Norfolk Island Regulations 2017

The instrument revolves around a small set of concrete legal concepts and mechanisms:

• Limited subject‑matter scope: The Part governing sittings applies only to civil matters, specifically matters “otherwise than in the exercise of its criminal jurisdiction” (s 6(1)). The instrument therefore does not purport to authorise off‑island criminal sittings.

• Judicial satisfaction and interests of justice: The trigger for a sitting outside Norfolk Island is the Judge’s satisfaction that hearing the matter elsewhere is “not contrary to the interests of justice” (s 7). That phrase is the central substantive standard used throughout Part 2: a Judge must be satisfied that an out‑of‑island hearing is compatible with the interests of justice before ordering one (s 7; notes to ss 8 and 9 reiterate that constraint).

• Two decisional modes: There are parallel decision pathways. While a matter is before the Supreme Court at a sitting, the court itself may adjourn and continue the hearing at a specified interstate place (s 8). Separately, when the matter is not currently before the court, a single Judge may make orders about the location of future sittings and may revoke prior orders (s 9). These provisions distinguish between collective court orders made in open sitting (s 8) and individual Judge orders made out of sitting (s 9).

• Reversibility: Section 9 expressly allows a Judge to order that a matter previously ordered to be heard interstate be returned to Norfolk Island (s 9(a)(ii)). Section 9(b) also allows revocation of any earlier order about location. The instrument therefore contemplates both forward and reverse transfer of sitting locations.

• Service directions tied to party initiation: Section 10 gives power to the court or a Judge to give directions about serving a copy of an order made under Part 2, but only where the order was made “at the instance of a party to the matter.” That conditions the service‑directions power on party‑initiated orders.

• Continuity with prior regulations and repeal: Section 11 contains a mapping table preserving the effect of orders and directions made under specified provisions of the repealed 1979 Regulations, re‑characterising them as orders under ss 8, 9 and 10 as appropriate. Schedule 1 repeals the 1979 Regulations in their entirety.

• Dependence on the Act for institutional definitions: The instrument does not attempt to redefine “Judge” or “Supreme Court”; it explicitly relies on the Norfolk Island Act 1979 to supply those meanings (s 5). It also states that Part 2 operates for the purposes of paragraph 67(a) of the Act (s 6(2)), showing the instrument’s limited role as subordinate detail under the parent Act.

These concepts translate into a compact discretion architecture: Judges decide whether non‑Norfolk sittings are appropriate by reference to “interests of justice”, the court can move an ongoing hearing, the Judge can set or revoke locations out of sitting, parties can seek such orders and, if they initiate the order, can obtain directions about service.

The instrument directly affects three groups of actors, and indirectly affects others, although it does not allocate costs or set procedural detail beyond location and service directions:

• Judges of the Supreme Court: Judges have the statutory discretion to authorise or order sittings outside Norfolk Island, both while the court is sitting (s 8 carried out by the court) and when the court is not sitting (s 9 permitting a Judge to act alone). The standard is the Judge’s satisfaction that hearing the matter outside Norfolk Island is not contrary to the interests of justice (s 7). Judges also have power to revoke earlier orders about location (s 9(b)).

• Parties to civil matters (litigants): Parties to non‑criminal matters in the Supreme Court of Norfolk Island are affected operationally. A party may initiate an application that leads to a sitting being ordered in a State, the ACT or the NT; where the order is made at a party’s instance, the court or Judge may give directions about service of the order on other parties (s 10). Parties will therefore face potential relocation of hearings and must be prepared to attend and participate at the specified interstate venue if ordered.

• The Supreme Court as institutional actor: The court’s ability to sit outside Norfolk Island is central. The court may adjourn and continue hearings at a specified place in a State, the ACT or the NT (s 8). The regulation does not create a new judicial body; existing institutional roles (Judge, Supreme Court) are supplied by the Norfolk Island Act 1979 (s 5).

Indirectly affected actors include:

• Local counsel and opposing counsel: The regulation will change where counsel must appear for certain civil hearings if the court or a Judge orders sittings elsewhere. The instrument does not address substitutionary mechanisms such as appearances by remote counsel, telephone or video links, or rules for representation at out‑of‑island sittings.

• Witnesses, expert witnesses and third‑party participants: Those required to give evidence or take part in a hearing may be required to travel to a State, the ACT or the NT for sittings ordered under ss 7-9. The instrument does not prescribe witness attendance rules or financial support.

