument’s status as a service delivery rule and set out which interpretive regimes apply; these are part of the instrument’s immediate statutory context rather than subsequent amendments.

Scheduled modifications

• Schedule 1 constitutes the substantive amendments to the adopted Queensland Act for the Territory. The schedule lists five modifications to the Education (Work Experience) Act 1996 (Qld): insertion of s 4(2A) clarifying off-island premises; modification of s 5 to specify the educational establishment for State-school-enrolled students; replacement of the “responsible body” with “chief executive (education)” in s 8(2); replacement and expansion of s 9(3) to allow contracting with QGIF and to permit indemnities for off-island placements, with a definition of “insuring body”; and omission of several dictionary definitions. These scheduled modifications are operative immediately upon commencement as they form part of the current instrument.

Temporal repeal

• The instrument contains a stand-alone repeal clause: “This instrument is repealed at the start of 1 January 2027” (s 5). That is the terminated-end amendment: the instrument contains its own sunset.

No subsequent amendments recorded in instrument

• The provided text contains no later amendment dates, amending instruments, or saved transitional provisions other than those embedded in the notes to s 4(1) regarding the operation of the Queensland Acts Interpretation Act 1954 and the Statutory Instruments Act 1992, and the note about s 18A of the Norfolk Island Act 1979 post-2026. The instrument’s own life-cycle is therefore: made 14 April 2022 (signature date), commenced the day after registration (s 2(1)), operative with the Schedule modifications, and repealed at the start of 1 January 2027 (s 5).

Practical reading for amendment history

• For any compliance or legal review, the instrument’s Schedule is the only place within this document where the local law diverges from the Queensland Act; any further changes to how work experience is regulated on Norfolk Island during the operative period would require a new service delivery rule or other legislative action. After repeal, the transition to s 18A Norfolk Island Act 1979 is the next statutory milestone noted in the instrument.

The instrument’s text contains no record of litigation, cases or judicial interpretation. There are no named judicial decisions, appeals, or precedent references within the instrument. The parts labelled “Note” supply explanatory material about application and interpretation, but they do not record court decisions.

Implications of absence of litigation in the text

• Because the instrument is an administrative adoption of Queensland law and contains discrete textual modifications, litigation that might arise would involve: (a) interpretation disputes about the meaning and scope of the Schedule 1 modifications; (b) questions about the extent to which subordinate Queensland instruments have been adopted under s 4(2); (c) disputes as to the chief executive (education)’s exercise of powers (for example, procurement of insurance with QGIF, approvals of placements, or administrative decisions formerly made by a “responsible body”); and (d) coverage/indemnity disputes between claimants and QGIF if a contract is entered and invoked. None of those possible avenues have produced reported cases referenced in this instrument.

Points that could generate litigation (textually grounded)

• Omitted dictionary terms (Schedule 1) may occasion disputes about meaning where the Act depends on those terms. Courts or tribunals would need to rely on the remaining text and on the Queensland Acts Interpretation Act 1954 (as stated in the s 4(1) note) to construe omissions.
• The permissive nature of the insurance provision (“may be entered into” with QGIF, Schedule 1 modified s 9(3)) could generate litigation if an injured student or provider seeks indemnity and the chief executive declines to procure cover or procures insufficient cover. Any such dispute would raise contractual questions and questions about administrative discretion under the adopted Act.
• Cross-jurisdictional arrangements for placements outside Norfolk Island (Schedule 1 s 4(2A)) may create conflicts of laws issues or questions as to which statutory regime governs an incident occurring off-island; those points would be litigated under applicable choice-of-law and statutory construction rules using Queensland interpretation statutes as directed by the instrument.

Practical reading

• The instrument does not contain litigation history. Any litigation relevant to its operation will be generated by disputes that arise during its operative period and will require courts or tribunals to apply the adopted Queensland law and the Schedule’s modifications within the interpretive framework the instrument prescribes.

