Norfolk Island Legislation (Migration) Transitional Rule 2016

Final transition time: defined in section 4 as the commencement of Part 1 of Schedule 2 to the Norfolk Island Legislation Amendment Act 2015, which is 1 July 2016. This is the pivot point on which all deeming operates. A person’s immigration status under Norfolk Island law immediately before this moment determines which Commonwealth visa they are taken to have been granted immediately after it.

Unrestricted entry permit: a permit under the former Immigration Act 1980 (Norfolk Island). Holding this permit, combined with New Zealand citizenship, triggers a deemed Subclass 444 visa under section 6. The instrument also uses this permit as a trigger for certain child provisions.

General entry permit and temporary entry permit: also permits under the Norfolk Island Act. Holding either permits (and not holding a permanent Commonwealth visa) triggers a deemed Subclass 159 visa under section 8.

Non-citizen: defined identically to the definition in the Migration Act 1958 - a person who is not an Australian citizen. Australian citizens were not affected by this instrument because they were already outside the migration framework.

Dependent child and parent: section 5 borrows the definitions from the Migration Act and Migration Regulations. This is critical because the instrument grants visas to certain children born between 30 December 2015 and 30 June 2016 based on their parents’ permit holdings. A child born during that window who did not hold a permit themselves but whose parent held an unrestricted, general, or temporary entry permit may receive a deemed visa through sections 6(3) or 8(3). The child’s age and dependency are determined by Commonwealth law, not Norfolk Island law.

Subclass 444 (Special Category) visa: a visa normally available to New Zealand citizens who meet certain criteria. Under this instrument, it is deemed granted to New Zealand citizens who held unrestricted entry permits and to New Zealand citizen children meeting the parent test. It is a temporary visa, but Special Category visa holders can generally stay indefinitely and work. The coming-into-effect rules in section 7 allow it to be deferred if the person already held another temporary visa (except Visitor visas).

Subclass 159 (Provisional Resident Return) visa: a visa that normally allows certain former permanent residents to re-enter. Here it is repurposed as a one-year temporary visa, geographically restricted to Norfolk Island except for study by dependent children under 25. It is a unique subclass with conditions that override the standard Subclass 159 provisions in the Migration Regulations (section 10). It cannot be in effect after 30 June 2017 (section 9(3)).

Subclass 808 (Confirmatory (Residence)) visa: a permanent visa that confirms an existing right of residence. It is deemed granted to two categories: (1) persons who were residents of Norfolk Island under the Norfolk Island Act and did not hold a permanent Commonwealth visa; (2) holders of Subclass 834 (Permanent Resident of Norfolk Island) visas. The visa permits travel and entry for five years from the final transition time (section 11(4)). This is a permanent visa, so the holder can remain indefinitely in Australia, but the travel facility is limited - after five years they need a Resident Return visa to re-enter.

Immigration cleared: defined implicitly in section 12. All persons in Norfolk Island at the final transition time are taken to be immigration cleared immediately after that time for Migration Act purposes. This avoids the need for individual clearance processing. The note clarifies that they do not need to present identity evidence under section 166 of the Migration Act.

The instrument affects only non-citizens - persons who were not Australian citizens - present in Norfolk Island immediately before 1 July 2016 and who held one of the specified entry permits or resident status under the former Norfolk Island immigration regime. It does not affect Australian citizens, who were never subject to the migration framework, nor does it affect non-citizens outside Norfolk Island at that time. The instrument creates three distinct cohorts.

The first cohort is New Zealand citizens who held an unrestricted entry permit under the Norfolk Island Act and did not hold a permanent Commonwealth visa (section 6(2)). Also included are New Zealand citizen children born after 30 December 2015 but before 1 July 2016 who were in Norfolk Island at the final transition time, did not hold a permit themselves, were not Norfolk Island residents, and had a New Zealand citizen parent who held an unrestricted entry permit (section 6(3)). These persons receive a deemed Subclass 444 visa. This cohort effectively becomes equivalent to New Zealand citizens who enter Australia on a Special Category visa, with the usual work and study rights that flow from that visa.