• Courts and registries in States, the ACT and the NT: These jurisdictions may host sittings of the Norfolk Island Supreme Court. The instrument does not create obligations for host registries or set out logistical responsibilities for venue, security, or facilities.

What the instrument does not affect, as written: criminal sittings (s 6(1) expressly limits the Part to non‑criminal matters), and the substantive rules of procedure and evidence, costs allocation, travel expenses, or practical arrangements for out‑of‑island sittings. The instrument is silent on who pays venue costs, travel, or ancillary expenses, and does not set rules on alternate modes of attendance.

The instrument creates a small set of rights and procedural powers, and leaves many routine judicial and administrative duties to other legal instruments or to judicial practice. The provisions create the following specific duties and rights:

• Judicial duty to be satisfied about interests of justice: A Judge must be satisfied that hearing the matter outside Norfolk Island is “not contrary to the interests of justice” before ordering an out‑of‑island sitting (s 7). That requirement operates as a decision rule constraining judicial exercise of power to move a sitting.

• Court duty to adjourn and continue upon order: When a matter is before the Supreme Court, the court has power to order an adjournment and continuation at a specified place in a State, the ACT or the NT (s 8). This is expressed as a power of the court rather than a mandatory duty to transfer; thus the court may exercise that power where appropriate.

• Judge’s power to order location and to revoke prior orders: When the matter is not before the Supreme Court for hearing, a Judge may order that the matter be heard or continued at a specified interstate place, may order return to Norfolk Island if a prior order had placed the matter interstate, and may revoke any earlier order about the location of a sitting (s 9(a)(i)-(ii), s 9(b)). Those powers create rights for parties to seek location orders and rights for the Judge to alter or cancel earlier directions.

• Power to give service directions when party‑initiated: If an order under Part 2 is made “at the instance of a party”, then the court or the Judge may give directions about serving a copy of the order on the other parties (s 10). This gives an express procedural right to obtain tailored service directions when a party prompts the order, but it is a conditional power rather than an unconditional right to bespoke service arrangements in every case.

• Transitional continuity: For orders and directions made under specific provisions of the repealed 1979 Regulations and that were in force immediately before commencement, s 11 provides that those orders and directions continue to have effect under the corresponding new sections. That protects the legal effect of pre‑existing orders and directions in the transition to the 2017 instrument.

Rights and duties not specified by the instrument:

• Allocation of costs and expenses, obligations on host venues or registries, detail on practical management of interstate sittings (e.g. record keeping, security, court staff attendance), and rules about remote attendance are not set out in the instrument. The instrument is silent on these matters; it confines itself to location authority, adjournment power, revocation power and service‑direction power (ss 7-10).

• The instrument does not create a duty on any State, the ACT or the NT to provide facilities or resources for the Supreme Court to sit there, nor does it create statutory entitlements for witnesses or parties to travel assistance.

In consequence, parties and judges operate against a background where location decisions rest on judicial satisfaction about the interests of justice (s 7) and where ancillary practical and financial duties are governed elsewhere or left to judicial orders not specified in this instrument.

The instrument contains no express penalty provisions, criminal sanctions, or administrative fines. It is a procedural regulation that confers powers on the Supreme Court and Judges and supplies transitional mechanics; it does not prescribe offences, enforcement mechanisms, or monetary penalties.

Enforcement of the instrument’s directions therefore operates indirectly through ordinary judicial processes and contempt powers inherent in the court’s institutional competence under the Norfolk Island Act 1979. The instrument itself outlines who may make orders (the court at a sitting, or a Judge when the court is not sitting) and how orders may be served when made at a party’s instance (s 10), but it does not create statutory sanctioning powers beyond those the court already possesses by statute or common law.

Practical implications of the absence of statutory penalties:

• Non‑compliance with an order transferring a hearing (for example, a party failing to attend an interstate sitting ordered under s 8 or s 9) would not attract a specific penalty created by this instrument; enforcement would rely on usual court processes, for example, contempt proceedings or interlocutory enforcement steps pursuant to the court’s pre‑existing jurisdiction under the Act or rules of court. The instrument does not set out those enforcement routes.

• The instrument does not prescribe procedural consequences for failure to comply with service directions under s 10; consequences will depend on general procedural law, practice directions or subsequent court orders.