This instrument contains a number of points that can produce practical or legal friction if overlooked. These are matters raised by the instrument’s text and Schedule rather than policy commentary.

Temporary, predetermined sunset

• The adopted provisions operate only until the end of 31 December 2026 (s 4(1)) and the instrument is repealed at the start of 1 January 2027 (s 5). Organisations planning long-term arrangements must factor in the automatic expiry and the note directing attention to s 18A of the Norfolk Island Act 1979 for post-2026 arrangements (s 4 note). Failure to plan for the transition may leave arrangements without the expected statutory backing post-2026.

Geographic extension beyond the Territory

• The explicit insertion that work experience premises “include premises and places outside Norfolk Island” (Schedule 1, inserted s 4(2A)) means off-island placements are within the statutory framework. Practitioners should not assume territorial limits. This raises practical issues including travel, supervision, applicable workplace safety rules, and choice-of-law for incidents occurring off-island.

Permissive (not mandatory) insurance procurement

• The modified s 9(3) permits the insuring body to enter an insurance contract with QGIF; it does not obligate procurement (Schedule 1, modified s 9(3)). The new s 9(4) allows such a contract to indemnify students and providers for off-island incidents, but indemnity depends on procurement and the contract’s terms. Stakeholders should not assume indemnity exists by default.

Centralisation of authority

• Substituting “responsible body” with “chief executive (education)” (Schedule 1, mod. of s 8(2)) centralises statutory powers in a named office. That concentrates discretion in one administrative position; parties should identify the correct decision-maker for approvals, contracts and disputes. If local bodies previously performed these functions, they must adjust practice and delegation arrangements.

Omitted definitions create interpretive gaps

• The Schedule omits several dictionary definitions (Schedule 1: “enrolled in an educational establishment”; “home education”; “home education place”; “law”; “non-State school”). Where the Queensland Act’s other provisions rely on those definitions, their omission can create ambiguity about scope and applicability. Users should check how these terms are otherwise defined in adopted subordinate instruments or in Queensland interpretation acts that the instrument directs to apply (s 4(1) note).

Selective adoption of subordinate instruments

• Subordinate legislation under the Queensland Act is adopted only if it is subject to disallowance in Queensland (s 4(2)). Some commonly used subordinate instruments might not be disallowable and thereby would not be part of Norfolk Island law under this instrument. Do not assume the familiar Queensland regulatory matrix is fully imported.

Interpretive regime differs from local practice

• The instrument states that the Interpretation Act 1979 (NI) does not apply to it and that Queensland interpretation statutes apply to the adopted provisions (s 3 note; s 4(1) note). Practitioners accustomed to Norfolk Island interpretive rules need to adjust to Queensland rules for construing the adopted Act during the instrument’s life.

No automatic adoption where already in force

• The instrument expressly does not adopt any provision of Queensland law “so far as the provision is in force in Norfolk Island apart from this instrument” (s 4(3)). This prevents duplication but requires checking whether particular Queensland provisions were already in force in the Territory independently.

Administrative and insurance process reliance

• The insurance pathway via QGIF links claims and coverage to Queensland public-insurance procedures and contract terms. Coverage depends on the chief executive’s decisions and the contract with QGIF, which will contain its own exclusions and claims processes. Stakeholders should not assume entitlement without examining the actual insurance contract and any procurement decision.

These are practical “gotchas” that arise directly from the instrument’s text and the Schedule’s modifications. Each is a point of legal or operational friction that actors must address by checking which subordinate instruments are adopted, confirming whether insurance has been procured, and preparing for the statutory sunset at the end of 2026.

Compliance requires reading the adopted Queensland Education (Work Experience) Act 1996 as modified by Schedule 1, and then operationalising the specific modifications set out in the instrument. Below are concrete steps grounded in the instrument’s text.