The second cohort is non-citizens (including New Zealand citizens who did not meet the section 6 test) who held a general entry permit or temporary entry permit under the Norfolk Island Act and did not hold a permanent Commonwealth visa (section 8(2)). Also included are non-New Zealand citizen children born between 30 December 2015 and 30 June 2016 who were in Norfolk Island, held no permit, were not residents, and had a parent who held either an unrestricted permit (as a New Zealand citizen) or a general/temporary permit (section 8(3)). These persons receive a deemed Subclass 159 visa, which is markedly more restrictive than either the Subclass 444 or Subclass 808 visas. They are confined to Norfolk Island for work, study and residence, and the visa expires on 30 June 2017. This cohort includes many long-term residents of Norfolk Island who had permanent residence rights under Norfolk Island law but who did not qualify for the resident category under the new regime. They face the highest compliance burden because they must apply for a new visa before the Subclass 159 expires or become unlawful.

The third cohort is non-citizens who were residents of Norfolk Island under the Norfolk Island Act immediately before the final transition time and did not hold a permanent Commonwealth visa (section 11(2)). Also included are holders of Subclass 834 (Permanent Resident of Norfolk Island) visas (section 11(3)), which were a temporary Commonwealth visa created for Norfolk Island purposes. These persons receive a deemed Subclass 808 permanent visa with a five-year travel facility. This cohort is the most advantaged: they obtain permanent residence under Commonwealth law, can live and work anywhere in Australia without restriction, and have five years to re-enter after travel. However, they must be aware that after the five-year travel validity period, they need a Resident Return visa to re-enter Australia if they leave.

The instrument also affects the children of these cohorts who were born in a narrow window (30 December 2015 to 30 June 2016). This window corresponds to the period after the Norfolk Island Legislation Amendment Act was passed (which received Royal Assent on 30 December 2015) and before the transition date. Children born earlier would have acquired their own permit or resident status under Norfolk Island law; children born later fall under the standard Migration Act regime and would need a visa application.

For each deemed visa, the instrument specifies both the rights conferred and any limitations. The Subclass 444 visa (deemed under Division 1) confers the right to travel to, enter and remain in Australia under the same conditions as a Subclass 444 visa granted under the Migration Act. No explicit work or study restrictions are imposed in this instrument, so the standard conditions for Subclass 444 visas apply - generally, the visa allows indefinite stay and work authorization. However, section 7(2) clarifies that the visa may be cancelled or cease to be in effect under the Migration Act, meaning the holder is subject to the same cancellation grounds (e.g., character, non-compliance) as any other visa holder.

The Subclass 159 visa (deemed under Division 2) is far more limited. Section 8(4) states it is a temporary visa permitting the holder to travel to, enter and remain in Australia for a period starting when it comes into effect and ending at the end of 30 June 2017. The maximum period is thus approximately one year. Section 8(5) imposes a geographic condition: the holder must live, study and work only in Norfolk Island. There is a study exception for dependent children under 25 who are ordinarily resident in Norfolk Island and who study elsewhere in Australia, meeting condition 8105 (work limitations for student visa holders). Note 2 to section 8(5) clarifies that condition 8105 itself is not imposed; only the study exception is imported. This means the child can study on the mainland but may only work to the extent permitted under condition 8105 if they were on a student visa. The instrument expressly overrides the standard Subclass 159 visa provisions in the Migration Regulations regarding when the visa is in effect and conditions (section 10).

The Subclass 808 visa (deemed under Division 3) is a permanent visa. Section 11(4) states it permits the holder to travel to and enter Australia for a period of 5 years from immediately after the final transition time. This overrides the standard Subclass 808 provisions in the Regulations. The permanent nature means the holder can remain in Australia indefinitely after entry. The five-year travel facility means that if the holder leaves Australia after that period, they must apply for a Resident Return visa to re-enter, or return within the period. The holder can live, work and study anywhere in Australia without the geographic restriction that applies to Subclass 159.