• There is no administrative enforcement mechanism for host jurisdictions: the States, the ACT and the NT are not given statutory roles for enforcement in the instrument; they are simply identified as permissible locations for sittings (ss 7-9).

Because the instrument confers powers without attaching specific statutory penalties or enforcement regimes, compliance and enforcement will be managed through the Supreme Court’s ordinary judicial authority and any relevant rules of court or practice directions enacted under the Norfolk Island Act 1979 or rules made by the court. The instrument’s text does not provide further detail on how enforcement is to be effected.

The instrument is subordinate legislation made under the Norfolk Island Act 1979. The text explicitly states it is made under the Act (s 3) and relies on the Act for a number of defined expressions, including “Judge” and “Supreme Court” (s 5). Section 6(2) states that Part 2 has effect for the purposes of paragraph 67(a) of the Act, tying the instrument’s siting powers directly to a specific provision of the parent statute.

Key interaction points evident from the instrument:

• Reliance on the Norfolk Island Act 1979 for definitions and authority: The instrument does not purport to define the court or the judicial office; it imports those institutional definitions from the Act (s 5). It also states it is made under the Act (s 3), making it a regulation that should be read and applied in that legislative context.

• Limits on subject matter (criminal v civil): Section 6(1) confines the instrument’s substantive scope to sittings “for the purpose of hearing and determining a matter, otherwise than in the exercise of its criminal jurisdiction.” That interacts with any other statutory rules that authorise criminal sittings, this instrument does not displace them; it simply does not apply to criminal jurisdiction.

• Transitional continuity with previous subordinate law: Schedule 1 repeals the Norfolk Island (Supreme Court Sittings) Regulations 1979 in full. Section 11 contains a mapping table that preserves the legal effect of specified orders and directions made under the 1979 Regulations by treating them as if made under the corresponding new sections. That ensures continuity of existing orders and directions despite the repeal.

• Procedural and rules‑of‑court gap‑filling: The instrument leaves extensive procedural detail unaddressed (costs, witness attendance, venue obligations, practical records, remote appearance modalities). Those matters will therefore be governed by the wider scheme of procedural law applicable to the Supreme Court of Norfolk Island under the Act and any rules or practice directions made under the Act. The instrument itself does not create or modify those rules.

• Territorial limitation to Australian jurisdictions: The instrument permits sittings only in a State, the ACT or the NT (s 7, s 8, s 9). It does not authorise sittings in other territories or foreign jurisdictions. Any interaction with laws of host jurisdictions (for example, permission to occupy court facilities, cooperation in service, or enforcement issues) will depend on the consent and administrative arrangements with those jurisdictions and not on any express grant in this regulation.

• Service of orders: Where an order under Part 2 is made “at the instance of a party”, the court or Judge may give directions about service (s 10). That interacts with broader service rules in the Act and rules of court; the instrument does not supplant those rules but adds an express direction power in the specific context of party‑initiated location orders.

In short, the instrument operates as a narrow procedural layer within the statutory architecture created by the Norfolk Island Act 1979 and leaves substantial interactional work, costs, venue logistics, enforcement of non‑attendance, and inter‑jurisdictional administrative arrangements,to the Act, rules of court, and the existing legal framework.

The instrument contains its own limited record statements but does not include any subsequent amendments within the text provided. The commencement provision records the basic commencement mechanics: each provision commences, or is taken to have commenced, in accordance with the table in s 2; the table records that the whole of the instrument commenced the day after registration, specifically noting 6 July 2017 as the commencement date for the instrument as originally made (s 2). The note to that table emphasises that the table relates only to the provisions of the instrument as originally made and will not be amended to reflect later amendments.

Schedule 1 effects repeal of the Norfolk Island (Supreme Court Sittings) Regulations 1979 (Schedule 1, item 1: “The whole of the Regulations,Repeal the Regulations”). Section 11 implements transitional continuity by mapping orders and directions under particular provisions of the old 1979 Regulations to corresponding sections of the 2017 instrument (s 11 and the table contained in s 11). The mapping shows continuity for five categories of order/direction under the old Regulations to become orders under ss 8, 9 or directions under s 10.