1. Identify whether the adopted Queensland subordinate instruments apply

• Check which subordinate instruments made under the Queensland Act are subject to disallowance in Queensland and therefore adopted into Norfolk Island law (s 4(2)). Do not assume all Queensland subordinate legislation applies. Obtain an up-to-date list of disallowable subordinate instruments and confirm their status.

2. Adopt Queensland interpretation practices for construction

• Use the Acts Interpretation Act 1954 (Qld) and the Statutory Instruments Act 1992 (Qld) when construing the adopted Act and its subordinate instruments (note to s 4(1)). Administrative decision-makers and legal advisors should apply Queensland interpretive rules to time limits, service, and statutory forms during the instrument’s operative period. The Norfolk Island Interpretation Act 1979 does not apply to the instrument (s 3 note).

3. Recognise the chief executive (education) as the primary decision-maker

• Where the Queensland Act attributes powers or duties to the “responsible body,” those functions are assigned to the chief executive (education) in the Territory (Schedule 1, modification of subsection 8(2)). Organisations seeking approvals, indemnities, or other administrative actions should direct applications and correspondence to that office. If delegations are required, ensure they are documented under the chief executive’s authority consistent with local administrative law.

4. If indemnity is required, secure insurance procurement with QGIF

• The modified s 9(3) allows the insuring body (the chief executive (education)) to enter a contract of insurance with the Queensland Government Insurance Fund (QGIF) (Schedule 1, modified s 9(3); s 9(5) defining insuring body). If parties require coverage for off-island placements, request that the chief executive exercise the permissive power to procure cover and ensure the policy expressly covers personal injury and property damage arising from work experience outside Norfolk Island (Schedule 1, inserted s 9(4)). Record the contract terms, scope, exclusions and claims procedures.

5. Treat placements outside Norfolk Island as within the statutory scheme

• The adopted law expressly includes off-island premises and places in which students may be provided with work experience (Schedule 1, inserted s 4(2A)). Ensure all safety, supervision, consent, and transport arrangements for off-island placements comply with the adopted Work Experience Act provisions as modified, and document cross-jurisdictional arrangements, including applicable workplace law and insurance.

6. Schools must treat State-school students’ educational establishment as the school

• For State-school-enrolled students, the educational establishment is the school (Schedule 1, modified s 5). Schools should ensure their internal systems for enrolment, consent forms and parent communications reflect that statutory status and record the school’s decision-making in relation to placements.

7. Account for omitted definitions in drafting forms and policies

• The Schedule omits certain dictionary definitions (Schedule 1). When preparing consent forms, policies and agreements, do not rely on those omitted dictionary terms; instead, define terms clearly within documents or seek guidance under the Queensland Acts Interpretation Act 1954 to resolve meanings consistent with the adopted regime.

8. Plan for the sunset and transition at end-2026

• The adopted provisions operate only until the end of 31 December 2026 (s 4(1)), and the instrument is repealed at the start of 1 January 2027 (s 5). Develop a transition plan for placements, insurance, and administrative responsibilities that anticipates the legal changeover and the possible application of s 18A of the Norfolk Island Act 1979 beyond 2026 (s 4 note).

9. Maintain records and document decisions centrally

• Centralisation of authority in the chief executive (education) suggests that approvals, insurance procurement decisions, and delegated functions should be recorded in a clear, auditable manner. Parties should maintain copies of insurance contracts with QGIF if procured, written approvals for placements, signed consent forms, and any memoranda of understanding with off-island host providers.

10. Seek confirmation on coverage and subordinate instrument applicability

• Before sending students off-island or accepting placements, request written confirmation from the chief executive (education) about whether QGIF cover has been procured and which subordinate Queensland instruments apply locally. For providers, obtain written statements on indemnity and claims procedures. If cover is unavailable, amend agreements to allocate risk accordingly or obtain commercial insurance.

Following these steps will align practice with the instrument’s text. The primary compliance levers are verifying which subordinate instruments are adopted, engaging with the chief executive (education) for approvals and insurance, and preparing for the instrument’s sunset at the end of 2026.