All three deemed visas are subject to cancellation or cessation under the Migration Act (sections 7(2), 9(4), 11(5)). The instrument does not grant any immunity from the character provisions, fraud provisions, or other cancellation powers under the Migration Act. The holder’s ongoing compliance with visa conditions is required.

Part 3 (section 12) creates an important right: persons in Norfolk Island at the final transition time are taken to be immigration cleared immediately after that time. This means they are not required to go through a physical immigration clearance process or present identity documents under section 166 of the Migration Act. This provision forestalls any argument that they were unlawful non-citizens because they had not been cleared. It effectively deems lawful status from the outset.

The instrument does not impose any positive duty on affected persons to do anything proactively. The visas are granted automatically. However, the limited duration of the Subclass 159 visa creates a de facto duty on its holders to apply for a new visa before 1 July 2017, otherwise they will become unlawful non-citizens subject to detention and removal under the Migration Act.

The instrument itself does not create any new penalties. Enforcement flows from the underlying Migration Act 1958. The deemed visas are subject to cancellation under the Migration Act. Cancellation can occur on various grounds, including incorrect information, breach of visa conditions, failure to pass character tests (section 501), or if the visa was granted in error. The instrument does not limit those powers.

The geographic restriction on the Subclass 159 visa (must live, study and work only in Norfolk Island except for the study exception) is a condition of that visa. If a holder breaches this condition by living, studying or working outside Norfolk Island without meeting the exception, they may be liable for visa cancellation under section 116 of the Migration Act (failure to comply with a condition). If the visa is cancelled, the person becomes an unlawful non-citizen and may be detained and removed under Division 8 of the Migration Act. There are no separate criminal penalties for breach of this condition in the instrument itself, but the Migration Act provides criminal offences for remaining in the migration zone while being an unlawful non-citizen.

For the Subclass 444 and Subclass 808 visas, standard enforcement mechanisms apply. Overstaying a Subclass 444 visa (if it ceases) or breaching any condition not specified in this instrument attracts the usual Migration Act sanctions.

The deemed immigration clearance in section 12 means that no penalties arise from the failure to present identity evidence at the final transition time. However, if a person later makes a false claim about their immigration status or provides false information in a future visa application, the standard penalties for fraud (including criminal penalties under section 234 of the Migration Act) apply.

The instrument does not create any enforcement role for Norfolk Island authorities. After the transition, the Department of Immigration and Border Protection (as it then was) assumes full responsibility for visa compliance, cancellation, and enforcement on Norfolk Island as it does on the mainland.

It is notable that the instrument does not address the situation of persons who might have been unlawfully present in Norfolk Island under the Norfolk Island Act immediately before the transition. Only persons holding specified permits or being residents are covered. If a non-citizen was neither a resident nor a permit holder, they are not deemed to have been granted any visa, and they would become unlawful non-citizens at the final transition time. The instrument does not otherwise address their status.

This instrument is made under item 357 of Schedule 2 to the Norfolk Island Legislation Amendment Act 2015. That Act amended the Migration Act and other Commonwealth laws to extend the full Australian migration framework to Norfolk Island. This rule is a transitional mechanism to avoid disruption during the changeover. The Norfolk Island Legislation Amendment Act is the parent legislation, and this rule must be read consistently with it.

The instrument interacts directly with the Migration Act 1958. The deemed visas are taken to be granted “under the Migration Act 1958” (sections 6(1), 8(1), 11(1)). This means the full provisions of the Migration Act apply to those visas, including the powers to cancel, the obligations of visa holders, and the enforcement mechanisms. Section 12 deems persons to have entered Australia and to be immigration cleared for the purposes of the Migration Act. The interaction with section 166 is specifically waived.

The Migration Regulations 1994 are also relevant. The instrument borrows definitions of “dependent child” from regulation 1.03 of the Regulations (section 5). It also overrides specific divisions of Schedule 2 to the Regulations: Division 159.5 and 159.6 (about when a Subclass 159 visa is in effect and conditions) and Division 808.5 (about when a Subclass 808 visa is in effect). This means the usual regulatory provisions for those visa subclasses are displaced by the instrument’s own rules. For Subclass 444, no override is specified, so the standard regulatory provisions apply.