The instrument itself does not list subsequent amendment events, and there is an explicit editorial note in s 2 that the commencement table will not be amended to reflect later amendments. The instrument therefore presents only its original text and the repeal of the prior 1979 Regulations. Any later amendments, if they exist, are not recorded in the text provided.

Because the instrument is subordinate legislation made under the Norfolk Island Act 1979, any changes to the parent Act that affect definitions or the powers referenced here (for example paragraph 67(a) of the Act) would interact with this instrument, but the instrument’s text does not record such amendments or their effects. The only stated textual alterations in the instrument itself are the repeal of the 1979 Regulations (Schedule 1) and the transitional mapping (s 11).

The instrument as supplied contains no reference to litigation history. There are no reported cases, judgments, or court proceedings cited in the regulation text or the transitional provisions. The instrument is procedural subordinate legislation; its text does not record judicial challenges, appeals, or litigation outcomes. Therefore, based solely on the instrument provided, there is no litigation history to report.

This silence may mean one of three possibilities, none of which can be inferred from the instrument alone: (a) no litigation has arisen directly challenging these regulations; (b) litigation has occurred but is not recorded in the instrument text; or (c) any litigation relevant to these provisions is recorded in external sources (for example, court reports or gazette notices) not included here. The instrument itself provides no data about disputes over the meaning or operation of ss 7-10, or about judicial interpretation of “interests of justice” in this statutory context.

Accordingly, practitioners needing to assess precedent or interpretive history should consult authoritative case law databases, court transcripts, and the Norfolk Island courts’ decisions rather than relying on the instrument text for litigation history; the instrument itself records no cases or litigation.

This instrument is short and specific; however, several features can create practical or legal surprises for practitioners and parties if they are not read carefully:

• Limited to civil jurisdiction: Section 6(1) expressly confines Part 2 to sittings “otherwise than in the exercise of its criminal jurisdiction.” A practitioner who assumes the regulation authorises off‑island criminal sittings will be mistaken. Criminal sittings are not authorised by this instrument.

• Judicial discretion framed by “interests of justice”: The requirement that a Judge be “satisfied that the hearing of the matter outside Norfolk Island is not contrary to the interests of justice” (s 7) is the pivotal threshold. The instrument provides no elaboration of what facts or considerations must be proved to satisfy that standard. The absence of statutory elaboration means variable judicial standards and case‑by‑case determinations are likely.

• Only States, the ACT and the NT: The instrument permits sittings only in a State, the Australian Capital Territory or the Northern Territory (s 7, s 8, s 9). It does not permit sittings in other territories or offshore places; practitioners should not assume broader geographic reach.

• No provisions on costs, expenses or logistical obligations: The instrument is silent on who bears the costs of holding a sitting in another jurisdiction. It does not assign responsibility for travel, accommodation, venue hire, court staff attendance, transcript costs, or costs to witnesses. Expect those matters to be governed by separate rules of court, orders of the Judge, or commercial arrangements; do not rely on the instrument to resolve them.

• Service directions limited to party‑initiated orders: Section 10 allows directions about serving a copy of the order only if the order was made “at the instance of a party.” If the court or the Judge initiates the order without any party prompting, s 10 does not expressly empower service directions tied to party initiative. Practitioners should note this conditionality when seeking service arrangements.

• Transitional carryover may preserve legacy orders: Section 11 maps certain orders and directions made under the 1979 Regulations into the new regime. That means pre‑commencement orders may survive by being read as orders under s 8, s 9 or directives under s 10. Parties should check for any existing orders made under the 1979 Regulations to understand whether they continue and how they are characterised under the 2017 instrument.

• Revocation power can upend expectations: Section 9(b) authorises a Judge to revoke any earlier order about the location of a sitting. Parties who rely on a prior order to plan logistics should be aware that a Judge may revoke that order and change the venue back to Norfolk Island or to a different place, subject to the statutory interests‑of‑justice test.

• No host‑jurisdiction obligations set out: The instrument does not create duties on the host State, the ACT or the NT to provide facilities or staff. Logistical and administrative arrangements will need to be negotiated or handled under other legal and administrative frameworks.

• Absence of procedural detail for remote attendance or technology: The instrument does not contemplate or govern hearings conducted by remote audio‑visual means. If counsel or parties seek to rely on remote evidence or appearances, other rules or specific court orders will be necessary; the instrument does not supply that authority.

• Dependence on the parent Act for definitions and supplemental powers: Because the instrument imports definitions (s 5) and states it operates for paragraph 67(a) of the Act (s 6(2)), practitioners must consult the Norfolk Island Act 1979 to understand the full institutional and procedural context; the instrument alone is not self‑sufficient.

These features are not defects per se; they are the consequences of the instrument’s narrow scope and deference to judicial discretion and the parent Act. But they are potential sources of planning and litigation risk if not attended to.

Compliance with the instrument requires understanding which actor is entitled to make location decisions, the applicable legal standard, and the limited procedural tools the instrument provides. The following practical checklist translates the instrument’s provisions into actionable steps for parties, counsel and court officers.

1. Ascertain subject‑matter eligibility:

   • Confirm the matter is within the instrument’s scope. Part 2 applies only to matters “otherwise than in the exercise of its criminal jurisdiction” (s 6(1)). If the matter is criminal, do not rely on these regulations to obtain an off‑island sitting.

2. Engage the Judge with evidence relevant to “interests of justice”:

   • If seeking a sitting outside Norfolk Island, obtain and marshal submissions and evidence that will enable a Judge to be satisfied that hearing the matter outside Norfolk Island is “not contrary to the interests of justice” (s 7). The instrument itself does not list factors; provide concrete, case‑specific material: reasons for relocation, effects on parties and witnesses, accessibility, public interest considerations, and any logistical arrangements to mitigate prejudice.

3. Know the appropriate procedural route:

   • While the matter is being heard, the court may order an adjournment and continuation at a specified place in a State, the ACT or the NT (s 8). Outside of court sittings, make an interlocutory application to a Judge under s 9 seeking a location order, or seeking return to Norfolk Island if a prior order places the matter elsewhere (s 9(a)(ii)). Use s 9(b) if seeking revocation of a previous order.

4. If you initiate the order, seek service directions:

   • If the order is sought “at the instance of a party”, request directions under s 10 about serving copies of the order on other parties. Be prepared to propose specific service arrangements, particularly where parties are offshore or dispersed.

5. Prepare for practical logistics not addressed by the instrument:

   • The instrument does not allocate costs, set venue obligations, or manage witness attendance. Prepare formal submissions or interlocutory material to address who will cover travel, accommodation, transcription costs and how exhibits, bundles and records will be managed. Where relevant, seek specific orders on costs and logistical arrangements as part of the location application.

6. Check for pre‑existing orders under the 1979 Regulations:

   • Under s 11, certain orders and directions made under the repealed 1979 Regulations and in force immediately before commencement continue and are to be treated as if made under ss 8, 9 or 10. Before moving to enforce or rely on location orders, inspect existing court records to see if any pre‑commencement orders apply.

7. Expect possible revocation and be flexible:

   • A Judge may revoke a prior order about the location of a sitting (s 9(b)). If planning significant logistics around a location order, include contingency measures and seek express orders addressing the consequences of any revocation (for example costs or notice requirements) if those matters are critical.

8. Coordinate with host jurisdiction administrative authorities:

   • Although the instrument does not create host‑jurisdiction duties, practical compliance requires arranging facilities, security, transcription and registry access with the intended host State, the ACT or the NT. Make those arrangements in advance and seek judicial endorsement where appropriate.

9. Record keeping and communications:

   • Ensure any order under ss 8-10 is properly documented, and serve copies in accordance with directions. If the order was made at the instance of a party and directions are given under s 10, follow those directions exactly to avoid procedural challenge.

10. Consult the Norfolk Island Act 1979:

• Because the instrument relies on the Act for definitions and operates for paragraph 67(a) of the Act (s 6(2), s 5), consult the parent statute and any applicable rules of court or practice directions for complementary procedural requirements that affect hearings, notice, representation and enforcement.

Who decides and who pays: Judges and the court make location decisions under ss 7-9; the instrument does not specify payment obligations for travel, venue, or related costs. Parties should therefore seek express orders if financial allocations are material, because those matters are not resolved by the instrument itself.

In short, compliance is procedural and preparatory: ensure the matter is non‑criminal, prepare submissions directed at the “interests of justice” standard, use the correct statutory route (s 8 for in‑sitting adjournments; s 9 for out‑of‑sitting applications), obtain service directions where party‑initiated (s 10), and make separate arrangements for practical logistics and costs, since the instrument is silent on those matters.