The Immigration Act 1980 (Norfolk Island) is the old law that this instrument replaces. The instrument references that Act to define the categories of permits and residency that trigger the deemed visas. The instrument does not repeal or amend that Act; the Norfolk Island Legislation Amendment Act did that. This rule merely uses the categories to set the transition.

The instrument does not interact with state or territory migration laws (none exist). It also does not interact directly with tax laws, social security laws, or other Commonwealth laws that use visa status as a condition of eligibility. However, because the instrument determines visa status for a cohort of people, it indirectly affects access to Medicare, the age pension, family tax benefits, and other Commonwealth programmes that require permanent residence or a specific visa subclass. For example, holders of Subclass 159 visas, being temporary visas restricted to Norfolk Island, may not meet the residence requirements for many social security payments. That interaction is not addressed in this instrument but will require separate analysis by those affected.

The instrument does not create any contractual rights or override private agreements. It is purely public law.

There is no amendment history for this instrument. The instrument was made on 28 June 2016 by Paul Fletcher, Minister for Territories, Local Government and Major Projects, and commenced on 1 July 2016. The table in section 2 notes that the commencement information relates only to the provisions as originally made and will not be amended to deal with any later amendments. The instrument as provided in the source material shows no amending instruments or subsequent changes. It is a single generation instrument.

The authority provision (item 357 of Schedule 2 to the Norfolk Island Legislation Amendment Act 2015) is a specific transitional rule-making power. That power may have been time-limited or has now ceased to be exercisable because the transition period has passed. The instrument itself may have been repealed or superseded, but the source text does not show any such event. Given that the instrument operated for a specific transition (the deemed visas for Subclass 159 expired on 30 June 2017, and the deemed visas for Subclass 444 and 808 are ongoing but could be cancelled), the instrument may no longer have operative effect for new situations, but it remains relevant for historical status determinations.

Because no amendments are shown, we cannot discuss any changes in the instrument’s terms. The original instrument remains as drafted. This is typical for transitional rules that serve a one-off purpose.

The source text does not mention any litigation. No cases are cited within the instrument. The instrument is a legislative instrument, not a court decision. However, given that the instrument created deemed visas for a cohort of people, it is possible that litigation arose concerning the validity of those visas or the interpretation of the instrument. Common areas of potential dispute include: whether a person was properly classified as a “resident of Norfolk Island” under the Norfolk Island Act (which is a precondition for the Subclass 808 deemed grant); whether a child born in the window met the dependency and parent tests; whether the condition restricting Subclass 159 holders to Norfolk Island was valid; whether the coming-into-effect rules under section 7 or 9 correctly applied when a person held overlapping visas.

No such cases are readily identifiable from the instrument alone. The instrument does not refer to any judicial decisions. It is possible that the Administrative Appeals Tribunal or Federal Circuit Court dealt with applications concerning the cancellation of these deemed visas, but that would be a matter of general migration litigation beyond the instrument’s text.

The absence of litigation history in the source means we cannot state that any specific case law exists. The instrument itself is unambiguous in its terms, which may have reduced the scope for litigation. The deeming provisions are mechanistically simple: if you held X permit, you get Y visa. Most interpretive disputes would centre on whether someone held the permit or was a resident, which are factual determinations.

The most significant trap in this instrument is the limited duration of the Subclass 159 visa and its geographic restriction. Holders of general or temporary entry permits under the Norfolk Island Act may have believed they had permanent residence rights because they could reside on the island indefinitely. The instrument converts those rights into a one-year visa that confines them to Norfolk Island. After 30 June 2017, they must have obtained another visa or become unlawful. Many holders may have missed this deadline, especially if they did not consult a migration agent. The instrument does not provide any automatic extension or reminder. The instrument also does not create a pathway to permanent residence from the Subclass 159 visa; it is a dead-end visa.

The study exception for dependent children under 25 is narrow. It only applies while the child is studying and meets condition 8105 (work limitations). If the child finishes study or turns 25, the exception ceases, and they must return to Norfolk Island. The child’s work rights are limited even during study. This could create difficulties for families who need the child to work to support their studies.

The coming-into-effect rules in sections 7(1) and 9(1) can cause a deemed visa to be deferred if the person held another temporary visa (not Visitor visas) at the final transition time. This means the deemed visa might not commence immediately, and the person’s status depends on the other visa. If the other visa is later cancelled, the deemed visa might not take effect as intended. This could create a gap in lawful status.

The Subclass 808 visa, while permanent, has a travel validity of only 5 years. Holders who are used to crossing between Norfolk Island and mainland Australia without needing a travel facility may be caught out after the 5-year period expires. They will need to apply for a Resident Return visa before re-entering Australia after a trip abroad. If they do not, they may be refused entry or find their permanent residence technically still exists but they cannot board a plane without a travel facility.

The instrument does not address whether persons who were in Norfolk Island unlawfully under the Norfolk Island Act on 30 June 2016 are affected. They are not covered by any deeming provision and become unlawful non-citizens immediately. They have no transitional rights.

Businesses that employed persons who held general or temporary entry permits may have relied on those workers. After 1 July 2016, those workers became Subclass 159 holders restricted to working in Norfolk Island. If the business operated elsewhere or required travel to the mainland, the worker could no longer comply. Employers must verify the visa status of workers and ensure they are not breaching geographic conditions.

The reliance on definitions of “parent” and “dependent child” from the Migration Act and Regulations means that family structures that were recognised under Norfolk Island law may not be recognised under Commonwealth law. For example, de facto relationships or extended family care arrangements that did not meet the strict Migration Act definitions may result in a child not being considered a dependent child, and thus not receiving a deemed visa. This could leave some children without lawful status.

For persons affected by this instrument, compliance is largely passive because the visas are granted automatically. However, there are ongoing compliance obligations for those who wish to maintain lawful status. Holders of deemed Subclass 159 visas must comply with the geographic condition in section 8(5). They must live, study and work only in Norfolk Island. If they wish to study outside Norfolk Island, they must be a dependent child under 25, ordinarily resident in Norfolk Island, and comply with condition 8105. They should document their status as a dependent child and their study enrolment to demonstrate compliance. Any work outside Norfolk Island would breach the condition. If the holder needs to travel to the mainland for medical treatment, tourism, or other reasons, they must apply for a different visa (e.g., a Visitor visa) before doing so, or risk cancellation.

The Subclass 159 visa expires on 30 June 2017. Well before that date, holders must apply for a substantive visa under the Migration Act. Options may include a Partner visa if they have an Australian citizen or permanent resident spouse, a Subclass 189 or 190 Skilled visa if they have the skills and points, or a Subclass 600 Visitor visa if they only need short-term stay. If they apply for another visa before expiry, they may be granted a Bridging visa that allows continued lawful stay. If they do not apply, they become unlawful non-citizens and face detention and removal, as well as possible exclusion periods from Australia. This is a critical timeline that every Subclass 159 holder must manage.

Holders of deemed Subclass 444 visas should be aware that they are now under Commonwealth migration law. They should ensure they hold a valid passport and comply with any conditions that may be imposed. If they lose their passport or have it cancelled, they must notify the Department. They are generally able to live and work anywhere in Australia.

Holders of deemed Subclass 808 visas should note the five-year travel validity. If they plan to travel overseas after 1 July 2021, they must apply for and be granted a Resident Return visa before returning to Australia. They should do this even if they have a valid passport. The application must be made while the holder is in Australia, or in certain circumstances while overseas. If the holder becomes an Australian citizen, the travel facility issue disappears, but citizenship is not automatic.

All affected persons should retain a record of their deemed visa grant, though the instrument provides no physical document. They can access their visa grant via the Department’s online systems (VEVO) using their passport details. Businesses employing such persons should verify their visa status and conditions via VEVO before employing them in work outside Norfolk Island.

The instrument does not impose any reporting obligations, but holders should be aware of general Migration Act obligations such as providing correct information, not working in breach of conditions, and not overstaying.
